Abstract

Penipuan dalam konteks investasi ilegal merupakan praktik yang merugikan dan meresahkan masyarakat. Para pelaku penipuan ini seringkali menggunakan berbagai macam modus operandi yang canggih dan menarik, membuat para calon korban terjebak dalam janji-janji palsu tentang keuntungan besar dalam waktu singkat, seperti misleading informasi, skema piramida, atau manipulasi pasar. Perlindungan hukum menjadi penting untuk menghentikan aksi para penipu ini dan memberikan keadilan bagi para korban yang terperangkap dalam investasi ilegal. Permasalahan yang dibahas dalam penelitian ini adalah Perlindungan Hukum Terhadap Korban Tindak Pidana Investasi Ilegal Di Polresta Denpasar. Penelitian ini menggunakan penelitian hukum empiris dengan metode wawancara, observasi, dan studi dalam proses pengumpulan data mengenai Perlindungan Hukum Terhadap Korban Tindak Pidana Investasi Ilegal Di Polresta Denpasar. Pengaturan hukum mengenai penipuan diatur dalam Pasal 378 KUHP, yang menyatakan bahwa setiap individu yang dengan tujuan menguntungkan diri sendiri atau orang lain dengan menggunakan trik atau tipu muslihat, yang mengelabui orang lain sehingga menyebabkan kerugian harta benda, dapat dijatuhi hukuman penjara selama empat tahun atau denda hingga sepuluh ribu rupiah. Selain tindak pidana penipuan, kejahatan dalam bentuk bisnis investasi juga dapat dikategorikan sebagai tindak pidana penggelapan sesuai dengan Pasal 372 dan Pasal 374 KUHP. Faktor – faktor penghambat dalam upaya penindakan tindak pidana penipuan di antaranya. Keterbatasan sumber daya manusia yang memadai. seperti personel (penyidik dan kepolisian ), waktu, dan anggaran. Kurangnya laporan korban. Kesimpulannya, pengaturan mengenai tindak pidana investasi ilegal dalam hukum yang berlaku di Indonesia tercantum dalam Pasal 378 KUHP dan dapat juga dikategorikan sebagai tindak pidana penggelapan sebagaimana diatur dalam Pasal 372 dan Pasal 374 KUHP. Penanganan kasus penipuan terhambat oleh keterbatasan sumber daya manusia seperti personel (penyidik dan kepolisian), waktu, dan anggaran. Kurangnya laporan korban juga menghambat penegakan hukum. Selain itu, sulitnya mengumpulkan bukti yang cukup, terutama dalam penipuan online, menjadi tantangan serius. Saran untuk lebih tegas dan adil dengan pasal yang sudah berlaku adalah dengan melakukan penguatan aparat penegak hukum dan sistem peradilan untuk membantu dalam penindakan pelaku penipuan ilegal. Untuk mengatasi kendala ini, diperlukan upaya kolaboratif antara kepolisian, lembaga penegak hukum, regulator, dan masyarakat secara keseluruhan. Perlu juga peningkatan pendidikan dan kesadaran masyarakat tentang tindak pidana penipuan serta penguatan sumber daya dan keahlian di bidang investigasi penipuan.

Abstract

Adanya upanya penyeludupan dalam kegiatan ekspor di bandara Ngurah Rai yang diberitakan pada menyebabkan Direktorat Jendral Bea dan Cukai berupaya untuk memaksimalkan pengawasan terhadap Ekspor barang terkhusus pada barang larangan dan atau terbatas untuk mencegah terjadinya penyeludupan oleh eksportir. Jenis penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan perundang-undangan, kasus, dan konseptual. Sumber data yang digunakan adalah data primer dan data sekunder. Pengumpulan data dilakukan dengan wawancara kepada petugas direktorat jenderal bea dan cukai Bandara Ngurah Rai serta dokumentasi. Hasil Penelitian menunjuka bahwa Pengaturan pengawasan pelayanan Direktorat Jenderal Bea dan Cukai dalam perdagangan ekspor di bandara Ngurah Rai sudah diatur tegas dengan sanksinya yakni jika mengekspor barang tanpa menyerahkan pemberitahuan pabean dikenakan pidana penjara paling singkat 1 tahun, maksimal 10 tahun dan pidana denda paling sedikit Rp50.000.000. Pelaksanann pengawasan pelayanan Direktorat Jendral Bea dan Cukai dalam perdagangan ekspor di Bandara Ngurah Rai terhadap barang yang dilarang dan/atau dibatasiterbukti sudah dilaksanakan dengan baik hal ini dapat dilihat dengan kasus digagalkannya upaya ekspor ilegal baby lobster ke Singapura pada Senin 24 Febuari 2020 pukul 06.00 WITA.

