JHSS (Journal of Humanities and Social Studies) is a journal that publishes scientific papers in the field of humanities and social studies. This Journal, run by Lembaga Penelitian dan Pengabdian Pada Masyarakat, Universitas Pakuan, Bogor. The Journal provides opportunities for scholars to submit papers in humanities and social studies, and also management policies related to education, teaching, and learning fields which will be published online. The internet connection will add to the richness of information and scientific knowledge derived mainly from research. This journal is published three times a year, well documented in the form of books, which include a variety of humanities and social studies papers by writers of various backgrounds. Abstract

Global developments and the decentralization of governmental authority have encouraged regional governments to utilise international cooperation as an instrument for regional development through the practice of paradiplomacy. This study aims to analyse the implementation and contribution of the international cooperation undertaken by the West Java Provincial Government in supporting regional development, while identifying the factors that facilitate and constrain its implementation. The study employs a descriptive qualitative approach. Data were collected through document analysis, a review of relevant literature, and an in depth interview with a practitioner from the Bureau of Government and Regional Autonomy of the West Java Provincial Government. The analytical framework integrates the policy implementation models of Van Meter and Van Horn and Mazmanian and Sabatier within the perspective of multi level governance. The findings indicate that West Java's international cooperation has contributed to regional development in the economic, employment, and cultural sectors. However, its long term effectiveness depends on the comprehensive fulfilment of the Six Governance Conditions, with institutional capacity and intergovernmental coordination remaining the principal challenges to effective implementation.

Abstract

Digital public service transformation requires not only greater efficiency and service accessibility but also governance that ensures integrity, fairness, transparency, accountability, and the protection of citizens’ data. This study aims to analyze the implementation of ethical governance in digital public service transformation at the Population and Civil Registration Office of Sumedang Regency. The study employed a qualitative approach with a single-case study design. Data were collected through non-participant observation, documentation, and semi-structured interviews with purposively selected informants representing organizational leaders, division heads, service officers, system operators, and citizens using digital services. The study focused on ethical leadership, ethical standards and codes, ethical organizational culture, accountability and controlling, and ethics education and communication. Data were analyzed using an interactive model comprising data reduction, data display, conclusion drawing, and verification, while data validity was maintained through source and technique triangulation. The findings indicate that ethical governance has been supported by leadership role modelling, standard operating procedures and ethical codes, access restrictions, individual user accounts, multi-level verification, a culture of integrity, system activity records, hierarchical controlling, and employee development. However, its implementation has not been fully optimal due to inconsistent complaint follow-up, reactive use of audit trails, irregular security audits, insufficient protection for internal reporters, the absence of specific and periodic digital ethics training, and limited transparency and clarity in communicating data protection and service status. The study concludes that ethical governance has been institutionalized in internal policies and practices, but further strengthening is required to ensure that its outcomes are consistently experienced by citizens through secure, responsive, transparent, inclusive, and public-oriented digital services.

Abstract

This study aims to analyze the extent to which the political will of the Ministry of Communication and Digital Affairs (Komdigi) affects the effectiveness of cybersecurity governance over personal data in Indonesia, using the 2022 Bjorka data hacking case as the case study. The method used is descriptive qualitative, with informants selected purposively from an internal representative of Komdigi and the civil society organization SAFENet, combined with secondary data from official documents and media reports, analyzed through governance network theory and Brinkerhoff's theory of political will. The results show that personal data security governance in Indonesia following the Bjorka case is marked by unresolved institutional fragmentation between Komdigi and the National Cyber and Crypto Agency (BSSN), and by a political will that remains symbolic rather than substantive, reflected in reactive policy initiatives, minimal civil society involvement in drafting implementing regulations, inconsistent budget allocation, the absence of credible sanctions due to the independent data protection authority not yet being established, and recurring major data breaches after Bjorka. The study also finds that leaked personal data has been used as an instrument of repression against critical citizens, indicating that the consequences of weak data governance extend beyond economic loss into the political sphere. It is concluded that strengthening Indonesia's cybersecurity governance requires substantive and sustained political will, rather than merely formal regulatory products on paper.

