Abstract

Law enforcement concerning the legal protection of children and women who become victims of violent crimes constitutes an important issue within the Indonesian legal system. These groups are particularly vulnerable to various forms of violence, including physical, psychological, and sexual abuse. This study aims to analyze the law enforcement measures undertaken by law enforcement officers to provide protection for victims, while also identifying the obstacles encountered during their implementation. The study employs a normative juridical method using statutory and case approaches. The research data were collected through a literature review of applicable legal provisions, including Law Number 35 of 2014 concerning Child Protection, Law Number 23 of 2004 concerning the Elimination of Domestic Violence, and Law Number 12 of 2022 concerning Sexual Violence Crimes, and were subsequently analyzed using a qualitative approach. The findings indicate that although Indonesia has established a relatively comprehensive legal framework, the implementation of legal protection for children and women continues to face several challenges. These obstacles include the limited capacity of law enforcement officers, insufficient public understanding, and the persistent influence of patriarchal culture. Therefore, stronger interinstitutional coordination, enhanced competence among law enforcement officers, and human rights-based public education are required to ensure effective protection for children and women who are victims of violence.

Abstract

Advances in information technology have brought significant benefits to society, but they have also increased the risk of cybercrime, such as the theft of personal data, online fraud, and the hacking of electronic systems. This situation raises legal issues, particularly regarding the criminal liability of perpetrators. This study aims to analyze the legal framework governing the criminal liability of cybercrime perpetrators in Indonesia, as well as the obstacles to its enforcement. The method used is a normative legal approach based on legislation and case law. The results of the study indicate that criminal liability for cybercrime is regulated under Law No. 11 of 2008 on Electronic Information and Transactions, along with its amendments. Perpetrators who intentionally and unlawfully commit acts through electronic systems may be subject to criminal sanctions. However, law enforcement is still hampered by limitations in digital evidence, a lack of technological understanding among some law enforcement officials, and difficulties in reaching perpetrators across jurisdictions. Therefore, adaptive regulatory updates and capacity building for law enforcement officials are needed to make the handling of cybercrimes more effective.

Abstract

The development of digital technology has also encouraged the rise of online gambling practices in Indonesia, especially among the younger generation, which causes financial losses, psychological disorders, and potential for illegal behavior. The problem is increasingly complex because perpetrators use technology to disguise their identities and gambling activities, making it difficult for law enforcement. This study aims to analyze the effectiveness of law enforcement against online gambling crimes and formulate a comprehensive countermeasure strategy. The research uses a normative juridical method by examining laws and regulations related to gambling, including Article 303 of the Criminal Code and the Electronic Information and Transaction Law (UU ITE). The results of the study show that law enforcement still faces obstacles in the form of difficulties in tracking digital activities, disguising the identity of perpetrators, and suboptimal coordination between institutions. Therefore, it is necessary to integrate penal and non-penal approaches through the provision of strict sanctions against the city, the application of restorative justice principles for juvenile offenders, the improvement of digital literacy, the strengthening of family supervision, and the increase of the digital forensic capacity of law enforcement officials. The participation of the community and the younger generation is needed to create a safe digital environment from online gambling practices.

Abstract

The control and supervision of alcoholic beverages constitute one of the local government's authorities aimed at protecting public health, maintaining public order, and ensuring legal certainty. This study aims to analyze the effectiveness of the Mataram City Government’s authority in controlling and supervising alcoholic beverages based on Mataram City Regional Regulation Number 2 of 2015 and to identify the factors influencing its implementation. This research employed an empirical legal method using statutory, conceptual, and sociological approaches. Data were collected through literature review and interviews with the Civil Service Police Unit (Satpol PP), the Investment and One-Stop Integrated Service Office, the Health Office, and community representatives in Mataram City, and were analyzed using a qualitative descriptive approach. The results indicate that the Mataram City Government has implemented control and supervision measures through guidance, public outreach, routine inspections, joint inter-agency operations, licensing examinations, administrative sanctions, confiscation, and destruction of illegal alcoholic beverages. However, the implementation has not been fully effective, as evidenced by the continued circulation of illegal alcoholic beverages, licensing violations, and public criticism regarding weak enforcement. The effectiveness of implementation is influenced by legal factors, law enforcement factors, facilities and infrastructure, community factors, and cultural factors. Community and cultural factors are the most dominant influences, reflected in the low level of compliance among some business actors and the persistence of permissive social attitudes toward alcohol consumption. Therefore, strengthening legal awareness, legal culture, and inter-agency coordination is essential to improve the effectiveness of regional regulation implementation.

