Komunikasi merupakan elemen fundamental dalam proses pendidikan karena melalui komunikasi terjadi penyampaian informasi, pembentukan pemahaman, dan interaksi edukatif antara pendidik dan peserta didik. Namun dalam praktiknya, proses komunikasi sering menghadapi berbagai hambatan yang berdampak pada efektivitas pembelajaran. Artikel ini bertujuan untuk menganalisis bentuk-bentuk hambatan komunikasi dalam pendidikan, seperti hambatan psikologis, linguistik, lingkungan, budaya, serta hambatan penggunaan teknologi pada era digital. Selain itu, artikel ini membahas strategi alternatif untuk mengatasi hambatan tersebut melalui pendekatan pedagogis, penggunaan media pembelajaran, peningkatan kompetensi komunikasi guru, serta penguatan hubungan interpersonal dalam lingkungan sekolah. Dengan memahami hambatan komunikasi dan cara mengatasinya, diharapkan proses pembelajaran dapat berjalan lebih efektif, komunikatif, dan berpusat pada peserta didik.

Abstract

This article will discuss the concept of Independent Regulatory Agencies (IRAs) as an alternative to constitutional protection for c in Indonesia. State auxiliary agencies are state institutions that are formed and have authority based on other laws and regulations. In Indonesia, state auxiliary agencies are not regulated in a legal basis, so it is still unclear about their position in the constitution. Apart from that, there is still uncertainty regarding the independence of state auxiliary agencies which causes the authority of these state institutions to be limited. This study is a qualitative legal research. Data collection techniques using literature study. The type of data used is secondary data derived from data sources of laws and regulations, articles, and journals. The research method used is a normative juridical approach. Data analysis techniques use descriptive analysis specificatios. This research finds that state auxiliary agencies in Indonesia were formed on the basis of other laws or are said to be not state institutions that have the authority mandated by the 1945 Constitution. Unlike in the United States and Europe, state auxiliary agencies are legally guaranteed by laws and regulations and are even stated explicitly and limitively. Independence and self regulatory are two important elements in IRAs. This study recommends the concept of IRAs as an idea for improving the arrangement of state auxiliary agencies in Indonesia so as to create effective democratic state services. Some of the models that can be applied include; minimizing the authority of the DPR in selecting leaders of state auxiliary agencies, granting independent authority and affirming non-partisan provisions.

Abstract

There are various government agencies around us; perhaps this raises the question of why some agencies seem more efficient and effective than others. One of the main factors that influences the performance of an agency is the implementation of a meritocracy system, where civil society is promoted and given responsibility based on their abilities and achievements, not connections or seniority alone. In this article, we will discuss in depth the importance of implementing a meritocracy system in government agencies to increase work accountability, supervision, and bureaucratic reform. We will also provide examples of agencies that have successfully implemented a meritocracy system.

Abstract

The debate on the age limit for presidential and vice-presidential candidates is an important issue in the context of Indonesian democracy. Democracy emphasizes the principles of equality and participation, while meritocracy emphasizes competence and experience. Currently, the minimum age limit for presidential candidates in Indonesia is 35 years old. Debates have arisen over the relevance of this age in the current political context, with arguments in favor of the role of younger generations bringing innovation versus the need for experience and wisdom. This study aims to re-evaluate the age limit for presidential candidates in Indonesia from historical, constitutional and international comparative perspectives, and examine its impact on political dynamics and leadership quality. The research methodology involves literature analysis and recent case studies. The results are expected to contribute significantly to the discussion on the age limit for presidential candidates and its implications for democracy and meritocracy in Indonesia.

Abstract

The Bill on the Limitation of Cartal Money Transactions (RUU PTUK) is a regulation regarding the limitation of cartal money transactions to 100 million rupiah in a day either in one transaction or several times, more than that must use digital money. The purpose of this bill is to reduce circulation and emphasize counterfeit money and reduce corruption activities. This paper aims to identify the problems and impacts of the passage of the PTUK Bill on corruption and money politics in Indonesia. The PTUK Bill in its application requires public participation to support the PTUK Bill, besides that the public needs to understand the consequences of money politics on the sustainability of government.

Abstract

This article discusses the implementation of Indonesian diplomacy in facing the trade war against the European Union (EU) using a self-help concept approach. By analyzing the concept of self-help in international relations and its application in diplomatic strategy, this research highlights how Indonesia applies cooperative diplomacy with regional partners and diplomacy to overcome the challenges posed by the European Union's palm oil discrimination.This study uses a qualitative approach by collecting data from various primary sources of diplomatic documents related to the trade war involving the European Union. Apart from that, secondary data obtained from news, scientific articles and journals are relevant data sources.

