Abstract

One form of compensation for victims of criminal acts is restitution. Restitution in accordance with the Principle of Restoration to its Original Condition (restutio in integrum) is an effort that ensures that crime victims must be returned to their original condition before the crime occurred, even though it is based on the fact that it is impossible for the victim to return to their original condition. This principle emphasizes that the form of recovery for victims must be as complete as possible and cover various aspects arising from the consequences of the crime. With restitution, victims can have their freedom, legal rights, social status, family life and citizenship restored, returned to their place of residence, their job restored, and their assets restored. Restitution itself is defined as the payment of compensation charged to the perpetrator based on a court decision which has permanent legal force for material and/or immaterial losses suffered by the victim or his heirs. For this reason, the perpetrator is required to pay restitution to the child victim of a crime to compensate for the losses suffered by the victim as a form of the perpetrator's responsibility for his actions which caused harm to the victim, his family or his heirs, as the implementation of Article 71 D Paragraph (2) of Law Number 35 of 2014 concerning Amendments to Law number 23 of 2002 concerning Child Protection. Applications for restitution can be submitted by child victims of criminal acts who must be accompanied by parents/guardians, their heirs or through the Institution witness and victim protection. To apply for this restitution, it is hoped that the child's companions have equipped themselves with the applicant's identity file, the identity of the perpetrator, a description of the criminal act, a description of the losses suffered, the amount of restitution requested and the form of restitution requested.

Abstract

This study aims to analyze the influence of organizational culture consisting of the dimensions of involvement, consistency, adaptability, and mission on the use of the digital tax system in MSMEs in Medan City. The population of this study is MSME owners and managers in Medan City, with a sample of 50 respondents. The research method uses a quantitative approach with multiple linear regression analysis, classical assumption test, and partial hypothesis test (t-test) and simultaneous (F-test). The results of the study show that partially and simultaneously, the dimensions of organizational culture have a positive and significant effect on the use of digital taxation systems. In conclusion, improving organizational culture can support the effectiveness of the implementation of the digital tax system for MSMEs. This research suggests the need for more intensive socialization and training related to the use of the digital tax system so that MSMEs can more easily adopt it.

Abstract

The purpose of this research is to provide knowledge to parents about the importance of good communication with children. This type of research is qualitative research that is descriptive in nature data collection techniques through observation, interviews and documentation. The data sources in this study are village heads, community leaders and parents. This paper seeks to explain that effective communication between parents and children not only increases parental involvement in children's education but also has a positive impact on children's cognitive and emotional development. By building good communication, parents can act as active educational partners, creating an optimal learning environment for their children. This includes communicating effectively, listening empathetically, and understanding the child's emotional needs. With a better understanding, parents are expected to play an active role in their children's education. Encourage parents to be actively involved in the child's education process, both at home and at school. This includes attending school meetings, supporting learning activities at home, and collaborating with teachers to monitor children's academic development. building a strong communication network between parents, teachers, and the school. With good communication, all parties can share information and support each other in an effort to improve the quality of children's education.

Abstract

Traffic accidents remain a significant concern in Indonesia, particularly in Deli Serdang, where the number of cases continues to rise. This study examines the role of Deli Serdang Police investigators in handling traffic accident cases, focusing on their tasks, challenges, and efforts to ensure effective legal processes. The research highlights that investigators play a crucial role in conducting comprehensive investigations, gathering evidence, and determining legal accountability in each case. However, investigators face numerous obstacles, including limited resources, insufficient evidence, and environmental factors that complicate the investigative process. The study underscores the importance of collaboration between law enforcement and the community, as well as the need for enhanced investigator training and public education on traffic safety to mitigate accidents.

Abstract

Money laundering is a serious crime that threatens the economic and social systems, often involving sophisticated methods and multiple parties. This study analyzes the application of law in the Supreme Court decision Number: 559 PK/Pid.Sus/2022, which addresses the crime of continuous money laundering involving participation. The defendant, Gulabray Naraindas Keswani, was found guilty of continuous money laundering and sentenced to prison and a fine. Through an analysis of the legal considerations and application of legal principles such as inclusion (deelneming) and continuing acts (voortgezette handeling), this study highlights the judiciary's commitment to eradicating money laundering and its implications for law enforcement. This case sets a significant precedent for combating similar crimes in Indonesia.

This research examines the procedures implemented by the Lubuk Pakam Police Criminal Investigation Unit in conducting investigations and addresses the challenges faced during the process. The study highlights the investigative steps starting from receiving reports, evidence collection, and crime scene visits to determine the criminal nature of reported incidents. It also identifies obstacles, including insufficient evidence, limited resources, and legal complexities, that impact effective law enforcement. This analysis aims to provide insights into improving investigative efficiency and strengthening the role of police in public service.

