Abstract

This study examines the effectiveness of the Electronic Information and Transactions Law (UU ITE) in addressing the dissemination of pornographic content on Twitter/X. Using a literature review approach, it highlights UU ITE’s role in regulating digital activities by prohibiting the distribution of obscene content. Despite providing a robust legal framework, its implementation faces significant challenges, including user anonymity and limited monitoring capabilities. Data from the Ministry of Communication and Informatics (Kominfo) reveals a substantial increase in the number of blocked pornographic content, although it represents only a fraction of the broader issue. Additionally, Twitter/X’s content moderation policies often conflict with local regulations, requiring closer collaboration between governments and digital platforms. Potential solutions include adopting artificial intelligence for automatic detection, enhancing user verification, and fostering international cooperation. This study concludes that synergy between the government, digital platforms, and the public is essential for creating a safer and more conducive digital space.

Abstract

Misuse of accounts linked to telephone numbers has become a serious issue in the realm of cybercrime. This often happens when a user's telephone number is inactive or has entered a grace period, and is then resold by the provider to a third party. This creates an opening for hackers to access accounts associated with that number, including banking and e-commerce accounts. By utilizing the information obtained, hackers can carry out illegal transactions that harm genuine users. This article was created to analysis the mechanisms of abuse in the context of cybercrime, as well as the psychological and financial impacts experienced by victims. The results of this case analysis show that a lack of awareness of cyber security and personal data protection increases the risk of misuse, making it important for users to implement stricter security measures.

Abstract

This study aims to describe the principles of legality in Indonesia and France. This study uses normative legal research methods, namely secondary legal materials in the form of data obtained from books and opinions of experts related to this study. The results of this study indicate that the principles of legality in Indonesia and France highlight the importance of legal certainty, human rights, and a sense of justice in the criminal law system. In Indonesia, the principle of legality has been regulated in the Criminal Code since 1946, but its application is often not pure because of the customary law that still applies. Although there have been amendment efforts, it often ends in a confusing system. Meanwhile, in France, the principle of legality developed from resistance to arbitrary power, which was emphasized in the Habeas Corpus Act in England in 1679. This principle gives parliament the authority to determine the components of violations and their sanctions, as a guarantee of the freedom of citizens from excessive tyrannical actions.

Abstract

The prohibition of committing injustice (zulm) is a fundamental principle in Islamic teachings that emphasizes justice as the foundation of social life. In various hadiths of the Prophet Muhammad (peace be upon him), injustice is strongly condemned as a violation of both divine rights and human rights. This article aims to discuss in depth the prohibition of zulm and explore its deeper implications in both criminal and civil law. Injustice is not only seen as an individual sin, but also as a breach of social justice and public order. Therefore, the command to avoid zulm, as conveyed in hadiths, goes beyond theological and moral dimensions, extending into concrete and applicable legal principles. Through a normative and juridical approach, this study seeks to demonstrate that the prohibition of injustice can serve as a foundation for developing a fair legal system that upholds individual rights. In the context of criminal law, acts of injustice often manifest as crimes requiring firm punishment to maintain social order. Meanwhile, in civil law, injustice appears in forms such as unlawful acts, breaches of contract, or violations of property rights, which demand compensation or restitution. This reflects the importance of integrating Islamic values in building a civilized and justice-oriented legal system.

Abstract

The development of information technology in this modern era means that people increasingly need things in life, especially with the increasing prevalence of mobile phone technology and other smart phones which are widely distributed in society. This technology makes everything more efficient and easier. Protection of children's data on social media, especially on the social media platform TikTok, is an issue that is increasingly occurring in the digital modernization realm. With the rapid growth of children's users who are increasingly connected to various online platforms, although TikTok provides space for expression and creativity, on the one hand, TikTok also presents various risks related to the collection and misuse of children's personal data. The data collected on this platform, which will include information such as location, content data preferences, and social interactions, will ultimately be used for advertising purposes and can even be misused by irresponsible parties spread across the Tiktok platform. This article aims to explore aspects of protecting children's personal data on TikTok, as well as including the policies implemented by TikTok and the government.

