Abstract

Abstract: The formulation of this research is What are the substance of the implementation of the Minister of Social Affairs Regulation Number 1 of 2018 concerning the Family Hope Program, What are the supporting and inhibiting factors for the implementation of the Minister of Social Affairs Regulation Number 1 of 2018 concerning the Family Hope Program), How is the implementation of the Ministerial Regulation Social Affairs Number 1 of 2018 concerning the Family Hope Program from the Maslahah Mursalah Perspective. This type of research is field research (field research) with a qualitative approach. The results of the research substance from the implementation of the Minister of Social Affairs Regulation Number 1 of 2018 concerning the Family Hope Program are in accordance with the main content of this program reducing numbers and breaking the poverty chain, improving the quality of human resources, and changing welfare-enhancing behavior. The supporting and inhibiting factors for the implementation of the Minister of Social Affairs Regulation Number 1 of 2018 concerning are the assistance from the social service, the existence of complete data and adequate road access to reach the homes of residents and schools that receive, while the obstacle is the lack of human resources and sometimes there are some technical problems during disbursement. Implementation of the Minister of Social Affairs Regulation Number 1 of 2018 concerning the Family Hope Program Perspective of Maslahah Mursalah This family of hope program has become a benefit for the people of Sengkuang Jaya Village by using the maslahah mursalah theory in order to provide an illustration that a rule made will contain a benefit for the community which prioritizes the interests of maslahah al-ammah. Keywords: Minister of Social Affairs Regulation Number 1 2018, Family Hope Program, Maslahah Mursalah Perspective Abstrak: Rumusan penelitian ini adalah Apa saja substansi dari implementasi Peraturan Menteri Sosial Nomor 1 tahun 2018 tentang Program Keluarga Harapan (PKH), Apa saja Faktor pendukung dan penghambat pelaksanaan Peraturan Menteri Sosial Nomor 1 tahun 2018 tentang Program Keluarga Harapan (PKH), Bagaimana impelementasi Peraturan Menteri Sosial Nomor 1 tahun 2018 tentang Program Keluarga Harapan (PKH) Perspektif Maslahah Mursalah. Jenis penelitian ini adalah penelitian lapangan (field research) pendekatan kualitatif. Hasil penelitian substansi dari implementasi Peraturan Menteri Sosial Nomor 1 tahun 2018 tentang Program Keluarga Harapan (PKH) sudah sesuai dengan isi pokok dari program ini mengurangi angka dan memutus rantai kemiskinan, meningktkan kualitas sumber daya manusia, serta mengubah perilaku peningkatan kesejahteraan. Faktor pendukung dan penghambat pelaksanaan Peraturan Menteri Sosial Nomor 1 tahun 2018 tentang adalah adanya pendampingan dari dinas sosial, Adanya data yang lengkap dan akses djalan yang telah memadai untuk menjangkau rumah warga dan sekolah yang penerima PKH, sedangkan penghambatnya adanya kurangnya sumber daya manusia dan terkadang ada beberapa kendala secara teknis pada saat melakukan pencairan. Impelementasi Peraturan Menteri Sosial Nomor 1 tahun 2018 tentang Program Keluarga Harapan (PKH) Perspektif Maslahah Mursalah Program keluarga Harapan ini sudah menjadi sebuah kemaslahatan bagi masyarakat Desa Sengkuang Jaya dengan menggunakan teori maslahah mursalah agar dapat memberikan gambaran bahwa suatu aturan dibuat akan mengandung sebuah maslahat bagi masyarakat yang mana lebih mengutamakan kepentingan maslahah al-ammah. Abstract

Humans need to carry out marriage in order to legalize the relationship between the prospective husband or wife. Given the importance of marriage to human life, it is appropriate for marriage rules to be regulated in such a way that it can minimize the occurrence of problems in the field of marriage. One important thing to realize orderly in the field of marriage is the existence of legal certainty in the field of marriage, especially on marriage dispensation in prospective husband / future wife whose age has not been eligible by law. The law governing marriage is Law no. 1 of 1974 and the Compilation  of Islamic Law. One of the issues  discussed in the Act and KHI is the minimum age limit for marriage. Therefore it must be prevented the existence of underage marriage. The type of research used is qualitative research, which produces descriptive data in the form of words or oral from people and observed behavior. Based on the formulation of problems and research objectives, the approach method used is the sociological juridical approach. Means that this study could include research on legal principles, legal systematics, legal synchronization, legal history, and  comparative law.  While  the  sociological means this research consists  of research on legal identification (not  written)  and  research on the  effectiveness of the  law. Research location in Religious Court of Bengkulu  City. The data  used  in this study consist  of primary data  and secondary data.  Data obtained from both the literature  and the interview  will be analyzed  by using qualitative  analysis method, a research procedure that produces analytical  descriptive data.  In this analysis,  the authors conclude that the determination of the dispensation has been juridically appropriate. While the sociological reasons proposed by the applicant is not in an ideal position. This lack of ideals is due to the fact that the applicant does  not have a plan to mature marriage, the status  of the applicant who is still a student, and has not / does not have a job or income to support  the family.

