Abstract

Conceptually in the ijârah contract 'ala al-'amâl, the work agreement must clearly specify the object of work and the wages. In the implementation of agreements with Sharia Proofreading Institutions, their services are classified into six forms by unilaterally setting service fees but in reality raises potential formatted problems, namely how to determine proofreading service fees at LSP IAIN Zawiyah Cot Kala Langsa? How is the fulfillment of LSP's obligations for proofreading services with various journal qualifications and review of ijârah 'ala al-'amâl contracts on costs and their correlation with proofreading services. This study uses a normative empirical approach with descriptive analysis research types and interview and documentation collection techniques. The result of his research is that the costing system is carried out unilaterally by the LSP according to the classification of its services. The fees that consumers have to pay are determined based on six types of LSP services, namely full services, template editing services, citation services, translation services, paraphrasing services and article submission services. LSP management provides service guarantees in accordance with contract dictums and SOPs that have been set internally in serving consumers on the use of proofreading services. consumer. Even though the fee is set unilaterally by the LSP management, in principle the entire operational mechanism of LSP is in accordance with the provisions of the ijârah 'ala al-'amâl contract, and ujrah obtained by fiqhiyyah is valid as income for proofreading services which does not conflict with the basic principles of fiqh muamalah.

Abstract

This research aims to answer 3 research questions, namely how the form of legal protection for consumers who use non-halal cosmetic products, how the form of use of non-halal label cosmetic products, and how the perspective of Islamic law on the legal protection of non-halal label cosmetic consumers in the city of Banda Aceh. The research method used is descriptive analysis, namely data collection techniques in the form of field and literature studies. The results of this study indicate that the form of legal protection for consumers who use non-halal labelled cosmetic products carried out by the Banda Aceh city government is by imposing jinayah sanctions. Both in the form of flogging, imprisonment, and fines in accordance with Aceh Qanun Number 8 of 2016 concerning the Halal Guarantee System. The form of use of non-halal labelled cosmetic products in the people of Banda Aceh city varies, namely Special UV whitening, bb cream night and day, Doolby lipstick, make over, and so on. This product is used for skin beauty on the face, hands and body. The perspective of Islamic law on legal protection for consumers of non-halal labelled cosmetics in the city of Banda Aceh in the sale and purchase contract must be carried out so that consumers are protected from buying and selling which contains elements of lies about the goods they buy, especially from elements that are not halal for use by buyers. From the results of this study, the author suggests that the Banda Aceh city government continue to take firm steps in the circulation of non-halal labelled products. In addition, buyers must also be more careful in choosing cosmetics that will be used daily.

Abstract

This research aims to find out how the mechanism of cutting scales in buying and selling chili peppers, and how to analyze the existence of elements of gharar and tadlis in the practice of cutting scales in buying and selling chili peppers. This research uses normative-empirical legal research with descriptive analysis. The data comes from primary data obtained from the field and secondary data obtained from literature research. The results showed that the implementation mechanism for cutting the weight of the scales in the sale and purchase of chili peppers that took place was practiced according to the customs prevailing in the community of Gampong Abo Teubeng. This sale and purchase is carried out with the application of mandatory deductions at the time after weighing. Weighing pieces in this transaction range from 0.5-2kg depending on the size of the sack used by the farmer. If blue line sacks are used, the weight cut ranges from 1-2kg and fertilizer sacks with weight cuts range from 0.5-1kg. The weight cut is also influenced by market prices, if the market price is expensive then the cut will be small, if the price is cheap the cut will be large. Second, according to the review of muamalah fiqh, the existence of elements of gharar and tadlis in the transaction of cutting the weight of the scales in the sale and purchase of chili in Gampong Abo Teubeng shows that there is an element of gharar in the transaction, but the element of gharar is forgiven because it is included in mild gharar. Because the risk of heavy shrinkage is something that cannot be separated from the transaction. The existence of the element of tadlis in the transaction is visibly absent because of the willingness of both parties. However, invisibly it may not be because it is up to the buyer's intention. If they intend to gain more profit from the cut in the scales then it falls into tadlis. And if he does not intend to gain more profit then it is not included because it is in the pleasure of both parties when dealing.

