Abstract

Qat'i and zanni consist of two elements; al-thubut (the truth of the source) and al-dalalah (meaning). There are no differences in arguments about the truth of the Al-Qur'an source. The problems are in the contents since it depends on the intellectual capacity of mufassir.

Abstract

The methods of interpreting al-Qur’an often elaborate upon philosophy, lest, and reality and those give new perspectives towards some controversies in Islamic laws. This chapter explains about one method which is practiced by Islamic Liberal Network (JIL). Commonly JIL contributes the rational thought and it is based on the maslahah principles.

Abstract

A method to define the first day of Qomariyah or Hijriyah months is by rukyatul hilal. It will be esmore perfect when it uses a contemporary hisab method. The data from contemporary hisab sourc (Ephemis and Nautica almanac) are in Masehi calendar system. To find out data for doing the hisab we have to convert from Hijriyah calendar to Masehi calendar.

Abstract

ADR is an alternative dispute resolution, that consider peaceful and agreement. Such a dispute has been a long time known by Indonesia society. Musyawarah and mufakat principles that exist in Adat Law and Islah principle that exist in Islamic Law constitute Living Law in Indonesia. Principle of Law as forgiving, peaceful and agreement that exists in Islah can construct ADR in frame National Law system.

Abstract

Marriage law states that the descent of somebody can only be approved by birth certificate or decision from a Religious Court, based on sufficient evidences. DNA as one evidence is a blue print which explains the blood relation that can be descended to the next generation. However, the validity of this test is still hesitated. It is because the test is still insufficient as a powerful proof which can be used in courts.

Abstract

There are some changes towards law protection of human rights. UUD 1945 is not as accommodative as RIS constitution. To overcome the problems, the government made an amendment to UUD 1945 section 28, to give more law protection for human right.

Abstract

The important point in Islamic law is justice and punishment. This principal is the reference in deciding an Islamic law. The execution of d{aru>rah in Islamic law is natural because its priorities the ease and avoiding difficulties. D{aru>rah has some meanings. Al-Jas}s}a>s stated as the fear of the damage of soul and body. D{aru>rah is something which is related to the big problems which need ease (mashaqqah).

Abstract

This text compares among three methods in Usul al-Fiqh: Hanafiyah, Shafi'iyah, and tariqah al-jami'. Hanafiyah has some strengths such as rich of examples in furu', close with the reality and concise in discussion. The weakness of this method is it causes a kind of fantastic and rich of argumentation. Shafi'iyah method is too narrow in philosophical point of view and lack for examples. Tariqah al-jami' generally could overcome the weakness of those two methods above.
