Abstract

The handling of postoperative anesthesia requires special attention to legal and medical ethical aspects, as it involves the patient's right to safe treatment and the doctor's responsibility in providing services according to professional standards. The importance of legal protection and the application of medical ethics is becoming increasingly relevant given the potential complications of anesthesia that can affect the patient's quality of life. This article highlights two main areas, namely the protection of patient rights, such as the right to clear and honest information about the risks of anesthesia, as well as the responsibilities of doctors, including the obligation to ensure patient recovery and avoid medical negligence. This study uses a qualitative method with a juridical-normative approach. Data were obtained through analysis of health law literature, principles of medical ethics, and review of legal cases related to anesthesia malpractice. This approach provides systematic insight into the relationship between legal regulation and ethical principles in medical practice. The results of the study show that negligence in providing adequate information to patients regarding the effects of anesthesia can trigger legal conflicts, such as malpractice lawsuits. In addition, doctors' non-compliance with medical ethical principles, such as nonmaleficence (not harming patients), can damage patient trust and the reputation of the medical profession. In conclusion, the integration between legal protection and the proper application of medical ethics is key to improving the quality of postoperative care, protecting patient rights, and ensuring that doctors' responsibilities are optimally fulfilled.

Abstract

Traffic violations involving children are increasingly found in everyday life. Children, who in this case are categorized as a person under the age of 18, are often involved in various forms of traffic violations, such as driving a motor vehicle without a driver's license, violating traffic signs, riding and driving at dangerous speeds. This phenomenon raises concerns, especially due to the high risk of accidents and the potential for casualties. In this paper, we will discuss criminal liability for children who commit traffic violations and legal sanctions for children who commit traffic violations. The method applied in this study is the normative juridical method, a deductive approach that uses theory as a starting point to answer research questions. This study will analyze articles in laws and regulations related to legal studies of children who commit traffic violations. Legal sanctions against children who commit traffic violations can be in the form of criminal or non-penal actions. Criminal sanctions are more educational in nature such as warnings, supervision, and coaching in special institutions. Meanwhile, non-penal actions such as guidance or counseling are prioritized so that children can understand mistakes and correct their behavior. The system aims to ensure that children are given the opportunity to change. The application of sanctions against children who commit traffic violations must pay attention to the balance between law enforcement, the best interests of the child, and prevention goals. Despite violations, an approach based on the protection of children's rights remains the basis for coaching efforts.

Abstract

This study aims to analyze the strategies of Islamic religious education teachers in instilling students' religious character in MIS AlHikmah. Through the SWOT (Strengths, Weaknesses, Opportunities, Threats) analysis approach, this study identifies factors that affect the success or challenges in the process of religious education. The results of the analysis show that the main strength lies in the in-depth competence of teachers, varied teaching methods, and support from the curriculum and MIS AlHikmah. On the other hand, there are weaknesses such as lack of adequate training for teachers and limited teaching time. The study also found that opportunities such as the use of educational technology and religion-based extracurricular activities can strengthen students' religious character. However, there is a threat in the form of social media and global cultural influences that can reduce the practice of religious teachings. Based on the results of the analysis, this study suggests a number of policies, including increasing teacher training, increasing religious learning time, and developing religion-based extracurricular activities. It is hoped that the implementation of this policy can increase the effectiveness of Islamic religious education in shaping the religious character of students at MIS AlHikmah.

Abstract

This paper wants to see how the legal position of Perma No. 7 of 2022 is related to the summoning of the parties to attend the trial in court. The summons according to Perma Number 7 of 2022 is carried out through a registered letter where the summons is carried out by an officer outside the court bailiff, namely PT. Pos Indonesia, while in the previous regulation, namely in HIR/RBg. the person who is obliged to make a summons is a court bailiff, and Government Regulation Number 9 of 1975 the summons is carried out by an officer ordered by the chairman of the religious court. After the legal position, it was also examined how effective the PERMA was when applied in a judicial work unit, namely the Simalungun Religious Court. The method used in this study is normative-empirical juridical (applied law research) where for normative law it examines legal norms, rules and principles contained in laws and regulations, and finds out the facts in the field from the application of rules in a work unit, namely the Simalungun Religious Court. From the results of the research, the researcher obtained the results that although there is no legal void in the law that regulates the summons of litigants to attend the trial, the legal position of Perma Number 7 of 2022 remains strong because the rules governing the summons are not rigid and provide space to make a perma that regulates summonses through registered letters. For the effectiveness of its implementation, Perma number 7 of 2022 is very effective for the principle of simplicity and low cost but not effective enough for the principle of fast justice. This means that the issuance of Perma Number 7 of 2022 does not deviate from higher rules and its application is very effective for the realization of the principles of the judicial trilogy, especially in terms of simple and cost-effective principles.
