Abstract

Abstract The existence of health law has a huge influence on national development, especially in the health sector. At this time there were so many medical crimes in the form of malpractice that happened to the community especially in the medical world, but so many people did not know between the difference between malpractice and medical risk. To find out whether what is done by medical personnel is malpractice or medical risk, therefore the authors are interested in conducting research in the form of a thesis under the title Malpractice and Medical Risk Sanctions Performed by Doctors. The research method used is a normative legal method. What can be determined by the difference between malpractice and medical risk is in the Medical Practice Law and the Medical Ethics Code is sanctions on malpractice doctors, namely medical malpractice, civil malpractice, and administrative malpractice including legal ethical violations. Malpractice is a deliberate and negligent action because it fulfills the element of error. But medical risk is not a criminal offense and includes medical accidents and accidents that have elements that cannot be predicted beforehand, cannot be prevented, and cannot be blamed. Keywords: Doctors; Malpractice sanctions; Medical Risk Abstrak Keberadaan hukum kesehatan membawa pengaruh yang sangat besar terhadap pembangunan bangsa, khususnya di bidang kesehatan. Pada masa ini begitu banyak kejahatan medis berupa tindak malpraktik yang terjadi pada masyarakat khususnya pada dunia kedokteran, akan tetapi begitu banyak masyarakat yang tidak mengetahui antara perbedaan malpraktik dan resiko medik. Untuk mengetahui apakah yang dilakukan oleh tenaga medis tersebut malpraktik atau resiko medik, maka dari itu penulis tertarik mengadakan penelitian dalam bentuk skripsi dengan judul Sanksi Malpraktik dan Resiko Medik Yang Dilakukan Oleh Dokter. Metode penelitian yang digunakan ialah metode hukum normative. Yang dapat penulis tentukan dari perbedaan yang dimiliki Sanksi malpraktik dan resiko medik ialah dalam UU Praktek Kedokteran dan UU Kode Etik Kedokteran ialah sanksi kepada dokter yang melakukan malpraktik yaitu medical malpractice, civil malpractice, daan administrative malptactice termasuk pelanggaran etik legal. Malpraktik merupakan tindakan sengaja dan lalai karena terpenuhinya unsur kesalahan. Melainkan resiko medik tidak merupakan tindak pidana dan termasuk kecelakaan medik merupakam kecelakaan yang memiliki unsur yang tidak dapat diduga sebelumnya, tidak dapat dicegah, dantidak boleh dipersalahkan. Abstract

Buying and selling is an deal between the parties about paying a certain price of an item, with the aim of transferring ownership rights. in achieving legal certainty in the sale and purchase of land rights, the parties are bound by an agreement based on an agreement made before a notary. Considering Government Ordinance Number 24 of 1997 concerning Land Registration, the transfer of rights to land only arises after the issuance of a sale and purchase deed by the Land Deed Official, then vague norm arises related imposition of tax in the binding agreement on the sale and purchase of land rights. The formulation of the problem: 1. What is the process of binding agreement on the sale and purchase of land rights related to imposition of tax? 2. What is the form of tax imposition in the agreement to buy and sell rights to land? The research method used was Normative/Literature. Binding agreement on the sale and purchase of land rights is a pre-agreement made because it relates to the imposition of tax in the case of a transfer of rights to land that must be paid in advance to order carry out transactions in the Land Deed Official. The tax imposed in the binding agreement on the sale and purchase of land rights is the income tax for the seller and the Cost of Acquiring Land and/or Building Rights for the buyer.

Abstract

A Service wash or known as laundry has made many people easier in working because it could save their daily life. However, most of the consumers are aggrieved by the standard form contract between two parties where the therms and contracts are set by one of the parties. The formulation of the problems in this study are 1. What is the form of consumer protection for laundry against laundry standard agreements? 2. What are the legal consequences if there is default on the laundry standard agreement? The research method used is an empirical method. In the case, this contract is set by the owner whose ability is higher to negotiate more favorable terms. Therefore, there is a need for legal protection for laundry consumers according to the Consumer Protection. Both parties-the owner and consumer-are wired to make deals if it is associated with the article 1320 on Indonesian Civil Code. The protections law for the consumer of the laundry service regarding to the standard form contract is the owner is obligated to pay damages if he/she is in default or tort. Whereas, if there is a default on laundry service’s strandard from contract, it can be canceled by law, because the owner should pay damages as the consumer has rights and obligations as had been regulated in article 4 and 5 of act number 8, 1999 on Consumer Protection.
