Abstract

The problem of population has become a major problem for the world as a whole because it covers many aspects. One of the countries with the largest population is Indonesia. Occupation administrative arrangements must be made to enhance the establishment, protection, and public service to protect and fulfil the constitutional rights of citizens. These arrangements should also be made for the protection and recognition of all occupancy events and important events experienced by the inhabitants of Indonesia and Indonesian citizens who are outside the territory of the United States of the Republic of Indonesia. The method of normative jurisprudence is a normative juridical approach as research is carried out against the laws and regulations of the government as well as literature. Ministry of Home Affairs Regulation No. 2 of 2016 on the Child Identity Card, which obliges the public to comply with it, is ineffective in its implementation because it is incompatible with its useful functions with the previously existing system of occupation administration, namely the Birth Certificate.

Abstract

Covid-19 first appeared at the end of December 2019, which then increased its status to a pandemic. With the high number of cases of death due to being infected with the Covid-19 virus, the World Health Organization provides a protocol for the burial of Covid-19 bodies, intending to prevent and control infection of the body. Because many ordinary people do not know about the funeral process for the Covid-19 corpse, which is different from the funeral of a corpse in general, there is often hoax news circulating that the Covid-19 body can transmit the Covid-19 virus. The number of rejection of the Covid-19 body burial is one of them because of hoax news circulating in the community and provocation carried out by irresponsible people who spread the hoax news, even though in the burial of the Covid-19 body, it must use standard operating procedures must be followed by medical personnel. The research that will be utilized uses normative juridical review, namely study by examining various sources such as sources of library materials such as journals, literature, books, written documents, and multiple laws such as legal theories, legislation, doctrine, opinions of legal experts. The approach used in this research is statutory, conceptual, and analytical approaches. This research is a prescriptive-analytical which data synthesis, discussion, and conclusions are analyzed in qualitative research. In this journal, we will discuss the case of rejection of the Covid-19 body review and see from a legal perspective the perpetrators who spread hoax news to provoke the public and also spread misleading to others.

