Al-Aqad is an interdisciplinary journal published twice a year online (e-journal) by the Department of Sharia Economic Law of Sharia Faculty of the Pontianak State Institute of Islamic Studies. It would be maintained every year to come up as a properly online journal included the reviewing process. The special issue would be made available for a particular condition. The regular issue includes August and November editions in each year which would be managing in journal archives.

Abstract

Tujuan penelitian ini untuk mengetahui sistem Binary Option pada platfrom Binomo serta meminta Pandangan MUI Kota Singkawang tentang transaksi Binary Option pada Platfrom Binomo. Penelitian ini menggunakan metode penelitian kualitatif dan pendekatan normatif empiris. Sumber data menggunakan data primer dan data sekunder berupa buku-buku dan tulisan ilmiah hukum dan dapat membantu dalam menganalisa terkait objek penelitian. Teknik pengumpulan data berupa observasi, wawancara dan dokumentasi. Hasil penelitian menyimpulkan bahwa: 1) Sistem trading binary option platform binomo ini trader hanya menganalisa grafik pada platform Binomo. Setelah itu para trader bisa memperdagangkan berbagai aset seperti Crypto, uang asing, dan lain-lain. Dalam sistem Binary Option pada binomo ini para trader hanya melakukan transaksi beli dengan opsi naik dan jual dengan opsi turun dengan waktu penutup yang sudah dipilih oleh trader itu sendiri dan waktu itu di antaranya, 30 detik hingga 1 jam, dan jumlah nominal perdagangan itu dari Rp14.000,00 hingga Rp14.000.000,00, dengan sistem keuntungan ditentukan oleh aplikasi yang mana salah satu opsi trader betul maka akan meraih keuntungan 80% dari hasil yang diperdagangkan dan sebaliknya opsi salah maka akan mendapatkan kerugian 100%. 2) Pandangan Majelis Ulama Indonesia (MUI) Kota Singkawang sepakat bahwa sistem Binary Option pada Binomo ini diharamkan atau dilarang untuk dilakukan karena mengandung spekulasi, untung-untungan, dan mengandung unsur penipuan dalamnya yang mana bisa di bilang maysir dan gharar seperti loutre sehingga dikatakan sebagai permaianan judi yang berdasarkan dalam ayat Al-Maidah ayat 90-91.

Abstract

This study aims to find out the activities of leasing coconut plantations in Teluk Nangka Village, Kubu District, in this case, leasing is carried out with two different contract systems. This study uses a qualitative approach. The primary data source is in the form of interviews from musta'jir (tenants) and mu'ajir (renters). Secondary data comes from various parties such as the results of journals, articles, and theses. The study results show that: 1) In the practice of leasing contracts for coconut plantations in Teluk Nangka Village, two systems are used, namely on a monthly and annual basis. Monthly system by paying rent every month and the object of rent in the beneficiary is only the garden. Meanwhile, the annual system is a one-time payment, usually made in cash or a certain number of days with a bonus of 1 month. Thus, the annual rental period is 13 months. The contract agreement is made orally and has never used a written contract. Pricing is determined based on the condition of the garden, area, and unit of time to be rented and agreed upon at the beginning of the contract. Maintenance of the coconut plantation is the responsibility of the musta'jir i. The end of the lease for coconut plantations in Teluk Nangka Village because the lease period in the agreement has ended; 2) Whereas the practice of leasing contracts contained in the Compilation of Sharia Economic Law (KHES) in Chapter XI Articles 295-320 supports the leasing contract for coconut plantations in Teluk Nangka Village. It is only that the agreement between the two parties must have a clear statement so that the transaction is full of honesty and fairness.

