Abstract

Law enforcement in Indonesia continues to face challenges in balancing procedural legal certainty and substantive justice. A predominantly legalistic approach often produces decisions that are legally valid but do not fully reflect society's sense of justice. This study analyzes the relationship between procedural legal certainty and substantive justice and examines the role of progressive law and restorative justice in promoting fair law enforcement. The research employs a normative legal method using statutory, conceptual, and case approaches. Legal materials were collected through library research, including legislation, legal doctrines, scholarly articles, and official documents, and analyzed qualitatively using deductive legal reasoning. The findings show that procedural legal certainty and substantive justice are complementary principles. Progressive law functions as an interpretative paradigm, while restorative justice serves as an implementation mechanism that integrates legal certainty, justice, and utility. This study proposes a conceptual harmonization model that positions legal certainty as the normative foundation, progressive law as the interpretative paradigm, restorative justice as the dispute resolution mechanism, and substantive justice as the ultimate objective of law enforcement. The model is expected to guide policymakers and law enforcement agencies in developing a more adaptive, humane, and just legal system.

Abstract

This article examines the uncertain boundary between contractual authority held by employees of state-owned banks and the abuse-of-authority element under Article 3 of the Corruption Law. It focuses on Jambi District Court Decision Number 36/Pid.Sus-TPK/2025/PN Jmb concerning manipulated documents for People’s Business Credit (KUR) financing at PT Bank Syariah Indonesia Tbk. This normative legal study applies statutory, conceptual, and case approaches. Primary legal materials are examined through grammatical, systematic, and teleological interpretation and through reconstruction of the ratio decidendi of the trial and appellate decisions. The study finds that the courts’ reliance on Article 2 paragraph (1), rather than Article 3, is doctrinally defensible because Article 2 paragraph (1) does not require proof that the defendant’s authority originated in public law. Liability nevertheless requires proof of an unlawful act, enrichment, culpability, causation, and actual state financial loss. Constitutional Court Decisions Number 48/PUU-XI/2013 and Number 62/PUU-XI/2013 confirm that separated state capital remains within state finances, while business management must still be assessed under business-judgment principles. The novelty of this article is a four-stage qualification test covering the source of authority, the status and actuality of loss, culpability and causal connection, and selection of the appropriate criminal-law regime. This test offers a more precise basis for distinguishing corruption from contractual breaches, banking offences, and ordinary crimes.

Abstract

The number of higher education students in Indonesia working full-time is rising, driven by pursuits of financial independence and career experience, yet balancing these dual roles often creates time management constraints that negatively affect academic performance and mental health. This study aims to explore and analyze in depth the dimensions of work-life balance (WLB) among working students using a qualitative method with a phenomenological approach. Informants comprised three unmarried, active undergraduate Psychology students (aged 22–25) in Kudus Regency who work full-time; data were collected through structured interviews, direct observation, and documentation, then analyzed using the constant comparative method covering data reduction, categorization, synthesis, and working hypothesis formulation, with credibility established through source triangulation. Findings show that under Work Interference with Personal Life (WIPL), informants reported chronic fatigue that reduced sleep, hobbies, and personal time, while under Personal Life Interference with Work (PLIW), toxic romantic conflicts and academic procrastination emerged as major distractions that lowered concentration and work productivity. Conversely, under Personal Life Enhancement of Work (PLEW) and Work Enhancement of Personal Life (WEPL), family support, salary appreciation, and peer flexibility served as positive coping mechanisms that restored emotional energy, boosted confidence, and sustained academic and professional motivation. Overall, working students' work-life balance is largely shaped by personal emotional regulation and the strength of their environmental support systems in managing dual-role pressures.

