Abstract

This study aims to describe and analyze the implementation of e-Government in passport services at the Surabaya Special Class I Immigration Office and the opportunities and challenges in the implementation of e-Government at the office. The research method used is descriptive qualitative. Data collection techniques include interviews, observations, and documentation. The research informant is the Head of the Surabaya Special Class I Immigration Office. Data analysis techniques use the interactive model developed by Miles et al. (2014), namely data condensation, data presentation, and conclusion drawing. The results of the study show that the implementation of e-Government in passport services at the Surabaya Special Class I Immigration Office includes five main aspects: (a) complete telecommunication infrastructure, (b) adequate connectivity and use of information technology, (c) sufficient human resource readiness, (d) availability of funds and budget without issues, and (e) regulations and rules with legal force. Opportunities for e-Government at the Surabaya Special Class I Immigration Office include positive public response and accessibility to information technology. The challenges faced include cybercrime and the lack of awareness among some people about e-Government.

Abstract

Dismissal of a Regional Head can occur due to two factors, the first is 'Objective' in investigating violations of the oath or promise of office carried out by the Regional Head. Second, 'Subjective' in using his authority, namely looking for loopholes to dismiss the Regional Head on sentimental grounds. The reasons for the dismissal of a Regional Head are regulated in Article 78 paragraph (1) and paragraph (2) of Law Number 23 of 2014 concerning Regional Government (UUPD). Some of the problems that often occur in the dismissal of Regional Heads are, the Regional Head is elected directly but the mechanism for dismissal is indirectly (representatively) through the DPRD so that it is not in line with democracy, then regional autonomy is not implemented freely because there is still a role for the central government and there is also no Judicial institutions in regions specifically for the dismissal of Regional Heads. After we analyzed the many articles in the Constitution, the amendments relating to the main duties of the House of Representatives, also in UUMD3 1999 in conjunction with UUMD3 2014, were further emphasized by DPR Standing Orders No. 16/DPR/RI/1999-2000 jucto Regulation of the House of Representatives of the Republic of Indonesia Number 1 of 2014 concerning Rules of Procedure, from the authority and duties of the DPRD above, it can be formulated that the DPRD has three functions, namely the supervisory function, the budget function, and the function of making Law or legislation. In carrying out its functions and duties, the DPRD has several rights that can be used to carry out its duties as government supervisor. Some of the rights in question are the Right to Questionnaire, the Right to Interplation, the Right to Express an Opinion. As for the right to inquiry itself, the definition is contained in Article 79 paragraph (3) of Law Number 17 of 2014 concerning the MPR, DPR, DPD and DPRD.

Abstract

Crimes that occur in human life include social events that will always be faced by every human being, society and even the State. Crimes can only be prevented and reduced but it is impossible to completely eliminate them. One of these crimes is violence. This study aims to determine the form of legal protection that has been carried out by the government, law enforcement officers and parties who have the right to provide protection for women as victims of domestic violence and to determine the obstacles faced by law enforcement in providing protection for women as victims of domestic violence. The results of the study indicate that the role of law enforcement officers in protecting women's rights has begun since the discovery of cases of violence by police officers until the time of examination in court and in efforts to provide legal protection for women who are victims of domestic violence, several obstacles were found. These obstacles include factors of the victim themselves, factors of law enforcement officers, factors of facilities and infrastructure, community factors, cultural factors.

Abstract

Nominee agreements provide a way for foreigners to own land in Indonesia by using the name of an Indonesian citizen on the land certificate. The Indonesian citizen in the Nominee Agreement dies. The land used as an object in the Nominee Agreement is one of the inheritance assets to the legal heirs. The results showed that the disputed land should have fallen to the state, even though the heirs were legitimate heirs to inherit the property rights to the disputed land.

Abstract

This research examines life insurance consumer rights and protection in Indonesia, given the growth of the industry and the complexity of insurance products. The background of the research highlights the gap between regulation and consumer protection practices. The research objective is to analyze the effectiveness of regulations and their implementation. The research method used is normative-empirical juridical, with analysis of laws and regulations and case studies. The research findings show that although the regulations are comprehensive (Law No. 8/1999, Law No. 40/2014, POJK), their implementation still faces obstacles, such as lack of information transparency, harmful standard clauses, and suboptimal supervision. The implication of this research is the need to strengthen regulations, consumer education, and increase the effectiveness of dispute resolution mechanisms to increase consumer confidence in the life insurance industry.

