Abstract

Marriage is a legal institution that not only regulates the personal relationship between husband and wife but also gives rise to legal consequences regarding the rights and obligations of the parties. In practice, inequalities in the fulfillment of rights are still frequently encountered, particularly concerning the wife. This study aims to analyze the forms of legal protection for the wife's rights in marriage under positive law in Indonesia as well as its implementation in society. The research method used is normative juridical, employing a statutory approach and a conceptual approach. The results of the study indicate that legal protection for the wife has been regulated in Law Number 1 of 1974 concerning Marriage as amended by Law Number 16 of 2019, as well as in the Compilation of Islamic Law. However, in practice, obstacles such as cultural factors, economic conditions, and lack of legal understanding still exist. Therefore, it is necessary to enhance legal awareness and optimize law enforcement to ensure the fulfillment of the wife's rights in marriage.

Abstract

Perkawinan siri merupakan perkawinan yang dilaksanakan sesuai dengan hukum agama Islam, namun tidak dicatatkan di hadapan Pegawai Pencatat Nikah (PPN) sebagaimana diamanatkan dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan dan Peraturan Pemerintah Nomor 9 Tahun 1975. Ketiadaan pencatatan perkawinan menimbulkan konsekuensi yuridis yang luas, terutama dalam konteks hak waris istri dan anak yang lahir dari perkawinan tersebut. Penelitian ini bertujuan untuk menganalisis dua permasalahan utama, yaitu: pertama, kedudukan hukum perkawinan siri dalam sistem hukum positif Indonesia dan implikasinya terhadap status perkawinan; kedua, akibat hukum yang ditimbulkan oleh perkawinan siri terhadap hak waris istri dan anak ditinjau dari Hukum Perdata, Hukum Islam, dan Kompilasi Hukum Islam (KHI). Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Analisis dilakukan terhadap berbagai peraturan perundang-undangan, putusan Mahkamah Agung, putusan Mahkamah Konstitusi—khususnya Putusan MK Nomor 46/PUU-VIII/2010—serta doktrin hukum yang relevan. Hasil penelitian menunjukkan bahwa perkawinan siri, meskipun sah secara agama, tidak memiliki kekuatan hukum mengikat dalam sistem hukum negara sehingga istri tidak memperoleh hak waris sebagaimana istri sah. Anak yang lahir dari perkawinan siri hanya memiliki hubungan keperdataan dengan ibu dan keluarga ibunya, kecuali jika ayah biologisnya mengakui dan telah membuktikan hubungan darah melalui ilmu pengetahuan dan teknologi. Penelitian ini merekomendasikan pentingnya itsbat nikah sebagai upaya hukum untuk melegitimasi perkawinan siri sekaligus melindungi hak-hak keperdataan pihak yang lemah.

Abstract

This study aims to provide a comprehensive understanding of a non-extremist religious attitude, covering both right-wing extremism (radical/rigid) and left-wing extremism (liberal/unrestrained), through the concept of religious moderation or wasathiyah in Islam. The diversity of ethnicities, cultures, and religions in Indonesia is a double-edged sword with the potential to trigger horizontal conflicts if religious understanding becomes rigid and exclusive. The phenomenon of polarization due to extremist movements has threatened social cohesion and national integration. Therefore, this study examines the definition of religious moderation as a just and balanced middle path, as well as the implementation of the wasathiyah concept through three main pillars: tawassut (moderation), i'tidal (proportionality), and tasamuh (tolerance). This implementation is applied in three practical domains: moderation in creed (aqidah), worship (ibadah), and morality (akhlaq). By understanding religious moderation, Muslims are expected to embody Islam as rahmatan lil 'alamin (mercy for all creation), maintain harmony, reject violence in the name of religion, and uphold the fundamental principles of creed and sharia within a pluralistic society.

Abstract

The philosophical approach in Islamic studies is a methodological framework that emphasizes the role of reason in understanding Islamic teachings logically, critically, and reflectively. This article aims to elaborate on the basic concepts of the philosophical approach, explain its application across various Islamic disciplines, and identify the figures who have contributed to its development. This research employs a qualitative method with a library research approach. The findings indicate that the philosophical approach is capable of connecting revelation and reason proportionally, thereby producing an understanding of Islam that is not only normative but also contextual and relevant to contemporary developments. Furthermore, this approach encourages the emergence of a more open, moderate, and dialogical religious attitude.

Abstract

Research is a systematic and structured scientific process aimed at finding solutions to various problems, particularly in the field of Islamic education. This paper aims to describe the steps of educational research, including problem identification, literature review, research preparation, data collection, data analysis, conclusions, and research reporting and evaluation. The method used in writing this paper is a literature study, reviewing various relevant literature sources. The results of the discussion indicate that the research begins with the identification and formulation of a clear problem as the primary basis for the research. Next, a literature review is conducted to obtain a strong theoretical foundation. The research preparation stage includes planning the research methodology and instruments. Data collection is conducted systematically according to the method used, then analyzed to produce valid and objective findings. The final stage includes the conclusion of the research results, as well as reporting and evaluation as a form of scientific accountability. By following systematic research stages, educational research is expected to produce findings that are relevant, valid, and beneficial for the development of science and improving the quality of Islamic education practices.

