Abstract

There are no discussion about banking usury in classic Fikh books, because there were no banks, which nowadays they are needed by society to save their worth. As the research of classic Fiqh, there are differences in ulamas’ instructions, based on their understanding. However, they agree to state that bank interest is a usury or forbidden in Islam. Qardul Hasan is another term of qard, that is interpreted by the most of Indonesian people as social engagement, or bequest. Financial department must be careful in understanding the instructions, related to the implementation in the real life. Banks and financial departments claim that money saving is as akad wadi’ah yad dhamanah, whereas the meaning of dhomanah is responsibility. Fiqh ulamas decide that actually, wadi’ah is responsible. Yad dhamanah is irresponsible.

Abstract

Marketing has undergone rapid development since the 1990s. Until now, marketing is not only known as a practical element but marketing is also known as one of the disciplines. In other words, marketing has elements of the scientific method that can produce marketing theories. However, marketing does not have a general theory that can explain all aspects related to marketing itself. The fact that marketing continues to play an important role in corporate strategy in several companies indicate that there is an opportunity and take a real approach to build marketing competence as a source of competitive advantage. Business practices and marketing today is experiencing a shift or a transformation from an intellectual level (rational), to the emotional, spiritual, and finally to. On the intellectual level (rational), marketers will address the functional-technical marketing by using a number of marketing variables that exist, such as the marketing mix (marketing mix), market segmentation, targeting, branding, positioning.

Abstract

A justice is the essence of the law, but its presence is often overlooked in the name of legal certainty. These loopholes are often manipulated by parties to serve his own interests. The judge's decision is basically a representation of the legal behavior of judges in deciding cases. The judges' verdict is a legal non-sterile products of interest, so sometimes nuanced decision sharply downward and upward blunt. As a result, the practice of law becomes increasingly brighten commodity of judicial mafia practices. To cut commodity of law, the role of judges into a strategic entrance to spread spirituality progressive law in order to achieve social justice.

Abstract

Warung Tegal (Warteg) is an example of local based small and medium enterprises, of which the owners are coming from a local town called Tegal. While the town of Tegal, where such restaurants originally come from, has its own distinctive culture, Warung Tegal are closely linked with urban migrant culture of Jakarta. Warteg is not only a place to suffice people needs of having meals but also as a place for people to share and discuss stories and information from daily life up to political issues. On the other hand, this small enterprise is not individually owned, but rather it is owned and developed by families in turns. I found the social modal factor within Warteg owners is interesting to be further researched. This study aims at finding out the level of social modal among Warteg owners in Jakarta. The quantitative approach to measure social modal based on the variables of cohesion, trust, norms and economic empowering networking were employed in this research. The result of this study showed that there was a significant correlation of 54.8 % between social modal variables, which included cohesion, trust, norms and networking, and Warteg economic development. Additionally, the result of the study also indicated that cohesion level and networking factor were the most significant factors influencing the economic development of Warteg in Jakarta.

Abstract

This study aims at analysing further and deeper on the concept of baiinah in Syafii thought construction. There were two research questions to be answered in this study: (1) whether or not Syafii allows the existence of hilah in trading; and (2) whether there are different concepts in which bai nah in hilah is allowed. To answer these questions, hermeneutikadilthey approach was employed in this research. Within this approach, the external and historical factors of a figure's historical life were taken into account. The result of the study indicated that there has been a misconception of how Syafii allowed baiinah. He actually allows the practice of qiyas and was against ulama who did not allow bai nah. The bai nah concept which was allowed by Syafii was not the trading in which contains dual trading intents; rather it was two trading which stand by themselves and did not relate with each other; thus avoiding misunderstanding within the trading process.

Abstract

Islamic teachings in Indonesia have been influenced by ulama, or Islamic thinkers from Saudi Arabia (Haramin). One of these Islamic teaching areas is rukyyahhisab. One of prominent Islamic teachings on rukyah was spread by Mas Manshur al-Batawi. While, his teaching, which was based on Ptolomeus' Geocentrics theory, was being put aside as the Geocentric theory itself and was replaced by Heliosentrics theory, interestingly, his teaching is still widely used in deciding the starting Qomariyah month by many muslim communities in Indonesia, including al-Khairiyah al-Manshuriyah Jakarta and Pondok Pesantren Ploso Mojo Kediri, East Java. Meanwhile, Mas Manshur al- Batawi admitted the existence of this loophole as well. Thus, I am interested in researching further on his Islamic thinking in this study.

Abstract

Zakat must be spent rich man that aims to reduce poverty. There are some obstacles in gathering the zakat, awareness among the obligatory zakat, facilities, inadequate management of amil and policies that strengthen the rule shar'i not adequate. Likewise sanctions given to the muzaqis directly who do not pay the zakat is not available. These errors must be resolved based on previous experiences, if not the eradication of poverty through the empowerment charity will not be complete. All aspects and institutions should be synergy to solve the problems. Government as regislator and facilitator should be control the activities.

Abstract

This study aims at analyzing Mudhofir Abdullah's thought on environmental conservation as the final aim of sharia. Up to present, there have been five principles of sharia, al-maqasid al-syari‘ah, which includes nurturing religion, souls, dignity, wealth and descendants. Environmental problems (al-bi‘ah) have never been included in the analysis of al-maqasid al-syari‘ah. Through literature study with critical discourse analysis approach, the results of this study indicate that: (1) Al-Quran as a source of knowledge, provides insights and discusses ecological and environmental issues, (2) as a religious text, verses in Al quran which deal with ecological and environmental issues should be contextually understood by employing eco-ushulfiqh; and (3), without ecological and environmental guarantee, al-maqasid al-syari‘ah may not be able to be achieved. Therefore, according to Mudhofir's thought, ecological and environmental issues should be the top concern in sharia. Within Islamic study context, Mudhofir has broadened the horizon on how Islamic teaching can answer the challenge of ecological and environmental problems within society.

Abstract

This study aims at analysing how Sharia Bank products innovation may be embedded with the social background where the products were aimed to be. There were four indication of why this case mattered: (1) the social construction of the rise of sharia bank, (2) sharia bank values in developing its products, (3) the role of Syaria Advisory Board in maintaining sharia compliance, and (4) the dominance of micro-finance. How the social background and values which surround sharia bank are embedded in its product innovation shows that sharia bank is not only an an sich business entity but more than that, it's an integrated part of kaffah/principled Islamic values.

Abstract

Islamic branding practices have recently been the main discussions within practitioners' and academicians' discussions in the recent years. Several experts reported that Islamic branding concept has attracted interests of many companies. Muslim consumers are to be more selective in consuming their products. The labelling of halal may not always guarantee that the product is. This study aims at finding out how Islamic branding influences consumers' decision and whether consumers' religiosity correlates with Islamic branding and their decision in choosing products. The population of this research consists of lecturers, staffs and students of STAIN Pekalongan. The samples of this research are 113 randomly chosen participants. A 5-scale Likert questionnaire was used in this study and was then analysed using double linear regression model. The results indicated that Islamic branded has the power of 9.4 % in influencing customers' decision. Meanwhile, 90.6 % of customers' decision was influenced by other factors. Additionally, religiosity as the moderating variable weakens the correlation between Islamic branding variables and customers' decision.