Abstract

Hak atas bantuan hukum merupakan salah satu hak yang terpenting yang dimiliki oleh setiap warga negara, Negara Republik Indonesia mengenal dua jenis bantuan hukum yang pertama adalah bantuan hukum Prodeo dan yang kedua adalah bantuan hukum Pro Bono. Permasalahan dimasyarakat begitu banyak termasuk adanya persoalan tentang hukum yang mereka alami, masih banyak masyarakat miskin yang mengalami permasalahan hukum, ketika menghadapi permasalahan hukum mereka menjadi bingung bagaimana mereka harus menyelesaikan permasalahan tersebut, sehingga kehadiran pemerintah sangat dibutuhkan dalam membantu masyarakat miskin, dalam Penyelenggaraan Bantuan Hukum di daerah khususnya Provinsi Bali Kantor Wilayah Kementerian Hukum dan HAM Bali mempunyai peranan yang sangat penting. Dalam Penyelenggaraan Bantuan Hukum, peranan Kantor Wilayah Bali sangatlah penting, adapun peranan Kantor Wilayah antara lain : menyusun rencana anggaran program bantuan hukum yang didasarkan pada jumlah dan akreditasi dari organisasi/ lembaga bantuan hukum, membentuk dan menetapkan Panitia Pengawas Daerah yang terdiri dari unsur Biro Hukum Setda Provinsi Bali, Kepala Divisi Pelayanan Hukum dan HAM, Kepala Divisi Pemasyarakatan, Pengelola Bantuan Hukum, melaksanakan verifikasi dan akreditasi calon pemberi bantuan hukum, Melakukan pengawasan, pelaksanaan pemberian bantuan hukum oleh organisasi/ lembaga bantuan hukum, yang dilaksanakan di kantor organisasi/ lembaga bantuan hukum, Lembaga Pemasyarakatan, Rumah Tahanan Negara dan Rumah penerima bantuan hukum; dan Mengusulkan rekomendasi terkait dengan kinerja dan pelaksanaan anggaran organisasi/lembaga bantuan hukum kepada Badan Pembinaan Hukum Nasional terhadap hasil laporan dari Panitia Pengawas Daerah ; dan melakukan sosialisasi terkait program bantuan hukum kepada masyarakat.

Abstract

One of the problems that occurs in developing countries like Indonesia is social inequality, or the increasingly widening gap in income distribution between groups, between urban and rural areas. This high poverty rate has a direct impact on the poor standard of living of people who choose to live on the streets as beggars (sprawl). As stated in regional regulations that seek to provide a deterrent effect, the Badung Regency Government continues to strive to improve supervision and control of sprawl. The government is fighting against sprawl in areas that commonly occur and disrupt public permits by carrying out efforts to prevent sprawl in Badung Regency through the Civil Service Police Unit. Based on the findings of this research, it can be said that Regional Regulation Number 7 of 2016 concerning Public Order and Community Peace is the basis for eradicating sprawl in the Badung Regency area which is very difficult to implement and is not yet functioning well. This requires support from various related parties, all levels of society in Badung Regency, as well as tourists who come to the Badung area itself.