Abstract

Abstracts: Divorce is an increasing phenomenon in Indonesia, influenced by various factors, one of which is parental intervention in their children's households. This interference can cause disharmony and lead to divorce. This article analyzes divorce due to parental intervention in the perspective of positive law and Islamic law with a case study of Decision 379/Pdt.g/2024/PA.Prob. The research method used is a normative juridical approach through literature study and analysis of court decisions. Seeing from the results of the contents of the decision that the judge considered this household could not be saved because the Plaintiff and Defendant had tried to resolve the problem.  The results of the study show that positive law in Indonesia regulates divorce as an individual right that must be processed through the courts. Meanwhile, in Islamic law, divorce is allowed but recommended to be avoided except in emergencies. This study emphasizes the importance of balancing between individual rights in marriage and the role of parents so as not to overstep limits that can damage the integrity of the household. In addition, a mediation approach and legal education are needed to prevent divorce due to external factors such as family intervention.Keywords: Divorce, Parental Intervention, Positive Law, Islamic Law, Court Decision. Abstrak : Perceraian merupakan fenomena yang terus meningkat di Indonesia faktor yang mempengaruhi salah satunya adalah intervensi orang tua dalam rumah tangga anak mereka. Campur tangan ini dapat menimbulkan ketidakharmonisan dan berujung pada perceraian. Artikel ini menganalisis perceraian akibat intervensi orang tua dalam perspektif hukum positif dan hukum Islam dengan studi kasus Putusan 379/Pdt.g/2024/PA.Prob. Metode penelitian yang digunakan adalah pendekatan yuridis normatif melalui studi kepustakaan dan analisis putusan pengadilan. Melihat dari hasil isi putusan bahwa hakim mempertimbangkan rumah tangga ini sudah tidak bisa di selamatkan karena  Penggugat dan Terguggat sudah berupaya dalam menyelesain permasalahannya. Hasil kajian menunjukkan bahwa hukum positif di Indonesia mengatur perceraian sebagai hak individu yang harus diproses melalui pengadilan. Sementara itu, dalam hukum Islam, perceraian diperbolehkan tetapi dianjurkan untuk dihindari kecuali dalam keadaan darurat. Studi ini menegaskan pentingnya keseimbangan antara hak individu dalam pernikahan dan peran orang tua agar tidak melampaui batas yang dapat merusak keutuhan rumah tangga. Selain itu, diperlukan pendekatan mediasi dan edukasi hukum untuk mencegah perceraian akibat faktor eksternal seperti intervensi keluarga.Kata kunci: Perceraian, Intervensi Orang Tua, Hukum Positif, Hukum Islam, Putusan Pengadilan.