Abstract

The purpose of this study is to determine the practice of buying and selling furniture in Sungai Rengas Village, Sungai Kakap District, as well as the practice of buying and selling furniture from the perspective of the Compilation of Sharia Economic Law (KHES). This type of research is qualitative research, while the technique in data collection uses primary data, namely observation, interviews, and in the form of documentation. The analysis techniques that researchers use are the stages of data collection, data reduction, data presentation, and conclusions. While in the test stage the validity of the data using triangulation. The results of this study concluded that: 1) The practice of buying and selling furniture in Sungai Rengas Village, Sungai Kakap District involves furniture owners and consumers. In buying and selling this order follows the theoretical study of the istisna contract, namely the provisions of the goods ordered are clear in form, content, and information. The payment method is also by the istisna contract contained in KHES, namely, consumers can pay in advance, in the middle, or at the end of the furniture manufacturing process. 2) Regarding the practice of buying and selling in the Sungai Rengas Furniture store, the theory used is by KHES, namely that each party agrees when a contract occurs on the ordered goods and has been explained in articles 104, 105, 106, 107, 108 and these articles are implemented in practice in the field even though the seller has never known before about KHES.

Abstract

Tujuan penelitian ini adalah untuk mengetahui kewenangan notaris dalam hal melegalisasikan surat di bawah tangan, prosedur legalisasi yang dilakukan notaris terhadap akad konvensional di masyarakat Pontianak, dan prosedur legalisasi yang dilakukan notaris terhadap akad konvensional di masyarakat Pontianak ditinjau dari Kompilasi Hukum Ekonomi Syariah. Peneliti menggunakan metode analisis deskriptif bersifat kualitatif. Sumber data menggunakan data primer berupa wawancara Pejabat Notaris di Pontianak. Sedangkan data sekunder adalah Kompilasi Hukum Ekonomi Syariah, dan Kitab Undang-Undang Hukum Perdata. Hasil penelitian menunjukkan bahwa: 1) Notaris berwenang membuat akta autentik mengenai semua perbuatan, perjanjian, dan penetapan yang diharuskan oleh peraturan perundang-undangan dan/atau yang dikehendaki oleh yang berkepentingan untuk dinyatakan dalam akta autentik, menjamin kepastian tanggal pembuatan akta, menyimpan akta, memberikan grosse, salinan dan kutipan akta, semuanya itu sepanjang pembuatan akta itu tidak juga ditugaskan atau dikecualikan kepada pejabat lain atau orang lain yang ditetapkan oleh undang-undang; 2) Para pihak membuat suratnya, di bawa ke kantor notaris, penandatanganan di hadapan notaris, dicatatkan dalam buku daftar legalisasi. Tanggal pada waktu ditandatangani dihadapan notaris adalah, sebagai tanggal sahnya perbuatan hukum yang dibuat para pihak, yang mengakibatkan hak dan kewajiban antara para pihak; 3) akad bertujuan untuk memenuhi kebutuhan hidup dan pengembangan usaha masing-masing pihak yang mengadakan akad, sighat akad dapat dilakukan dengan jelas, baik secara lisan, tulisan, dan/atau perbuatan.

