Abstract

This study analyzes the implications of marriage annulment on the status and division of joint property under Indonesian civil law. The research focuses on the dichotomy between the legal fiction in Article 28 of the Marriage Law, which states that everything applies "as if the marriage never existed," and the empirical reality of accumulated joint assets during the marriage. Using a normative legal research method, this study examines the legal vacuum created by this fiction, leading to uncertainty regarding the status of property. The findings indicate that in practice, the Supreme Court through its jurisprudence (e.g., Supreme Court Decision No. 105 K/Pdt/2016) overcomes this impasse by applying the legal construct of a civil partnership (maatschap) from the Civil Code as a basis for fair division. However, this approach still faces significant problems, including proving the origin of assets, protecting third parties in good faith, and the vulnerability of parties with non-financial contributions. The research concludes by emphasizing the urgency for legal clarification through the harmonization of jurisprudence or legislative reform to ensure legal certainty and justice for all involved parties.

Abstract

This research is motivated by the rapid advancement of digitalization, which has significantly impacted the resilience of Muslim families in Indonesia. Issues such as online infidelity, gadget addiction, and declining communication quality within households pose serious challenges to the values of sakinah, mawaddah, and rahmah as taught in Islam. Based on these problems, this study seeks to examine the ideal concept of sakinah, mawaddah, rahmah from the perspective of Islamic law, analyze the implications of digitalization on Muslim family resilience, and formulate strategies to safeguard family values in accordance with Islamic principles. The research employs a qualitative library-based approach, analyzing classical Islamic literature, legal regulations, national legislation, and contemporary social phenomena. The findings reveal that the concept of sakinah, mawaddah, rahmah requires contextual actualization in the digital era, while digitalization indeed poses serious implications for family stability. Effective strategies include strengthening communication, enhancing digital literacy, reinforcing religiosity, and adopting selective adaptation toward technology. Furthermore, the study contributes to the renewal of family law in Indonesia, ensuring its responsiveness to modern challenges.

Abstract

Child marriage remains a crucial issue in Indonesia and Malaysia even though both countries have laws restricting it. This study aims to analyze the dynamics of child marriage in the perspective of legal anthropology, focusing on the interaction between local traditions and Islamic legal regulations. Through a qualitative approach and literature study, this study found that the root of the problem of child marriage lies not only in economic and educational factors, but also in the strong influence of old-fashioned social, cultural, and religious norms that are often dialectic with formal law. In Indonesia, the existence of Law No. 16 of 2019 has not been fully effective due to the high number of marriage dispensation applications and the strong practice of elopement such as merariq. In Malaysia, state autonomy in Islamic family law creates regulatory variations and complexities in handling child marriage. This study concludes that a holistic approach through strengthening the role of religious courts, economic empowerment, inclusive education, and campaigns involving religious and customary leaders are key in breaking the chain of child marriage.

Abstract

The transfer of Hajj quotas for pilgrims who pass away before departure raises debates from both Islamic law and Indonesian positive law perspectives. This study aims to analyze the issue through three dimensions: Islamic legal views, the maqāṣid al-sharī‘ah framework, and the psychological implications for the deceased pilgrim’s family. Using a qualitative, literature-based approach, the findings indicate that quota transfer is permissible as an administrative right, not an inheritable one, provided it is implemented fairly and transparently. From the maqāṣid al-sharī‘ah perspective, such a policy supports the preservation of religion (ḥifẓ al-dīn) and life (ḥifẓ al-nafs), as long as it does not harm other pilgrims in the waiting list. Psychologically, it offers comfort to the bereaved family but requires strict supervision to prevent perceptions of injustice. Therefore, the transfer of Hajj quotas should be regulated and monitored carefully to align with justice and public welfare principles.

Abstract

This study aims to analyze the effectiveness of the security system at Class IIA West Lombok Correctional Facility, which faces multidimensional challenges. The research employed a qualitative method with a case study design. Data were collected through in-depth interviews with 15 informants (officers and inmates), participatory observation for 30 days, and documentation studies. The results revealed three key themes: (1) Severe infrastructure and human resource limitations, marked by 250% overcapacity and an officer-to-inmate ratio of 1:30, were the root cause of tension and hindered effective supervision; (2) The implementation of Dynamic Security, colored by the local wisdom of "Bethek," was effective in mitigating conflict but risked blurring formal regulations; (3) Technology adoption was hampered by low user acceptance due to inadequate training and technical obstacles. These findings conclude that the security system requires a contextual, integrated approach that harmonizes technical, human, and cultural aspects. This study recommends holistic steps, including capacity addition, the development of hybrid guidelines, and continuous training to create an effective and sustainable security environment.

Abstract

Law Number 27 of 2022 concerning Personal Data Protection provides a sound legal basis for personal data management in Indonesia. This research examines the implementation of debtor data protection by PNM, a creditor that controls and processes personal data. The aim is to evaluate the implementation of procedures in accordance with applicable regulations. News about personal data protection is increasingly vital in the modern era due to the increasing risk of debtor data leaks and misuse. The research method used is empirical juridical, combining a normative approach from laws and regulations with an empirical approach conducted through interviews with PNM, the creditor. The main focus of this study includes the roles and responsibilities of creditors, legal and operational obstacles, and steps in approval, transparency, and fulfillment of personal data subjects' rights. The results indicate that PNM, as a creditor, has implemented company policies related to transparency in data collection, intended use, and processing consent. However, in practice, the results are not always consistent. Obstacles remain, such as a lack of employee insight, system complexity, and a lack of debtor knowledge. Major obstacles also stem from internal and external factors, such as inadequate monitoring and limited debtor awareness. To address this issue, PNM implemented training, outreach, and operational system adjustments. This study emphasized the importance of strengthening regulations and public education to ensure continued data protection.