Abstract

Peristiwa jatuhnya sampah antariksa di Indonesia tersebut menyisakan berbagai pertanyaan, terutama menyangkut keamanan lingkungan dan manusia terhadap dampak langsung jatuhnya sampah antariksa. Namun pada kasus-kasus yang terjadi di Indonesia terutama pada kasus yang terjadi di Sanggau, Kalimantan Barat sampai saat ini belum ada tindak lanjut untuk upaya ganti rugi. Jenis penelitian yang digunakan adalah penelitian hukum normatif. Pengaturan mengenai prosedur tuntutan ganti rugi melalui hukum internasional yang berlaku, maka tuntutann ganti rugi melaui jalur diplomatik dan komisi penuntutan. Proses klaim dilakukan melalui jalur diplomatik antara negara yang terlibat untuk menegoisasikan besar ganti rugi, dimana harus sesuai dengan hukum internasional dan prinsip-prinsip keadilan dan kesetaraan. Bentuk ganti rugi yang ditujukan kepada China sesuai dengan kerugian yang diderita oleh Indonesia ialah restitusi.

Abstract

Setiap pekerja, tanpa memandang asal negara, seharusnya memiliki hak yang sama dan bebas dari diskriminasi, baik di dalam negeri maupun saat bekerja di luar negeri. Kasus-kasus buruk yang masih sering terjadi pada Tenaga Kerja Indonesia di tempat kerja mereka, seperti perlakuan kasar dari majikan, kekerasan, pelecehan seksual, pekerjaan yang tidak sesuai dengan perjanjian, pembayaran upah yang tidak layak, serta gangguan kesehatan akibat bekerja berlebihan, terus terjadi tanpa henti. Penelitian hukum Yuridis normatif, yang melibatkan analisis literatur dan peraturan yang relevan dengan masalah ini, adalah suatu metode yang digunakan untuk memahami situasi ini. Meskipun Pemerintah mengakui kontribusi besar Pekerja Migran Indonesia Krama Bali dalam pembangunan daerah, mereka belum menerima perlindungan yang memadai. Oleh karena itu, peraturan ini dibuat untuk memberikan panduan, dasar hukum, dan kepastian bagi Pemerintah Provinsi dan pihak-pihak terkait dalam melaksanakan perlindungan terhadap Pekerja Migran Indonesia Krama Bali.

Abstract

In writing this article the author used library research methods and also collected data using qualitative methods by interviewing or interviewing several sources where Tembilahan is an area in Riau province which has many ditches and types of peat soil and every year Tembilahan is always prone to flooding. tidal floods and on January 25 2023 Tembilahan was hit by the worst tidal floods in recent years. The tidal flood itself is a tidal flood caused by sea water that overflows and inundates the land. Based on this, the formulation of the problem in this paper includes (1) What is the role of the BPBD of Tembilahan city in overcoming tidal floods that continuously occur in Tembilahan (2) What are the strategies of the BPBD of Tembilahan city in overcoming tidal floods and (3) What are the obstacles? faced by BPBD Tembilahan in dealing with the tidal flood disaster. So the conclusions of this research are (1) the role of regional disaster management agencies in the disaster management process is very important where in the stages of the disaster management implementation process it can start with disaster prevention itself, emergency response and rehabilitation and reconstruction, another role of BPBD is to carry out several planning in an effort to reduce the risk of tidal floods, apart from carrying out emergency response and playing an active role in providing education to the community, (2) the strategy carried out by BPBD Tembilahan to overcome tidal floods is to make efforts to revitalize the ditches in Tembilahan, carry out mitigation and planting mangroves on seashores and coastlines, (3) however, in the process of implementing disaster management, there are certainly several obstacles, including cost constraints, insufficient human resources, inadequate infrastructure and lack of public awareness about disasters, resulting in The process of implementing flood disaster management is difficult to implement.