Abstract

Penelitian ini dilatarbelakangi adanya kegiatan sewa-menyewa kebun kelapa di Desa Teluk Nangka Kecamatan Kubu dalam hal ini sewa-menyewa dilakukan dengan dua sistem akad yang berbeda. Tujuan penelitian ini adalah untuk mengetahui: 1) Bagaimana praktik sewa-menyewa kebun kelapa di Desa Teluk Nangka. 2) Bagaimana tinjauan KHES terhadap praktik sewa-menyewa kebun kelapa di Desa Teluk Nangka. Penelitian ini menggunakan pendekatan kualitatif karena berkaitan dengan hukum, maka peneliti menghubungkannya dalam pradigma penelitian hukum yaitu normatif-empiris. Sumber data primer berupa wawancara dari pihak Musta’jir (penyewa) dan Mu’ajir (menyewakan). Sedangkan data sekunder bersumber dari berbagai pihak seperti hasil buku jurnal, artikel-artikel, skripsi atau yang telah diterbitkan baik online maupun offline yang mendukung penelitian ini. Teknik pengumpulan data dengan melakukan observasi, wawancara dan dokumentasi. Sedangkan teknik analisis data, peneliti melakukan pengumpulan data, reduksi data, penyajian data, dan kesimpulan. Kemudian, data tersebut diperiksa keabsahan datanya dengan melakukan triangulasi yaitu triangulasi teknik, triangulasi sumber, dan triangulasi waktu. Hasil penelitian menunjukan bahwa: 1) Pada praktik akad sewa menyewa kebun kelapa di Desa Teluk Nangka menggunakan dua sisem, yakni secara bulanan dan tahunan. Sistem bulanan dengan membayar uang sewa setiap bulannya dan objek sewa dalam pemanfaatnya adalah hanya kebunnya saja. Sedangkan sistem tahunan adalah dengan pembayaran sekali biasanya dilakukan secara cash atau tempo berapa hari dengan diberikan bonus 1 bulan sehingga masa waktu sewa tahunan adalah 13 bulan. Akad perjanjian dilakukan secara lisan dan belum pernah menggunakan akad secara tertulis. 2) Bahwa praktik akad sewa menyewa yang terdapat di dalam Kompilasi Hukum Ekonomi Syariah (KHES) pada Bab XI Pasal 295-320, mendukung terkait akad sewa menyewa kebun kelapa di Desa Teluk Nangka. Hanya saja perjanjian antara kedua belah pihak harus terdapat kesepakatan yang jelas agar transaksi penuh dengan kejujuran dan keadilan.

Abstract

This study aims to find answers to the main problems, namely the system of caretaker services for the Batu Layang Pontianak tomb and the legal fees for caretakers for the Batu Layang Pontianak tomb in the review of the Sharia Economic Law Compilation (KHES). This type of research uses qualitative methods and a normative-empirical approach. Researchers collect primary data from observations, interviews, and documentation, while secondary data researchers obtain from literature, articles, journals, and websites. Based on the results of the study it can be concluded that: 1) The caretaker of the Batu Layang tomb applies two practices, namely wages from pilgrims who are voluntary and wages from the Pontianak Cultural Heritage Service worth IDR 1,000,000.00 per month. 2) The law on the wages of caretakers of the Batu Layang tomb in KHES has complied with and is by the provisions in the ijarah chapter, namely pillars and ijarah contracts, and is not contradictory. However, there is one article that is inconsistent with the caretaker wages for the caretaker of the Batu Layang Pontianak tomb, namely article 311. The results of this study indicate that concerning pilgrims if they do not require the services of a caretaker, they will not receive ijarah. However, the caretaker always does the work in his contract with the Pontianak Cultural Heritage Service.

Abstract

Penelitian ini bertujuan untuk mengetahui bentuk permainan layanan gratis ongkir XTRA pada Shopee yang dilakukan oleh penjual dan pembeli dalam menghindari penjual membayar biaya admin yang sudah di tentukan oleh pihak Shopee. Penelitian ini menggunakan penelitian kualitatif. Teknik pengumpulan data yaitu wawancara dan dokumentasi. Peneliti ini dapat di simpulkan bahwa: 1) Bentuk permainan layanan gratis ongkir ini dimana penjual membebankan biaya admin kepada pembeli. Sehingga penjual tidak perlu menanggung biaya admin yang besar dari pihak Shopee dan pembeli dapat menikmati potongan gratis ongkir dari Shopee tanpa harus menanggung biaya ongkir yang besar. 2) Hukum permainan layanan gratis ongkir XTRA terhadap akad yang telah disepakati oleh kedua belah pihak antara penjual dan pembeli tidak memenuhi norma keabsahan fikih muamalah dan KHES pasal 26 huruf a. Sebagai akibatnya, akad tersebut masuk ke dalam kategori akad fasad yaitu akad yang dapat dibatalkan. Akad fasad yang diatur dalam pasal 27 huruf b yaitu akad fasad/dapat dibatalkan yang penjelasannya diatur di pasal 28 angka 2. Ketentuan tentang asas akad yang diatur dalam pasal 21 tentang asas akad di atas memberikan konsekuensi hukum yang membatalkan keabsahan akad gratis ongkir yang telah memenuhi unsur pasal 22 tentang rukun akad dikarenakan tidak adanya unsur transparasi antara penjual dan market place Shopee sehingga menjadi akad fasad yaitu akad yang dapat dibatalkan atau tidak sah.

