The problem of crime victims raises various problems in society in general and victims / victims of crime in particular.Legal protection for the community is very important because both groups and individuals can become victims or even as perpetrators of crime.Legal protection of crime victims as part of the protection of the people can be realized in various forms such as through restitution and compensation, medical services and legal aid.The protection of victims is an attempt to recover the losses suffered by the victims.

Abstract

Abstract

Permasalahan yang terjadi dalam hal pembelian Sparepart Alat Berat, sering sekali dijumpai dan terdapat pihak dalam pelaksanaan pembelian dalam hal ini menggunakan invoicesebagai bentuk perjanjian jual beli dengan unsur itikad tidak baik, sebagai contoh pihak pembeli tidak melaksanakan kewajiban pembayaran sesuai dengankesepakatan diawal pembelian dengan alat bukti berupa invoice sebagai bukti perjanjian pembelian Sparepart Alat Berat. Berdasarkan latar belakang yang telah diuraikan di atas, maka penulis merumuskan permasalahan sebagai berikut, Bagaimana Akibat Hukum pihak yang Beritikad Buruk dalam pelaksanaan pembelian Sparepart Alat Berat secara Invoice? dan Bagaimana Upaya Hukum bagi para pihak yang dirugikan akibat pembelian Sparepart Alat Berat dengan menggunakan Invoice?Penelitian ini menggunakn penelitian yuridis normatif, penelitian kepustakaan dengan pendekatan masalah yang digunakan dalam penulisan skripsi ini ialah pendekatan Perundang-undangan (statute approach). Hasil penelitian menunjukan bahwa bentuk Wanprestasi sebagaimana diterangkan Pasal 1238 KUHPerdata adalah kondisi di mana debitur dinyatakan lalai dengan surat perintah atau jika dalam penelitian ini yaitu invoice, atau dengan akta sejenis itu, atau berdasarkan kekuatan dari perikatan sendiri, yaitu bila perikatan ini mengakibatkan debitur harus dianggap lalai dengan lewatnya waktu yang ditentukan. Akibat atau sanksi wanprestasi ini dimuat dalam Pasal 1239 KUHPerdata yang menerangkan bahwa tiap perikatan untuk berbuat sesuatu, atau untuk tidak berbuat sesuatu, wajib diselesaikan dengan memberikan penggantian biaya, kerugian dan bunga, bila debitur tidak memenuhi kewajibannya dan upaya hukum yang dapat dilakukan oleh pelaku usaha adalah dengan cara melakukan somasi sebagai bentuk teguran agar penyelesaian tidak dilakukan melalui jalur pengadilan, dan apabila tidak ada penyelesaiannya maka dapat dilanjutkan gugatan ke pengadilan, tetapi mengingat bahwasannya penyelesaian pada jalur litigasi memerlukan waktu yang lama dan biaya yang banyak, maka para pihak yang dirugikan menempuh jalur kekeluargaan atau mediasi.

Abstract

Komisi Pengawas Persaingan Usaha (KPPU) merupakan suatu organisasikhusus yang mempunyai tugas ganda selain menciptakan ketertiban dalam persainganusaha juga berperan untuk menciptakan dan memelihara iklim persaingan usaha yangkondusif.Penelitian ini bertujuan untuk mengetahui kewenangan KPPU dalammenjatuhkan sanksi serta mengetahui tujuan dari Undang-undang Nomor 5 Tahun 1999tentang larangan praktek monopoli dan persaingan usaha tidak sehat. Metodologi yangdigunakan dalam penelitian ini adalah metode kepustakaan (Library Research).Berdasarkan penelitan diperoleh dua kesimpulan yaitu: 1). Bahwa KPPUmerupakan lembaga yang independen yang terlepas dari pengaruh pemerintah dan pihaklain, yang berwenang melakukan pengawasan terhadap persaingan usaha agarmenumbuhkan iklim usaha yang kondusif melalui terciptanya persaingan usaha yangsehat, dan mencegah praktek-praktek monopoli; 2). Hukum persaingan usahamerupakan hukum yang mengatur segala sesuatu yang berkaitan dengan kegiatanekonomi dan bisnis dalam berinvestasi yang bertujuan untuk menjamin terlaksananyapasar yang optimal, khususnya biaya produksi terendah, harga dan tingkat keuntunganyang wajar, kemajuan teknologi, dan pengembangan produk dan menjadi payunghukum yang sama bagi setiap pelaku usaha atau sekelompok pelaku usaha dalammenjalankan usahanya.

The results of the research are isthat the other countries do not trust to the government of Indonesia aboutthe illegal usage of the frequency 3G which receives te formal letter asthere is no trust to Indonesia about the process of the law inforcement (Gto G atau government to government) which is owned by Qatar. Abstract

Indonesia and even the world now feel the impact of the Corona virus outbreak (covid-19), in connection with it hindering the burial of the bodies of victims who died. The phenomenon of corpse rejection of corona virus patients (covid-19) continues to occur in various regions. In fact, the body must be buried immediately no later than 4 hours after being declared dead. The main reason people are reluctant to accept the bodies of patients co-19 because of fear of contracting. While the medical ensure that the body will not transmit the virus. The body in the coffin has been wrapped and declared sterile. The type of research used in this study is the type of normative legal research, which is a legal research method that uses a statutory approachThe results of the study showed that obstructing officers who will carry out official burials could indeed be convicted. Law enforcement officials can use Article 178 of the Criminal Code. not a complaint offense. Law enforcement officials can immediately take action without anyone complaining. "If the incident fulfills the elements contained in Article 178 of the Criminal Code, the perpetrators can be charged. However, it must look at intentions and actions as a condition for imposing a crime on someone.

