Abstract

Tujuan penelitian ini adalah untuk menjelaskan dan menganalisa pandangan fiqh klasik terhadap usia minimal kawin, landasan filosofis penentuan batas usia minimal kawin dalam Undang-Undang Perkawinan Nomor 1 Tahun 1974, serta analisis tinjauan maqȃshid asy-syarî’ah terhadap pembatasan usia minimal kawin menurut Undang-Undang Perkawinan. Jenis penelitian adalah studi pustaka. Pendekatan penelitian yang digunakan adalah pendekatan kualitatif. Teknik pengumpulan data yang peneliti lakukan adalah teknik kepustakaan. Hasil penelitian adalah bahwa dalam fiqh klasik tidak ditentukan secara jelas dan tegas mengenai batas usia minimal. Begitu pula dengan penafsiran kriteria dewasa menurut undang-undang. Landasan filosofis penentuan batas usia minimal kawin yang terdapat dalam Undang-Undang Perkawinan Nomor 1 Tahun 1974 memiliki latar belakang yang panjang dan dipengaruhi oleh unsur (tuntutan) seperti sosialpolitik, budaya, ekonomi dan agama. Sedangkan analisis tinjauan maqȃshid alsyarî’ah terhadap pembatasan usia minimal kawin menurut undang-undang perkawinan dari sudut pandang kulliyat al-khamsah (lima prinsip umum) Maqȃshid Al-Syarî’ah pembatasan usia minimal kawin terkait dengan memelihara agama, jiwa, dan keturunan. Dalam memelihara agama, menikah adalah salah satu bentuk menegakkan syiar-syiar Islam. Dalam hal memelihara jiwa, maka sejalan dengan prinsip yang diletakkan UU Perkawinan. Serta dalam hal memelihara keturunan maka, Islam mengaturnya dengan cara mensyariatkan pernikahan dan mengharamkan zina.

Abstract

Abstract: This study examines the practice of marriage postponement among career women in Medan Kota District and analyzes it from an Islamic legal perspective. The issues discussed are the factors driving marriage postponement and how these reasons are positioned within Islamic legal considerations. This study uses a qualitative approach with an empirical normative design. Data were obtained through interviews, observations, and document reviews, then analyzed descriptively and interpretively to connect field findings with relevant Islamic legal concepts. The results indicate that marriage postponement is generally influenced by an orientation toward economic stability, self-development, educational attainment, and work demands and family expectations. Under Islamic law, marriage postponement is not automatically prohibited, but it becomes problematic when it triggers a violation of religious ethical boundaries or opens up the risk of greater harm. Therefore, marriage postponement can be viewed as a permissible choice if it is based on rational considerations, accompanied by the ability to protect oneself, and directed toward achieving benefits and preventing harm.Keywords: marriage postponement, career women, Islamic law, Medan Kota, empirical normative. Abstrak: Penelitian ini mengkaji praktik penundaan perkawinan pada wanita karier di Kecamatan Medan Kota serta menganalisisnya dalam perspektif hukum Islam. Masalah yang dibahas adalah faktor-faktor yang mendorong penundaan perkawinan dan bagaimana alasan tersebut diposisikan dalam pertimbangan hukum Islam. Penelitian ini menggunakan pendekatan kualitatif dengan desain normatif empiris. Data diperoleh melalui wawancara, observasi, dan telaah dokumen, lalu dianalisis secara deskriptif interpretatif untuk menghubungkan temuan lapangan dengan konsep-konsep hukum Islam yang relevan. Hasil penelitian menunjukkan bahwa penundaan perkawinan umumnya dipengaruhi oleh orientasi pada stabilitas ekonomi, pengembangan diri, pencapaian pendidikan, dan tuntutan kerja serta ekspektasi keluarga. Dalam hukum Islam, penundaan perkawinan tidak otomatis terlarang, namun menjadi bermasalah ketika memicu pelanggaran batas etika agama atau membuka risiko kerusakan yang lebih besar. Karena itu, penundaan perkawinan dapat dipandang sebagai pilihan yang dibolehkan apabila didasarkan pada pertimbangan yang rasional, disertai kemampuan menjaga diri, dan diarahkan pada tercapainya kemaslahatan serta pencegahan kemudaratan.Kata Kunci: penundaan perkawinan, wanita karier, hukum Islam, Medan Kota, normatif empiris.