Abstract

This research is motivated by the existence of various additional fees in Shopee Pinjam (SPinjam), but with regard to the meaning of this additional fee, several scholars do not agree on the exact meaning of this additional fee. Therefore, the researcher wants to examine the meaning of additional fees in Shopee Pinjam from the perspective of the fatwa of the National Sharia Council-Majelis Ulama Indonesia whether it is contradictory or not. This research employs normative and empirical research methods. The results of this study indicate that: 1) SPinjamm users know the amount of additional fees from the beginning. The additional fees in SPinjam are a 5% installment fee, a 1% disbursement fee, a 0.3% SPinjam protection fee, and a 5% late fee. These additional fees are not a burden to users. The additional fees charged in SPinjam can relieve the lender party and can provide prudence to the borrowers so that they are disciplined and not negligent in paying loans. 2) The additional fees in SPinjam are not among the additional fees prohibited in the fatwa of DSN-MUI because these additional fees are part of the improvement and maintenance of the company's systems and facilities. Moreover, this additional fee in SPinjam is in accordance with the general provisions of Fatwa DSN-MUI No. 117/DSN-MUI/2018 in point 5 of the general provisions and Fatwa DSN-MUI No. 19/DSN-MUI/IV/2001 in point 3 of the general provisions.

Abstract

This study aims to determine the practice of reviewing the Compilation of Sharia Economic Law on khiyar in buying and selling with a return system between distributors and resellers of Roti Royal in Sungai Kakap District, Kubu Raya Regency. This research uses a qualitative method with the type of empirical legal research. Data sources use primary data and secondary data in the form of books, journals, theses, and articles. Data collection techniques are interviews and documentation. The data analysis technique used by researchers is to collect data, reduce data, present data, and draw conclusions. The results showed that: 1) The agreement and agreement between the two parties the distributor and the reseller is oral because both parties trust each other and do not harm any party. 2) The review of the Compilation of Sharia Economic Law on khiyar in Sungai Kakap District, Kubu Raya Regency is permissible because it has implemented khiyar 'aib and khiyar conditions. Then, in this sale and purchase the 'aib goods have been explained previously by the distributor and the reseller also knows the physical condition of the goods.

Abstract

This research was initiated because of the practice of rotating system cooperation in the behuma tradition which is different from cooperation in general so that it is unique to be researched. The research objectives are to find out: 1) The implementation of the rotating system of cooperation in the practice of behuma in Manggala Village, Pinoh Selatan District, Melawi Regency and 2) Sharia Economic Law Review of the rotating system of cooperation in the practice of behuma in Manggala Village, South Pinoh District, Melawi Regency. This research is a type of field research with a qualitative descriptive approach, using observation, interview and documentation data collection techniques taken from primary and secondary data sources. The results of this study indicate that 1) The implementation of rotating system cooperation in the behuma tradition is carried out by the Manggala village community during behuma activities by exchanging services, and there is an agreement that is conveyed verbally and on the basis of the parties' voluntary principles. 2) Sharia Economic Law Review of the rotation system cooperation in the behuma tradition, that the rotation system cooperation in the behuma tradition has relevance to the syirkah abdan contract because in the implementation of both of them both only contribute work (a’mal) without contributing capital (mal). Then when viewed from the type of 'urf, the gilir system cooperation in the behuma tradition is ‘urf amali which is ‘urf khus then when viewed in terms of its validity it is ‘urf shahih because in its implementation the gilir system cooperation in the behuma tradition is not contrary to Islamic law.
