Abstract

Today in the world of electronic transactions many are found deviant actions, and not based on existing legal norms, most of which occur in online buying and selling systems. Buying and selling is online buying and selling sometimes based only on trust which means the buying and selling actor is sometimes unclear, therefore many prefer COD or Cash On Delivery and or payment at the place of delivery of goods. Be careful in making payments via transfer, first research the reputation of the seller who offers goods in accordance with the posted, check the existence of the seller's offline store or the seller's business license. There is also a problem formulation (1) How is the legal arrangement regarding the actions that have been done by business actors against consumers on online buying and selling sites? (2) What criminal sanctions are imposed on perpetrators of embezzlement crimes on online buying and selling sites? This research uses normative methods because there are still vague norms, based on the opinion of legal experts. If a person has fulfilled all the elements of the crime of embezzlement, then he can be called a perpetrator.

Abstract

Arbitration is the settlement of civil disputes outside the court that bases arbitration clauses made in writing by the parties to the dispute. Arbitration clauses may be construed as individual provisions of an agreement on dispute resolution through arbitration. In resolving arbitration disputes requires the existence of arbitrators, the arbitrator is a private judge for the parties selected based on mutual agreement to resolve the dispute between them. The arbitrator who wishes to give a verdict fairly, honestly, and in accordance with the applicable provisions. The formulation of the issue discussed is how is the legal power against the phrase arbitration clause in the land buying and selling agreement ? and how is the mechanism of resolving land buying and selling disputes through arbitration ?. Research used using normative research types. Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution, dated August 12, 1999 which is intended to change the rules regarding arbitration institutions that are not in place with future developments. The establishment of a comprehensive arbitration clause is to pour out all the main elements contained in Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution.

Abstract

Effects that are included in property can also be interpreted as securities that can cause indirect losses to victims, namely investors, even though they have arrived at the court process. Therefore, to provide legal protection in the return of illegal profits and compensation funds in the capital market, Disgorgement emerged. Not only as an effort to protect, but disgorgement also seeks to provide sanctions to violators of its regulations. In this study, normative law with a statutory approach and a conceptual perspective is used. This study finds that disgorgement can provide protection in the form of return of profits from violators who receive illegal profits or who violate current regulations in the capital market sector. In addition, the legal sanctions given can also provide certainty to violators so that they cannot use and enjoy the illegal profits they get by imposing the transfer or disbursement of their assets contained in financial service institutions.

Abstract

Indonesia is a country consisting of sharing tribes, races, and cultures where each community has its own thoughts and understandings to live their lives. In carrying out his life, society is no stranger to the name of human rights where human behavior must not interfere with the rights of others and does not behave outside the norms that apply in accordance with positive laws. In carrying out a job ordinary people do it for the sake of earning income to support their families plus the needs of life that every day increase makes someone have to work hard to get income. But in the present day get income alone without getting dependents such as the absence of balance every worker must get income plus work safety dependents which later if one day happens something unwanted a worker can be dependents that will later be used for treatment and additional costs for himself and his family. The thing that happens when the situation of workers making a living is the occurrence of unwanted things where the project is stopped because the superiors commit tax evasion.

Abstract

The demand for the availability of housing needed to support the primary needs of the community, especially in the Badung Regency also continues to increase. However, the fact is that the housing development process is often not accompanied by adequate social facilities. There is a problem formulation, namely how to implement the developer's obligations in providing social facilities in Badung Regency housing and what are the obstacles to implementing the developer's obligations in providing social facilities in Badung Regency housing. The purpose of this study was to determine the implementation and development barriers. The method used in this research is empirical. There are still developers who have not fully provided social facilities in accordance with the regulations. In the provision of social facilities in Badung Regency are still several obstacles such as internal and external. The conclusion that can be drawn from this paper is that developers in Badung Regency have not fully carried out their obligations to build facilities in accordance with the site plan. the authors suggest implementing the developer's obligations in providing social facilities to run in accordance with the law, the government must carry out supervision and guidance for developers.