Abstract

In accordance with Article 43 of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary (UUJN), this study investigates the legal gaps pertaining to the drafting of notarial deeds in foreign languages without an official translation. This phenomenon often occurs in transactions involving foreign parties or cross-border transactions. Although the UUJN stipulates that deeds must be prepared in Indonesian and, if the parties do not understand Indonesian, an official translation must be provided, there are no detailed regulations regarding the legal consequences if this provision is ignored. As a result, legal uncertainty arises that has the potential to reduce the validity of the deed from an authentic deed to a private deed, even triggering the cancellation of the deed in a dispute. This study outlines the existing regulations, identifies the legal gaps, and analyzes their implications from the perspectives of civil law, administrative law, protection of foreign parties, and legal risks for notaries. Several case studies and court decisions indicate differing interpretations regarding the validity of foreign-language deeds without an official translation, indicating the need for clear technical guidelines. Recommendations include revising the UUJN or issuing implementing regulations by the Ministry of Law and Human Rights, as well as implementing the precautionary principle by notaries through sworn translators to ensure legal protection and certainty for the parties. The results are expected to provide an academic basis for policymakers in strengthening regulations governing the language used in notarial deeds.

Abstract

Mineral and coal mining (Minerba) is a strategic sector in the Indonesian economy, but its management practices continue to raise serious issues related to environmental damage and ecological injustice. In the context of the national energy transition towards cleaner and more sustainable energy use, existing mining legal policies are deemed not fully adaptive to the need for environmental protection and the rights of affected communities. This study aims to analyze the current legal regulations for mineral and coal mining, identify their weaknesses, and formulate a direction for legal reform that can integrate the principles of sustainability and ecological justice. Using a normative juridical approach, this study looks at several relevant laws, such as Law Number 32 of 2009 concerning Environmental Protection and Management, Law Number 3 of 2020, and Law Number 6 of 2023 about Job Creation. The results indicate an imbalance between the interests of resource exploitation and environmental protection, as well as weak recognition of the rights of local and indigenous communities. Reformulation of mining legal policies needs to be directed at strengthening sustainable development principles, enforcing ecological obligations for mining businesses, and providing regulatory support for energy diversification. These efforts must be accompanied by increased oversight and law enforcement capacity to effectively and sustainably achieve the goals of the energy transition and ecological justice.

Abstract

The development of the digital economy, including fintech, e-commerce, and Sharia-compliant digital assets, has created an urgent need for reform of Islamic law in regulating modern financial transactions. Although the basic principles of Islamic law, such as the prohibition of riba (usury), gharar (gharar), and maysir (risk of betting), as well as the provisions of Sharia contracts, serve as primary guidelines, practice demonstrates a gap between classical norms and the dynamics of the digital economy. The primary legal bases, namely the Qur'an (Qur'an, Surah Al-Baqarah: 275-279, Surah An-Nisa': 29) and the Hadith concerning buying and selling and contracts, are sometimes difficult to directly apply to digital instruments such as Sharia crowdfunding, digital tokens, and Sharia e-wallet services. Furthermore, fatwas issued by the National Sharia Council (DSN-MUI) and international standards such as AAOIFI and IFSB do not fully cover all financial technology innovations, creating legal uncertainty and challenges to Sharia compliance. Some digital transaction practices, such as the use of smart contracts, digital asset trading, and peer-to-peer lending, still require new interpretations to fulfill the principles of fairness, transparency, and equality in contracts. This research employs a normative juridical method with statutory regulations approach and Islamic legal concepts, utilizing secondary data from Islamic legal literature, national regulations, fatwas from the National Sharia Council (DSN-MUI), and AAOIFI and IFSB standards. The analysis aims to identify areas of Islamic law that must be updated or developed to accommodate innovations in the digital economy and the Islamic financial system. It also provides recommendations for regulators, academics, and practitioners in creating a digital financial ecosystem that is compliant with Islamic principles and legally secure.

Abstract

Discretion is an integral part of the authority of law enforcement officers in the modern state administration system, including within the Indonesian National Police. In the context of dynamic police duties and functions that often confront unexpected situations, discretion provides a means for officers to act swiftly to maintain public order and security. However, the use of discretion by the police also carries the potential for legal issues if not supported by a clear and measurable normative framework. The fundamental problem that arises is the indication of a legal vacuum or unclear boundaries and mechanisms for implementing such discretion, which have implications for the accountability of officers' actions in the field. The absence of detailed guidelines often leads to overlapping legal interpretations and opens up loopholes for abuse of authority. It raises an urgent need to reformulate the regulation of discretion in Indonesian police law to align with the principles of a state based on the rule of law that guarantee legal certainty, justice, and the protection of human rights. This research uses a normative juridical method, an approach that focuses on the study of primary and secondary legal materials, including laws, legal literature, and other relevant normative documents. This approach aims to analyze the concept of discretion in administrative law, evaluate applicable laws and regulations, and identify normative deficiencies in current police discretionary arrangements. With this framework, this research is expected to provide theoretical and practical contributions to the development of a more responsive and accountable police legal system
