Abstract

This study was conducted to determine the performance of the Mataram City General Election Commission in increasing public political participation in the 2024 presidential election. The research method used is qualitative with a qualitative descriptive approach. Data were obtained through interviews, documentation, and theoretical studies. The results of this study indicate that the performance of the Mataram City General Election Commission in increasing public political participation in the 2024 presidential election has 5 aspects, namely the first quality of work, the quality of work of the Mataram City KPU, namely its success in managing logistics, human resources, and election infrastructure, as well as providing effective complaint channels for voters and election observers. Second productivity, the productivity of the Mataram City KPU, namely conducting voter data collection, procurement of logistics, and socialization to the community such as providing an understanding of the stages in the implementation of the election. Third initiative, the initiative of the Mataram City KPU, namely conducting direct voter education in communities and schools, in order to provide understanding to new voters and conduct intensive training for KPPS officers in increasing capacity and professionalism. Fourth cooperation, the Mataram City KPU has collaborated with the Mataram city government in order to ensure logistical and infrastructure support such as the provision of polling stations, security and campaign facilities, as well as cooperation with community organizations (ORMAS) and non-governmental organizations (NGOs) in various activities such as monitoring polling stations, voter education, and campaign supervision. Fifth responsibility, the responsibility of the Mataram City KPU is to submit reports on the implementation of voting and vote counting to the NTB KPU to the RI KPU such as data on the presence of observers and witnesses for election participants at each polling station, as well as reports on the recapitulation of vote counting results such as data on the acquisition of votes for each candidate at the sub-district and city levels.

Abstract

Along with the enactment of Law Number 7 of 2020 concerning the Third Amendment to Law Number 24 of 2003 concerning the Constitutional Court (Constitutional Court Law) which has reaped academic and practical debates among the public, especially regarding its urgency aspects towards strengthening the independence of the constitutional justice institution, so this study is present to identify the nature and characteristics of the dynamics of the formation of the third revision of the Constitutional Court Law which is analyzed parsimoniously in the legal political landscape. This study is a normative legal research conducted through a library research method using several approaches, namely the statute approach, conceptual approach and case approach. The results of the study show that the strengthening of the government's position and the weakening of the role of the DPR as well as civil society in the third revision of the Constitutional Court Law as a result of the formation of an oversized coalition posture have implications for legislative performance that characterizes the authoritarian political configuration. Then, the massive public criticism of the norms in the third revision of the Constitutional Court Law, which in fact is considered not in line with public aspirations, substantively indicates that the law produces conservative legal arrangements.

Abstract

The strategy of the Election Supervisory Agency in supervising the quality of services for groups with disabilities in the implementation of the 2020 Simultaneous Regional Elections in NTB is one of the obligations to realize democratic election rights. This study aims to determine the strategy of the NTB Provincial Election Supervisory Agency in supervising the quality of services for groups with disabilities in the 2020 Simultaneous Regional Elections in NTB and to determine the factors that influence the implementation of strategies for the quality of services for groups with disabilities in the implementation of the 2020 Simultaneous Regional Elections in NTB. The research method used is qualitative with a descriptive analysis approach. Data were obtained through interviews and literature studies. The results of the study show that the strategy of the Election Supervisory Agency in supervising the quality of services for groups with disabilities in the 2020 Simultaneous Regional Elections in NTB has three aspects. The first aspect determines the long-term formulation, the second aspect selects a series of actions, the third aspect determines the allocation of resources, and shows that the factors that influence the implementation of the Election Supervisory Agency's strategy are communication factors and resource factors.

Abstract

Along with the dynamics of governance that increasingly leads to a process of autocratization that tends to be counterproductive to the values of constitutionalism and seems to destroy the will of the wider community, which is shown through the practice of autocratic legalism by utilizing the power of the three branches of power to perpetuate a unilateral interest through legal reform so that it appears to be legal and constitutional but essentially deviates from the principles of the rule of law, Where one of its main characteristics is to provide protection for human rights, so this research is present to reveal the causal relationship between the practice of autocratic legalism and its impact on the enforcement of citizens' individual rights within the framework of analyzing several court decisions. The method used in the research is normative research using several approaches, namely the statute apporoach, conceptual approach, and case study approach. The results of the study concluded that: first, in several court decisions, judges in formulating their ratio decidendi did not seem to apply the law properly as a result of only relying on formal truth and negating material facts which in fact are the truth that must be prioritized so that the arbitrary actions of the government seemed to be “normalized” through court decisions. Second, from this situation, of course the implication of autocratic legalism on law enforcement of citizens' individual rights is the abuse of government power by power holders for one-sided interests by overriding the individual rights of citizens, including human rightsvaccines are more due to global supply issues and high demand than Australia's violation of Article 31 TRIPS. This research confirms the importance of compulsory licenses in the face of the global health crisis. A fair and effective implementation of compulsory licenses can improve access to essential medicines, support public health, and fulfill the principles of fairness in licensing.

