Abstract

Children are a gift from Allah SWT who must be looked after and educated as best as possible. Apart from that, children are the hope of the nation so children must be protected and not made objects of violence. In this writing the author uses two methods, namely the library method and also internet searching, where the data obtained comes not only from book sources but also the internet, which of course contains a lot of information related to the author's research. Where the formulation of the problem in this paper is (1) what is meant by violence against children, (2) what are the legal sanctions for perpetrators of violence against children and examples of cases, (3) what are the obstacles for investigators in handling cases of violence against children in Indonesia, (4) what is the role of the government in preventing violence against children in Indonesia, and the conclusions are (1) violence against children is all forms of violence against children committed by those who should be responsible for the child or those who have power over the child who should be trustworthy , for example parents, close family and teachers, (2) criminal sanctions for perpetrators of violence against children can be punished with imprisonment for three years and six months and/or a fine of up to Rp. 72,000,000, and an example of a case of violence against children occurred in Jambi where the mother had the heart to attach an iron to her child who had just come home from school, this was triggered by the mother being emotional with her husband because he was given little spending money. (3) the obstacles faced by law enforcers are the difficulty of obtaining information from victims because the victims have a high level of trauma and fear, there are no articles that regulate certain sexual violence against children, there is intimidation from the perpetrator and a lack of support from the community in the environment. around the victim's house, (4) and the government's role in the process of preventing violence against children is through various wise policies, strengthening the child protection system, public education and strict law enforcement and the government can create a safe environment and support for children. so that they can grow and develop without violence and carry out campaigns or outreach and education to parents about the impact of violence on children.

Abstract

In general, elections are actions carried out by a legitimate state to elect a leader or political position. Although positive laws regulate the holding of elections, general election participants sometimes engage in money politics to win the competition. All aspects of the Government of the Republic of Indonesia are strictly regulated by the provisions of the legislation, including the rules for the general election. By recognizing the state as the law and placing the law as the highest command in the maintenance of the state, every state action and operation is carried out through the mechanism of the law itself. A state is an organization that requires officials authorized by law to manage its governance. Success in combating corruption in Indonesia depends on an integrated electoral policy. But unfortunately, research shows that the agenda for improving our electoral political integrity is hampered by the abundance of money politics. The existence of democracy is a means for the people to control the government and a means to hold public officials accountable. This accountability changes direction if politicians have bought votes, there is a foundation that must be run well, that is, a direct foundation, general, free, secret, honest and fair. The author thinks the five foundations have the same position in producing high-integrity officers. The research focus of this article is political practice involving money in legislative elections involving voters and politicians. Monetary politics has become a new norm in post-New Order elections. Institutional design, especially an open proportional system, has proven to contribute to the plethora of monetary political incidents. In order to prevent the use of political money from becoming a habit in future elections in Indonesia, this paper recommends a thorough review of the open proportional system.

Abstract

The intent of this article is to explain how to conduct a mortgage charging auction. Normative juridical research—research conducted by looking at the subject of books or secondary information—is the method used. This method makes it possible to regard mortgage rights as a type of collateral. However, it is not clear whether the collateral stems from an agreement. Basically, mortgage laws state that mortgage grants must meet the conditions of a legal agreement. In contract law, sanctions against actual guarantees can be exercised in three ways: public auction via public execution, public auction via judicial apartments, and private sale.

