INVENTION: Journal of Intelectual Property is an open access journal using a double blind peer-review process, published by Lembaga Penelitian Pengabdian Masyarakat Pusat Kajian (LPPMPK-Universitas Ngurah Rai). Published twice a year (June and December) INVENTION aims to publish manuscripts of high-quality research as well as conceptual analysis that studies specific fields of Intelectual Property. INVENTION welcomes academics, researchers, and practitioners to submit their manuscript. It might be written in Indonesia or English, have never been published elsewhere, are original, and are not under consideration for other publications. For checking Plagiarism, INVENTION Editorial Board will screen plagiarism using Turnitin Program. If it is found that there is a plagiarism indication (above 20%), the editorial board will automatically reject the manuscript immediately.

Abstract

Today's society cannot be separated from the development and progress in the field of science and technology. This progress makes it easier for people to gain access and distribute content through social media, streaming sites, and other digital platforms. Digital content such as music, films, e-books, and graphic designs are vulnerable to duplication, distribution, and reuse without permission. This study aims to analyze the form of norm conflict between the two laws, especially in the practice of blocking content by the government through the Ministry of Communication and Information (Kominfo). This research method uses normative legal research, namely research that is based on literature reviews and analysis of written legal materials. The main focus of the study is the norm conflict between the Copyright Law and the ITE Law using a statute approach, a conceptual approach, and a case approach. The results of the study show that there is a procedural conflict between the principle of judicial proof in the Copyright Law and the administrative authority in the ITE Law. This conflict creates legal uncertainty, potential violations of digital rights, and the need for regulatory harmonization.

Abstract

The development of information and communication technology has brought significant changes to patterns of social interaction within society, particularly through the use of social media. The promotion of online gambling by Instagram celebrities (selebgram) through social media raises issues of criminal liability under Indonesian law. Selebgrams play a role in disseminating prohibited gambling content, thereby potentially expanding online gambling practices. This study aims to analyze the criminal liability of selebgrams who promote online gambling under Indonesian criminal law. This research employs a normative legal method with a statutory approach. The findings indicate that selebgrams who intentionally promote online gambling may be held criminally liable under the Electronic Information and Transactions Law and relevant provisions of the Indonesian Criminal Code.

Abstract

The implementation of risk-based business licensing through the Online Single Submission (OSS) system places the Detailed Spatial Plan (RDTR) as a key basis for issuing business permits. This policy aims to accelerate licensing procedures and enhance legal certainty. However, in practice, RDTR-based business licensing raises juridical issues within the national land law system. This study examines the juridical problems of RDTR-based business licensing and their implications for legal certainty. Using normative legal research with statutory and conceptual approaches, the study finds inconsistencies between the spatial planning and land law regimes, weak examination of land rights legality, and potential violations of good governance principles. Additionally, the uneven availability of RDTR across regions leads to unequal legal treatment. Therefore, strengthening the integration of spatial planning and land administration is essential to ensure legal certainty in business licensing.

Abstract

This study aims to examine the normative gap in the regulation of Intellectual Property (IP) valuation as an asset within the Indonesian legal system. As an intangible asset, Intellectual Property possesses significant economic value and has increasingly been recognized as an asset that can be utilized in business activities and financing schemes, including as collateral. However, Indonesia currently lacks comprehensive legal provisions governing the standards, methods, and mechanisms for the valuation of Intellectual Property. This research employs a normative legal research method using statutory and conceptual approaches. The findings reveal that the existing legal framework does not provide adequate legal certainty regarding the valuation process of Intellectual Property, particularly concerning valuation standards and the institutions authorized to conduct such valuations. This condition creates various obstacles to the utilization of Intellectual Property as an economic asset, especially in legal relationships involving creditors and debtors. Therefore, this study recommends the establishment of a clearer, more integrated, and comprehensive regulatory framework on Intellectual Property valuation to ensure legal certainty and support the optimal utilization of Intellectual Property as a valuable economic asset.