Abstract

Abstract: Penelitian ini diadakan di Kota Arga Makmur dengan mengangkat permasalahan apa penyebab muncul anak jalanan di kota Arga Makmur dan bagaimana tinjauan hukum keluarga Islam terhadap layanan Pemerintah Daerah Bengkulu Utara terhadap anak jalanan di Kota Arga Makmur. Untuk menjawab permasalahan tersebut, jenis penelitian yang yuridis empiris. Data didapat melalui informan anak jalanan dan dinas sosial dengan mengunakan metode pengamatan, wawancara mendalam dan pengumpulan data sekunder, kemudian setelah data didapat dilakukan rekotruksi bahan dengan dianalisis secara yuridis kualitatif dengan metode deduktif dan induktif. Dari hasil penelitian menunjukan bahwa 1) penyebab munculnya anak jalanan di kota Arga Makmur disebabkan karena faktor ekonomi, faktor kemauan sendiri (kemandirian), dan faktor budaya (kebiasaan), faktor orang tua. 2) Islam telah memberikan petunjuk kepada umatnya untuk memberikan perlindungan terhadap anak-anaknya. Islam tidak pernah menyebutkan dan menyinggung tentang perbedaan gender dan jenis kelamin dari seorang anak. Maksudnya, semua anak mendapatkan porsi dan hak yang sama untuk dilindungi demi perkembangan dan pertumbuhan anak secara wajar, baik dari segi fisik maupun mental dan sosialnya, hal ini sejalan apa yang dilakukan oleh Pemerintah Bengkulu Utara dalam memberikan pemeliharaan dan perlindungan terhadap anak jalanan agar dapat terpenuhi segala kebutuhan hidupnya dengan cara yang telah terprogram, dengan cara; a) Melakukan pembinaan, b) melakukan kegiatan rehabilitasi sosial yang dilaksanakan oleh dinas sosial yang bekerja sama dengan lembaga-lembaga pusat rehabilitasi untuk anak jalanan, gelandangan, pengemis, dan pengamen dilakukan dalam kurung waktu tertentu, c) melaksanakan proses penguatan keluarga yang dilakukan secara terencana dan terarah melalui kegiatan bimbingan dan pelatihan keterampilan, d) melaksanakan bimbingan lanjutan untuk memonitoring dan evaluasi hasil kinerja secara terencana dan berkesinambungan, e) dibutuhkan peran serta masyarakat dalam memberi perlindungan hukuk kepada anak jalanan. Kata Kunci: Perlindungan Hukum, Anak Jalanan Abstrak: This research was conducted in the City of Arga Makmur by raising the problem of what causes the emergence of street children in the city of Arga Makmur and how the Islamic family law review of the services of the North Bengkulu Regional Government for street children in the City of Arga Makmur. To answer this problem, the type of research is juridical empirical. Data obtained through street children informants and social services using the method of observation, in-depth interviews and secondary data collection, then after the data is obtained, material reconstruction is carried out by being analyzed in qualitative juridical ways with deductive and inductive methods. The results showed that 1) the cause of the emergence of street children in the city of Arga Makmur was due to economic factors, self-will (independence), cultural factors (habits), parents’ factors. 2) In Islam street children are known as laqit, the North Bengkulu Government has provided maintenance and protection for street children so that all their daily needs can be fulfilled in a programmed manner, namely; a) Conducting coaching, b) providing further coaching by continuing to patrol in public places in the City of Arga Makmur, especially places where there are indeed many street children, c) carrying out social rehabilitation activities, d) carrying out the process of strengthening the family which is carried out in a planned and directed through guidance and skills training activities, e) carry out further guidance to monitor and evaluate performance results in a planned and continuous manner, f) community participation is needed so as not to give money to street children. Abstract