Abstract

Human trafficking is a serious and growing crime, including in Cambodia, which has become one of the countries vulnerable to this practice. This study aims to analyze the handling of human trafficking crimes in Cambodia from an international law perspective. Cambodia plays a significant role in the context of human trafficking due to its geographic location and socio-economic conditions, which influence the rate of human trafficking, whether for sexual exploitation, forced labor, or organ trafficking. This research uses a qualitative method with a literature review approach from various sources, including international conventions, reports from international organizations, and Cambodia's national regulations. The findings show that although Cambodia has adopted several laws to combat human trafficking, the implementation of these policies is often hindered by limited resources, corruption, and lack of cooperation between countries. Additionally, despite efforts from the international community, such as the Palermo Protocol, challenges in consistently applying the law remain a significant barrier. The study also finds that stricter law enforcement and better rehabilitation systems for victims are necessary to improve the situation. Therefore, further collaboration between the Cambodian government, international organizations, and non-governmental organizations is needed to comprehensively address this issue.

Abstract

The Senkaku Islands dispute involves Japan, China, and Taiwan on the basis of historical claims, international law, and strategic and economic interests. The strategic value of this region increases along with the potential of natural resources and the importance of maritime routes in the East China Sea. The main problems in this research are, first, how is the chronology of the Senkaku Islands dispute, and second, how is the analysis of international law on the sovereignty claims of each party. This research uses a qualitative approach with a descriptive-analytical method, which is based on a literature study of international legal documents, scientific journals, and various related official sources. The results show that Japan controls the Senkaku Islands de facto and strengthens its claim based on the principle of effectiveness. In contrast, China and Taiwan make claims based on the history of the Ming and Qing Dynasties but have no actual control over the territory. The dispute is further complicated by the United States' security support for Japan, as well as increased maritime and military patrol activities around the disputed area. Efforts to resolve the dispute through the International Court of Justice have been stymied by Japan's refusal to recognize the dispute and China's caution in taking the case to international law. Overall, the dispute has not only a legal dimension, but also reflects the sharp geopolitical competition in the East Asian region. Resolving this dispute requires a flexible diplomatic approach, given that formal legal channels are difficult to pursue. Multilateral dialog is the key to preventing conflict escalation that could threaten regional stability.

Abstract

The development of tourism villages is an effective strategy to support environmental conservation and empower local communities. This study aims to describe the development of Simathani Marurup Tourism Village in Tulungagung Regency based on community empowerment. A descriptive qualitative method was employed, using four tourism village development indicators proposed by Prakoso (2022): setting, management, resources, and benefits, along with community empowerment approaches outlined by Widjajanti (2011). The findings indicate that the village has successfully utilized its geographical and cultural potential, with active community participation in management and partnerships with the government. Empowerment strategies applied include problem-based, need-based, rights-based, and asset-based approaches. The economic impact has begun to emerge, although distribution remains uneven. This study emphasizes the importance of integrating local potential with empowerment approaches to create an inclusive, participatory, and sustainable tourism village. Recommendations focus on strengthening the role of local government in training, funding, and supportive policy formulation.

Abstract

Eradication of corruption in Indonesia has been made maximum efforts, but the reality shows that the number of corruption cases continues to increase. This situation is caused by the obstacles encountered in efforts to prevent and eradicate corruption. In its development, corruption in Indonesia is no longer a monopoly of bureaucrats but has also involved actors in the private sector. For example, corruption can be committed by corporations, either directly or through the actions of people acting on behalf of or for the interests of the corporation. The method used is the normative juridical method, a legal research method that relies on the study of primary legal materials, such as laws, legal theories, and legal concepts. This method is analytical and examines the legal norms applicable in laws and regulations. Enforcement of criminal law against corporations in corruption cases is an important aspect in efforts to eradicate corruption in Indonesia. Corporations are responsible for actions taken in their interests. Sanctions imposed on corporations, either in the form of fines or administrative sanctions, are expected to provide a deterrent effect and prevent the recurrence of corruption. Criminal law enforcement against corporations in corruption cases faces various complex and diverse obstacles. These obstacles include the complexity of the corporate organizational structure, difficulty in providing evidence, transfer of responsibility, lack of clear regulations, minimal sanctions imposed.

Abstract

This study aims to analyze student satisfaction with the quality of dormitory facilities at Sriwijaya University. Adequate dormitory facilities are an important factor in supporting student comfort and the smooth running of academic activities. Using a qualitative approach, this research explores students' perceptions of the condition of the facilities and investigates the responses from both dormitory management and the central authority. The results show that students are generally satisfied with aspects such as cleanliness and security but express concerns over the lack of supporting facilities, disruptions in water availability, and the slow response from the management. Based on interviews, dormitory managers stated that the authority for repairs lies with the central office, while the central office acknowledged issues in administrative systems and communication. These findings highlight the need for improved management systems and coordination between parties to enhance the quality of dormitory services.