Abstract

The implementation of clinical learning in teaching hospitals involves medical students in medical services as part of professional medical education. This condition raises ethical, legal, and healthcare quality management issues, particularly regarding the implementation of informed consent for patients. This study aims to analyze the implementation of informed consent in clinical learning at teaching hospitals from the perspectives of medical ethics, health law, and healthcare quality management, as well as to examine the legal, ethical, and quality management implications of involving medical students in medical services without optimal informed consent. This study employed a normative legal research method using statutory and conceptual approaches. The results indicate that the implementation of informed consent in clinical learning constitutes a form of patient rights protection, respect for patient autonomy, and an essential part of a healthcare system oriented toward patient safety and patient-centered care. The lack of optimal implementation of informed consent may result in legal implications in the form of civil, administrative, and criminal liability, ethical implications in the form of violations of patient autonomy, and healthcare quality management implications in the form of weak healthcare governance and an increased risk of medical disputes in teaching hospitals.

Abstract

The sale of land plots with techniques or how to do the packaging in the form of plots of land is increasingly becoming a trend in the land buying and selling business. This kapling land is often referred to as mature land or ready-to-build land, that is, the land rights holder or developer has arranged the land to be sold in such a way that it looks attractive with various promised facilities. The research carried out is normative legal research. Registration of land rights as a form of legal certainty for kaplingan land after the birth of a land rights certificate as proof of ownership of rights. The certificate will provide a guarantee of legal certainty regarding a plot of land, and a legal protection for the subject who is entitled to the land. People who are involved in the process of transferring land rights through land ownership, in order to first check the clarity of the land, the Notary/PPAT is obliged to check the land certificate before the transfer of rights is carried out at the local Land Agency Office. This is done to ensure certainty for legal subjects and objects. If it is ready to be transferred to the right of way, the kapling land must be registered at the Land Agency Office where the land is located for the process of changing the name on the certificate. This land rights certificate is valid proof of ownership of land rights.

Abstract

This study raises the issue of the limit of investigators' discretionary authority in stopping cases of minor crimes (tipiring) based on the peaceful agreement of the parties, considering that Article 205 of the Criminal Code only regulates the mechanism of rapid investigation and does not provide an explicit legal basis for the termination of cases outside the court. The practice at the Musi Rawas Police Station actually shows the termination of a number of tipiring cases through restorative justice based on Police Regulation Number 8 of 2021 and the Circular Letter of the National Police Chief Number SE/7/VII/2018, two regulations at the same level under the law. This research uses an empirical legal method with a statutory and conceptual approach, supported by interviews with investigators and studies of related regulatory documents. The results of the study show that investigators play the role of mediators as well as determinants of the continuation of cases by considering juridical and non-juridical aspects, but the practice that takes place is actually a combination of penal mediation as a process and peace as a result, not the full application of the restorative justice paradigm. Data on the handling of tipiring for the 2021–2023 period shows a downward trend in the number of cases but accompanied by fluctuations in unresolved cases, influenced by the adequacy of evidence, willingness to reconcile, involvement of community leaders, and grudges that have not subsided. This study concludes the need to strengthen the hierarchy of norms and standards for supervision of investigators' discretion so that the implementation of restorative justice does not cause disparities in handling similar cases.