Abstract

Penelitian ini merupakan studi literatur yang bertujuan untuk menganalisis peran konkret pengawas proyek dalam pelaksanaan perjanjian pemborongan bangunan serta mengidentifikasi tantangan dan hambatan yang dihadapi oleh pengawas proyek dalam menjalankan tugasnya guna memastikan kesuksesan pelaksanaan proyek. Metode penelitian yang digunakan adalah studi literatur dengan mengumpulkan dan menganalisis sumber-sumber yang relevan, termasuk peraturan hukum, buku, jurnal, dan publikasi terkait. Hasil penelitian menunjukkan bahwa peran pengawas proyek memiliki peran sentral dalam memastikan pelaksanaan proyek pemborongan bangunan berjalan sesuai rencana dan spesifikasi teknis. Pengawas proyek memiliki tugas memantau, mengendalikan mutu, mengawasi keselamatan kerja, menyelesaikan permasalahan, dan melakukan dokumentasi serta pelaporan secara akurat. Namun, penelitian juga mengungkapkan beberapa tantangan dan hambatan yang dihadapi oleh pengawas proyek, seperti keterbatasan sumber daya, ketidakpatuhan kontraktor, perubahan perencanaan, koordinasi yang kompleks, dan ketidakpastian lingkungan dan cuaca. Ketentuan hukum yang berlaku, seperti Undang-Undang No. 2 Tahun 2017 tentang Jasa Konstruksi, menjadi panduan dalam mengatasi tantangan ini. Penelitian ini menyimpulkan bahwa peran pengawas proyek sangat penting untuk mencapai kesuksesan pelaksanaan proyek pemborongan bangunan. Dalam menghadapi tantangan dan hambatan, pengawas proyek harus mengacu pada ketentuan hukum yang berlaku dan menggunakan pendekatan yang efektif dalam pemantauan, pengendalian mutu, serta penanganan permasalahan. Diharapkan hasil penelitian ini dapat memberikan wawasan bagi para praktisi dan pihak terkait dalam meningkatkan efisiensi dan kualitas pelaksanaan proyek konstruksi.

Abstract

The government has carried out reforms in many ways through the land reform program which regulates land ownership and the legal relationship between the landowner and the object of the land, in order to create a society that has a prosperous and productive life in advancing a national community economy and food security. One of these efforts is the prohibition of land ownership, especially agricultural land which has been regulated in a composition of law article 10 paragraph 1 of the UUPA. With this article, the government expects the owner of the land or land to work on it himself. So that productivity can run optimally, with people who have been educated regularly and have high discipline. However, in fact, in the field in some villages, there are still many people who control absentee land and the community interprets all forms of rules regarding absentee land ownership is very ineffective. Therefore, the author conducted this study with the aim of finding out what causes the occurrence of absentee land ownership and why absentee land ownership is prohibited in Indonesia. Where this research uses a literature method where the reference sources come from books, journals, previous articles. So as to produce a study in which the cause of absentee land ownership in Indonesia are based on several factors, namely public awereness factor that are still too low, community knowladge that is still weak, culture, legal factors, facilities, law enforcement and economy. In addition, the ban on absentee land ownership is carried out to prevent land ownership without a cultivation process so that the agricultural land becomes scrub and abandoned.

Abstract

Abstrak Reformasi pertanahan telah menjadi isu utama di Indonesia sejak kemerdekaan tahun 1945. Reformasi pertanahan merupakan salah satu reformasi yang bertujuan untuk menghilangkan ketimpangan dalam kepemilikan tanah, memperbaiki tata guna tanah dan memastikan pemerataan distribusi tanah. Secara umum, reformasi agraria bertujuan untuk mengatasi kepemilikan tanah secara adil dan merata untuk memaksimalkan kesejahteraan rakyat, terutama petani. Reforma agraria merupakan program pemerintah yang mencakup antara lain larangan pemilikan dan penguasaan tanah pertanian di atas batas maksimum, larangan pemilikan dan pemindahtanganan tanah pertanian, redistribusi tanah pertanian dan tanah cadangan, tanah bekas guntai dan tanah negara lainnya di atas batas maksimum, pengaturan ganti rugi dan pembelian tanah pertanian yang digadaikan, revisi perjanjian pembagian tanah, dan redistribusi tanah.

