Abstract

Abstract General Principles Good governance can be a claim in the State Administrative Court even though the existence of AAUPB can be said to be juridical and not formal as described in Article 53 Paragraph 2 of Act Number 51 of 2009 concerning State Administrative Courts. In the life of the AAUPB community can be used as a basis for seeking justice, where if the community feels aggrieved by a State Administrative Decree that does not at all refer to the AAUPB and burdensome the community in making decisions or regulations applied in community life. The problems studied are: Application and how the functions that should be played by AAUPB in the decision and form of legal logic from the side of PTUN judges. If you look at the concept of a Dutch country that implements good governance, in Indonesia the entry into force of AAUPB by looking at the theoretical basis applied in the AAUPB, State Administrative Courts, and Article 53 Paragraph 2 of Law Number 51 of 2009. Results of the study: 1) In the research 06 / G / 2017 / PTUN.DPS the role of AAUPB can be seen in the principle of accuracy, the principle of legal certainty and the principle of professionalism in which officials who are authorized to make decisions regardless of the prevailing historical value. Because in terms of the principle of legal certainty, the principle of professionalism, and the principle of accuracy the decisions issued are burdensome, in this case the community is given the decision issued by the competent authority, 2) in the implementation of the AAUPB to decide a case or dispute that occurs in the Administrative Court The AAUPB country acts as a test tool used by PTUN judges to decide on a case. Conclusions from this study: 1) In the decision No. 06 / G / 2017 / PTUN.DPS implementation or AAUPB function has been running to see from the logic of the panel of judges in implementing AAUPB to decide on a dispute, 2) The judge has acted actively in searching for causes and what which becomes a case by applying AAUPB in a consideration to decide on disputes that occur, without forgetting Emersonfraise that can be used by the government in making a decision that applies to the community. Suggestions from researchers: 1) AAUPB that is used or as a basis for testing instruments for PTUN judges in deciding a case should always be accompanied by regulations that apply in accordance with legislation, 2) the panel of judges must clearly use the legal logic by applying AAUPB as Test equipment decides on a dispute that occurs in the realm of the State Administrative Court. Keywords: Article 53 paragraph (2) law number 51 of 2009; disputes; general principles of good governance; PTUN Abstrak Asas-Asas Umum Pemerintahan yang baik dapat menjadi suatu gugatan dalam Pengadilan Tata Usaha Negara meskipun keberadaan AAUPB dapat dikatakan masih secara yuridis dan belum bersifat formal seperti apa yang dijelaskan dalam Pasal 53 Ayat 2 Undang-Undang Nomor 51 Tahun 2009 tentang Peradilan Tata Usaha Negara. Dalam kehidupan masyarakat AAUPB dapat dijadikan dasar untuk mencari keadilan, dimana jika masyarakat merasa dirugikan dengan Keputusan Tata Usaha Negara yang tidak Sama sekali mengacu pada AAUPB dan memberatkan masyarakat dalam membuat keputusan atau peraturan yang diterapkan dalam kehidupan bermasyarakat. Permasalahan yang dikaji yaitu: Penerapan dan bagaimana fungsi yang seharusnya diperankan AAUPB dalam putusan dan bentuk logika hukum dari sisi hakim PTUN. Jika melihat dari konsep negara belanda yang menerapkan good governance, di Indonesia berlakunya AAUPB dengan melihat landasan teori yang diterapkan dalam AAUPB, Peradilan Tata Usaha Negara, Pasal 53 Ayat 2 Undang-Undang Nomor 51 Tahun 2009. Hasil penelitian: 1) Dalam penelitian Putusan Nomor 06/G/2017/PTUN.DPS peran AAUPB dapat terlihat di dalam asas kecermatan, asas kepastian hukum dan asas profesionalitas yang dimana pejabat yang berwenang membuat keputusan tanpa melihat nilai historis yang berlaku. Karena ditinjau dari asas kepastian hukum, asas profesionalitas, dan asas kecermatan putusan yang dikeluarkan memberatkan, dalam hal ini masyarakatlah yang diberatkan oleh putusan yang dikeluarkan oleh pejabat yang berwenang, 2) dalam penerapan AAUPB untuk memutus suatu perkara atau sengketa yang terjadi di Peradilan Tata Usaha Negara AAUPB berperan sebagai alat uji yang digunakan oleh hakim PTUN untuk memutus seuatu perkara. Simpulan dari penelitian ini: 1) Dalam putusan No 06/G/2017/PTUN.DPS penerpan atau fungsi AAUPB sudah berjalan melihat dari sisi logika majelis hakim dalam menerapkan AAUPB untuk memutus suatu sengketa, 2) Hakim sudah bertindak aktif dalam mencari sebab dan apa yang menjadi perkara dengan menerapkan AAUPB dalam suatu pertimbangan untuk memutus sengketa yang terjadi, tanpa melupakan freies emerssen yang dapat digunakan oleh pemerintah dalam membuat suatu keputusan yang berlaku bagi masyarakat. Saran dari peneliti: 1) AAUPB yang dijadikan atau sebagai dasar alat uji bagi majelis hakim PTUN dalam memutus suatu perkara harusnya selalu didampingi dengan peraturan yang berlaku sesuai dengan perundang-undangan, 2) majelis hakim harus secara jelas dalam menggunakan logika hukum dengan menerapkan AAUPB sebagai alat uji memutus suatu sengketa yang terjadi di ranah Peradilan Tata Usaha Negara. Abstract