Abstract

Praktik sewa-menyewa emas sudah menjadi kebiasaan masyarakat di Kecamatan Seunagan Timur Kabupaten Nagan Raya dan sebagai jalan altenatif untuk mendapatkan pinjaman dalam keadaan mendesak, sistem penyewaan emas yang dipraktikkan oleh masyarakat adalah penyewa tidak memanfaatkan barang sewa sebagai perhiasan yang semestinya melainkan dijual untuk mendapatkan uang, begitupula dalam penetapan ujrah yang ditetapkan sepihak, banyaknya ujrah yang harus dibayarkan setiap tahunnya berbeda tergantung berapa yang ditetapkan oleh pemilik emas. Permasalahan yang diteliti dalam penelitian ini bagaimana praktik sewa-menyewa emas pada masyarakat di Kecamatan Seunagan Timur, kedua bagaimana penetapan ujrah, ketiga bagaimana Tinjauan Fiqh Muamalah terhadap emas sebagai objek sewa-menyewa dan penetapan ujrah yang dilakukan oleh masyarakat di Kecamatan Seunagan Timur. Dalam penelitian ini penulis menggunakan penelitian Kualitatif meliputi wawancara dan dokumentasi dari masyarakat serta menggunakan Pendekatan yuridis empiris untuk mengkaji ketentuan hukum yang berlaku serta kenyataannya yang terjadi dalam masyarakat. Adapun hasil penelitian adalah praktik sewa-menyewa yang dilakukan oleh masyarakat di Kecamatan Seunagan Timur tidak sah Menurut Tinjauan Fiqh Muamalah karena tidak memenuhi syarat sah objek yaitu emas sebagai objek sewa-menyewa harus dimanfaatkan sesuai perutukan dan kegunaaannya yang diharuskan seperti perhiasan dikalangan wanita, bukan disewa untuk dijual. Begitupula dengan penetapan ujrah yang sudah ditetapkan sepihak oleh pemilik emas, Dalam Fiqh Muamalah menjelaskan ujrah yang sah adalah ujrah yang tidak memberatkan dan merugikan sebelah pihak, jika penetapan ujrah seperti praktik ini masuk ke ranah ribawi karena mencari keuntungan secara berlipat ganda dan melebihi dari pokoknya, jadi praktik emas sebagai objek sewa-menyewa di Kecamatan Seunagan Timur Kabupaten Nagan Raya dilarang menurut Tinjauan Fiqh Muamalah.

Abstract

Every human being, male or female, will not be separated from the practice of buying and selling, whether on a large or small scale, at the individual, community and even inter-country levels. Likewise, when someone wants to run a business, they should pay attention to the licensing of the product so that people who buy it will be more confident and safe and legal under the law. Moringa Cheong's product is a herbal drink made from fermented Moringa leaves, but it is immediately marketed even though the distribution permit has not been fully issued, so this is a problem in decision Number 341/Pid.Sus/2022/Pn.Bna. This research aims to find out what type of contract is used by shops and supermarkets with PT.Korea Aceh Mandiri in buying and selling food products in the form of Moringa Cheong drinks and to find out the judge's considerations in handing down sentences to Lee Chungyoung as the owner of PT.Korea Aceh Mandiri based on decision Number 341/Pid.Sus/2022/Pn BNA. Using Normative Jurisprudence as a research method, library research to obtain materials. The marketing process for the Moringa Cheong herbal drink uses a deposit agreement or wadi, ah, where the drink product is entrusted to supermarkets and drug stores in Banda Aceh City. When the product sells, the profits will be given according to what was agreed at the beginning. In decision Number 341/Pid.Sus/2022/Pn Bna, the judge considered that the defendant's good intentions in producing the Moringa Cheong drink product were to make the people who drank it healthy, and also that the distribution permit for the product was almost ready. throughout the process, but because of the defendant's lack of patience, what he didn't want happened.

Abstract

The Banda Aceh City Fire and Rescue Service must ensure that fire extinguishers are well maintained and can be used at any time in an emergency. Fire extinguishers are state property that are useful for the community. Therefore, the author aims to conduct research to find out how fire extinguishers are inspected at the Banda Aceh City Fire and Rescue Service, as well as what Milk al Daulah's perspective is regarding checking fire extinguishers at the Banda Aceh City Fire and Rescue Service. This research uses a sociological juridical method with a qualitative research type, and data was obtained using interview techniques and documentation. Based on the research results, it was found that, first, inspection and maintenance of fire extinguishers at the Banda Aceh City Fire and Rescue Service was carried out by checking and warming up the engine, checking lubricants and fuel, checking the condition of tires, checking the braking system, checking equipment completeness. fire extinguisher, electrical system inspection, exterior maintenance, water tank drain, and vehicle roadworthiness test. Maintenance is carried out regularly at certain time intervals. Usually every 3 months, 6 months or 1 year. Depends on manufacturer's instructions, vehicle model and components used. Second, the Banda Aceh City Fire and Rescue Service is responsible for inspecting fire extinguishers. So that these tools function and are used properly when a fire disaster occurs. Maintaining fire extinguishers provides benefits to the community. The Banda Aceh city fire and rescue service as the regional government has done its job well in carrying out inspections of fire extinguishers, therefore this is in accordance with the concept of milk al-daulah