Abstract

Social media has become an influential digital public sphere in shaping public perceptions of local government policies, including those of the Makassar City Government. Advances in communication technology have transformed government communication from a one-way model into a more open, rapid, interactive, and participatory process. This study aims to analyze public perception formation through social media regarding Makassar City Government policies by examining digital communication patterns, public responses, opinion dynamics, and challenges in managing digital information. The study employs a descriptive qualitative approach through a literature review and analysis of relevant digital documentation concerning social media, government communication, public opinion, and local government policies. The findings show that social media plays a strategic role in expanding policy communication, accelerating information dissemination, and providing opportunities for public participation. However, it also presents challenges, including disinformation, public misunderstanding, opinion polarization, and negative perceptions when government communication is not managed adaptively and responsively. These findings highlight the importance of informative, transparent, dialogical, and ethical social media-based public communication to promote objective public understanding. Practically, the findings can guide the Makassar City Government in developing participatory digital communication strategies, strengthening public information management, anticipating disinformation, building public trust, and increasing public acceptance of policies. The study contributes theoretically to digital government communication and provides a reference for local governments in developing adaptive and responsive public communication policies in the digital era.

Abstract

This study examines public sentiment and responsibility attribution toward LPDP as a public institution in a social media controversy involving one of its alumni. Drawing on Attribution Theory and digital crisis communication, this study argues that reputational risk is shaped not only by negative sentiment but also by how public responsibility is attributed to individuals and institutions. A descriptive quantitative approach was applied using computational sentiment analysis and text-based attribution analysis. Data were collected from Twitter/X through scraping with the keyword “LPDP Dwisasetyaningtyas” during 20 February–6 March 2026”. A total of 106 tweets were processed using the Knowledge Discovery in Databases (KDD) stages: data selection, preprocessing, transformation, analysis, and interpretation. The results show that neutral sentiment dominated the conversation at 82.08%, followed by negative sentiment at 15.09% and positive sentiment at 2.83%. Attribution analysis shows that individual attribution appeared in 100% of tweets, institutional attribution in 89.62%, moral attribution in 61.32%, and systemic attribution in 10.38%. These findings indicate that the LPDP controversy is better understood as a reputational issue based on visibility and attribution rather than merely a crisis driven by negative sentiment.

Abstract

Within local culture-based institutions like Persaudaraan Setia Hati Terate (PSHT), organizational communication is vital for shaping public perception. This study explores how PSHT Komisariat Padepokan Madiun utilizes the SMCRE (Source, Message, Channel, Receiver, and Effect) framework to strengthen its community reputation. Adopting a descriptive qualitative method, data were gathered through extensive interviews, field observations, and documentary reviews. Five key informants including the branch committee head, secretary, treasurer, instructor, and a local resident representative were chosen via purposive sampling. To maintain data integrity, the study cross-verified findings using source and method triangulation, followed by data reduction, layout formatting, and final synthesis. The analysis reveals that the organization’s positive standing relies on four pillars: the trustworthiness of its leadership as information sources, core messaging centered on moral growth and brotherhood, a hybrid approach of face-to-face and digital outreach, and hands-on civic engagement. Ultimately, the paper concludes that a well-rounded communication approach successfully reshapes how the public views PSHT-elevating its identity from a standard martial arts club to a prominent hub for character building and community service.

Abstract

This study aims to describe the level of active lifestyle culture among Generation Z Strava users in Bandung City, a topic that remains rarely examined in this specific local context. The novelty of this article lies in positioning active lifestyle culture as a construct measured through three indicators simultaneously, namely the regularity of physical activity, the habituation of physical activity in daily life, and health values and responsibility, rather than mere exercise frequency. This study employed a descriptive quantitative approach using a Likert-scale questionnaire distributed to 150 Generation Z respondents from two sports communities in Bandung City. The six-item instrument was valid and reliable (Cronbach's Alpha of 0.851). The total variable score fell into the high category (mean of 23.51 within a theoretical range of 6-30), with 74.67% of respondents in the high category and a smaller proportion in the moderate and low categories. These findings indicate that the respondents studied tend to demonstrate regularity, habitual engagement, and value-based awareness in maintaining an active lifestyle, underscoring the potential of digital fitness applications as a medium that supports the formation of this culture among urban Generation Z.

