Abstract

Background Corruption has become a very dangerous problem for all countries in the world, including Indonesia. According to data compiled by Transparency International in 2022, Indonesia ranked 110th out of 180 countries, with a score of 34. Therefore, it is crucial for a country to establish efficient procedures, especially for the recovery of state financial losses caused by corruption. This study examines the mechanism for recovering state financial losses due to corruption from a legal perspective in Indonesia. This study aims to analyze the regulations for recovering state losses due to corruption in Indonesia in accordance with statutory provisions. This study uses various methodologies, including conceptual frameworks, legal analysis, case studies, and normative legal research. Emphasis is placed on the process of restitution of state losses in accordance with legal provisions, as well as the difficulties in handling corruption. The results show that the application of restorative justice in corruption cases can reduce the burden on the state budget because it eliminates the need to process and cover the costs of treatment for detained or convicted perpetrators of corruption. However, the findings of this study also show that there is a discrepancy with Article 4 of Law Number 31 of 1999, which states that the return of state financial or state economic losses does not eliminate criminal penalties for perpetrators of criminal acts as referred to in Article 2 and Article 3. Research Metodes : In this research, the author uses a normative legal research method (normative juridical) Findings: The return of state financial losses is an effort by the state against the perpetrators of corruption to return the state's financial losses that have been corrupted, the amount of which is equal to the amount of money that was corrupted by the perpetrator according to the audit results, where if the perpetrator does not have the same value of money as what he took, the state will confiscate the assets or property belonging to the perpetrator whose value is equal to the amount of money that was corrupted. However, in the field, investigators and prosecutors are often overwhelmed in confiscating assets from the perpetrator, because the perpetrator tries to hide his assets so that they are not confiscated by the state by laundering money where the assets are changed to the name of another person, so that investigators and prosecutors in this case the prosecutor's office as the executor are hampered. Therefore, there must be quick and accurate action from investigators and prosecutors to be able to examine all distribution of money from the perpetrator in order to find out if there are suspicious transactions and to examine all those who received transactions from the perpetrator. Conclution: Corruption is a criminal act that is very detrimental to the State for personal or group interests. The consequences of corruption cause a State's economy to be paralyzed and can damage the order of a State, especially with a large number, considering that there are still many Indonesian people who are financially disadvantaged so they need a touch from the government in the form of social assistance, so there needs to be firm, fast and accurate action from authorized officials in this case the Corruption Eradication Commission, the Prosecutor's Office and the Police to return the State's financial losses by confiscating the perpetrator's assets with a value equal to the amount of money they embezzled, before the perpetrator launders money by changing the name of his assets to another person's name to avoid confiscation by authorized State officials.

Abstract

Modern cooperatives are increasingly required to implement professional, transparent, andaccountable governance in response to the growing complexity of business activities andpublic accountability. This study aims to examine the implementation of Good CorporateGovernance (GCG) principles within the Indonesian cooperative legal systemandtoformulate an ideal model for strengthening GCG-based regulation and cooperativegovernance. This research employs normative legal research methods using statutory, conceptual, and comparative approaches, through an analysis of Law Number 25 of 1992onCooperatives, its implementing regulations, and legal doctrines on corporate governance. The findings reveal that the principles of GCG have been normatively accommodatedintheIndonesian cooperative legal framework, particularly through economic democracy, theresponsibilities of cooperative management, and accountability mechanisms withinthegeneral meeting of members. However, such regulation remains implicit, fragmented, andlacks comprehensive governance standards comparable to those applied in modern corporateentities. Furthermore, this study proposes that an ideal model for strengthening GCG-basedcooperative regulation and governance should be developed through the reformof cooperative legislation that explicitly incorporates the principles of transparency, accountability, responsibility, independence, and fairness; the enhancement of the roles andprofessionalism of cooperative organs; and the establishment of modern cooperativegovernance guidelines aligned with cooperative values and identity. This model is expectedto promote legally sound, ef iciently managed, and sustainable cooperatives with enhancedcompetitiveness within the national economic system

