Abstract

The MSME sector is indeed a big challenge in ensuring the continuity of entrepreneurship. This entrepreneurial interest is still not accompanied by commensurate capacity in running a business. The purpose of this study is to examine and analyze the Micro, Small and Medium Enterprises (MSMEs) sector in the National Capital Region (IKN) and collaboration and local authorities for business activists. The research method used in this research is empirical juridical. The primary data source uses Law Number 80 of 2008 concerning Micro, Small and Medium Enterprises. The data collection used by researchers is by using certain research methods that are adapted, namely by way of question and answer, observation and documentation to collect as much data as possible. Data analysis technique; condensing data and drawing conclusions. The results of the study concluded that this sector is able to meet the needs of clothing and food. Regulators should accommodate the progress of MSME businesses. The existence of IKN has the potential to increase people's welfare. The weaknesses are the degradation of the area and the income of the community's economic value and local authorities.

Abstract

Perjanjian kemitraan merupakan kerjasama dalam keterkaitan usaha, baik langsung maupun tidak langsung perjanjian atas dasar prinsip saling memerlukan, mempercayai, memperkuat, dan menguntungkan yang melibatkan pelaku Usaha Mikro, kecil, dan Menengah dengan Usaha besar salah satunya kegiatan kemitraan antara Alfamidi dan UMKM di Kota Balikpapan dengan melihat  perjanjian yang diterapkan antara Alfamidi dan UMKM sesuai Peraturan Perundang-undangan yang berlaku di Indonesia serta peran Komisi Pengawas Persaingan Usaha terhadap perjanjian kemitraan. Penelitian ini menggunakan pendekatan doktrinal. Hasil penelitian disimpulkan bahwa kemitraan yang dilakukan antara Alfamidi dan UMKM di Kota Balikpapan telah memenuhi syarat sah perjanjian menurut Kitab Undang – Undang Hukum Perdata. Namun, secara yuridis perjanjian kemitraan perlu dituangkan dalam bentuk tertulis, sedangkan fakta yang diperoleh tidak semua outlet Alfamidi yang tersebar di Balikpapan memiliki perjanjian tertulis adapun perjanjian tertulis yang dimiliki tidak memuat substansi bentuk pengembangan.

Abstract

Sexual violence in the digital space can occur in various motives, such as Flaming, which is an act of harassment committed personally on social media, where the perpetrator insults, attacks, or humiliates the victim through abusive words, private photos, or messages that lead to sexual activity. In the context of digital sexual violence. This form of harassment aims to cause the victim distress, fear, or embarrassment, and can cause psychological trauma. To protect victims, the law needs to impose sanctions against sexual harassment committed through electronic media. In the Indonesian legal system, several laws have been implemented to follow up and address this kind of crime, including the Electronic Information and Transaction Law (ITE Law), the Criminal Code (KUHP), and the Sexual Violence Crime Law (TPKS Law), so that perpetrators of sexual violence in digital spaces are expected to be subject to strict criminal sanctions. Laws are an important step in law enforcement and victim protection. However, effective implementation and public education are needed to achieve these goals. Therefore, there is a need for training for law enforcement officials to better understand and be able to handle appropriate cases of digital sexual violence and community counselling and public education to increase public awareness of electronic sexual violence.

Abstract

The purpose of this study is to find out the legal protection of Small and Medium Enterprises (SMEs) against monopolistic practices at the nation's capital/IKN and find out the role of the government to eradicate the monopolistic practices against Small and Medium Enterprises (SMEs) at the nation's capital/IKN in the business competition. The conclusion showed 1) the legal protection against UMKM consist of preventive legal protection and repressive legal protection at the nation's capital/IKN. Preventive protection such as prevention, the Big Businessman has forbidden to make agreements and other acts which tend to make damages to other businessman competitor and if the agreement makes unfair business competition for UMKM. However the repressive protection such as giving sanctions like administrative sanction, criminal punishment principal, and another criminal punishment. 2) the role of the government to eradicate the monopoly practice business at the nation's capital/IKN has been regulated in several regulations. This government role such as providing the financial facility, infrastructure, the information facilities services, the partnerships and easy business licensing, providing facilities and incentives, and managing the partnerships and structuring modern market locations.