Abstract

Abstrak Kegiatan ini dilatar belakangi oleh masih belum memahami masyarakat Kelurahan Tanjung Batu Kecamatan Tanjung Batu Kabupaten Ogan Ilir terhadap UU nomor 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga (KDRT). Hal itu dapat dilihat pada banyaknya kasus KDRT. Oleh karena itu, diperlukan penyuluhan UU tersebut. Pada Pasal 4 UU No. 23 Tahun 2004 Tentang Panghapusan Kekerasan Dalam Rumah Tangga mempunyai tujuan : (1) Mencegah segala bentuk kekerasan dalam rumah tangga. (2) Melindungi korban kekerasan dalam rumah tangga. (3) Menindak pelaku kekerasan dalam rumah tangga. (4) Memelihara keutuhan rumah tangga yang harmonis dan sejahtera. Pemahaman masyarakat terhadap hukum dianggap kurang tegas dan kurang menitikberatkan pada sistem keadilan, apakah yang terjadi ini peraturan perundangundangannya atau apakah alat atau birokrasi hukumnya terutama setelah masa reformasi, seolah-olah peras hukum dikalangan masyarakat melemah, sehingga menimbulkan rasa krisis kepercayaan. Oleh karena itu sangat diharapkan sekali kepedulian peran pemerintah untuk kerjasama dengan perguruan tinggi hukum, lembaga-lembaga hukum, lembaga pemerintah, tokoh masyarakat perlu sekali dan sangat penting untuk dilakukan sosialisasi pengenalan pengetahuan hukum di masyarakat agar dapat diberdayakan. Sebetulnya banyak sekali perihal yang justru dipertanyakan oleh masyarakat yang memiliki rasa ingin tahu yang tinggi, maka sudah sepantasnya kepedulian akan sosialisasi pemahaman masyarakat terhadap hukum yaitu mengenai Undang-undang RI no 23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga (KDRT), sehingga untuk menanamkan rasa kepercayaan masyarakat terhadap hukum perlu sekali untuk mengadakan sosialisasi. Adapun Kekerasan Dalam Rumah Tangga (KDRT) bisa berwujud kekerasan fisik maupun psikologis : (1) Kekerasan fisik bisa berupa penganiayaan, seperti menampar, memukul atau jenis lain yang bisa melukai korban secara fisik, apalagi sasaran kekerasan terkena di bagian-bagian yang sangat sensitif seperti organ bagian kepala atau anggota badan yang bisa berakibat menimbulkan penderitaan dan bahkan bisa berakibat fatal yang disebabkan kekerasan fisik, baik bagi kepala rumah tangga, ibu rumah tangga maupun anak. (2) Demikian juga kekerasan psikologis juga bisa berupa penganiayaan, seperti halnya membentak, menelantarkan nafkah baik yang berwujud kebutuhan biaya hidup maupun kebutuhan biologis bagi pasangan suami istri, dan terkhusus nafkah biaya hidup dan pendidikan untuk anak. Dalam kegiatan ini dilakukan beberapa tahapan mulai dari observasi, penjajakan awal guna mengenali permasalahan, sampai tahap pelaksaan, dan monotoring untuk mengukur keberhasilan sosialisasi UU tersebut. Kata Kunci: Kekerasan, Keutuhan, Keluarga Abstract This activity was motivated by the fact that the people of Tanjung Batu Village, Tanjung Batu District, Ogan Ilir Regency still did not understand the Law number 23 of 2004 concerning the Elimination of Domestic Violence (KDRT). This can be seen in the number of cases of domestic violence. Therefore, it is necessary to educate the law. In Article 4 of Law no. 23 of 2004 concerning the Elimination of Domestic Violence has the following objectives: (1) Prevent all forms of domestic violence. (2) Protect victims of domestic violence. (3) Take action against perpetrators of domestic violence. (4) Maintaining a harmonious and prosperous household. The public's understanding of the law is considered to be less firm and less focused on the justice system, whether this is the legislation or whether the legal tools or bureaucracy, especially after the reform period, is as if the legal squeeze among the community is weakening, causing a sense of crisis of trust. Therefore, it is highly expected that the concern for the role of the government for cooperation with law universities, legal institutions, government institutions, community leaders is very necessary and very important to carry out socialization of the introduction of legal knowledge in the community so that it can be empowered. In fact, there are many things that are actually questioned by people who have a high curiosity, so it is appropriate to pay attention to the socialization of public understanding of the law, namely RI Law No. 23 of 2004 concerning the Elimination of Domestic Violence (KDRT), so as to instill the public's sense of trust in the law is necessary to conduct socialization. As for Domestic Violence (KDRT) can take the form of physical and psychological violence: (1) Physical violence can be in the form of abuse, such as slapping, hitting or other types that can physically injure the victim. organs of the head or limbs that can result in suffering and even fatal consequences caused by physical violence, both for the head of the household, housewives and children. (2) Likewise, psychological violence can also take the form of persecution, such as yelling, neglecting a living, both in the form of living expenses and biological needs for married couples, and especially living expenses and education for children. In this activity, several stages were carried out starting from observation, initial assessment to identify problems, to the implementation stage, and monitoring to measure the success of the socialization of the Law.

Abstract

Music is one of the building blocks of culture and civilization. The relationship between music and culture is clearly seen from regional cultures that are enriched by various tones, both in the form of pure music and as an integral part of dance. In the 14th century there was a rapid development of Islamic kingdoms that ruled Sumatra. Of course, this paved the way for Islamic (Middle Eastern) culture to exert a strong influence in various fields, including music. The types of music introduced by Arab traders at that time were gambus, tambourine and rebab. But in its development, these musical instruments experienced differences in name, form, and how to play them in each region. The research method used is a legal research method with a statutory approach and a case approach. Conclusions are drawn using deductive logic. The proposed draft law on music is currently deemed unable to provide legal certainty, usefulness and justice as it should be based on the complexity of the problem of music in Indonesia which in outline or even the main point because this draft law in substance seems to contain many things that are not in accordance with the 1945 Constitution on freedom of speech. Whereas freedom of speech is one side of human rights.