Abstract

Indonesia is ranked 8th in the world and 2nd in ASEAN in the most cases of early marriage. This research uses the literature study method in which the main problems are (1) what is meant by early marriage, (2) the view of civil law on early marriages that occur in Indonesia, (3) the factors that cause the rampant cases of early marriage in Indonesia and (4) government efforts in reducing the number of early marriages in Indonesia. This study concludes several things, including (1) early marriage is an engagement that occurs and is carried out by couples who are still classified as young or puberty, (2) according to the view of civil law, early marriage is at the age of the prospective husband or wife under nineteen years and is basically not allowed by law, but early marriage according to civil law can be done by obtaining permission from both parents and asking for marriage dispensation to the religious court with the right reasons, evidence and conditions. (3) the factors causing the prevalence of early marriage in Indonesia are social factors, health, family parenting, economy, easy access to information, customs and culture, education and religion, (4) efforts made by the government in reducing the number of early marriages are by conducting socialization, education, empowering women, conducting pre-marital guidance activities in schools and increasing knowledge to adolescents about the importance of reproductive health in an effort to prevent child marriage at an early age.

Abstract

In general, general elections are conducted by a legitimate state in order to select a leader for the nation (a political position). Legislative regulations govern the procedures for holding elections, but some candidates use money politics to gain an advantage over their rivals. To genuinely be in line with the essence of money politics, money politics actions need to be carefully thought out. Legal studies must substantiate the practice of substituting transportation, fatigue, and food funds for voter mobilization in public campaigns. The use of criminal law as a last resort must be thoroughly examined, as well as the legal tools for preventing money politics. A number of additional strategies can. The recognition and assertion of the rule of law, along with the placement of the law as the supreme command in state administration, imply that all facets of government administration, including the regulation of general elections (Elections), are subject to stringent legal frameworks and legislative regulations. Election procedures must adhere to certain principles, including those of direct, general, free, secret, honest, and fair. Though in this instance the author focuses more on the application of the principles of honesty and fairness, the author believes that these five values have a similar role in developing officials with high integrity. Since it is commonly known that throughout the several elections that have taken place since they were first conducted in 1955 till the present Money politics is the area where election violations occur most frequently. Money politics is prohibited by legal instruments (criminal legal instruments), and there are two ways to deal with political violations: the police can impose administrative sanctions or criminal penalties. The issues brought up in this article are as follows, based on the introduction: first, how is money politics regulated by positive law? Secondly, how successful are the legal tools available to stop money politics, and what cultural countermeasures are there?

Abstract

Environmental damage due to environmental pollution does not only occur in Riau Province but also occurs throughout the world. So based on this, the author is interested in conducting research using library research methods, where the sources used in this writing come from books, online newspapers, previous journals, articles and documents. The formulation of the problem in this writing is (1) what is meant by environmental pollution and its scope, (2) how to apply criminal sanctions for perpetrators of environmental pollution in Riau province, (3) what obstacles are faced by the Riau Provincial government in overcoming the problem of environmental pollution and (4) what efforts are being made by the Riau Provincial government in dealing with this environmental pollution. And the conclusions are (1) environmental pollution is contamination of physical and biological components of the earth system and atmosphere in such a way that disrupts environmental processes, (2) criminal sanctions for perpetrators of environmental pollution based on Article 60 in conjunction with Article 104 The PPLH law requires a maximum prison sentence of three years and a maximum fine of three billion rupiah. And in the process of implementing criminal sanctions for perpetrators of environmental pollution in Riau Province, law enforcement officials have handled it firmly, this has been proven by the arrest of two suspects in cases of environmental pollution committed by PT. SIPP is located in Pematang Pudu Village, Mandau District, Bengkalis Regency, Riau Province. (3) The obstacles faced by the Riau Provincial government in overcoming the problem of environmental pollution are due to several influencing factors, namely inconsistent legal facilities, law enforcers who lack knowledge and understanding of the environment, a lack of sophisticated technological tools and experienced experts and lack of public awareness. (4) The government's efforts to overcome environmental pollution are by conducting outreach to the public about the importance of protecting the environment, managing peat ecosystems in a sustainable manner, carrying out waste recycling processes and making appeals to industrial owners to reduce water so that there is not a lot of waste generated. wasted.