Abstract

Abstrak: Kewajiban suami terhadap istri yang paling pokok setelah akad nikah adalah kewajiban pemberian nafkah baik secara lahir yakni pemenuhan kebutuhan rumah tangga dan batin yakni pemenuhan kebutuhan biologis. Dalam sebuah hadis ditunjukkan bahwa pemberian nafkah yang pantas adalah wajib bagi suami untuk istri atas kehalalan suami terhadap kemaluan istri. Di Desa Somagede ditemukan bahwa saat istri membantu suami mencari penghasilan untuk memenuhi kebutuhan keluarganya, ada sebagian suami yang tidak memberikan nafkah lagi pada istrinya dengan alasan bahwa istrinya telah bekerja sehingga menganggap bahwa nafkah telah gugur. Jenis penelitian ini adalah penelitian lapangan. Teknik pengumpulan data, yaitu dengan wawancara, observasi, dan dokumentasi. Subjek penelitian ini adalah pasangan suami istri yang bekerja di Desa Somagede Kabupaten Banyumas. Sedangkan objek penelitianya adalah praktik pelaksanaan pemberian nafkah dari suami kepada istri yang berpenghasilan di Desa Somagede Kabupaten Banyumas. Nafkah wajib hukumnya dipenuhi oleh suami berdasarkan nash-nash yang bersumber dari al Qur’an, hadis dan ijma.Nafkah adalah hak istri meskipun ia kaya dan suaminya miskin. Kewajiban memberi nafkah kepada istri tidak gugur, kecuali jika istri membangkang atau nusyuz. Tentang praktik pemberian nafkah dari suami pada istri yang berpenghasilan di Desa Somagede Kabupaten Banyumas berdasarkan hasil wawancara peneliti dengan responden, masing-masing keluarga mempunyai cara yang berbeda dalam mengaplikasikan kewajiban memberi nafkah pada istrinya. Sedangkan menurut sosiologi hukum Islam, suami tetap wajib memberikan nafkah pada istri yang berpenghasilan sendiri sesuai dengan kemampuannya tanpa menuntut nafkah melebihi batas kemampuan suaminya.Kata kunci: Nafkah, Berpenghasilan, Sosiologi Hukum Islam. Abstract: The most basic obligation of a husband to his wife after the marriage contract is the obligation to provide a living both physically, namely the fulfillment of household needs and spiritually, namely the fulfillment of biological needs. In a hadith it is shown that it is obligatory for a husband to provide a proper living for his wife for the husband's lawfulness of the wife's genitals. In Somagede Village, it was found that when the wife helps her husband earn an income to meet the needs of his family, there are some husbands who do not provide any more support for their wives on the grounds that their wives have worked so they think that their livelihoods have died. This type of research is field research. Data collection techniques, namely by interview, observation, and documentation. The subject of this research is a married couple who work in Somagede Village, Banyumas Regency. While the object of the research is the practice of providing a living from husband to wife who earns income in Somagede Village, Banyumas Regency. The husband's obligatory livelihood is fulfilled by the husband based on texts sourced from the Qur'an, hadith and ijma. Sustenance is the right of the wife even though she is rich and her husband is poor. The obligation to provide a living for the wife does not fall, unless the wife disobeys or nusyuz. Regarding the practice of giving a living from a husband to a wife who earns money in Somagede Village, Banyumas Regency, based on the results of interviews with respondents, each family has a different way of applying the obligation to provide for their wives. Meanwhile, according to the sociology of Islamic law, the husband is still obliged to provide a living for his wife who earns herself according to her ability without demanding a living beyond the limits of her husband's ability.Keywords: Live, Earn, Sociology of Islamic Law.

Abstract

This study raises the issue of the causes of the reluctance wife filed a divorce against her husband who violate sighat taklik divorce and understanding with their wives taklik divorce in marriage as well as the legal implications of the breach taklik divorce for a marriage. The purpose of this study was to determine the factors causing reluctance wife filed a divorce against her husband who violate sighat taklik divorce and understanding wives District of South Kaur Kaur District with their taklik divorce in marriage as well as to know the legal implications of the breach taklik divorce for a marriage. This study uses empirical juridical law starts from the primary data / basic data is data obtained directly from informants selected are six wives whose husbands abuse sighat  taklik divorce  in the  district South Kaur Kaur regency.  The data  collection techniques used  were  observation, interview  and secondary data collection. When  the data to do the data analysis by descriptive normative. The results showed that the wives of the District Kaur Southern District Kaur assume that sighat taklik divorce in a marriage is only limited pledge of marriage and does  not quite understand that sighat taklik divorce is guaranteed protection of self-wives while factors causing reluctance wife filed a divorce against husband sighat abuse taklik divorce in the district of South Kaur Kaur District is because of shame to the neighbors and the psychological impact  of small children, not understanding the process of the divorce to the religious courts, and embarrassed by the title of a widow who still put it negatively as a widow in society