Abstract

Artikel ini dibuat untuk dapat meningkatkan kesadaran hukum dalam konteks perbankan di kalangan kaum pelajar, hal ini tentunya merupakan salah satu bentuk pencegahan di tengah maraknya penipuan dan investasi ilegal pada era digital saat ini. Oleh karena itu, dalam kegiatan tersebut dilaksanakan menggunakan metode penyuluhan hukum langsung melalui pemberian materi, studi kasus yang disimulasikan dan diskusi interaktif tanya jawab. Kegiatan ini dilakukan oleh tim dosen dan mahasiswa Fakultas Hukum Universitas Mulawarman kepada siswa SMK Negeri 14 Samarinda. Pada penyuluhan ini, para pelajar dapat memahami konsep dasar dari hukum perbankan, ciri-ciri tindak penipuan atau investasi ilegal juga dibahas. Dengan demikian, para pelajar diharapkan setelah kegiatan ini memiliki pengetahuan praktis untuk menilai dan menghindari kerugian finansial. Dengan demikian, program penyuluhan efektif dalam membentuk generasi muda yang arif secara keuangan dan mampu melindungi diri sendiri berlaku untuk setiap tindak finansial yang buruk

Abstract

This study examines the practice of tying in the sale of the government-subsidized cooking oil "Minyakita" in Samarinda, where consumers are required to purchase additional products alongside the oil. Such practices violate Article 15(2) of Law No. 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition. Using doctrinal legal research, the study identifies strong indicators of tying practices initiated by major distributors and continued by retailers, resulting in consumer disadvantage. The government and the Indonesian Competition Commission (KPPU) have implemented monitoring and educational measures, and are authorized to impose administrative sanctions or pursue criminal penalties. These findings highlight the importance of enforcing competition law in the distribution of essential goods.Keywords: Business Competition, Minyakita, Tying Sales

Abstract

This study focuses on the analysis of legal studies in the use of e-stamps in notary offices/land deed making officials (PPAT). This study aims to determine how the use of e-stamps in authentic deeds made before a notary/PPAT and how legal protection is provided for e-stamp users in notary/PPAT offices. This study uses a doctrinal approach which is a type of legal research on a collection of written norms/regulations and other secondary legal materials. The results obtained from this study are, first, that documents affixed with e-stamps are perfect evidence if used as evidence at a conference, the existence of e-stamps does not affect the validity of civil documents, only the authentic evidentiary force is degraded to a private deed due to the prohibition as stipulated in Article 5 paragraph (4) letter b of the ITE Law. Second, legal protection if the disputed document can be preventive, namely education and socialization related to the use of e-stamps in authentic deeds and repressive, namely providing protection to buyers as victims related to lawsuits for the Cancellation of certificates issued due to legal defects related to e-stamps sold to the State Administrative Court.

Abstract

The rise of digital business and technological advancement has shifted conventional economic practices to digital platforms, with e-commerce often dominated by companies using strategies like predatory pricing to maintain market control. Such practices, including flash sales and free shipping, are challenging to regulate due to difficulties in gathering sufficient evidence. This study employs a socio-legal research method, with data from interviews and legal materials, identifying three key indicators of predatory pricing: sales below production cost, competitor exit, and subsequent price increases. Although Indonesia's Business Competition Supervisory Commission (KPPU) enforces competition laws, evidence challenges and legal interpretation complexities remain. Policy reform and capacity-building efforts are essential for effective oversight in this evolving digital landscape.Keywords: E-commerce;Legal Supervision;Predatory Pricing

Abstract

MSMEs are one of the most reliable drivers of the Indonesian economy. In carrying out Cooperation, MSMEs enter into partnership agreements with prominent business actors so that there will be legal consequences for the agreement. The COVID-19 pandemic period provides separate arrangements for implementing MSMEs so that they can survive during the COVID-19 pandemic. MSMEs, in this case, can be proven from employment and as a source of state income and reduce the number of poor people. The problem in this research is how to implement partnership arrangements for MSMEs during the pandemics and how to arrange partnerships for MSMEs from a business competition perspective. This study examines and analyzes the implementation of partnership arrangements for MSMEs from the perspective of business competition. This study certainly explains the factors and impacts of the COVID-19 pandemic for MSME actors who carry out partnership agreements with prominent business actors who can provide justice.