After the issuance of the decision of the Constitutional Court Number  46/PUU-VIII/2010, Article 43 of Law Number  1Year 1974 concerning Marriage which originally stated that the married child has only a civil relationship with his mother and his mother’s  family, has blood  relation  including  civil relationship with father his biological and his father’s family although there  must  be recognition or can  be proven  on the basis  of science and  technology and/or  other  evidence. The decision of the Constitutional Court can  be seen from two sides,  namely  the protection of the rights of the married child, and  the conformity  of the  understanding of the  child outside of marriage according to Islamic  law, because according to Islamic law the  child outside marriage should  not at all have  a nasab relationship with his biological  father.  Based  on the  above background, this research reveals  two issues,  firstly how the legal power  of the Constitutional Court decision regarding the outsider marriage perspective of Law Number  35 year 2014 on Child Protection. Second, what is the conformity between the Constitutional Court decision No. 46/PUU-VIII/2010 concerning the married child against the provision of an outsider from the perspective of Islamic law. This type of research is normative juridical research or library research which  is then described descriptively.  The results of this study conclude that the legal force of the Constitutional Court decision is binding (final and binding).  Recognition  of the rights of children  outside marriage shall be exercised by all parties  concerned, in accordance with Article 59 paragraph 2 letter o Law No. 35 of 2014 on Child Protection, that every child has the right to survival, growth and development and is entitled to protection from violence and discrimination, including special protection to children  who are victims of stigmatization from labeling related to the condition of their parents. Meanwhile,  if you look at the provisions in Islamic law, the decision of this Constitutional Court should be adjusted to the understanding of children  outside marriage in Islamic law, because the Constitutional Court decision is a law made man,  while Islamic law is a law that comes from Allah SWT. It is also important to revise Article 2 paragraph (2) on the provision of marriage registration as a legal marriage requirement to be only an administrative requirement. “Outer Child Marriage, Constitutional Court and Islamic Law”.

Abstract

Abtstract : The aims of this research are: First, to find out whether working women in Lubuk Pinang District, Mukomuko Regency position the period of ihdad from a maslahah perspective. Second, to find out the obstacles to ihdad for working women in Lubuk Pinang District, Mukomuko Regency from a maslahah perspective. This type of research is descriptive qualitative research. This research concludes that: First, the realization of ihdad for women who work after the death of their husbands in Lubuk Pinang District, Lubuk Pinang is not yet perfect due to job demands. Ihdad, a working woman whose husband died in Lubuk Pinang District, is more focused on maintaining family life because of the necessities of life that must be met. There are three categories of ihdad realization, namely: not knowing ihdad and not implementing ihdad, knowing but not implementing ihdad and knowing and implementing ihdad.  Second, the obstacles to ihdad for working women whose husbands have died in Lubuk Pinang District consist of the economy and job demands, their husband's knowledge and work during life are included in maslahah al-dharuriyat which is directly related to basic human needs both in this world and the hereafter.Keywords: ihdad, women, maslahah. Abstrak : Tujuan penelitian ini adalah : Pertama, untuk mengetahui perempuan pekerja di Kecamatan Lubuk Pinang Kabupaten Mukomuko memposisikan masa ihdad perspektif maslahah. Kedua, untuk mengetahui hambatan ihdad bagi perempuan pekerja di Kecamatan Lubuk Pinang Kabupaten Mukomuko perspektif maslahah.. Jenis penelitian ini adalah penelitian deskriptif kualitatif. Penelitian ini menyimpulkan bahwa: Pertama, Realisasi ihdad perempuan yang bekerja setelah kematian suami di Kecamatan Lubuk Pinang Lubuk Pinang belum sempurna dikarenakan adanya tuntutan pekerjaan. Ihdad perempuan pekerja yang ditinggal mati suami di Kecamatan Lubuk Pinang lebih fokus pada menjaga kehidupan keluarga karena kebutuhan hidup yang harus dipenuhi. Ada tiga katagori realisasi ihdad yaitu: tidak mengetahui ihdad dan tidak menjalankan ihdad, mengetahui tapi tidak menjalankan ihdad dan mengetahui dan menjalankan ihdad.  Kedua, Hambatan ihdad bagi perempuan pekerja yang ditinggal mati suaminya di Kecamatan Lubuk Pinang terdiri dari Ekonomi dan tuntutan pekerjaan, pengetahuan dan pekerjaan suami semasa hidup termasuk ke dalam maslahah al-dharuriyat yang berhubungan langsung dengan kebutuhan dasar manusia baik di dunia maupun akhirat.Kata Kunci : ihdad, perempuan, maslahah.

