Abstract

Customary land for the Lampung Pepadun community has a meaning that is more than just an economic asset, but also reflects the identity, spirituality, and socio-cultural system inherent in the life of the community. In the Lampung Pepadun traditional view, land is "heritage land" that is passed down from generation to generation and managed by customary leaders based on the values ​​of Piil Pesenggiri and Sai Batin. However, to date, this customary land has not received formal recognition from the local government, making its legal status weak and vulnerable to takeover by outside parties. This study uses a normative juridical approach by examining the Basic Agrarian Law (UUPA) of 1960 and its various implementing regulations. The results show that the recognition of customary rights of indigenous communities is declarative, not constitutive, thus creating ambiguity in its implementation. In addition, obstacles faced by the Lampung Pepadun indigenous community include the lack of mapping of customary territories, weak public legal awareness, and overlap between customary law and national positive law. Therefore, regional regulations are needed that specifically recognize and protect the customary rights of the Lampung Pepadun community, with the active involvement of traditional institutions and the local government. Efforts to strengthen legal protection can be carried out through customary land registration, the integration of customary legal values ​​into land policies, and improving legal education for indigenous communities. With these steps, the protection of Lampung Pepadun's customary land can be realized in a just and sustainable manner in accordance with the principle of social justice mandated by Article 33 of the 1945 Constitution of the Republic of Indonesia.

Abstract

This study examines the democratization process during the New Order government. The study attempts to understand and trace President Soeharto's response to the current of democratization in Indonesia, influenced by the global political constellation. The analysis reveals that President Soeharto had his own unique approach to responding to this trend. He did not simply accept the liberal Western democratic ideals, but instead sought to adapt them to suit his own Indonesian context. This study utilizes historical methods, including heuristics, verification, interpretation, and historiography. The conclusion is that the democratic space developed by Soeharto was a "half-hearted" democracy. This study demonstrates that the New Order government was not overly rigid, and the political dynamics it fostered resulted in political compromises.

Abstract

Praktik politik uang dalam Pemilihan Kepala Daerah (Pilkada) merupakan masalah korupsi sistemik yang membahayakan pembangunan demokrasi dan nasional. Perguruan tinggi memiliki tanggung jawab strategis membentuk mahasiswa berintegritas melalui pendidikan anti korupsi untuk mereduksi fenomena tersebut. Penelitian ini bertujuan mengidentifikasi strategi integrasi pendidikan anti korupsi dalam kurikulum pendidikan tinggi di Indonesia. Metode yang digunakan adalah studi kepustakaan kualitatif-deskriptif dengan sumber data dari buku, jurnal, dokumen kebijakan, dan laporan implementasi lima tahun terakhir. Hasil penelitian menemukan tiga model strategi integrasi: (1) mata kuliah mandiri, (2) insersi/sisipan dalam mata kuliah yang sudah ada, dan (3) integrasi holistik yang mencakup kurikulum, budaya kampus, serta tata kelola. Meskipun sekitar 80 persen perguruan tinggi telah melaporkan integrasi, implementasi di lapangan masih beragam dan membutuhkan standar minimum yang jelas. Keterbatasan kapasitas pengajar menjadi tantangan utama dalam transformasi nilai integritas mahasiswa dari ranah kognitif ke afektif dan psikomotorik.

Abstract

This study aims to analyze the criminal liability of a juvenile offender in a child sexual violence case and the judge's legal considerations in Decision Number XX/Pid.Sus-Anak/2025/PN Tjk. The research employed normative juridical and empirical approaches. Data were collected through library research and field research. The results indicate that the imposition of criminal liability on the juvenile offender in Decision Number XX/Pid.Sus-Anak/2025/PN Tjk was in accordance with the applicable laws and regulations. The defendant was found guilty of violating Article 81 paragraph (2) in conjunction with Article 76D of Law Number 17 of 2016 concerning Child Protection and was sentenced to two years of imprisonment accompanied by job training. Although diversion was not applicable because the statutory requirements were not fulfilled, the court upheld the principle of the best interests of the child by emphasizing guidance and rehabilitation. The judge's decision was based on juridical considerations, including the facts presented at trial, evidence, and applicable legal provisions, as well as non-juridical considerations, including the child's age, psychological condition, family background, remorse, and the impact of the offense on the victim.
