Abstract

The development of information technology and the digitalization of banking services have significantly increased the use of digital transactions, offering efficiency and convenience while simultaneously giving rise to increasingly complex cybercrimes. One prevalent form of cybercrime in digital banking practices is fraud through social engineering schemes. This type of fraud exploits psychological manipulation to obtain customers’ confidential information, authentication codes, or unauthorized transaction approvals, resulting in substantial financial losses. In the context of banking law, social engineering fraud raises legal issues concerning banks’ liability for customer losses, particularly in determining the boundary between bank negligence and customer fault. The Indonesian banking regulatory framework has incorporated prudential principles, risk management, and consumer protection measures. However, regulations specifically addressing banks’ liability in cases of social engineering fraud remain insufficient and lack comprehensive clarity, leading to potential legal uncertainty and inconsistent dispute resolution. This study aims to analyze banks’ liability for social engineering fraud in digital transactions from the perspective of banking law and customer protection. The research employs a normative legal method with statutory and conceptual approaches by examining banking regulations, consumer protection laws, and legal doctrines related to liability and negligence. The findings indicate that banks may be held liable when customer losses arise from weaknesses in security systems, failure to properly implement prudential principles, or inadequate customer protection and education measures. Therefore, clearer legal regulation is necessary to define the allocation of liability between banks and customers in order to ensure legal certainty and strengthen customer protection in digital banking transactions.

Abstract

The adoption of financial technology is crucial for the sustainability of Micro, Small, and Medium Enterprises (MSMEs), but doubts regarding cost efficiency and the tangible benefits of technology investment remain a major obstacle for businesses in the region. This study aims to evaluate the feasibility of implementing digital accounting applications through quantitative Cost-Benefit analysis and Value for Money (VfM) assessment, as well as to analyze its impact on improving the financial performance of MSMEs in South Kalimantan. This study uses quantitative methods with data collection techniques through questionnaire surveys of 67 MSME players who have used digital accounting applications. Data analysis was conducted by calculating the Benefit-Cost Ratio (BCR) and VfM indicators, which include Economic, Efficiency, and Effectiveness aspects. The results show that the implementation of digital accounting applications produces a BCR value [specify the number, e.g., >1], indicating that the economic benefits received exceed the investment costs incurred. Based on the Value for Money assessment, the use of the application was proven to meet economic criteria in procurement, be efficient in operational processes, and be effective in producing accurate financial reports. Overall, the implementation of this system had a positive and significant impact on improving the financial performance of MSMEs through operational cost efficiency and speed of managerial decision-making.

Abstract

The development of information technology and the digitization of financial services have driven significant transformations in banking financing agreements, one of which is through the use of blockchain-based smart contracts. Smart contracts offer various advantages, such as process efficiency, transparency, certainty of agreement implementation, and automated contract execution without the need for third-party intervention. However, the application of smart contracts in bank financing agreements also raises a number of legal issues, particularly those related to the validity of agreements, legal evidence, the responsibilities of the parties, and customer protection in banking legal relationships. In the Indonesian legal system, regulations regarding smart contracts have not been specifically and comprehensively regulated, so their use in the banking sector has the potential to create legal vacuums and legal uncertainty. This study aims to analyze the use of smart contracts in bank financing agreements from a legal perspective, with an emphasis on their conformity with the principles of contract law and their legal implications in banking practice. The research method used is normative legal with a legislative and conceptual approach, through a review of banking regulations, contract law, and legal doctrines related to electronic contracts and blockchain technology. The results of the study indicate that, conceptually, smart contracts can be applied in bank financing agreements as long as they meet the requirements of a valid agreement and the applicable principles of contract law. However, the absence of specific legal regulations regarding smart contracts in Indonesian banking law emphasizes the need to establish an adaptive regulatory framework to ensure legal certainty, customer protection, and the security and sustainability of banking financing transactions in the digital era.