Abstract

Abstract: Family is the forerunner of the most basic character formation. The attitude of educating children in a family is very influential on the next life. Therefore, families must be ready and able to face the challenges of the times. The industrial revolution 4.0 has a great influence on families. Challenges and temptations that easily infiltrate family life through technology, communication, and information. As well as the torrent of materialism brought major changes in patterns of life and attitudes of daily behavior. Therefore, it is necessary to conduct research in order to answer the challenges that occur in the family environment. This paper is the result of qualitative research from various data sources (works): books, journals, and articles that discuss families in facing the era of the industrial revolution 4.0. From this research, it produces impacts and various kinds of offers that can be used in responding to the industrial revolution 4.0, especially in the family sector. The impacts that occur due to the industrial revolution 4.0 in the field of family law include: concentration of family members focused on seeking pleasure, lack of parental attention, tendency to use gadgets excessively, breaking up of the whole family system, materialistic life. To respond to this impact, there are several offers that are considered capable of responding to the era of the industrial revolution 4.0 including: fostering mutual understanding, actualizing roles, presenting awards, positive and effective communication, instilling a positive discipline attitude and building a quality generation. Keywords: Family, Industrial Revolution 4.0, Family Resilience. Abstrak: Keluarga merupakan cikal bakal pembentukan karakter yang paling mendasar. Sikap mendidik anak dalam sebuah keluarga sangat berpengaruh pada kehidupan selanjutnya. Oleh karena itu, keluarga harus siap dan mampu menghadapi tantangan zaman. Revolusi industri 4.0 memiliki pengaruh yang besar bagi keluarga. Tantangan dan godaan yang dengan mudahnya menyusup ke dalam kehidupan keluarga melalui teknologi, komunikasi, dan informasi. Serta derasnya materialisme membawa perubahan besar dalam pola hidup dan sikap perilaku sehari-hari. Oleh karena itu, perlu dilakukan penelitian guna menjawab tantangan yang terjadi di lingkungan keluarga. Tulisan ini merupakan hasil penelitian kualitatif dari berbagai sumber data (karya): buku, jurnal, dan artikel yang membahas tentang keluarga dalam menghadapi era revolusi industri 4.0. Dari penelitian ini menghasilkan dampak dan berbagai macam penawaran yang dapat digunakan dalam menyikapi revolusi industri 4.0 khususnya di sektor keluarga. Dampak yang terjadi akibat revolusi industri 4.0 di bidang hukum keluarga antara lain: konsentrasi anggota keluarga yang terfokus pada mencari kesenangan, kurangnya perhatian orang tua, kecenderungan untuk menggunakan gadget secara berlebihan, putusnya seluruh sistem keluarga, kehidupan materialistis. Untuk merespon dampak tersebut, ada beberapa tawaran yang dinilai mampu menjawab era revolusi industri 4.0 antara lain: menumbuhkan saling pengertian, mengaktualisasikan peran, memberikan penghargaan, komunikasi yang positif dan efektif, menanamkan sikap disiplin positif dan membangun kualitas. generasi. Abstract

In this research  there  are several  problems  1). How the rights and  obligations  of parents  to children  online  game addicts. 2). How to review Islamic law against children online game addicts at Warnet BM Jalan  Salak Raya, Bengkulu City. To answer  the problem  of research  above  conducted field research  (field research)  using qualitative  descriptive approach method. The data  collected by observation method, interview and documentation, from the source of the informant  that the author  set based  on purposive sampling.  The results of the study explain,  first Rights and  obligations  of parents  to the child has not been done  due to various factors, among  others,  busy work so that the lack of attention to children who cause  children abandoned. Second  Every child should  be good  and  obedient to the parents. The child is not justified in being  abusive  to both  parents. Therefore, every child must have  obligations  and  responsibilities  to parents  who have  raised  and  nourished them  from child- hood  to adulthood. Children should keep the rights of parents, children should also maintain morals as stock in running  Ikhsan against both parents