Abstract

This study examines the role of the Traffic Police in enforcing Law Number 22 of 2009 concerning Traffic and Road Transportation in the jurisdiction of the Deli Serdang Police. The significant growth in vehicle volume in Deli Serdang, which directly borders the city of Medan, has caused complex traffic problems such as congestion, traffic violations, and accidents. This study aims to analyze the role of the Deli Serdang Police Traffic Police in enforcing traffic laws and identify the obstacles faced. Data were obtained through a case study at the Deli Serdang Police using qualitative methods, including interviews with Traffic Police officers and field observations. The results of the study indicate that the Deli Serdang Police Traffic Police have implemented various law enforcement efforts, both preventive and repressive, but face several obstacles such as limited personnel, facilities and infrastructure, and low public awareness in complying with traffic rules. This study recommends increasing the capacity of the Traffic Police, providing adequate facilities and infrastructure, and intensifying socialization and education to the public to increase the effectiveness of traffic law enforcement in Deli Serdang.

Abstract

General elections are a fundamental pillar of democracy, ensuring the sovereignty of the people through fair and honest electoral processes. The integrity of vote recapitulation is crucial for democratic elections, yet it remains susceptible to fraud and manipulation, undermining public trust and electoral legitimacy. This study examines the application of material criminal law and judicial considerations in Decision Number 523/Pid.Sus/2019/PN.Ckr, a case involving negligence resulting in alterations to vote recapitulation minutes. The research highlights the legal framework, including the sanctions under Law Number 7 of 2017, and explores the challenges in law enforcement due to the complexities of election crimes. Through analysis of the case, the study emphasizes the importance of accountability and consistent enforcement to safeguard electoral integrity and deter future violations.

Abstract

Children as a vulnerable group face unique challenges in the justice system, both as perpetrators and victims of criminal acts. Addressing children involved in criminal offenses requires a balanced approach that prioritizes restorative justice over repressive measures to ensure their development and rehabilitation. This study examines the role of investigators in implementing diversion—a key aspect of restorative justice—at the Deli Serdang Police Station. It explores how diversion helps prevent stigmatization and reduces the negative impact of the judicial process on children. Additionally, the study identifies obstacles encountered by investigators during the implementation of diversion, including institutional and procedural challenges. The findings aim to enhance understanding of the critical role of law enforcement in protecting children’s rights and achieving effective justice.

Abstract

Traffic accidents that occur are caused by fatigue, carelessness, lack of caution, and negligence experienced by drivers. It is no exaggeration that all traffic accidents involving private vehicles or public vehicles are caused by factors of drivers, pedestrians, vehicles, facilities and infrastructure, officers / law enforcers in road traffic. The legal consequences of traffic accidents are criminal penalties for the creator or cause of the incident and can also be accompanied by civil lawsuits for material losses incurred. In implementing the law, road organizers have faced many obstacles and problems of a technical and non-technical nature. The dominant technical problem is the occurrence of road infrastructure safety deficiencies that have an impact on sub-standard road geometry. Users of heavy goods vehicles that overload and overdimension can accelerate the rate of road damage and interfere with the driver's visibility which has an impact on the chances of a vehicle accident. A significant non-technical problem is the uncontrolled growth of land use around national roads which can interfere with the function and benefits of the road making it difficult to determine the certainty of the level of road service. The problem in this study is about what are the main factors that cause traffic accidents and what can be done to prevent traffic accidents. The research method is by using a type of normative legal research that has a descriptive analysis nature. Using library research techniques (Library Research): namely by collecting and studying and analyzing concepts, opinions or findings and provisions of laws relating to the law. Then analyzed qualitatively to get answers to the problems studied. The results of the study indicate that there are problems related to regulations governing traffic, the implementing regulations of traffic laws have taken too long to be made, in addition to derivative regulations such as regional regulations and other technical instructions that are still not in sync with field conditions, law enforcement factors also dominate the high number of accidents as well as the legal culture that still ignores prioritizing the safety of road users, while efforts to reduce the number of accidents are through efforts to play the role of law enforcement officers in traffic jurisdictions such as the role of the Traffic Police in preventing traffic accidents, while related to legal policies in efforts to overcome criminal acts of traffic accidents that result in the death of victims in the Sat Lantas Polres, it is carried out through Penal, and from the aspect of legal culture, ways to prevent traffic accidents, for example, by implementing the pattern of Do Not Drive Under the Influence. Driving under the influence of alcohol or drugs can reduce your alertness and reaction time.