Abstract

This article aims to examine the application of learning management to improve the quality of education. The focus of this research is the concept of educational management in improving the quality of learning, which is broken down into five sub-focuses: (1) the objectives of R&D research in education, (1) the application of educational management in the school environment, (2) effective educational management to improve teacher performance and improve the quality of learning, (3) the role of educational management in improving the quality of teaching, (4) educational management strategies to improve teacher performance, and (5) supporting factors in improving teacher performance. This research used a qualitative method with a literature review. The results illustrate the need for learning management to improve abilities and skills to support the implementation of a quality education process.

Abstract

This research endeavors to investigate the evolution and scholarly framework of green waqf as a mechanism for fostering a sustainable economy. The methodology employed is a descriptive qualitative approach, utilizing a Systematic Literature Review (SLR) in conjunction with bibliometric analysis. Data were sourced from the Scopus database through the keyword “green waqf,” subsequently filtered to encompass only journal articles. The analysis encompasses trends in publication, citation dynamics, networks of author collaboration, and thematic categorization of research subjects. The results suggest that green waqf research is currently in its nascent yet rapidly expanding phase, with a notable surge in publications anticipated post-2024. Indonesia is identified as the principal center of research activity, underscoring its pivotal role in the confluence of Islamic social finance and sustainability initiatives such as the Sustainable Development Goals (SDGs) and net-zero emissions commitments. The literature is delineated into several predominant themes, which include Islamic finance and environmental sustainability, frameworks for the green economy, contextual applications of waqf (e.g., agroforestry and pesantren), behavioral dimensions of waqf involvement, and governance alongside ESG concerns. Nevertheless, the study indicates that the research ecosystem is still fragmented, characterized by limited interscholarly collaboration and a predominance of conceptual studies over empirical investigations. This study makes a significant contribution by delineating the intellectual framework of green waqf research and pinpointing essential gaps, notably the deficiency of empirical data concerning environmental and economic repercussions. The findings yield pertinent implications for policymakers and waqf institutions aimed at improving standardization, enhancing transparency, and integrating green waqf within sustainable development frameworks.

Abstract

Bankruptcy and Suspension of Debt Payment Obligation (PKPU) proceedings involving property developers frequently generate significant legal uncertainty for apartment buyers who have fulfilled payment obligations but have not received the promised units. In practice, homologation decisions approving settlement plans often require consumers to continue payments despite prior breaches of contract, including construction delays or project abandonment. This situation creates tension between the binding nature of homologation under bankruptcy law and consumers’ contractual rights under civil and consumer protection law. An examination of the Indonesian Civil Code, Consumer Protection Law, and Bankruptcy and PKPU Law demonstrates that a developer’s breach of contract entitles buyers to claim specific performance, contract termination, or compensation. The principle of exceptio non adimpleti contractus legitimizes a buyer’s refusal to perform further obligations when the counterparty has failed to fulfill its own. Empirical findings reveal structural bargaining power imbalance and limited legal certainty for consumers positioned as concurrent creditors within insolvency proceedings. A developer’s liability does not extinguish upon bankruptcy but remains inherent in the obligation to restore losses in accordance with good faith and contractual justice. Harmonization between bankruptcy and consumer protection regimes is therefore essential to ensure substantive justice for property buyers.

