Abstract

Advancements in Artificial Intelligence (AI) technology have given rise to deepfake technology capable of manipulating a person's image, voice, and identity with a high degree of realism. This phenomenon has spawned a new form of cybercrime—cyber defamation—that inflicts compounding harm on victims. This study aims to analyze the legal vacuum regarding the liability of AI developers in Indonesia and to formulate an ideal legal liability framework for developers for the future (ius constituendum). The study employs a normative legal research method, utilizing statutory, conceptual, and comparative approaches—drawing comparisons with the jurisdictions of the United States, Singapore, and the European Union. The findings indicate that current Indonesian positive law—specifically the ITE Law and the Criminal Code—focuses primarily on the content disseminator (end-user) and fails to address the legal obligations of developers regarding the misuse of dual-use technology. There are legal obstacles to applying the doctrine of complicity (deelneming) and difficulties in establishing a causal nexus between developer negligence and the harm suffered by the victim. Consequently, a legal reconstruction is required, incorporating the doctrine of strict liability for developers of high-risk AI systems, alongside legally binding obligations for "Safety by Design" and "Ethics by Design." Furthermore, a multi-layer liability model involving developers, platform providers, and end-users should be integrated to ensure proportional justice. The study recommends revising cyber legislation to mandate digital watermarking for synthetic media and harmonizing administrative and corporate criminal sanctions for AI developers who disregard safety standards during system design

Abstract

This study aims to analyze the legal basis of authority and the form of legal accountability of the Village Head in providing openness of the village land book (Buku C Desa) during the process of land boundary dispute resolution. Land registration serves as a primary instrument for establishing legal certainty over land rights in Indonesia. However, implementation at the village level frequently encounters obstacles due to limited access and ambiguity in historical land records. The research method applied is normative (doctrinal) legal research employing a statutory approach (statute approach) and a conceptual approach. Legal materials were collected through library research and analyzed qualitatively and normatively using deductive reasoning. The results indicate that the authority of the Village Head to manage and disclose village land book information originates attributively and delegatively from Law Number 6 of 2014 concerning Villages, Law Number 14 of 2008 concerning Public Information Openness, Government Regulation Number 43 of 2014, and related local regulations. The Village Head holds the authority to provide access to land information to foster transparency, legal certainty, and the acceleration of the Complete Systematic Land Registration (PTSL) program. Nevertheless, this authority is restricted (procedural openness) and must observe personal data protection pursuant to Law No. 27 of 2022 and Information Commission Regulation No. 1 of 2018, thereby restricting access solely to parties with direct legal standing. The accountability of the Village Head encompasses administrative liability as a State Administrative Official regarding the accuracy, authenticity, and maintenance of land records. The openness of the village land book is proven to serve as a valid database crucial for determining the effectiveness of land boundary dispute mediation and supporting the success of the PTSL program.

Abstract

The development of electronic commerce in Indonesia has brought convenience alongside new legal challenges, particularly the widespread circulation of products that infringe registered trademarks. This study aims to analyze the legal regulation of registered trademark protection in electronic commerce and to examine the legal responsibility attached to the Shopee platform for trademark infringement committed by sellers operating on it. This research applies normative legal research using statutory, conceptual, and case approaches, referring to primary, secondary, and tertiary legal materials. The results show that registered trademark protection is regulated under Law Number 20 of 2016 on Trademarks and Geographical Indications, while the legal framework for electronic commerce is regulated under Law Number 1 of 2024 on the Second Amendment to the ITE Law, Government Regulation Number 71 of 2019, and Government Regulation Number 80 of 2019. However, the existing regulations still contain normative ambiguity regarding the limits of platform responsibility. Shopee’s legal responsibility is not absolute but conditional, based on the principle of fault-based liability consistent with the concept of intermediary liability: Shopee may be exempted from responsibility if it promptly removes infringing content upon receiving a report, yet may still be held liable if proven negligent in verifying sellers or supervising products, which may be qualified as an unlawful act under Article 1365 of the Civil Code.

Abstract

This study analyzes the implementation of the Lamongan Regency Government's authority in administering mandatory basic health services and identifies the supporting and inhibiting factors. Using an empirical (sociological) legal method with juridical-empirical and statute approaches, primary data were gathered through in-depth interviews with officials of the Lamongan Health Office and Community Health Centers (Puskesmas), while secondary data comprised statutory materials and Minimum Service Standard (SPM) achievement reports. The findings show that implementation is reasonably effective, supported by strong regional political will, flagship programs such as the “1-10-100” stunting initiative and “Lamongan Sehat”, clear Standard Operating Procedures, and dedicated frontline health workers. However, implementation remains uneven due to the post-transition effects of abolishing the 10% mandatory health-spending allocation under Law Number 17 of 2023, facility disparities and geographical barriers in the southern and northern regions, the maldistribution of health personnel, and difficulties synchronizing health-insurance data for low-income residents. The study recommends performance-based budget regulations and incentive schemes to redistribute medical personnel to remote areas.

Abstract

Bankruptcy of a company brings about changes in the legal position of workers, from initially being subjects of an employment relationship to becoming creditors in bankruptcy proceedings. Under the Indonesian legal system, workers are classified as preferential creditors who have priority in the payment of wages and other normative rights, as wages constitute the primary source of livelihood for workers and their families. This study aims to examine the legal position of workers as preferential creditors in the distribution of bankruptcy assets and to assess the effectiveness of legal protection of wage rights in bankruptcy proceedings. This research employs a normative legal research method using a statutory approach, conceptual approach, and case approach. The results show that although the protection of workers’ rights is regulated under the Manpower Law, Bankruptcy Law, Civil Code, and reinforced by Constitutional Court Decision Number 67/PUU-XI/2013, its implementation still faces several obstacles, including limited bankruptcy assets, high bankruptcy administration costs, the dominance of secured creditors, and inconsistent application of payment priority principles. Therefore, harmonization of laws and regulations, as well as strengthening legal protection mechanisms, is necessary to ensure that workers’ wage rights are fulfilled fairly, optimally, and effectively.