Abstract

Abstrak : Penelitian ini bertujuan untuk menganalisis tindak kriminalitas pada anak dari perspektif kriminologi, dengan fokus pada faktor penyebab, bentuk tindak pidana yang dilakukan, serta pengalaman dan upaya pembinaan yang diterapkan di Lembaga Pembinaan Khusus Anak (LPKA) Kelas I Medan. Penelitian dilakukan dengan metode kualitatif melalui wawancara mendalam terhadap 10 anak binaan yang sedang menjalani masa pembinaan di LPKA Kelas I Medan. Hasil penelitian menunjukkan bahwa sebagian besar anak melakukan tindak pidana atas kemauan sendiri, namun dipengaruhi oleh lingkungan pergaulan yang negatif, faktor ekonomi, serta penyalahgunaan zat seperti minuman keras dan narkotika. Temuan ini sejalan dengan teori subkultur delinkuen yang dikemukakan oleh Albert K. Cohen dan teori Delinquency and Opportunity oleh Cloward dan Ohlin, yang menekankan peran lingkungan sosial dan ketimpangan akses terhadap kesempatan legal sebagai faktor pendorong perilaku kriminal anak. Selain itu, penelitian juga menemukan bahwa program pembinaan di LPKA, seperti pendidikan, kegiatan keagamaan, dan pelatihan keterampilan, memberikan dampak positif terhadap perubahan sikap dan perilaku anak binaan. Namun demikian, belum semua anak mendapatkan akses pendampingan hukum yang memadai. Secara keseluruhan, hasil penelitian ini menegaskan pentingnya pendekatan rehabilitatif dan restoratif dalam sistem peradilan anak serta perlunya dukungan berkelanjutan dari keluarga, masyarakat, dan negara dalam mencegah kriminalitas anak.Kata kunci: kriminalitas anak, LPKA Kelas I Medan, teori subkultur, pembinaan, peradilan anak.  Abstrac : This study aims to analyze criminal acts against children from a criminological perspective, focusing on the causal factors, the forms of crimes committed, and the experiences and efforts of guidance implemented at the Class I Medan Special Child Guidance Institution (LPKA). The study was conducted using a qualitative method through in-depth interviews with 10 foster children who were undergoing guidance at the Class I Medan LPKA. The results of the study showed that most children committed crimes of their own accord, but were influenced by negative social environments, economic factors, and substance abuse such as alcohol and narcotics. This finding is in line with the theory of delinquent subculture put forward by Albert K. Cohen and the Delinquency and Opportunity theory by Cloward and Ohlin, which emphasize the role of the social environment and inequality of access to legal opportunities as factors driving children's criminal behavior. In addition, the study also found that guidance programs at the LPKA, such as education, religious activities, and skills training, have a positive impact on changing the attitudes and behavior of foster children. However, not all children have access to adequate legal assistance. Overall, the results of this study emphasize the importance of rehabilitative and restorative approaches in the juvenile justice system and the need for ongoing support from families, communities, and the state in preventing juvenile crime.Keywords: child criminality, LPKA Class I Medan, subculture theory, guidance, juvenile justice.