Abstract

Abstract: This research aims to answer two main problems. First, what are the consequences if the marriage is carried out without going through the process of joining the tribe? Second, how is the implementation of gender entry in marriage for the Pekal Tribe community from the 'Urf perspective. Research results 1) The consequences that occur if a marriage is carried out without entering the clan are that the marriage cannot be carried out at home, cannot carry out traditional ceremonies, is not managed and attended by traditional leaders, is not recognized by the traditional community, can receive sanctions for dissolution, is ostracized from the traditional community and lacks support and restrictions on customary rights, including the right to be involved in community activities. 2) How is the implementation of gender entry from the Urf' perspective. If you look at the scope of its use, it is included in 'urf Al-khas, in terms of its object it is included in 'urf Al-Amali, and if you look at it in terms of its implementation and purpose, it is permissible for 'urf shahih as long as there is no public belief that leads to things that are prohibited by the 'urf shahih religion and it can become prohibited 'urf fasid if it is applied in society but is contrary to Islamic values.Keywords: Entering the Family, Marriage, “Urf. Abstrak : Penelitian ini bertujuan untuk menjawab dua permasalahan utama. Abstract: "Implementation of the appeal of the Ministry of Religion in South Bengkulu district regarding the requirements for marriage registration from the perspective of Islamic law and positive law." an appeal from the South Bengkulu Ministry of Religion regarding the requirements for marriage registration? (2) What is the review of Islamic law and positive law on the implementation of the South Bengkulu Ministry of Religion's appeal regarding the requirements for marriage registration. The research method used in this research is field research, namely collecting data directly in the field. The research location to be taken is the Ministry of Religion of South Bengkulu Regency. while for the research informants, namely the Ministry of Religion, Head of Section for Islamic Community Guidance, Head of Section for Islamic Community Guidance, Sharia Organizers, Head of KUA and the people of South Bengkulu. This data collection technique uses interviews and documentation. The results of the research conducted were the implementation of the appeal from the South Bengkulu Ministry of Religion regarding the requirements for marriage registration, namely requiring parents' marriage books as a requirement for marriage at the South Bengkulu KUA, realized by the KUA by writing it on the marriage registration form. Based on this call from the Ministry of Religion, there are still differences in implementation between KUA heads, such as some requiring only the first daughter and others requiring all daughters. Although the goal is the same, namely to determine the guardian of marriage. Then if viewed from the positive law regarding the parents' marriage book which is determined to be an administrative requirement for marriage, it is still classified as having very weak legal force because there are no written regulations that form the basis of the appeal, and only based on MUI fatwa No. 11 of 2012 concerning the status of children resulting from adultery and their treatment.Keywords: Ministry of Religion, Marriage Requirements, Islamic Law, Positive Law Abstrak: “Implementasi himbauan Kementrian Agama di kabupaten Bengkulu Selatan tentang syarat pendaftaran nikah perspektif hukum Islam dan hukum positif” Dalam hal ini persoalan yang akan di bahas pada tesis, yaitu: (1) Bagaimana implementasi himbauan Kementerian Agama Bengkulu Selatan tentang syarat pendaftaran nikah? (2) Bagaimana tinjauan hukum Islam dan hukum positif terhadap implementasi himbauan kementerian Agama Bengkulu Selatan tentang syarat pendaftaran nikah. Adapun metode penelitian yang digunakan dalam penelitian ini adalah penelitian lapangan (field research) yaitu pengumpulan data secara langsung dilapangan. Lokasi penelitian yang akan di ambil yaitu Kementerian Agama Kabupaten Bengkulu Selatan. sedangkan untuk informan penelitian yaitu Kementrian Agama, Kepala Kasi Bimas Islam, Staf Kasi Bimas Islam, Penyelenggara Syariah, Kepala KUA dan masyarakat Bengkulu Selatan.Teknikpengumpulan data ini menggunakan wawancara dan dokumentasi. Hasil dari penelitian yang dilakukan yaitu Implementasi himbauan Kementerian Agama Bengkulu Selatan tentang syarat pendaftaran nikah yaitu mewajibkan buku nikah orangtua sebagai persyaratan nikah yang ada di KUA Bengkulu Selatan, diwujudkan oleh KUA dengan menuliskannya di formulir pendaftran nikah. Berdasarkan himbauan Kementerian Agama ini, masih terjadi perbedaan penerapan di antara kepala KUA, seperti ada yang mewajibkan untuk anak perempuan pertama saja dan ada juga yang mewajibkan untuk semua anak perempuan. Meskipun tujuannya sama yaitu untuk menentukan wali nikah. Kemudian jika ditinjau dari hukum positif mengenai buku nikah orangtua yang ditetapkan menjadi persyaratan administratif pernikahan, masih tergolong sangat lemah  kekuatan hukumnya karena tidak ada peraturan tertulis yang menjadi dasar himbauan tersebut, dan hanya berdasarkan fatwa MUI No. 11 Tahun 2012 tentang kedudukan anak hasil zina dan perlakuan terhadapnya.Kata kunci:  Kementerian Agama, Persyaratan Nikah, Hukum Islam, Hukum Positif.