Abstract

Instagram saat ini tidak hanya menjadi media sosial, instagram juga telah menjadi tempat para pengiklan untuk memasarkan produknya kepada pengguna instagram. Namun, hadirnya tempat beriklan ini sering disalahgunakan oleh pihak-pihak yang tidak bertanggungjawab, salah satu bentuk penyalahgunaan ini dapat dilihat dengan hadirnya iklan judi online pada instagram. Hal ini juga diikuti dengan banyaknya wajah-wajah orang terkenal yang tanpa izin digunakan pada pemasaran iklan yang dimaksud. Pendekatan penelitian dilakukan dengan menggunakan pendekatan doktrinal yang mengandung karakter normatif yang bertujuan untuk mengkaji dua pokok pembahasan yaitu menganalisis pertanggungjawaban perantara (intermediary liability) instagram atas penggunaan foto tanpa izin pada iklan judi online dan upaya hukum yang dapat dilakukan pemilik foto atas penggunaan foto tanpa izin pada iklan judi online. Instagram selaku PSE memiliki tanggungjawab atas kegagalannya dalam melakukan penjaringan iklan pada platform Instagram sehingga mengakibatkan terjadinya pendistribusian dan pengumuman iklan illegal judi online yang menggunakan wajah seseorang tanpa izin. Pemilik foto secara perdata dapat meminta pertanggungjawaban dengan mengajukan gugatan perbuatan melawan hukum, dengan dasar hukum Pasal 27 ayat (2) Undang-Undang Republik Indonesia Nomor 1 Tahun 2024 Tentang Perubahan Kedua Atas Undang-undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik yang menyatakan dan Pasal 12 Undang-undang Nomor 28 Tahun 2014 tentang Hak Cipta.

Abstract

The effectiveness of law enforcement is shaped not only by statutory provisions but also by the moral integrity and ethical accountability of those entrusted with judicial authority. The bribery case involving the former Head of the South Jakarta District Court, adjudicated under Decision Number 70/Pid.Sus-TPK/2025/PN.Jkt.Pst and subsequently affirmed with an increased sentence in Appeal Decision Number 4/PID.SUS-TPK/2026/PT DKI, illustrates a grave breach of both anti-corruption law and judicial ethical standards. This study draws upon Soerjono Soekanto’s law enforcement theory, deterrence theory, and the concept of institutional integrity to examine the case. Employing normative legal research with statutory and conceptual approaches, the analysis is based on primary legal sources, including anti-corruption statutes, the Judicial Power Act, the Code of Judicial Ethics, and relevant court rulings, complemented by doctrinal and scholarly references. The findings indicate that criminal prosecution serves not only as a punitive response but also as a structural corrective mechanism against corruption within the judiciary. The appellate court’s decision to enhance the sentence, accompanied by fines and restitution, reflects proportionality in sentencing and reinforces both general and specific deterrence. Moreover, ethical misconduct by judges erodes institutional credibility and weakens public confidence in the justice system. The study concludes that the integration of criminal liability and ethical enforcement is essential to restoring judicial legitimacy and strengthening preventive oversight within the judicial framework.

Abstract

The protection of children's rights is an essential component of the human rights system aimed at ensuring the fulfillment of children's fundamental rights. However, violations of children's rights continue to occur in various forms, indicating the need for stronger legal protection and policy implementation. This study aims to analyze the concept of child protection from a human rights perspective, examine the implementation of child protection within the Indonesian legal system, and identify the challenges and efforts to strengthen the protection of children's rights. The research questions address the concept of child protection in the human rights framework, its implementation in Indonesia, and the existing challenges in strengthening child protection.This research applies a normative legal method using statutory and conceptual approaches. The data consist of primary, secondary, and tertiary legal materials obtained through literature study. The results indicate that child protection within the human rights perspective recognizes children as legal subjects who possess the rights to survival, development, and protection from violence and discrimination. In Indonesia, the protection of children's rights has been regulated through several legal instruments, particularly Law Number 35 of 2014 concerning Child Protection. Nevertheless, its implementation still faces several challenges, including weak law enforcement and limited public awareness. Therefore, strengthening the child protection system requires improved law enforcement, stronger institutional support, and active community participation.