Abstract

Article 27 letters (g) and (h) of the 2006 Convention on the Rights of Persons with Disabilities regulates that state parties must employ persons with disabilities in the government sector and promote employment for persons with disabilities in the private sector through appropriate policies and measures which may include concrete action programs, incentives and other steps. Based on data from the Ministry of Manpower in 2021 and 2022, less than 1% of people with disabilities can work in the public and private sectors. The main problems in this research are: How is Article 27 of the Convention on the Rights of Persons with Disabilities 2006 implemented in Law Number 8 of 2016 concerning Persons with Disabilities; What is the solution to the weakness in implementing Article 27 of the 2006 Convention on the Rights of Persons with Disabilities in Law Number 8 of 2016 concerning Persons with Disabilities. The theories used in this research are the theory of monism and the theory of legal positivism.The type of research used in this research is normative legal research. Normative legal research is a process of finding legal rules, legal principles and legal doctrines to answer the legal issues faced. This research focuses on legal synchronization, namely examining the harmony of positive law (legislation) so that it does not conflict based on the hierarchy of laws and regulations.The results of this research are that the implementation of Article 27 of the Convention on the Rights of Persons with Disabilities 2006 in Law Number 8 of 2016 concerning Persons with Disabilities has weaknesses, where none of this law regulates sanctions for the government, regional governments, State-Owned Enterprises, Regional-Owned Enterprises and private companies that do not meet the quota for disabled workers as regulated in Article 53 of Law Number 8 of 2016 concerning Persons with Disabilities. Therefore, the government needs to formulate government regulations as soon as possible as implementing regulations for Law Number 8 of 2016 concerning Persons with Disabilities, so that there is legal clarity and certainty, especially for law enforcers and people with disabilities.

Abstract

Artificial intelligence is one of the most talked about technologies today. The advanced technology that allows computers to mimic human behaviour is what defines artificial intelligence. Advanced technology that allows computers to mimic human behaviour is at the core of artificial intelligence. The utilisation of this technology is widespread in all industries around the world. The purpose of this research is to find out how influential the advancement of AI Technology is on the insight of the archipelago. The method used is a qualitative method that emphasises qualitative information data. Qualitative research method is a research method that focuses on understanding a social phenomenon that occurs in society. The result of this discussion is that the development of the times has made technological advances increasingly sophisticated. Technology can facilitate the quick and easy acquisition of information about history, culture, values, and the latest national developments. Technology understands the diversity and uniqueness of each country, so it is expected to give birth to a spirit of solidarity to achieve common progress.

Abstract

This research highlights the importance of women's representation in the legislature as an indicator of the quality of democracy in Indonesia. Although regulations set a minimum quota of 30% women's representation, the realization is still low with a projection of only 22.1% of women elected in the 2024 DPR. The open proportional electoral system provides opportunities but also presents challenges, such as money politics and patriarchal culture. Internal factors such as lack of confidence and double burden, as well as external factors such as political violence and lack of support from parties, hinder women in politics. To increase this representation, strategies such as gender mainstreaming in political communication, effective affirmative action, and inclusive political education are needed. These efforts aim to create a more inclusive and gender-equal parliament, supporting women's role in public policy-making.

Abstract

Santet is generally difficult to understand or understand its meaning, as a supernatural belief phenomenon involving the use of magic or black magic, has become part of local culture in Indonesia. Santet, from some opinions, can also cause someone to become a victim due to the misuse of witchcraft which is used as a medium to cause harm, illness, or even death, including criminal acts. This article focuses on an analysis of the criminalization of witchcraft as a criminal act. Through an exploration of the existing legal basis, this research seeks to provide a deeper understanding of how criminal law can be applied in order to suppress an act of witchcraft practice that harms the community. This research provides a clear picture of the role of criminal law in dealing with the phenomenon of witchcraft, although challenges related to belief, culture, and the unclear definition of the practice remain complex. Thus, this article is intended to provide a basis for further discussion regarding the criminal analysis of witchcraft as a criminal offense, with the aim of creating fair law enforcement and protecting the public from the negative impact of supernatural practices.

Abstract

Indonesia and China are two countries with rapidly developing economies in Southeast Asia. These two countries have great potential to attract foreign investment. However, there are differences in investment and foreign investment regulations in the two countries. This research aims to compare investment and foreign investment laws in Indonesia and China. This research uses normative legal research methods with a comparative approach. Research data was obtained from literature studies, namely laws, government regulations and other related literature. The research results show that there are similarities and differences in foreign investment and investment regulations in Indonesia and China. Similarities include, recognition of the rights of foreign investors; providing incentives for foreign investors; and resolving investment disputes. The differences include the subject of investment, business fields open to foreign investment, investment requirements. From this research, researchers can draw the title, namely Comparison of investment law and foreign investment in Indonesia and China