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui bagaimanaWakaf dan Peraturan Perlindungannya. Wakaf merupakan salah satu organisasi kedermawanan dalam Islam. Salah satu instrumen yang dipandang sangat kritis dan dapat memanfaatkan rasa simpati atas aktivitas publik kita terhadap orang lain adalah komponen wakaf. Dalam pelajaran Islam dikatakanbahwa bila seseorang mati, maka semua amalnya terputus, kecualisadaqah jariyah (wakaf).Metode penelitian yang digunakan adalah penelitian kepustakaan, buku-buku dan laporan-laporan yang berhubungan dengan masalah tersebut. Proseswakaf yang dikuasai, sebagian besar sudah mengikuti PP No. 41 Tahun 2004, masihada anggapan bahwa tanah yang benar-benar telah dihibahkan sebagai wakafdengan janji wakaf keluarga saat ini memiliki kekuatan yang sah. Wakaf adalah organisasi sosial yang tidak menahan apa-apa dan peningkatan dan koherensi dakwah Islam di seluruh Indonesia. Struktur yang jelas yang diciptakan oleh yayasan wakaf ini meliputi organisasi pendidikan Islam yang ketat, tempat kasih sayang, dan lembaga sosial yang berfokus pada kemaslahatan umat Islam, yang sebagian besar diperoleh dan dihasilkan dari hadiah wakaf. Kemampuan wakaf dalam jemaah legalisme memiliki keterbatasan finansial yang diarahkan untuk mendorong berkembangnya masyarakat secara lugas sehingga pemanfaatannya dapat lebih luas dan selaras dengan pelajaran syariat. The implications of subcontracting agreements in Indonesia's construction practice hold significant importance in ensuring project efficiency. This research highlights crucial factors to consider, including compliance with the law, efficient dispute resolution, workers' rights protection, and risk management. Adhering to construction and civil code regulations, alongside considering alternative dispute resolution, mitigates legal risks. Ensuring workers' rights protection and implementing robust risk management contribute to project success. By understanding and applying these implications, the practice of subcontracting agreements can achieve a harmonious and productive balance in construction project execution in Indonesia. Emphasizing these aspects will result in smoother operations, minimized conflicts, and improved overall project outcomes, ultimately leading to successful construction project completion in Indonesia. The consideration of these factors in the construction industry can positively impact project outcomes and lead to more effective and successful construction projects. This research highlights the significant role of contracting agreements in construction practices in Indonesia in ensuring project efficiency. It focuses on crucial factors that need attention, including compliance with the law, efficient dispute resolution, protection of workers' rights, and risk management. Adhering to construction laws and the Civil Code (KUHPerdata), as well as considering alternative dispute resolution, helps mitigate legal risks. Abstract

Kantor Pertanahan Kabupaten Indragiri Hillir didirikan untuk memberikan kepastian hukum dalam pendaftaran hak atas tanah di Kabupaten Indragiri Hillir. Berdasarkan keputusan Inspektur Jenderal BPN tersebut di atas, Kantor Pertanahan Kabupaten Indragiri Hillir diberi wewenang untuk menandatangani peta, akta survei, akta jual beli, dan pendaftaran tanah. Di Kabupaten Indragiri Hilir, Kantor Pertanahan sering menemui kendala dalam melakukan pendaftaran tanah, antara lain kurangnya pemahaman masyarakat akan pentingnya pendaftaran akta tanah, sehingga masih banyak masyarakat yang belum memiliki akta tanah, padahal akta tanah dapat memberikan kepastian hukum atas kepemilikan tanah.

Abstract

School Operational Assistance, or BOSS, is one of the programs initiated by the government aimed at improving the quality of education, both means and supplies, as well as expropriation affairs. It is in accordance with the mandate given to the Fifth Path of the ideology of the nation, namely Pancasila, “Social Justice for All the People of Indonesia." Any budget-related program is highly vulnerable to corruption, so it needs to be monitored in its enforcement. According to Act No. 15 of 2006 on BPK, the financial audit of financial statements is carried out with the aim of giving sufficient assurance or reasonable assurance that the presentation of the report has been reasonably made in relation to all material matters in its substance, in accordance with the principles of accounting in general, such as the Central Government Financial Report. There are three principles to be met in the evaluation: continuity (continuity), comprehensiveness (comprehensiveness), and objectivity. For that, it felt important to raise the formula for the problem of how the arrangement of the management of the funds of the boss by the recipients should be channeled to the person entitled. How are criminal sanctions applied to recipients who commit fraud against the BOS Fund? And how is the supervisory mechanism used by the BPK as the authority to prevent the fraud of the BOS Fund from happening?
