Abstract

Objective: This paper explores sociolinguistic variation in code switching behaviour among bilingual speakers in the academic subjects. Through the research, the most prevalent forms of code-switching will be identified, discuss social and contextual factors that affect language alternation, and investigate the ways bilingual speakers use language alternation as a communicative tool in the process of academic engagement. Method: The research design used in the study is mixed method (quantitative and qualitative research design). The data were gathered on 60 bilingual subjects, comprised of students of undergraduate level and postgraduate level, as well as academic instructors of different academic fields. The data were collected using three primary tools, i.e., semi-structured interviews, recorded academic interaction, and questionnaires that addressed the language use and attitudes to code-switching. Results: The results indicate that the process of code-switching is a common and regular characteristic of the academic communication in bilinguals. Out of the various types of switching established, intra-sentential switching was most common followed by inter-sentential switching and tag-switching was least common. Academic disciplines also showed some differences with the participants in humanities and social sciences showing more code-switching than the participants in applied sciences. Novelty: In general, the results of this research indicate that code-switching cannot be regarded as a lingual drawback but as an effective communicative tool that bilingual speakers apply to negotiate between academic speech and interpersonal communication.

Abstract

Objective: The Free Nutritious Meal Program (Program Makan Bergizi Gratis/MBG) is a government policy aimed at improving the nutritional status of the community, particularly students, toddlers, pregnant women, and breastfeeding mothers, as part of the effort to develop healthy and high-quality human resources. In its implementation, the program continues to face several legal issues, including the absence of comprehensive legal protection for beneficiaries and the lack of clear legal provisions governing liability when losses occur, such as food poisoning incidents during the implementation of the program. This research examines the legal framework governing the protection of beneficiaries of the Free Nutritious Meal Program and the legal liability of service providers in implementing the program. The objective of this research is to analyze the legal framework, the forms of legal protection, and the effectiveness of legal protection for the beneficiaries of the Free Nutritious Meal Program in safeguarding their rights. Method: This study employs normative legal research using the statutory approach and conceptual approach. The legal materials consist of primary, secondary, and tertiary legal sources collected through library research and analyzed qualitatively using legal interpretation methods. Results: The results indicate that legal protection for beneficiaries of the Free Nutritious Meal Program has been regulated under various laws and regulations concerning food, health, consumer protection, and the National Nutrition Agency. Such protection is provided through preventive legal measures, including supervision of food safety, quality standards, and program implementation, as well as repressive legal protection through dispute resolution mechanisms and administrative, civil, and criminal liability in cases of legal violations. Legal liability in the implementation of the program is borne not only by the government as the organizer but also by service providers according to their respective duties, functions, and authorities. Novelty: Nevertheless, the existing legal framework still requires more comprehensive regulations to clearly define the allocation of responsibilities and legal accountability in order to ensure legal certainty, effective protection for beneficiaries, and accountable implementation of the Free Nutritious Meal Program.

Abstract

Objective: This study aims to analyze the legal regulation of the digital economy in financial technology in Indonesia, the effectiveness of existing regulations, consumer legal protection, as well as challenges and the ideal concept for strengthening fintech regulations in the future. Method: This research employs a normative legal research method using statutory and conceptual approaches. The legal materials consist of primary, secondary, and tertiary legal sources analyzed qualitatively. Results: The results indicate that fintech regulation in Indonesia has been supported by various legal instruments, including Law Number 1 of 2024 concerning Electronic Information and Transactions, Law Number 27 of 2022 concerning Personal Data Protection, Law Number 4 of 2023 concerning Financial Sector Development and Strengthening, as well as regulations issued by the Financial Services Authority and Bank Indonesia. Based on the Theory of Legal Certainty, these regulations have provided legal certainty for both providers and consumers, although there remain issues related to regulatory overlap and legal gaps concerning emerging technologies. Based on the Theory of Legal Effectiveness, the effectiveness of fintech regulation is still challenged by illegal online lending activities, personal data breaches, cybercrime, and low levels of digital financial literacy. Based on the Theory of Legal Protection, consumer protection has been implemented through preventive and repressive mechanisms; however, stronger measures are still needed in personal data protection and supervision of fintech providers. Novelty: This study concludes that strengthening fintech regulation requires regulatory harmonization, enhancement of the regulatory sandbox mechanism, stronger personal data protection, regulation of Artificial Intelligence in digital financial services, and the improvement of digital financial literacy through collaboration among the government, the Financial Services Authority, Bank Indonesia, and higher education institutions.
