Abstract

The ICC’s failure to bring international criminals to justice has become a serious issue of impunity, necessitating the activation of universal jurisdiction mechanisms. This qualitative study aims to compare the regulations on universal jurisdiction in German and Indonesian law in order to improve these regulations in Indonesia. This study employs a legal and conceptual approach, utilizing a literature review method to collect legal materials; the findings are analyzed and compared to generate innovative improvements to these jurisdictional regulations in Indonesia. The findings indicate that Indonesia should adopt several prinsiples as regulated by German law. Consequently, it is important for legislators to revise the National Criminal Code or enact specific regulations on universal jurisdiction that are more comprehensive.

Abstract

This study analyzes the regulation and implementation of the fulfillment of the rights of prisoners convicted of narcotics offenses in accordance with Law Number 22 of 2022 on Corrections at the Class IIB State Detention Center in Bengkulu City, including an evaluation of its conformity with applicable legal norms. Using a normative juridical approach and literature study, the findings indicate that the law comprehensively regulates both basic rights and integrative rights, including medical and social rehabilitation for narcotics addicts, which is integrated with Law Number 35 of 2009. However, its implementation in practice is hindered by overcrowding, inadequate infrastructure, and limited human resources. The main findings highlight a disparity between das sollen (ideal provisions) and das sein (actual conditions), thereby recommending regulatory harmonization, strengthening institutional capacity, and enhancing inter-agency collaboration to improve rehabilitation programs and social reintegration.

Abstract

This study analyzes the provision of community service sanctions under the Indonesian Criminal Code (KUHP Nasional) as a viable alternative to conventional sentencing aimed at mitigating overcrowding in correctional facilities. Imprisonment remains the cornerstone of criminal justice enforcement in Indonesia, leading to escalating inmate populations that far exceed available prison capacities. Consequently, this has engendered multiple challenges, such as diminished rehabilitation efficacy, inadequate amenities, and elevated tensions among inmates (Directorate General of Corrections, 2023). Adopting a normative methodology, the research scrutinizes the statutory provisions for community service sanctions and their prospective integration into criminal adjudication processes. Results affirm that these sanctions represent a more humane and proportionate punitive measure, extending beyond retribution to encompass offender restoration and societal reintegration (Articles 70-72, KUHP Nasional). Moreover, their adoption holds substantial promise for alleviating pressures on penitentiary systems. Nonetheless, deployment encounters hurdles including law enforcement preparedness, insufficient technical protocols, and constrained field-level resources. Hence, resolute collaboration among key stakeholders is imperative to facilitate the efficacious and enduring enforcement of community service sanctions.

Abstract

This study aims to examine community service punishment as an alternative sentencing in the perspective of penology and the Indonesian penitentiary system and to analyze the legal position of community service punishment within the Indonesian criminal sentencing system under the new Criminal Code. This research uses a normative legal research method with statutory and conceptual approaches. The data used are secondary data consisting of primary, secondary, and tertiary legal materials obtained through library research and analyzed qualitatively. The results show that community service punishment in the new Criminal Code has the position as a principal punishment that serves as an alternative to short-term imprisonment and fines and is categorized as a non-custodial sentence. From the perspective of penology, community service punishment reflects rehabilitative, reintegrative, and restorative justice-oriented sentencing. In the correctional system, community service punishment can be a solution to prison overcrowding and supports the correctional objective of rehabilitation and social reintegration of offenders. However, its implementation still requires technical regulations, supervision mechanisms, and institutional readiness to ensure effective application within the Indonesian criminal justice system.

Abstract

Contemporary diplomacy faces complex challenges that demand flexibility in the implementation of international relations. As part of a special mission, a traveling ambassador plays a strategic role in bridging the interests of the sending state and the receiving state for specific and temporal purposes. The 1969 New York Convention on Special Missions provides a comprehensive legal framework governing the position, functions, rights, obligations, and immunities and privileges of a traveling ambassador. This study analyzes the role of a traveling ambassador, focusing on the provisions of the 1969 New York Convention and its implementation in the diplomatic practices of countries. Using normative legal research methods with a legislative and conceptual approach, this study finds that the 1969 New York Convention provides a clear yet flexible legal basis for the operationalization of a traveling ambassador. The legal status of a traveling ambassador is systematically regulated from appointment and accreditation to the end of the mission. The main functions include representation, negotiation, information gathering, and reporting with specific territorial and time limits. The rights and obligations of a traveling ambassador are formulated in a balanced manner, providing operational facilities while requiring respect for the laws of the receiving state. The immunities and privileges granted are equivalent to those of permanent diplomats, but with a limited duration, consistent with the term of the special mission. The implementation of the convention's provisions has demonstrated its effectiveness in supporting bilateral and multilateral diplomacy, despite challenges related to coordination with permanent diplomatic missions and the limited availability of global ratification.