Abstract

This study aims to analyze the forms of gender discrimination experienced by female characters in the novel Nyai Gowok by Budi Sardjono, examined through the lens of postcolonial feminism. The scope of the study covers the representation of subordination, marginalization, and silencing of women resulting from the collaboration between local patriarchal structures and the legacy of colonial hegemony. This research employs a qualitative approach using a descriptive-interpretive literary textual analysis method. The theoretical framework applied is postcolonial feminism, particularly Gayatri Chakravorty Spivak's concept of the subaltern and the notion of double colonization. The data are drawn from narrative excerpts, dialogues, and events in the novel that represent gender discrimination against the characters Nyai Lindri and Martinah. The findings show that gender discrimination operates through three mutually reinforcing mechanisms: (1) direct silencing, manifested in physical violence, sexual violence, and explicit customary regulations; (2) symbolic silencing, occurring through language, labeling, and traditions that internalize subordination; and (3) misrepresentation, which distorts women's identities into objects of masculine interest.

Abstract

Transformasi digital administrasi pertanahan melalui penerapan sertifikat tanah elektronik merupakan bagian dari reformasi pelayanan publik yang bertujuan meningkatkan efisiensi, transparansi, dan kepastian hukum. Namun, implementasinya masih menghadapi berbagai persoalan normatif, seperti fragmentasi regulasi, perlindungan hak keperdataan, keamanan sistem elektronik, dan tata kelola data. Penelitian ini bertujuan menganalisis kepastian hukum sertifikat tanah elektronik dalam sistem pendaftaran tanah digital di Indonesia serta merumuskan model rekonstruksi berbasis Good Digital Governance. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan perbandingan hukum. Data berupa bahan hukum primer, sekunder, dan tersier dianalisis secara kualitatif melalui interpretasi sistematis, analisis komparatif, dan sintesis hukum. Hasil penelitian menunjukkan bahwa kepastian hukum sertifikat tanah elektronik belum terwujud secara optimal akibat kesenjangan normatif, fragmentasi regulasi, dan belum terintegrasinya prinsip-prinsip Good Digital Governance dalam penyelenggaraan administrasi pertanahan digital. Penelitian ini menghasilkan Model Rekonstruksi Kepastian Hukum Sertifikat Tanah Elektronik Berbasis Good Digital Governance yang mengintegrasikan kepastian regulasi, perlindungan hak keperdataan, akuntabilitas kelembagaan, keamanan siber, interoperabilitas data, dan perlindungan data pribadi dalam satu kerangka konseptual. Model tersebut memberikan kontribusi teoretis bagi pengembangan hukum pertanahan digital serta rekomendasi normatif untuk memperkuat sistem administrasi pertanahan digital di Indonesia.

Abstract

This study analyzes the policy dynamics of Regional Regulation Number 12 of 2010 concerning the Regional Spatial Plan (RTRW) of Pasuruan Regency for 2010 to 2029, focusing on the conversion of conservation land for development. As one of East Java's strategic growth areas, Pasuruan Regency faces increasing pressure to balance economic development and environmental sustainability. The novelty of this study is the application of William N. Dunn's policy evaluation framework to assess long-term spatial planning implementation and identify governance gaps. A descriptive qualitative approach was employed. Data were collected through observation, documentation, and in-depth interviews with representatives of Bapperida, the Public Works and Spatial Planning Office, ATR/BPN, and environmental organizations. Data were analyzed using interactive qualitative analysis through data condensation, data display, and conclusion drawing and verification. The evaluation covered effectiveness, efficiency, adequacy, and equity. The findings reveal significant implementation gaps. The regulation has not effectively controlled conservation and agricultural land conversion, while OSS and KKPR implementation remains constrained by outdated spatial data, weak inter-agency coordination, and limited monitoring. The regulation is also inadequate to address development pressures, and its benefits remain unevenly distributed. The study recommends revising regional spatial regulations, strengthening coordination, improving spatial data governance, enhancing monitoring and law enforcement, and expanding public participation to support adaptive and sustainable spatial planning.