Abstract

Perkembangan teknologi yang tidak terbatas di era digital sekarang ini, semakin lengkap dengan hadirnya fintech. Istilah fintech merupakan sebuah layanan keuangan dengan menggunakan basis teknologi yang tentunya akan semakin memudahkan transaksi yang kita lakukan dimana saja dan kapan saja. Kemudahan ini lantas juga membuat menjamurnya fintech baik yang sifatnya legal maupun ilegal. Penelitian ini bertujuan untuk mengetahui tindakan hukum atas hutang pada pinjaman online ilegal. Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Adapun hasil penelitian ini adalah terkait dengan legalitas jasa pinjaman online maka dalam hal ini, penyelenggara tidak memenuhi unsur kecakapan akibat tidak terdaftar dan berizinnya penyelenggara tersebut. Namun hal ini tidak serta merta dapat membatalkan keabsahan perjanjian peminjaman antara pemberi pinjaman dan penerima pinjaman. Namun apabila masyarakat merasa dirugikan maka dapat melaporkan penyelenggara pinjaman online kepada Otoritas Jasa Keuangan (OJK).

Abstract

Abstrak Di Kota Manna Kabupaten Bengkulu Selatan sudah ada pelaksanaannya serta perencanaannya tetapi didalam pelaksanaan pengelolaan ruang terbuka hijau masih belum terlaksana sesuai dengan Peraturan Perundang-Undangan yang ada. Ada dua permasalahan yang dikaji dalam skripsi ini mengkaji 1) Bagaimana implementasi Peraturan Daerah Nomor 8 Tahun 2011 Tentang Rencana Tata Ruang Wilayah Kabupaten Bengkulu Selatan 2) Bagaimana Faktor Penghambat Rencana Tata Ruang Wilayah Kabupaten Bengkulu Selatan. Jenis penelitian ini menggunakan metode penelitian hukum empiris yaitu penelitian dengan adanya data lapangan sebagai sumber utama seperti hasil wawancara dan observasi dengan menganalisis hukum yang dilihat sebagai perilaku masyarakat yang berpola dalam kehidupan masyarakat yang selalu berinteraksi dan berhubungan dalam aspek kemasyarakatan. Hasil penelitian dan pembahasan 1)pelaksanaan pengelolaan ruang terbuka hijau di Kota Manna Kabupaten Bengkulu Selatan yang belum terlaksana sesuai dengan Peraturan Perundang-Undangan yang ada serta masih kurangnya kesadaran dari masyarakat dalam menjaga dan memelihara ruang terbuka hijau yang ada. 2) masih adanya faktor penghambat seperti faktor internal dan faktor eksternal dalam pengelolaan ruang terbuka hijau di kota Manna. Dapat disimpulkan bahwa pelaksanaan ruang terbuka hijau di kota manna sudah ada pelaksanaannya tetapi dalam pelaksanaannya belum berjalan sesuai dengan peraturan perundang-undangan yang ada serta maish banyaknya faktor-faktor penghambat dalam pelaksanaan ruang terbuka hijau itu sendiri. This type of research uses empirical legal research methods,namely research in the presence of field data as the main source such asinterviews and observations by analyzing laws that are seen as communitybehavior that is patterned in people’s lives that always interact and relate tosocial aspects. Research and discussion results 1) the implementation of greenopen space management in Manna City, South Bengkulu Regency which has hotbeen implemented in accordance with the existing Laws and Regulations as wellas the lack of awareness from the communityi in maintaining the existence ofgreen open spaces. 2) there are still inhibiting factors such as internal factors andexternal factors in the management of green open space in Manna city. It can beconcluded that the implementation of green open space in Manna city has beencarried out but in its implementation it has not proceeded in accordance with theexisting laws and regulations and also the many inhibiting factors in theimplementation of green open space itself