Abstract

Negara Indonesia adalah Negara hukum sebagai suatu sistem dapat berperan dengan baik, apabila instrumen pelaksananya dilengkapi dengan kewenangan Kejaksaan Tinggi sebagai penuntut umum dan sebagai penyidik dalam tindak pidana tertentu, misalnya tindak pidana korupsi sesuai dengan Undang-Undang Kejaksaan Republik Indonesia Nomor 16 Tahun 2004. Tindak pidana korupsi merupakan kejahatan yang serius sehingga berlaku undang-undang yang bersifat khusus yang mengesampingkan undang-undang yang bersifat umum. Hasil penelitian yang diperoleh di Kantor Kejaksaan Tinggi Kalimantan Timur KUHAP menganut asas praduga tidak bersalah, maka KUHAP memberikan hak kepada tersangka untuk mengajukan permohonan penangguhan penahanan dengan dasar yang terdapat dalam Pasal 31 ayat (1) KUHAP yaitu penyidik atau penuntut umum atau hakimsesuai dengan kewenangannya masing-masing, dapat mengadakan penangguhanpenahanan dengan atau tanpa jaminan uang atau jaminan orang berdasarkan syarat-syarat yang ditentukan.Berdasarkan hasil penelitian diperoleh data di Kantor Kejaksaan Tinggi Kalimantan Timur tersangka tindak pidana korupsi dapat mengajukan permohonan penangguhan penahanan yaitu tersangka kooperatif tidak melarikan diri, tidak menghilangkan barang bukti dan tidak mengulangi perbuatannya serta telah mengembalikan kerugian Negara namun dalam hal pengabulan permohonan sampai saat ini Kejaksan Tinggi Kalimantan Timur belum pernah mengabulkan permohonan penangguhkan penahanan tersangka tindakpidana korupsi dengan alasan subjektif bahwa tersangka tindak pidana korupsi merupakan kejahatan yang luar biasa dan untuk mendapatkan kepastian hukum.

Abstract

The State of Indonesia is a democratic constitutional state, based on Pancasila and the1945 Constitution of the Republic State of Indonesia, which upholds human rights and guarantees all citizens at the same time in law and government and is obliged to uphold such law and government without exception.The judge is the organs of the court on which should be placed duty and great responsibility for law and justice can be enforced, but on the other hand Judge is also an ordinary man who in carrying out his duty that can’t be separated from mistakes either intentionally or unintentionally.Many public scrutiny that saw the duties of a judge was questioned, ranging from the behavior of a dormant judge while performing his duties in the courtroom, to the alleged bribery to the judge when handling a case including Judge's infidelity into a bleak portrait of public concern.Given the many phenomena of irregularities committed by Judges above, it is necessary an independent institution in charge of providing oversight of violations of ethical   codes   and   judicial   behavior  guidelines.  This   judicial   commission  was established to fulfill a sense of justice and truth for the community with a background.In  this  research,  the  author  uses  normative  legal  research  methods,  and empirical law research methods as well. However, researchers will focus more on normative legal research, while empirical law research serves as supporting information. Using primary legal materials, secondary legal materials, and tertiary legal materials.The oversight of the judicial commission is carried out both internally and externally to ensure that all judges as the principal implementers of the court function shall be of high integrity, honesty and professionalism, thereby gaining the trust of the community and seekers of justice.The public may participate in supervising the behavior of judges in order to bring about a clean and professional judiciary through community reports. Reports may be  conducted  by  individuals,  groups  of  people,  public  entities,  legal  entities, corporation or Non-Governmental Organizations (NGOs) who are aware of alleged code violations Judicial conduct ethics and judicial guidelines and not limited to the injured party. As reported is the Judge allegedly violating the Code of Ethics and Judicial Conduct Guidelines.

Abstract

The formulation of the problem is how the modus operandi in circulationpornographic VCD DVD by actors, how the investigation process and theconstraints faced by the investigator and how efforts to control thecirculation of pornographic DVD VCD carried out by the PoliceSamarinda. In this case study method used by the author is empirical legalresearch, conducted research at Police Samarinda and Samarindajurisdictions whose purpose is to describe and analyze the modusoperandi by the perpetrators, constraints investigation and efforts incombating trafficking in pornographic DVD VCD Polresra Samarinda.List of reference in the this thesis is Law No. 2 of 2002 on the IndonesianNational Police, Law No. 44 Year 2008 on Pornography and the Code ofPenal (Penal Code).

Abstract

In order to complete studies at the University of Law Faculty of August 17, 1945 Samarinda, one of the tasks that must be completed is scientific writing, this imiah writing is entitled: "Juridical Review of the Fall of the Right to Prosecute under the Criminal Law Act". This scientific research method uses normative juridies.The violation of the right to sue is regulated in Chapter VII of the Criminal Code, while the violation of the right to sue is regulated in the Criminal Code, namely:The principle of "Ne bis in idem" (Article 76 of the Criminal Code).Death of the perpetrator (Article 77 of the Criminal Code).Expiry (Article 78 of the Criminal Code).Settlement of cases outside court trials (Article 82 of the Criminal Code).Amnesty and Abolition from the President (Article 14 of the 1945 Constitution).There are no complaints on complaints offenses.This provision contained in the Criminal Code is to provide legal certainty for the community specifically the perpetrators of criminal acts. Provisions for the cancellation of the right to sue are the duties and functions of the Attorney General's Office of the Republic of Indonesia based on Law 16 of 2004.The fall of the right to sue is caused by: 1) natural causes, 2) causes of human actions, and 3) legal causes It is hoped that the rules on the cancellation of the right to sue can be further emphasized in the new draft Law on Criminal Law (RKUHP) to provide legal certainty to the public. Likewise, cases of minor criminal acts (tipiring) should be resolved outside the court to avoid the accumulation of cases in court and the excess capacity of State Detention Centers or Penitentiaries.