Abstract

Abstract: This research raises the problem of what the panel of judges considered in the decision of the case Number 479 / Pdt.G / 2020 / PA.Bn on the father’s responsibility after the divorce pledge at the Bengkulu Religious Court Class IA in the perspective of Islamic law and how the father’s obligation to support the child after pledge of divorce in the case decision Number: 479 / Pdt.G / 2020 / PA-Bn at the Bengkulu Class IA Religious Court. This research uses the type of field research (field) and library research (literature), with a statutory approach, a case approach and a conceptual approach. To collect data, the documentary method was used which was obtained from the Bengkulu religious court’s decision on the case Number: 479 / Pdt.G / 2020 / PA.Bn and literature review refers to books that discuss issues that correspond to the problem. Then after the data obtained were analyzed descriptively normative. The research results show that: 1) The judges’ consideration that the father’s responsibility after the divorce vow to the child after the divorce is more burdened on the father and a mother is not obliged to provide for her child, whether there is a husband on her side or not. Whether the woman is rich or poor, a woman only has an obligation to provide for her parents and the slave she has. This is confirmed by the syafi’i, Hanafi and Hambali schools, if the father is unable to provide for the child, then the closest relatives can take over the role of the father to provide a living. 2) The obligation of the father to support the child after the divorce pledge in the decision of the case Number: 479 / Pdt.G / 2020 / PA-Bn at the Bengkulu Religious Court, namely punishing the Petitioner (father) to provide for the child outside the cost of education and health. If the Petitioner’s father renounces and does not fulfill his obligations as stated in the dictum of four orders of the Respondent’s decision, the Respondent may apply for the execution of the payment of child support to the Religious Court to force the male parent (father) to provide a living cost. Keywords: Child’s Livelihood, Father’s Responsibility, Islamic Law Abstrak: Penelitian ini mengangkat permasalahan apa pertimbangan majelis hakim dalam putusan perkara Nomor 479/ Pdt.G/2020/PA.Bn terhadap tanggung jawab ayah setelah ikrar talak di Pengadilan Agama Bengkulu Kelas IA dalam perspektif hukum Islam dan bagaimana kewajiban ayah terhadap nafkah anak pasca ikrar talak pada putusan perkara Nomor: 479/ Pdt.G/2020/PA-Bn di Pengadilan Agama Bengkulu Kelas IA. Penelitian ini menggunakan jenis penelitian field research (lapangan) dan library research (kepustakaan), dengan pendekatan undang-undang, pendekatan kasus dan pendekatan konseptual. Untuk mengumpulkan data digunakan metode dokumenter yang didapat dari putusan pengadilan agama Bengkulu pada perkara Nomor : 479/Pdt.G/2020/PA.Bn dan tinjauan pustaka merujuk pada pada buku-buku yang membicarakan masalah yang sesuai dengan permasalahan. Kemudian setelah data didapat dianalisis secara deskriptif normatif. Dari hasil penelitian menunjukan bahwa: 1) Pertimbangan majelis hakim bahwa tanggung jawab ayah setelah ikrar talak terhadap anak pasca perceraian yaitu lebih dibebankan kepada ayah dan seorang ibu tidak wajib memberikan nafkah kepada anaknya, baik itu ada suami di sisinya maupun tidak ada. Baik itu perempuannya kaya maupun miskin, seorang perempuan hanya punya kewajiban memberi nafkah kepada kedua orang tua dan budak yang dimilikinya. Hal ini ini dipertegas oleh mazhab syafi’i, Hanafi dan Hambali, apabila ayah tidak mampu menafkahi anak, maka kerabat terdekat bisa mengambil alih peran ayah untuk memberikan nafkah. 2) Kewajiban ayah terhadap nafkah anak pasca ikrar talak pada putusan perkara Nomor: 479/Pdt.G/2020/PA-Bn di Pengadilan Agama Bengkulu, yaitu menghukum Pemohon (ayah) untuk memberi nafkah anak diluar biaya pendidikan dan kesehatan. Jika ayah (Pemohon) ingkar dan tidak memenuhi kewajibannya sebagaimana dalam dictum empat amar putusan Termohon dapat mengajukan permohonan eksekusi pembayaran biaya nafkah anak ke Pengadilan Agama untuk memaksa orang tua laki-laki (ayah) tersebut untuk memberikan biaya nafkah. Abstract

This study raises the issue of implementation inheritance practices in society Kepahiang District of Kepahiang. So the urgency to fix the system of inheritance which has become a tradition for generations was considered good by most people Kepahiang to return it to the Islamic inheritance in order to create a qualified Muslim community. The purpose of this study (1) To investigate the implementation of the community Kepahiang inheritance; (2) To identify the background on which to base  the distribution of the next of kin; (3) To analyze  the views of Islamic law on inheritance practices implementation in society  Kepahiang and  add  related intellectual treasures of Islamic  heritage. This study uses  content analysis  (content analysis),  with a historical-normative approach. The results  showed that (1) In general  practice division of the estate made by the people Kepahiang is with individual bilateral  inheritance system  through  the deliberation and peace, this is done  to anticipate disputes among  heirs and to the achievement of welfare. It is also a habit of going on and practiced repeatedly and well-regarded in the community, while the comparison section received between heirs male and female heirs depending on the results  of consultation with emphasis on the principle  of mutual  benefit  and willingly accept any portion  thereof,  more often equally or 1:1; (2) The basis for the implementation of the division of inheritance in Kepahiang society is based on its own  traditions  that have been embraced for generations. Although there  are based on the Islamic inheritance, only when executing by way of inheritance Islam, then the disagreement / dispute they choose to implement with the tradition that has been handed down it; (3) The distribution of inheritance in the District Kepahiang society Kepahiang using a system of equal division is not in accordance with Islamic  law, because the  procedure of distribution carried out by dividing the  average whole  inheritance to the  heir on the  legal basis  is very weak.  But the  practice of the  division of the  estate in the  District Kepahiang society can be viewed  as the result of social construction, but in this Islamic regards  the division of inheritance practices such as ‘urf fasid because it is contrary to the text (Nash) of syariat. Especially if the grounds  of gender equality that will bring destruction and not in line with the objectives of the estabilishment of syari’at.