Abstract

This study aims to analyze curriculum development management based on needs assessment in Islamic educational institutions and explain the importance of implementing needs assessment in creating relevant and adaptive curricula. This study employed a library research method with a descriptive qualitative approach. Data were collected through documentation studies from various scientific journals, books, and articles relevant to the research topic. The data were analyzed using content analysis through data reduction, data presentation, interpretation, and conclusion drawing. The findings indicate that needs assessment plays an important role in identifying the needs of students, institutions, and society as the basis for curriculum development. The stages of curriculum development management include planning, organizing, implementation, and evaluation, which must be carried out systematically. In addition, Islamic educational institutions face various challenges such as limited human resources, technological developments, and the need to maintain a balance between scientific knowledge and Islamic values. Therefore, curriculum development based on needs assessment is considered an effective strategy to improve the quality of Islamic education in order to remain relevant, adaptive, and grounded in Islamic values.

Abstract

This study aims to analyze research design in educational policy, including its approaches, implementation, and challenges in the policy research process. The study employed a qualitative approach using a library research method by reviewing books, scientific journals, and relevant policy documents. Data were collected through documentation studies and analyzed descriptively through data reduction, data presentation, and conclusion drawing. The findings indicate that research design plays an important role in producing evidence-based educational policies that are relevant to educational needs. Three main approaches are commonly used in educational policy research, namely quantitative, qualitative, and mixed methods approaches, each of which has its own characteristics and advantages in analyzing educational policies. The implementation of research design has also been applied in various educational policy studies, such as the evaluation of School Operational Assistance (BOS), the Merdeka Curriculum, and inclusive education policies. In addition, the study found that the main challenges in educational policy research design include limited data access, stakeholder complexity, and gaps between theory and practice in the field. Therefore, a systematic and comprehensive research design is essential to support effective, adaptive, and quality-oriented educational decision-making.

Abstract

This study aims to analyze the role of verification and validation of visitation results in supporting the credibility of educational institution accreditation as part of the educational quality assurance system. The study employed a qualitative approach using a library research method by reviewing scientific literature, journal articles, and official documents related to visitation, verification, validation, and educational accreditation. Data were analyzed descriptively through data reduction, classification, and synthesis techniques. The findings reveal that verification functions to ensure the conformity of visitation data with supporting evidence and documents, while validation aims to ensure the accuracy, consistency, and feasibility of the data as the basis for accreditation decisions. The verification and validation process is conducted systematically through stages of data collection, examination, clarification, validation, and final determination. In addition, the application of objectivity, transparency, accountability, consistency, and professionalism principles plays an essential role in maintaining the quality and credibility of accreditation results. Therefore, verification and validation have a strategic role in improving the credibility of accreditation outcomes and supporting accurate and reliable data-based educational decision-making.

Abstract

This study aims to determine marketing strategies for fresh fruit businesses located in Kanigoro, Blitar, East Java, and to serve as a reference for decision-making regarding marketing strategies for several fruit stores in Blitar in order to increase sales in the future. The marketing strategy was formulated through a Strengths, Weaknesses, Opportunities, and Threats (SWOT) analysis, which was then outlined using the Internal Factor Analysis Strategic (IFAS) and External Factor Analysis Strategic (EFAS) methods. The results of the IFAS and EFAS analyses were subsequently mapped into a SWOT diagram to determine the appropriate strategy based on the data analysis. The results of the SWOT diagram analysis indicate that the business is positioned in Quadrant I, suggesting an aggressive strategy by utilizing external opportunities to maximize internal strengths.

Abstract

Islamic Studies is a discipline that systematically and comprehensively examines the teachings, history, thought, and religious phenomena of Islam. The urgency of Islamic Studies becomes crucial in the modern era, which is characterized by globalization, technological advancement, secularization, radicalism, and an overwhelming flow of unfiltered information. Without a deep understanding through Islamic Studies, a person is vulnerable to misinterpretation of religious proofs, religious hoaxes, erroneous interpretations, and extremist ideologies that damage the image of Islam. Islamic Studies has a strategic role in preserving the purity of Islamic teachings, forming noble character in accordance with the prophetic mission, answering contemporary problems with solutions based on Islamic values, and building a civilization for the Muslim community as exemplified by past Muslim scholars such as Ibn Sina and Al-Khawarizmi. The relationship between urgency and Islamic Studies is very close, where urgency serves as the fundamental reason why Islamic Studies must be studied, while Islamic Studies is the field of knowledge to be learned. In conclusion, studying Islamic Studies is a vital necessity for every Muslim in order to practice Islam comprehensively (kaffah) and become a mercy to all worlds (rahmatan lil 'alamin) amidst the challenges of the modern era.