Environmental protection and management is a systematic and integrated effort carried out to preserve environmental functions and prevent environmental pollution and/or damage which includes planning, utilization, control, maintenance, supervision and law enforcement. The formulation of the problem in this study are: How is law enforcement against perpetrators of violations of waste disposal not according to schedule based on Regional Regulation of Karangasem Regency Number 20 of 2012 concerning Waste Management and How are the obstacles and efforts made by the Government of Karangasem Regency against perpetrators of violations of inappropriate waste disposal timetable. The results of this study include: Law enforcement against perpetrators of violations of waste disposal not according to schedule based on Regional Regulation of Karangasem Regency Number 20 of 2012 concerning Waste Management, among others: Starting with the findings of the task force in the field of violations of disposing of waste not according to schedule. Violators of disposing of waste not according to schedule are subject to administrative sanctions in the form of: making a statement that they will not repeat their actions, being given warnings and warnings, being subject to forced fees, up to a recommendation to revoke the cancellation of their activities and business permits. Karangasem against perpetrators of violations of waste disposal that are not according to schedule, the obstacles faced include: The condition of infrastructure is still inadequate, causing vehicle operations to be less effective. Preventive efforts are carried out by conducting socialization, making a schedule for garbage collection. The repressive efforts are carried out, namely if there are people who violate the provisions, such as throwing garbage out of place, they will be subject to administrative sanctions by making a statement that they will not repeat their actions again.

Abstract

Land plays a very useful role for living things, so there must be national assistance to control and manage land well, evenly, and for the public interest. The question of this research is how the management of land use rights can be regulated in land reform and what are the legal implications of managing land use rights by the community. This type of investigation uses a normative legal investigation. The types and income of the data are carried out with two primary and secondary component data. The process of obtaining data employs investigations and the preparation of reviews related to the legal issues being investigated. The juridical data analysis process applied is descriptive analysis. Sources of an investigation indicate that the previous land ownership arrangements were in line with Article five of Presidential Decree No. 32, 1979. After fulfilling the requirements and relating to the interests of the people, the people are prioritized. The legal consequence of the previous owner of land rights and the law on land ownership is that if they do not extend the term of land ownership, the land itself becomes national land.

Abstract

Transportasi digunakan untuk memudahkan manusia dalam melakukan aktivitasnya sehari-hari. Menyadari hal tersebut Penyelenggara Bandar Udara harus melindungi Bandar Udara dari segala bentuk tindakan melawan hukum. Peningkatan jumlah penumpang menuntut pihak pengelola bandara untuk menjamin keamanan penerbangan. Pengelola bandara harus melakukan pemeriksaan terhadap semua penumpang dan barang bawaannya yang akan memasuki daerah terbatas bandara. Dengan ini pemerintah Indonesia menerbitkan beberapa aturan untuk penegakan hukum mengenai tanggung jawab Badan usaha Bandar Udara terhadap keamanan dan keselamatan penumpang yang diatur dalam Undang-Undang Nomor 1 Tahun 2009 tentang Penerbangan. Adapun rumusan masalah yang diangkat yakni bagaimana pengaturan hukum Badan Usaha Bandar Udara dan perihal sanksi hukum terhadap badan usaha bandar udara dalam hal standar keamanan dan keselamatan penerbangan yang tidak sesuai dengan aturan yang. Metode penelitian yang digunakan penelitian hukum normatif serta jenis pendekatan perUndang-Undangan dan pendekatan Konseptual. Hasil penelitian ini menunjukan bahwa akibat suatu Badan Usaha Bandar Udara melakukan tata cara pemeriksaan yang berbeda dan agar masyarakat mengetahui pentingnya budaya keamanan diterapkan. Kemudian mengenai sanksi yang akan dijatuhkan kepada pelaku atau suatu Badan Usaha Bandar Udara yang tidak memenuhi standar pemeriksaan yang berlaku.