Abstract

Khiyār ta'yiń is the right to choose for buyers in determining goods of different quality in buying and selling. Apart from that, khiyār also has the authority to withhold or accept trade that occurs before the sale and purchase is complete, whether in agreement or qabul. The focus of this research is on the concept of khiyār ta'yiń in muamalah fiqh and the application of khiyār ta'yiń to the buying and selling of used car tires at the Banda Aceh Tire Arena. The type of research used in this research is sociological juridical, while the nature of this research uses descriptive analysis methods, collecting primary data through interviews and documentation. The research results showed that the concept of khiyār ta'yiń in muamalah fiqh regarding buying and selling used tires is based on what is contained in the Al-Qur'an, Hadith and the opinions of ulama. Buying and selling used tires is permitted provided that the conditions of sale and purchase are met and mutual agreement is met between the seller and the buyer. In this case, the seller gives the buyer a choice of quality of goods. The choice of goods provided includes 3 choices, namely good, medium and low quality goods. Each quality option available also has a different price, as well as applying a time limit for the validity of khiyār ta'yiń. Then the application of khiyār ta'yiń to the buying and selling of used car tires at the Banda Aceh Ban Arena in relation to selling products that match the quality desired and needed by consumers is completely in accordance with the concept of khiyār ta'yiń, namely choosing one of the 3 types of goods will be purchased according to the level of quality it has, then the second condition is that the type of goods to be selected has a price difference from other types and the price must also be known for certain, and the last condition is that the time is limited according to the agreement that was made when the transaction occurred. between sellers and buyers. These three aspects have been completely fulfilled.

Abstract

This research aims to analyse how the mechanism of modern economic monopoly practices, and how its application can prevent harmful business practices, and support the creation of a fairer and more ethical market in accordance with Islamic teachings. This research uses a qualitative approach with a literature study method (library research). This approach was chosen because it is in accordance with the purpose of this research, which is to evaluate monopoly practices in the context of modern economics based on the perspective of Islamic law. The results show that the rapid development of the modern economy and the phenomenon of monopoly have become one of the issues that attract the attention of economists, legislators, and legal scholars, including Islamic legal experts. In the context of Islamic law, monopolies that harm the interests of society are considered immoral and prohibited, as they can lead to economic injustice and oppression of consumers. Islam emphasises the importance of fairness, balance and protection of individual rights in every economic transaction. Islamic law, through concepts such as hisbah (market supervision) and ihtikar (prohibition of hoarding goods to raise prices), prescribes those economic activities be conducted in a fair and transparent manner. Therefore, monopolistic practices that result in market imbalances and harm society should be avoided.

Abstract

Islamic Financial Institutions, especially Islamic banks, are a form of business in the financial sector based on sharia principles, and are currently showing a positive growth trend in Indonesia. However, this poses a challenge for the Islamic banking industry to ensure compliance with applicable sharia provisions. Based on current facts, there are several online gambling sites that provide payment and withdrawal options through Islamic bank accounts. This is the problem and purpose of the research, namely how efforts to prevent online gambling practices through Islamic banks, the mechanism of the online gambling system and the elements contained in it, as well as the steps that can be used by Islamic banks to reduce the number of online gambling. The research method used is library research which collects various references from journal articles as reference material, library research relies on literature such as books, notes, or research reports from studies. Based on the results of the research, that in this problem there are two ways that can be used by Islamic banks to prevent online gambling practices, namely by using modern technology owned by the Islamic bank (internal) and cooperating with other authorities (external).

Abstract

This article aims to analyse the judge's reasoning in Decision No. 3/Pdt.G/2023/PN.Jth regarding the default of a conditional land grant agreement between the plaintiff and the defendant. This case focuses on a land grant agreement that was made orally, with the condition that the plaintiff's child be appointed as a community service worker at the Puskeswan. The approach that the author uses is normative juridical research. The results showed that the judge considered the oral agreement invalid because it did not fulfil the applicable legal requirements, including the authority of the defendant in the appointment of community service personnel, as well as a violation of the principle of grants that must be made without compensation. As a result, the plaintiff's claim was rejected because there was no evidence or fulfilment of legal requirements. This research shows the importance of fulfilling legal requirements in conditional grants to prevent default
