Abstract

Law violations continue to increase every year, even children become lawbreakers. Children as the next generation must be protected. Because Indonesia is a State of Law. Then the Law on Legal Aid provides legal protection for the poor. The problems of this study are 1) what is the role of LBH APIK BALI in dealing with ABH? 2) What is the effectiveness of the APIK BALI LBH in handling ABH? The research method used in this paper is empirical, namely primary data sourced from research in the field and secondary data sourced from library research in the form of legal materials. The results of the study can be concluded that: 1) LBH APIK BALI in dealing with ABH by providing assistance to children in the Litigation and Non Litigation circles. 2) LBH APIK BALI in handling ABH has not been effective, but it is in accordance with the SPPA Law. The importance of cooperation, lobbying with the government to protect ABH so that the rights of the ABH regarding the provision of legal assistance in the LBH APIK BALI are fulfilled.Keywords: Role, Legal Aid Institution, Child Criminal Justice System

Abstract

The proliferation of spa businesses in the Sanur area is expected to bring a positive competitive atmosphere among entrepreneurs to improve the quality of the services they provide. However, in practice, several spa businesses in the Sanur area do not have a tourism business registration permit. The purpose of this study is to find out (1) the implementation of a tourism business license on a spa business in the Sanur area; (2) the constraints and efforts of the Denpasar City Government in implementing tourism business permits for spa businesses in the Sanur area. The type of research used is a statutory approach and a fact approach. The results of the study show that (1) the SPA business license as an applicant must first complete the conditions that have been determined by the relevant Office, then after the conditions are valid, a review will be carried out directly at the location and then the permit is issued by the Investment Office. and Denpasar City One Stop Services on behalf of the Mayor; and (2) the legal basis for granting SPA business permits in Denpasar City Regulation No. 13 of 2015 concerning tourism business registration, the government and related agencies seek to optimize business actors to register their businesses in order to have legal certainty that is the guide in running the business. , but in the community there is a lack of information about the importance of permits in the operation of SPA businesses in the Sanur area.

Abstract

Terdapat kerentanan yang dapat dialami oleh seseorang berusia dini yaitu anak – anak dalam lingkup tindak pidana, yang dapat menjerat anak sebagai korban maupun pelaku. Suatu kebijakan diversi akan diberikan oleh penyidik jika anak yang menjadi pelaku berusia 12 tahun, akan diserahkannya anak tersebut kepada orang tua serta walinya. Rumusan permasalahan ini, 1 bagaimana pengaturan kebijakan diversi terhadap anak yang melakukan tindak pidana dan 2 bagaimana peran jaksa dalam kebijakan diversi sebagai pengalihan peradilan formal? Dalam penelitian ini memakai metode hukum normatif dan pendekatan konseptual serta pendekatan undang-undang. Simpulan dari penelitian ini yaitu pengaturan kebijakan diversi terhadap anak yang melakukan tindak pidana sebagaimana disebutkan dalam Pasal 5 ayat 3 UU No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dan peran jaksa dalam kebijakan diversi yaitu jaksa harus melihat masalah dari berbagai sudut pandang pemerintah dan masyarakat, sehingga tidak merugikan salah satu pihak. Hal ini diatur dalam ketentuan Pasal 1 UU No. 16 Tahun 2004 tentang Kejaksaan Republik Indonesia.

Abstract

Deportation is a term for an immigration administrative action against foreign nationals who enter Indonesian territory and are suspected of violating Indonesian laws and regulations or committing dangerous acts that can threaten public safety and order. The formulation of the problem raised is, How is the juridical regulation of deportation of foreign nationals in Indonesia regulated in the applicable laws and regulations, How is the juridical policy of deportation of foreign nationals? The writing method used is normative legal research method. From the results obtained, the juridical regulation of deportation of foreigners in Indonesia is regulated in Law Number 6 of 2011 concerning Immigration. Based on Article 75 paragraph (1) of the Immigration Law. The policy carried out, if proven to have committed an immigration violation, the foreign national will be given a deportation order. The deportation order is signed by the Head of Immigration Office Class I Special TPI Denpasar. Foreigners who are deported will be put on the catch list.
