Abstract

Abstract

Abstract

Corruption is an extraordinary crime and has a systemic impact that is detrimental to the state and society at large. To overcome this problem, the Indonesian legal system provides the option of implementing the death penalty, which is regulated in Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 concerning the Eradication of Corruption. However, the application of the death penalty has raised significant debate from various perspectives, both legal, philosophical, and sociological, considering that this action is contrary to the principle of respect for human rights. This study will discuss the threat of the death penalty as a form of ultimum remedium, namely as a last resort carried out in certain circumstances, such as when corruption occurs in a crisis or disaster situation. To analyze the effectiveness and urgency of implementing the death penalty in the context of anti-corruption law enforcement, a legal-normative approach is used

Abstract

This study examines the universal concept of human rights as fundamental to all individuals. Human rights reflect dignity, equality, autonomy, and legal protection, and must be ensured by the state. Although broadly accepted, continuous education and public awareness—especially for marginalized groups—remain essential. In Gorontalo Province, the Ministry of Law and Human Rights’ Regional Office plays a pivotal role in responding to alleged human rights violations through its Community Communication Services Program, as regulated by Ministerial Regulation No. 23 of 2022. Using an empirical legal approach, the study gathers data through literature reviews, legal documents, and interviews with relevant stakeholders. Findings show that the Regional Office serves as a key constitutional institution promoting access to justice and upholding legal protections. Its activities include handling public complaints, forming investigative teams, and coordinating with law enforcement and legal aid bodies. Legal aid—both state-sponsored (pro deo) and volunteer-based (pro bono)—emerges as a crucial tool for promoting justice, especially for the underprivileged. The structured complaint mechanism under Ministerial Regulation No. 23 of 2022 strengthens the state’s role in ensuring equality before the law and fulfilling its constitutional obligations to protect human dignity and human rights.

Abstract

Service satisfaction is defined as an effort to fulfill something or make something adequate which is generally described as a feeling of pleasure or disappointment that arises towards performance (results) after being compared with expected performance. Measuring the level of student satisfaction towards services in schools is an important element in the school's efforts to provide the best, efficient and effective services for students. This study aims to evaluate the effectiveness of the Guidance and Counseling (BK) program in schools. This survey involved a number of BK teachers and students from several schools in certain areas. The research method used was qualitative with an open questionnaire instrument, namely a structured interview to measure various aspects of the BK program, including service quality, student involvement, and the impact on students' academic and emotional development. The survey results showed that most students and BK teachers felt that the BK program in schools had been running quite well, but there were still some areas that needed improvement, such as the availability of resources and further training for counselors. In addition, there was a positive correlation between the frequency of student involvement in BK sessions with an increase in their academic achievement and emotional well-being. This study provides recommendations for improving the BK program in schools, including increasing training for counselors and strengthening support from the school.

Abstract

Law enforcement is a fundamental pillar in upholding justice and maintaining social order. Indonesia and Malaysia, as neighboring countries with shared historical backgrounds and legal systems—both influenced by Continental European law and local customary laws—demonstrate different approaches in their judicial systems and law enforcement practices. This study aims to compare the judicial systems of both countries in terms of law enforcement, focusing on institutional structures, criminal and civil court mechanisms, and the effectiveness of law enforcement agencies such as the police, prosecution, and judiciary. The research employs a qualitative method with a juridical-comparative approach, analyzing legal documents, legislation, and scholarly literature. The findings reveal that although both countries share basic legal principles, significant differences exist in terms of judicial independence, procedural efficiency, as well as transparency and accountability of law enforcement institutions. This study is expected to contribute to the reform of Indonesia’s judicial system by adopting positive practices from the Malaysian legal framework.

Abstract

The state's efforts to provide accurate and up-to-date population data for various development needs, such as planning policies and public services, are known as the implementation of population administration. Due to the large number of people living in big cities, many non-permanent residents have not been officially registered. This is due to difficult procedures, lack of legal knowledge, and limited access to population registration services. The need to maintain the basic rights of every citizen, both permanent and non-permanent, and ensure orderly administration as part of national development is the basis of the policies used to manage population administration. By ensuring proper data collection, accurate recording, and legal protection for non-permanent residents, proper population administration is expected to be an important tool to reduce the negative impacts of urbanization, especially in the city of Surabaya. This study aims to determine how population administration for non-permanent residents in the city of Surabaya is implemented in the context of urbanization and to suggest more reasonable and efficient policies. The results of the study, which was conducted using a qualitative approach by conducting literature research, in-depth interviews, and policy analysis, showed that simplifying registration procedures, increasing socialization, and increasing cooperation between related institutions are needed to carry out population administration for non-permanent residents.

Abstract

The dissenting opinion phenomenon in Decision Number 12/G/2021/PTUN.GTO reflects the tension between the principle of legality and administrative practice in the dishonorable dismissal (PTDH) of Polri members. This study aims to analyze the legal position of dissenting opinions in the state administrative judicial system and assess the extent to which PTDH decisions reflect compliance with the principle of legality and general principles of good governance. This research uses juridical-normative method with conceptual approach and case study. The results of the study show that dissenting opinions function as judicial control over the potential for abuse of administrative authority, especially when the legal basis for PTDH refers to circular letters that do not have the binding force of laws and regulations. It is recommended that the PTDH mechanism prioritizes the principle of due process of law to ensure justice and legal certainty for members of the National Police who are subject to administrative sanctions.

Abstract

The comparison of health law between Indonesia andMalaysia covers critical aspects of the healthcare system that influence the quality of life of their citizens. This study primarily focuses on occupational health and safety (OHS) for healthcare workers. According to global data, Malaysia has a better healthcare system compared to Indonesia, as reflected in its higher ranking on the Health Care Index. In Indonesia, health law regulations often undergo changes and revisions, such as the enactment of the Omnibus Law, which consolidates various health sector regulations. However, this has raised concerns about the diminishing legal protection for healthcare workers. In contrast, Malaysia presents a more structured system, with the integration of health and labor institutions through the Department of Occupational Safety And Health (DOSH), which ensures better workplace safety and clearer standards. This research adopts a descriptive qualitative approach by analyzing legal documents such as Law Number 17 of 2023 on Health in Indonesia and the Occupational Safety and Health Act in Malaysia. The Malaysian approach is more preventive and promotive in nature, differing from Indonesia’s curative-dominated model. The study aims to compare the legal health regulations of both countries, assess their implementation effectiveness, and offer policy recommendations based on best practices applied inMalaysia to improve the quality of healthcare services inIndonesia. The findings reveal that although Indonesia has significant potential in the health sector, weak regulation implementation and supervision remain major obstacles. Therefore, a more structured and efficient regulatory reform is needed to enhance legal protection for healthcare workers and improve health services.

Abstract

The inconsistency in case rulings and its impact on the principles of separation of powers and the quality of democracy in Indonesia. The case challenges the age limit for presidential and vice-presidential candidates, with the Constitutional Court acknowledging the legal standing of the petitioner despite discrepancies in the outcomes of similar cases. The implications of adding norms in such rulings also raise questions about the legitimacy of Constitutional Court decisions in the political context. This study employs qualitative methods, leading to the conclusion that the decision results in controversy among the public, causing them to lose trust in the constitutional court due to autocratic rulings benefiting political elite. Keywords: Constitutional Court, Democracy.