Abstract

Usaha Mikro, Kecil, dan Menengah (UMKM) memiliki peran strategis dalam perekonomian nasional, namun masih menghadapi berbagai kendala dalam perlindungan hukum atas merek dagang, khususnya penggunaan nama generik sebagai identitas produk. Nama generik kerap digunakan oleh pelaku UMKM karena dianggap mudah diingat dan merepresentasikan jenis barang atau jasa yang ditawarkan. Namun, dalam praktiknya, penggunaan nama generik sering kali berujung pada penolakan pendaftaran merek oleh Direktorat Jenderal Kekayaan Intelektual (DJKI) karena tidak memenuhi unsur daya pembeda sebagaimana diatur dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Penelitian ini bertujuan untuk menganalisis tantangan perlindungan merek bagi produk UMKM yang menggunakan nama generik serta mengkaji pertimbangan hukum DJKI dalam menolak permohonan pendaftaran merek tersebut. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan studi kasus terhadap putusan atau keputusan penolakan pendaftaran merek di DJKI. Hasil penelitian menunjukkan bahwa keterbatasan pemahaman hukum merek di kalangan pelaku UMKM, minimnya pendampingan hukum, serta ketentuan hukum mengenai larangan pendaftaran merek generik menjadi faktor utama terhambatnya perlindungan merek. Oleh karena itu, diperlukan peningkatan sosialisasi, pendampingan, serta strategi penamaan merek yang lebih kreatif agar produk UMKM memperoleh perlindungan hukum yang optimal dan berkelanjutan.

Abstract

Tradisi menghitung nama untuk menentukan kecocokan pasangan dalam memilih jodoh adalah salah satu kebiasaan adat yang masih dilakukan oleh masyarakat Banjar, terutama di Desa Keliling Benteng Tengah, Kabupaten Banjar, Kalimantan Selatan. Tradisi ini dilakukan dengan cara menghitung nilai huruf dari nama calon mempelai untuk menilai sejauh mana kecocokannya serta memperkirakan kehidupan rumah tangga di masa depan. Penelitian ini bertujuan untuk memahami bagaimana masyarakat memandang tradisi menghitung nama ini dalam menentukan jodoh serta menganalisisnya dari perspektif hukum Islam. Penelitian ini menggunakan metode kualitatif deskriptif dengan pendekatan hukum dan sosial. Data yang dikumpulkan didapatkan melalui wawancara dengan tokoh agama, tokoh masyarakat, dan masyarakat yang pernah atau masih melakukan tradisi ini, serta dari studi literatur kitab hukum Islam dan karya ilmiah terkait. Hasil penelitian menunjukkan bahwa sebagian masyarakat masih memandang tradisi menghitung nama sebagai bentuk usaha dan kehati-hatian dalam memilih pasangan hidup, bukan sebagai penentu jodoh secara mutlak. Namun, tradisi ini tetap memengaruhi proses pengambilan keputusan dalam menikah. Dari sudut pandang hukum Islam, tradisi ini dianggap tidak memiliki dasar syari’at yang kuat dan berpotensi menyebabkan keyakinan yang bertentangan dengan prinsip tauhid jika diyakini sebagai penentu nasib dan takdir. Karena itu, tradisi ini dihukumi haram apabila diyakini memengaruhi takdir, dan makruh apabila hanya dianggap sebagai tradisi tanpa keyakinan terhadap kebenarannya. Penelitian ini menekankan pentingnya masyarakat membedakan antara adat yang sesuai dengan syariat Islam dan praktik yang bertentangan dengan prinsip dasar agama.

Abstract

Perlombaan dan permainan berhadiah merupakan praktik yang umum dijumpai dalam kehidupan masyarakat, termasuk di Kota Banjarmasin. Kegiatan ini sering dipandang sebagai bentuk hiburan dan apresiasi, namun dalam perspektif hukum Islam perlu dikaji lebih lanjut karena berpotensi mengandung unsur yang dilarang seperti maysir (perjudian) dan gharar (ketidakjelasan). Penelitian ini bertujuan untuk menganalisis status hukum hasil perolehan hadiah dari perlombaan dan permainan berdasarkan perspektif fikih Islam serta pandangan tokoh ulama di Kota Banjarmasin. Penelitian ini menggunakan pendekatan kualitatif dengan memadukan kajian normatif dan empiris. Data diperoleh melalui studi kepustakaan terhadap Al-Qur’an, Hadis, literatur fikih, dan karya ilmiah yang relevan, serta wawancara dengan tokoh ulama setempat. Hasil penelitian menunjukkan bahwa perlombaan dan permainan pada dasarnya diperbolehkan dalam Islam selama tidak mengandung unsur maysir dan gharar. Hadiah dinilai tidak sah apabila diperoleh melalui mekanisme taruhan dan ketidakpastian yang bergantung pada keberuntungan. Sebaliknya, hadiah dapat dibolehkan apabila mekanismenya jelas, adil, dan tidak merugikan salah satu pihak. Temuan ini diharapkan dapat menjadi rujukan bagi masyarakat dan penyelenggara dalam memahami batasan syariat terkait perlombaan dan permainan berhadiah

