Abstract

This study provides a critical appraisal of the legal safeguards governing the enforcement of transnational arbitral awards within the Indonesian jurisdiction, centered on the landmark dispute of Himpurna California Energy Ltd v. PT PLN. Utilizing a normative-juridical research framework with an emphasis on jurisprudential analysis and prevailing statutory structures, this inquiry examines the tension between Indonesia’s international obligations under the 1958 New York Convention and the practicalities of domestic judicial intervention. The findings indicate that the broad interpretative latitude applied to 'public policy' principles by local judicial authorities often functions as an anomaly that obstructs the execution of foreign arbitral mandates. Such unpredictability generates significant juridical risk for global investors and undermines the foundational independence of the arbitral forum. This paper advocates for a fundamental reorientation of the judicial paradigm toward a pro-arbitration stance and underscores the necessity of modernizing national arbitration regulations to bolster Indonesia's economic competitiveness within the global trade ecosystem.

Abstract

This research provides a rigorous examination of the termination of employment policies that exempt employers from severance pay obligations under Government Regulation Number 35 of 2021. Within the framework of labor market liberalization introduced by the Job Creation Law, significant legal ambiguity has surfaced concerning the "urgent misconduct" criteria used to disqualify workers from receiving post-employment benefits. Employing a doctrinal legal research methodology with a focus on statutory interpretation and conceptual frameworks, this study investigates the repercussions of these norms on the constitutional safeguards for employees. The analysis reveals that the lack of an independent evidentiary process for verifying grave misconduct creates substantial opportunities for administrative malpractice and unilateral decision-making by employers. Consequently, this shift undermines the principles of social justice and legal certainty, transforming severance pay—originally designed as an economic safety net—into a punitive tool. The study concludes that rigid standardization of misconduct definitions and enhanced labor oversight are imperative to ensure that industrial competitiveness does not compromise the fundamental normative rights of the workforce.

Abstract

Rapid population growth in Tangerang Regency has created serious pressure on job availability. This study aims to analyze the impact of population growth on the labor market and formulate mitigation strategies. The method used is library research with content analysis of BPS data, relevant agency reports, and academic journals from the 2015–2025 period. Seven main findings of this study are: (1) population growth rate reaches 2.3% per year, dominated by migration; (2) the proportion of working-age population reaches 68%; (3) labor force growth (3.1%) far exceeds formal job growth (1.2%); (4) the informal sector covers 58% of workers with wages below the district minimum wage; (5) competency mismatch occurs with 25% of industrial vacancies unfilled; (6) the vocational training budget is only 0.7% of the regional budget; (7) employment absorption elasticity per investment has declined drastically. The study concludes that population growth without being balanced by formal job expansion and vocational education transformation will worsen hidden unemployment and structural poverty. Integrated strategies are needed, including population control, restructuring of vocational training centers, and labor-intensive investment incentives.

Abstract

Although female workers play a vital role in economic growth, they also face challenges related to their reproductive health, particularly regarding maternity leave rights. Using a normative-legal methodology, this study aims to examine how Indonesian labor law regulates and implements maternity leave rights. The study considers both legal and conceptual aspects. This study shows that Indonesia has a strong, binding, and protective legal framework based on the 1945 Constitution and Law No. 13 of 2003. However, in real life, problems such as discrimination, wage reductions, and even termination of employment still exist. This is exacerbated by a lack of oversight and legal awareness. In conclusion, this study recommends enhancing maternity leave protections by combining regulations with improved oversight to provide fairer and more efficient protection for female workers.

Abstract

Information technology has driven the growth of global e-commerce, enabling rapid cross-border transactions. However, this situation has also raised a number of issues regarding legal protection, such as differences in legal systems between countries, conflicts of jurisdiction, inadequate consumer protection, and an increased risk of cybercrime. This study uses a normative legal approach, utilizing a literature review and a legislative approach. The study's findings show that legal protection for international e-commerce encompasses preventive elements (the ITE Law and UNCITRAL) and repressive elements (courts, arbitration, and ODR). However, due to the absence of harmonized international law and cross-border enforcement challenges, its effectiveness remains limited. Consequently, to create safe and sustainable e-commerce transactions, strengthening of regulations, digital security, and digital literacy is required.

Abstract

This study discusses the role of classical Muslim scholars as pioneers of modern science during the Islamic Golden Age (8th to 14th centuries CE). The method used is library research with a historical-factual approach and descriptive-qualitative analysis. The results show that figures such as Al-Khawarizmi (mathematics, algorithms), Ibn Sina (medicine, Canon of Medicine), Ibn al-Haytham (optics, experimental method), Al-Biruni (astronomy, geography), Jabir ibn Hayyan (chemistry, distillation), and Al-Jazari (engineering, automation) not only preserved ancient knowledge but also developed it through systematic observation, laboratory experimentation, and scientific documentation. Their contributions became the foundation for various modern scientific disciplines such as algebra, algorithms, the scientific method, optics, pharmacology, and mechanical engineering. In conclusion, classical Muslim scholars served as a bridge between ancient knowledge and the European Scientific Revolution, and their thoughts remain relevant in STEM education and contemporary technological developments such as artificial intelligence, robotics, and nanomaterials.

Abstract

This study aims to sociologically examine the roles and responsibilities of the government, community, and family in ensuring access to education for marginalized children at Madrasah Aliyah institutions. The research is grounded in the persistently low Net Enrollment Rate (NER) at the senior secondary level, which nationally stands at only 61.65 percent (BPS, 2023), with children from marginalized groups being the most vulnerable to dropping out of school. The study employs a qualitative approach using a case study method, with data collected through in-depth interviews with the Vice Principal of Student Affairs, the Vice Principal of Facilities and Infrastructure, the Vice Principal of Public Relations, and classroom teachers. The findings reveal four primary forms of support for marginalized students: (1) Guidance and Counseling (BK) services that specifically accompany students facing economic and social disadvantages; (2) active involvement of alumni associations in periodic motivational activities; (3) multilayered access to financial assistance through KIP (Smart Indonesia Card), UP2 (Education Program Management Unit), and fee reductions from the pesantren institution; and (4) direct financial assistance from the foundation chairman to boarding students experiencing economic hardship. The discussion is framed using Bourdieu's theory of social reproduction, Putnam's social capital theory, and Bronfenbrenner's ecological development model. The study concludes that pesantren-based Madrasah Aliyah has significant potential as an effective model of inclusive education through multi-stakeholder synergy among institutions, government, communities, and foundations, bound together by Islamic values and a commitment to serving the underprivileged.