Abstract

Abstract In the Indonesian constitution, it is explained that the sovereignty of the Indonesian state is in the hands of the people as stated in Article 1 paragraph (2) of the 1945 Republic of Indonesia Constitution so all actions taken by the state must side with the interests of the people. Indonesia is a country that adheres to a democratic system, which means from the people to the people. Indonesia is a country of law so it has a logical consequence that every state action must have a clear legal basis. The DPR is a legislative institution that represents the interests of the people as explained in Article 20 paragraph (1) of the 1945 Republic of Indonesia Constitution states that: "The DPR holds the power to form laws." So the DPR has the authority to greatly influence the development of democracy and law in Indonesia. However, Article 82 paragraph (1) of Law Number 17 of 2014 concerning the MPR, DPR, DPD and DPRD states that: "Factions are groupings of members based on the configuration of political parties based on the results of general elections." So that the existence of factions in the DPR's organizational structure can result in deviations from the Indonesian constitution because in practice the factions in the DPR only care about their existence in parliament and try to maintain their power and defend the interests of their own party, so it is necessary to restructure the faction system in the DPR which eliminates factions in the DPR's organizational structure and restores them. to its initial function of realizing democratic development. Abstract

Corruption is a major challenge in national development that negatively impacts the economy, political stability, and the welfare of society. This research analyses the effectiveness of anti-corruption policies in Indonesia, particularly in handling corruption cases in the public sector. This study uses a qualitative approach with secondary data analysis, including reports from anti-corruption agencies, legal studies, and government documentation. Anti-corruption policies in Indonesia significantly reduce corrupt practices, but they are not yet fully effective. The main obstacles include weak law enforcement, a lack of competent human resources, and insufficient coordination between the involved agencies. Moreover, the still strong culture of corruption and political influence often hinders the consistent implementation of policies. This research suggests increased transparency, stronger regulations, and deep institutional reforms to make anti-corruption policies more effective. With the synergy between agencies and community support, it is hoped that the efforts to eradicate corruption in Indonesia can increase public trust and create good governance in the public sector.

Abstract

The forestry crisis in Indonesia is multidimensional and triggers complex negative impacts primarily caused by forestry malpractice, especially illegal logging. (illegal logging). Law enforcement efforts are still weak against forest timber logging perpetrators; if there are any, they only stop at the field-level perpetrators. Therefore, the issue that arises is what comprehensive efforts can be made to prevent and eradicate illegal logging. This research attempts to identify and analyze the role of progressive law in addressing the issue of illegal logging. Basically, to stop illegal logging in Indonesia, a comprehensive approach that encompasses various aspects is needed. Progressive law applies the law by considering the normative and sociocultural aspects of society. Full appreciation and accommodation of the value of life and development within society, especially around forest areas, are very important for its operationalization. The multidisciplinary aspect of law enforcement is also very important. The orientation to combat forestry malpractice is another important component.

Abstract

ABSTRAK Tulisan in dimaksudkan untuk menelusuri Implementasi kebijakan pemerintah dalam mewujudkan kesejahteraan masyarakat melalui pemberdayaan UMKM akibat Pandemi Covid 19 di Kota Palembang. Pembinaan yang dilakukan seperti peningkatan kualitas dan pengembangan variasi produk dengan memberikan pelatihan kepada pelaku UMKM, Program Bantuan Produktif Usaha Mikro (BPUM) untuk 6000 pelaku Usaha Mikro Kecil dan Menengah (UMKM) di Palembang serta pinjaman modal tanpa bunga bagi 4.000 pelaku Usaha Mikro Kecil dan Menengah (UMKM) yang terdampak pandemi covid-19.Kalaupun nantinya ada penelitian serupa, paling tidak penelitian ini dapat dijadikan pembanding. Kata Kunci: Kebijakan pemerintah, umkm, pandemi covid 19 ABSTRACT This paper is intended to explore the implementation of government policies in realizing community welfare through empowering MSMEs due to the Covid 19 Pandemic in Palembang City. The guidance is carried out such as improving the quality and developing product variations by providing training to MSME actors, the Micro Business Productive Assistance Program (BPUM) for 6000 Micro Small and Medium Enterprises (MSMEs) in Palembang as well as interest-free capital loans for 4,000 Micro Small and Medium Enterprises actors. Medium Enterprises (MSMEs) affected by the COVID-19 pandemic. Even if there are similar studies in the future, at least this research can be used as a comparison.