Abstract

The rapid development of information technology has brought various conveniences to human life, but it also brings new challenges in the form of cybercrime threats. One of these threats is cyberstalking, which is the act of stalking, harassment, or threats through digital media. Cyberstalking utilizes the anonymity of technology to violate the privacy, dignity, and psychological safety of the victim. In Indonesia, the regulation of cyberstalking is implicitly regulated through Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE Law) or in its latest amendment, namely in Law Number 1 of 2024 concerning the Second Amendment to Law Number 1 of 2008 concerning Electronic Information and Transactions and the Criminal Code (KUHP). However, these regulations have not been able to cover the multidimensional dimensions of the crime, such as non-verbal harassment or emotional threats through digital media. This article analyzes cyberstalking in the perspective of Indonesian criminal law by highlighting the existing legal vacuum and the importance of regulatory reform based on the principles of legality, legal certainty, and protection of individual rights. Recommendations include revising the ITE Law, strengthening the capacity of law enforcers, and increasing public awareness to deal holistically with the threat of cyberstalking. With these steps, it is hoped that legal protection for victims can be improved in line with technological developments.

Abstract

The digital era has brought significant changes in societal communication patterns, including the dissemination of national values. Pancasila, as the ideology of Indonesia, faces new challenges and opportunities amidst the rise of social media as a primary communication platform. This study analyzes digital communication strategies for promoting Pancasila values through social media platforms. Using a qualitative approach, the research explores various effective communication methods to enhance public awareness and participation in national values. The findings indicate that interactive content-based strategies, collaboration with stakeholders, and the utilization of social media algorithms can improve the effectiveness of Pancasila value dissemination. The study concludes by emphasizing the importance of adapting communication strategies to digital technological developments to ensure national values remain relevant and embraced by younger generations.

Abstract

This study critically examines the implementation of Article 20 of Law No. 31/1999, as amended by Law No. 20/2001, concerning the eradication of corruption (UU Tipikor), with a focus on corporate accountability in corruption offenses. It aims to address three primary concerns: (1) the practical application of corporate liability mechanisms, (2) the effectiveness of sanctions imposed on corporations, and (3) the legal obstacles that impede the full enforcement of corporate criminal responsibility. Employing a normative legal approach, this research integrates statutory analysis, case law evaluation, and theoretical exploration. The findings highlight considerable challenges in proving corporate liability, as well as the limited scope and effectiveness of current penalties. These difficulties stem from ambiguities in distinguishing between the responsibilities of individuals and the corporation, and the lack of consistent legal interpretation by law enforcement authorities. The study proposes a set of recommendations, including the formulation of clear technical guidelines, the continuous professional development of legal practitioners, the enhancement of sanctions against corporations, and the establishment of a centralized database of judicial decisions involving corporate criminal liability. These measures are essential to ensure more effective corporate accountability and the prevention of systemic corruption in Indonesia.

Abstract

Consumer protection in Indonesia is regulated in Law No. 8/1999 on Consumer Protection (UUPK), which emphasizes consumers' basic rights to safe and quality goods. This research focuses on the violation of consumer rights in the “Daun Suji” brand rice oplosan case, which came to light in February 2025. The results show that the oplosan “Daun Suji” rice does not meet the promised premium rice quality standards. This resulted in a violation of consumer rights, specifically Article 4 letters b and c of the Consumer Protection Law. These violations include the right of consumers to choose goods according to exchange value and guarantees, as well as the right to correct and clear information. This fraudulent practice harms consumers who expect quality products at the price paid.

Abstract

The rapid development of information technology has had a significant impact on the pattern of collecting, processing, and storing personal data in the digital era. However, this progress is also accompanied by an increasing threat of cybercrime, one of which is phishing attacks. Phishing is a digital fraud mode that aims to obtain personal data illegally through social engineering and manipulation of electronic systems. This study aims to analyze the form of legal protection for phishing victims in the perspective of Law Number 27 of 2022 concerning Personal Data Protection (UU PDP). Using normative legal methods and conceptual approaches, this study examines the role of state authorities such as the National Cyber and Crypto Agency (BSSN) and the Directorate of Cyber Crime (Dittipidsiber) of the National Police Criminal Investigation Unit in the procedures for handling and prosecuting phishing. The results of the study show that although the PDP Law has provided a clear legal framework, its implementation still faces challenges in technical aspects, institutional coordination, and public digital literacy. Therefore, strong synergy is needed between regulation, supervision, and public education to realize effective and sustainable personal data protection in the digital era.