Abstract

This study analyzes the binding force of international treaties on ratifying states, focusing on the People's Republic of China's (PRC) rejection of the 2016 Permanent Court of Arbitration (PCA) Award in the South China Sea dispute. Despite ratifying the United Nations Convention on the Law of the Sea (UNCLOS) 1982, China rejected the arbitral award won by the Philippines. This normative legal research employs statutory, case, and conceptual approaches with prescriptive-analytical analysis. The findings indicate that ratified international treaties possess binding force based on the principles of pacta sunt servanda and good faith as stipulated in the Vienna Convention 1969. China's rejection of the PCA award constitutes a violation of Article 296 UNCLOS, which mandates compliance with dispute settlement decisions. Legal implications of this rejection include breach of international obligations, undermining the credibility of the international legal system, and setting negative precedents for other states. However, limitations in international law enforcement mechanisms remain a primary challenge in ensuring state compliance with treaty obligations.

Abstract

The WTO Dispute Settlement Mechanism (DSM) plays a critical role in maintaining international economic stability through a rule-based trading system. This article examines the effectiveness of the Dispute Settlement Body (DSB) in resolving international trade conflicts, particularly anti-dumping and subsidy cases. Employing a normative legal research methodology, this study analyzes the legal frameworks of the DSU, the Anti-Dumping Agreement, and the SCM Agreement. The Indonesia–EU stainless steel dispute (DS616) and the Airbus-Boeing case serve as primary examples. The findings indicate that while the DSB provides a structured and binding mechanism, it faces significant challenges including the paralysis of the Appellate Body since December 2019, protracted procedures, and regulatory ambiguities in high-tech industries. Despite these challenges, the WTO DSM remains essential for maintaining predictability in the multilateral trading system, though substantial institutional reforms are urgently needed.

Abstract

This study analyzes the effectiveness of the consular executive function in providing protection to Indonesian citizens abroad, focusing on the case of Diah Ayu Kurniasari, who faces the death penalty in Malaysia. Using a normative juridical approach and case study, this study examines the implementation of Article 5 of the 1963 Vienna Convention on Consular Relations in the context of the good faith of the sending state. The findings indicate that although the 1963 Vienna Convention provides a comprehensive legal framework, the effectiveness of consular protection depends heavily on institutional capacity, inter-agency coordination, and the political commitment of the sending state. The case reveals structural and operational challenges, including limited access, the complexity of receiving state law, and sensitive diplomatic dimensions. This study recommends strengthening consular capacity, improving inter-ministerial coordination, and developing rapid response mechanisms for critical cases involving Indonesian citizens abroad.

Abstract

This study aims to examine the dynamics of sentencing theory development from a penological perspective, while assessing the relevance of retributive and restorative approaches in achieving punishment objectives grounded in justice, utility, and offender rehabilitation in Indonesia. The normative legal method is employed, utilizing statutory and conceptual approaches. The analysis reveals a paradigm shift from a retribution-centered model toward an integrative framework accommodating deterrence, rehabilitation, and restoration. This transformation is reflected in the sentencing objectives stipulated under Law Number 1 of 2023 on the Criminal Code, the application of restorative justice mechanisms pursuant to Prosecutor Regulation Number 15 of 2020, and the reinforced correctional functions under Law Number 22 of 2022. The retributive approach retains significance in upholding legal certainty and preserving the public sense of justice, particularly in serious criminal cases. The restorative approach, meanwhile, contributes to repairing the relationships among offenders, victims, and communities, and strengthens social reintegration. Indonesia's sentencing system accordingly demonstrates an integrative orientation that seeks to balance legal certainty, social utility, and respect for human dignity.

Abstract

The phenomenon of overcrowding in correctional institutions has reached a critical point, threatening the stability of the criminal justice system in Indonesia. This study aims to analyze how Law No. 1 of  2023 concerning the Criminal Code (National Criminal Code) addresses this problem through criminal policy reform. Using normative legal research methods, this study examines new de-incarceration norms in the National Criminal Code. The study concludes that efforts to address overcrowding in Law No. 1 of 2023 are carried out through modifications to more humane sanctions, namely prioritizing non prison sentences (community work and supervision) for crimes punishable by imprisonment under five years. Furthermore, expanding the requirements for conditional sentences and formally recognizing restorative justice are expected to minimize the influx of convicts into prisons. The effectiveness of these instruments requires synchronization between law enforcement agencies and the availability of monitoring infrastructure outside prisons. The National Criminal Code offers new hope for resolving the issue of overcrowding through a criminalization approach that is no longer prison centric.