Abstract

In the era of digital transformation and fluctuating market dynamics, employee psychological well-being has become a key determinant of organizational success. This study aims to analyze the influence of mental health on employee performance by positioning the work environment as a moderating variable. Using a quantitative approach, this study processed primary data from 200 respondents in industrial sectors with high work pressure. The analytical tool used was E-Views through the Moderated Regression Analysis (MRA) method to test the interaction effect between the independent and moderator variables. The results of the analysis indicate that mental health contributes positively and significantly to employee performance. Furthermore, it was found that the work environment functions as a moderating variable that strengthens the relationship (strengthening effect). These findings confirm that a conducive work environment, both physically and psychosocially, can mitigate the negative impact of employee mental degradation on their work output. The implications of this study suggest that organizational management should integrate mental health policies into the work environment design to achieve sustainable productivity.

Abstract

In Islam, marriage aims to form a harmonious, prosperous, and high-quality family. A family that is of high quality both spiritually and materially. As explained in Marriage Law No. 1 of 1974, the position of the wife as a homemaker means that her economic life must be guaranteed by her husband. This is stated in Article 31 paragraph (3), which states that “The husband is the head of the family and the wife is the homemaker.” Then, Article 34 paragraph (1) states that the husband is obliged to earn money for the sake of the household's economy: “The husband is obliged to provide everything necessary for the household according to his ability.” Meanwhile, Article 34 paragraph (2) regulates the wife's obligation to take care of the household. If the husband or wife neglects their obligations, either party may file a lawsuit under Article 34 paragraph (3). In the Compilation of Islamic Law Article 77 paragraph (2) it is stated that husbands and wives are obliged to love each other, respect each other, be faithful, and provide physical and emotional support to one another. This article automatically closes the door to any attempt at hegemony by either party. This article is sufficient as a basis for the obligations of husbands and wives in fulfilling their obligations and obtaining their respective rights. There is no superiority between the two. All are equal, complementing and perfecting each other. Gender equality is the equal conditions for men and women to obtain their rights as human beings, to play a role and participate in political, economic, socio-cultural, defense and national security activities, and to enjoy the fruits of development equally. Gender construction is considered natural, and as a result, gender influences human beliefs and cultural norms about how men and women should think and act in accordance with these social norms. Eventually, these gender beliefs come to be considered natural, normal, and inherent, so that those who begin to violate them are considered abnormal and unnatural. According to Huzaemah, women are allowed to provide for their husbands, children, and households from the fruits of their labor as long as they are willing to do so. Even if the husband is poor, the wife may give zakat to her husband, but the husband may not give zakat to his wife because she is his responsibility.

Abstract

This study discusses the management of the school library at SMP Negeri 2 Alalak, focusing on the service sector based on management theory and in alignment with national standards for junior high schools. The purpose of this study is to examine the management of the school library at SMP Negeri 2 Alalak, particularly in terms of library services based on management theory and conformity with national standards for junior high school libraries, as well as to identify the challenges encountered in managing library services at SMP Negeri 2 Alalak. The research findings indicate that the management of the school library at SMP Negeri 2 Alalak has not yet fully met the national library standards. Library services are still conducted manually and have not adapted to technological developments through the integration of information technology in service delivery. However, library programs in the form of literacy activities conducted in collaboration with Indonesian language teachers serve as efforts to improve students’ reading abilities. The implication of this study is that it provides insights for school library managers in improving library services to increase library visits.

Abstract

The armed conflict between Israel and Palestine has resulted in numerous violations of international humanitarian law, including acts that may constitute war crimes. This study aims to analyze the forms of war crimes committed by Israel in Palestinian territories and to examine the mechanisms of legal accountability applicable under international criminal law. The research employs a normative juridical method using statutory and case approaches, focusing on international legal instruments such as the 1998 Rome Statute, the 1949 Geneva Conventions, and relevant United Nations Security Council resolutions. The findings indicate that Israel’s military actions—such as attacks on civilians, destruction of humanitarian facilities, and disproportionate use of force—fulfill the elements of war crimes as stipulated in Article 8 of the Rome Statute. However, the enforcement of legal accountability against Israel faces significant political and juridical obstacles, primarily due to Israel’s non-membership in the Rome Statute and the influence of veto powers within the UN Security Council. Therefore, the pursuit of justice for war crimes in Palestine requires stronger international support and reforms within the International Criminal Court system to ensure the effective realization of universal justice principles.