Abstract

This writing study examines criminal responsibility for murder perpetrators suffering from schizophrenia through a comparative analysis of Decision Number 2353/Pid.B/2018/PN.Mdn and Decision Number 150/Pid.B/2024/PN.Jkt.Brt. This study is motivated by inconsistencies in judicial decisions involving offenders with similar mental disorders, which create legal uncertainty and raise concerns about justice and legal protection. This study aims to analyze how judges assess criminal responsibility by considering juridical and psychological aspects, especially in interpreting Article 44 of the Old Criminal Code and evaluating psychiatric evidence such as Visum et Repertum Psychiatric (VeRP). This research uses normative juridical methods using legal, comparative, and conceptual approaches, focusing on legal materials such as laws, doctrines, and court decisions. The findings revealed that differences in judicial decisions were influenced by the interpretation of expert testimony, the quality and strength of psychiatric evidence, and the judge's perspective on the defendant's mental capacity (toerekeningsvatbaarheid). The Medan decision concluded that the defendant was not criminally responsible and mandated medical treatment, while the Jakarta decision found the defendant guilty of the fulfillment of the element of intent. The study offers a novelty by emphasizing the need for clearer legal guidelines and consistent standards in assessing criminal responsibility for individuals with schizophrenia, as well as integrating rehabilitative, restorative, and corrective approaches in Indonesia's reformed criminal justice system.

Abstract

Science and Social Studies learning in elementary schools currently tends to be conventional and lacks media capable of presenting real-world problems contextually. This research aims to develop valid, practical, and effective problem-based Teaching Materials using local environmental photography to enhance the scientific literacy of fifth-grade students on ecosystem topics. Method: This study employed Research and Development (R&D) using the ADDIE model (Analysis, Design, Development, Implementation, and Evaluation). The resulting product is a printed problem-based book that integrates authentic photographs of local environmental degradation as the primary learning stimulus. Results: Expert validation results showed a high level of feasibility, with scores of 91% from material experts and 94% from media experts. The practicality test conducted by fifth-grade teachers reached a score of 96%. The effectiveness of the Teaching Materials was significantly demonstrated by the increase in students' average scores, from 68 in the pre-test to 86 in the post-test, with a normalized gain (N-Gain) score of 0.56 in the medium category. Furthermore, observation results indicated that 94% of students were actively engaged in analyzing scientific phenomena and formulating environmental solutions. Conclusion: Problem-based Teaching Materials supported by authentic photographs are proven to be valid, practical, and effective learning media solutions for improving ecosystem understanding and scientific literacy, particularly in schools with limited instructional resources.

Abstract

The increasing sophistication of digital media manipulation has intensified the spread of political disinformation, presenting new challenges for civil liberties in digital public spaces. This study examines the implications of deepfake disinformation about "Ibu Jilbab Pink" disseminated by political buzzers on Instagram during the August-September 2025 movement for citizens' civil liberties in Indonesia's digital public sphere. Using a qualitative case study approach that combines netnographic observation of 15 purposively selected Instagram content units with in-depth expert interviews, the analysis identifies three dominant narrative constructions: symbolic delegitimization, identity delegitimization, and public polarization. The findings indicate that political buzzers systematically employed deepfake-based disinformation to undermine both the individual figure and the symbolic meaning of collective protest, thereby narrowing citizens' freedom of expression, weakening deliberative discourse, and suppressing civic participation. The study concludes that deepfake disinformation may function as an instrument of refeudalization, as theorized by Habermas, with implications that extend beyond the individual figure to the broader civil and political citizenship of the public she represented.

Abstract

This study aims to analyze the effect of facilities and service quality on visitor satisfaction at Sari Ater Hot Spring as a wellness tourism destination. A quantitative approach with a survey design was employed, using questionnaires distributed to visitors. The data were analyzed through descriptive statistics, classical assumption tests, and multiple linear regression. The results show that both facilities and service quality have positive and significant effects on visitor satisfaction, both partially and simultaneously. Facilities, including condition, completeness, and design, contribute to visitor comfort, while service quality, reflected in responsiveness, reliability, and courtesy, enhances visitor experience. The coefficient of determination indicates that these variables explain a substantial proportion of satisfaction, although other factors also play a role. Overall, improving facilities and service quality is essential for increasing visitor satisfaction and maintaining competitiveness in the tourism industry, particularly in wellness tourism destinations.