Abstract

This study aims to analyze the implementation of compulsory licenses as per Article 31 of the TRIPS Agreement in the context of pharmaceutical products in Australia. Compulsory licenses provide flexibility to WTO member countries to produce or use patented medicines during public health emergencies. Under Australia's Patents Act 1990, Section 133 provides for the grant of compulsory licenses that allow the exploitation of patents without the consent of the rights holder, provided that reasonable compensation is provided. This study uses a qualitative approach with normative legal research methods to examine the regulation and application of compulsory licenses in Australia. The analysis is conducted through a review of legislation, legal literature, and a case study of the H1N1 vaccine produced by CSL Limited during the 2009 pandemic. The results show that the compulsory license mechanism in Australia has been designed to comply with the TRIPS Agreement and ensure a balance between the interests of patent holders and public health needs. The obstacles faced by Indonesia in accessing vaccines are more due to global supply issues and high demand than Australia's violation of Article 31 TRIPS. This research confirms the importance of compulsory licenses in the face of the global health crisis. A fair and effective implementation of compulsory licenses can improve access to essential medicines, support public health, and fulfill the principles of fairness in licensing.

Abstract

Penelitian ini bertujuan untuk mengetahui konsep pengembangan promosi wisata Kuta Mandalika melalui digital tourism dengan model pantehelix. Metode penelitian menggunakan pendekatan kualitatif, penelitian kualitatif merupakan payungnya berbagai metode penelitian naturalitik dalam kehidupan sosial. Dalam penelitian ini yang akan menjadi data primer adalah pemerintah (DISPAR), komunitas swasta (PT. ITDC), pelaku usaha (UMKM), media, dan akademisi. Teknik pengumpulan yang digunakan peneliti yaitu observasi, wawancara (Interview), dan dokumentasi, Dari hasil penelitian yang dilakukan oleh peneliti diketahui bahwa pengembangan promosi wisata melalui digital tourism di wisata kuta Mandalika telah dilakukan melalui berbagai pengembangan aplikasi berbasis website dan melalui berbagai platform media sosial untuk mendukung promosi wisata kuta mandalika, selain hal itu secara bersama-sama kolaborasi melalui model pentahelix kerja sama antara pemerintah, akademisi, komunitas, pebisnis dan media telah memberikan dampak positif bagi perkembangan wisata kuta Mandalika. Penerapan digital tourism ini berfungsi sebagai media komunikasi, informasi, promosi serta pelayanan kepada masyarakat dalam pengembangan wisata kuta mandalika.

Abstract

Arbitration proceedings are conducted in private and confidential, a principle that is universally accepted in arbitration practice around the world. The private nature of arbitration proceedings ensures the confidentiality of the parties' disputes, given that arbitration is a forum for resolving business disputes where the evidentiary process often requires parties to present evidence in the form of business contracts containing company secrets. There are a number of countries that regulate the conduct of arbitration proceedings in an absolute closed manner, such as Indonesia. However, some countries, such as Singapore, regulate the conduct of arbitration proceedings in a non-absolute closed manner. Singapore's regulations allow for arbitration proceedings to be open in certain circumstances. Arbitration proceedings may be open if the parties to the dispute agree to open them. The arbitral tribunal may order arbitration proceedings to be open in disputes involving the public interest. Conducting arbitration proceedings in the open can provide legal protection for the public and fulfill the right to social control over an arbitration dispute involving the public interest. The concept of regulating open arbitration proceedings can be applied in Indonesia to disputes involving the public interest, such as arbitration disputes involving the government, local governments, state-owned company, and regional-owned company (known as BUMN and BUMD).