Abstract

Coronavirus Disease 2019 or COVID-19 is a pandemic threat that has been legally established by the World Health Organization (WHO) because it has an impact on the survival of the population. So that the Government of Indonesia issued legal regulations as an effort to overcome one of their health quarantines but still not obeyed by the public in connection with this, how is the legal arrangement on health quarantine? And what are the legal sanctions against someone who is fleeing health quarantine? This research uses normative research methods. The basis of the Health Protection and Quarantine Law in the 1945 Constitution stipulates that a prosperous life is born and inner, living, and getting a good and healthy living environment and entitled to health services is a community right. Those who violate the legal regulations that have been imposed in this pandemic situation get verbal reprimands, written reprimands, and administrative sanctions.

Abstract

Legian Traditional Village has experienced the influence of the globalization process. Awig-Awig is a traditional village which is used to regulate the welfare of indigenous peoples and the sustainability of traditional villages in maintaining traditions and culture in the midst of tourism development. The formulation of the problem: 1) What is the position and function of the Awig-Awig in Legian Traditional Village in preserving cultural tourism in the era of globalization? 2) What are the efforts to filter the negative impacts of globalization in preserving cultural tourism in the Legian Traditional Village?. This study uses empirical legal research methods. The results of the study indicate that the position and function of the Awig-Awig in Legian Traditional Village is able to coexist with the globalization paradigm. The globalization process accompanied by the strengthening of Awig-Awig which is implemented based on Palet 5 Indik Drewen Pawos Village 26, as a reference for preserving cultural tourism in the Legian Traditional Village. Efforts to filter the negative impacts that occur, it is necessary to maintain the socio-cultural aspect by filtering the incoming culture and strengthening the preservation of culture with local wisdom referring to the Awig-Awig contained in Palet 5 Indik Drewen, Pawos Village 26.

Tourism affairs are one of the elective matters that are closely related to the superior potential and regional peculiarities This research is important to do with the aim of knowing the setting of sanctions against unlicensed tour guides in the field of travel agencies regulated in the Bali Provincial Regulation Number 5 of 2016 This research will be carried out using normative legal research, normative legal research is used because it examines and analyzes laws tourism Setting Sanctions Against Unlicensed Tour Guides in the Field of Travel Bureaus Regulated in the Bali Provincial Regulation in accordance with Regional Regulation Number 5 of 2016 Article 15 paragraphs (1) and (2) states that : Every General Tour Guide as referred to in Article 2 letter a, is required to have an KTPP to carry out tourist guiding duties Everyone who violates the provisions as referred to in Article 3 paragraph (1) shall be punished with imprisonment for a maximum of 3 (three) months or a fine of a maximum of Rp.50,000,000 as for Administrative Sanctions in the form of verbal warnings and freezing of KTPP.

Abstract

The issues raised in this study include the legal arrangements of PPATK as a unit of Indonesian Financial Intelligence and the roles and responsibilities of PPATK to prevent money laundering in the banking system in Indonesia. The writing of this thesis uses the research method of collecting normative literature data (library research) along with collecting data and reading references through regulations, the internet and other sources, then selecting the appropriate data to support the writing. The result of this study is that PPATK as an agency established for the prevention and eradication of money laundering crimes has been extended with the enactment of Law Number 8 of 2010 concerning the Prevention and Eradication of the Crime of Money Laundering. One of them is PPATK to temporarily suspend suspicious financial transactions. PPATK plays a role in maintaining financial system stability, especially the Indonesian economic system and is responsible for efforts to eradicate money laundering in the banking system in Indonesia.

Abstract

The rapid advancement of information and communication technology has made it easier for some unscrupulous business actors to do online business illegally in cryptocurrency, cryptocurrency itself is a digital asset on the internet. The problem that can be raised is, how is the legal protection for investors against illegal online businesses? And what are the legal consequences for business actors who do illegal online business? This thesis uses a normative legal research method and uses a conceptual approach and legislation. After conducting research, it is known that cyber crime is difficult to overcome by the government which only relies on conventional positive law. There are two forms of legal protection for investors, namely, preventive and repressive legal protection. Based on the Consumer Protection Act, investors can file a class action lawsuit against business actors who conduct online business illegally, especially in the case of cryptocurrencies. The legal consequences for business actors who conduct online business illegally in cryptocurrencies are contained in Bappebti regulation 5/2019, precisely in Article 21 Paragraph 2.