Every marriage must take place before and under the supervision of a Marriage Registrar, and be proven by a Marriage Certificate. The purpose of this study is to find out how marriage is carried out at KUA in Bengkulu City after the issuance of PP No. 48 of 2014. This research is field research. The type of this research approach is descriptive-qualitative. Data collection techniques with interviews and documentation. The results of this study show that the implementation of marriage at the KUA office after PP No. 48 of 2014 was warmly welcomed, especially by the KUA and in general by the community in Bengkulu City, where before this PP was ratified, the community accused of marriage fees at the KUA, they were worried that there would be graft on these costs, but after the PP was issued, it was clear who had if you want to get married outside the office, you will be charged Rp. 600,000, the payment is through the bank by the married couple themselves, but those who want to get married at their KUA office are not charged at all ( free ), with the clarity of this regulation, the interest of the people in the city of Bengkulu to get married in the office is still lacking, even though there is no fee. there are still many who marry outside the office or at home even though they pay quite a lot of money. Keywords: Marriage Executor, KUA, PP No 48 of 2014 Abstrak: Ketertiban perkawinan bagi masyarakat Islam setiap perkawinan harus dicatat, yang dilakukan oleh Pegawai Pencatat Nikah. Setiapper kawinan harus dilangsungkan di hadapan dan di bawah pengawasan Pegawai Pencatat Nikah, dan dibuktikan dengan Akta Nikah. Tujuan penelitian ini mengetahui bagaimana pelaksanaan nikah pada KUA di Kota Bengkulu pasca keluarnya PP No. 48 Tahun 2014. Penelitian ini merupakan penelitian lapangan (field research). Adapun jenis pendekatanpenelitian ini adalah deskripitif-kualitatif. Teknik pengumpulan data dengan wawancara dan dokumentasi. Hasil penelitian ini menunjukan pelaksanaan nikah di kantor KUA setelah PP No. 48 Tahun 2014 ini keluar disambut baikk hususnya pihak KUA maupun umumnya pihak masyarakat di Kota Bengkulu, dimana sebelum PP ini di sahkan tuduhan masyarakat terhadapbiaya nikah di KUA mahal dan ada kekhawatiran terjadi grafitasi terhadap biaya tersebut, namun setalah PP itu dikeluarkan maka sudah jelas bagi siapa yang mau manikah diluar kantor di kenakan biaya Rp. 600.000 yang pembayaran tersebut melaluai Bank oleh pasangan yang menikah itu sendiri, namun yang mau menikah di kantor KUA mereka tanpa dikenakanbiaya sedikitpun (gratis), dengan kejelasan Peraturan ini minat masyarakat di kota Bengkulu untukmenikah di kantor masih kurang walaupun tanpa biaya, bahkan masih banyak yang menikah di luar kantor atau di rumah meskipun mereka membayar uang yang cukupbesar. Abstract

Abstract: The  education level of husband and wife in managing a gender-equal household. This research discusses problem 1). Gender equality in the relationship between highly educated husband and wife towards fulfilling family legal rights and obligations. 2). Gender equality in the relationship between husband and wife with low education towards fulfilling family legal rights and obligations. The research uses empirical legal research with a historical approach. Data collection was carried out through interviews and recording of couples with high and low education in Kwaron Village, Diwek District, Jombang Regency. This research provides results that: 1). Four out of five couples are still unable to implement a gender equal family as a whole even though they have higher education. Even though both partners have high education, this is not the main factor in implementing a gender equal family. 2). There are only 2 couples out of 5 (five) couples who have fully implemented a gender equal family pattern, even though they are not highly educated, this is not the main factor in implementing a gender equal family in Kwaron Village, Diwek District, Jombang Regency.Keywords: Family Law; Accountability; Gender equality; Level of education. Abstrak : Pendidikan keluarga sebagai penyumbang kesenjangan gender dan kesetaraan gender dalam perkawinan. Bedanya, penelitian ini fokus pada hubungan tingkat pendidikan suami istri dalam mengelola rumah tangga setara gender. Tulisan ini membahas masalah 1). Kesetaraan gender dalam hubungan suami istri yang berpendidikan tinggi menuju pemenuhan hak dan kewajiban hukum keluarga. 2). Kesetaraan gender dalam hubungan suami istri yang berpendidikan rendah terhadap pemenuhan hak dan kewajiban hukum keluarga. Penelitian ini menggunakan penelitian hukum empiris dengan pendekatan historis. Pengumpulan data dilakukan melalui wawancara dan rekaman terhadap pasangan yang berpendidikan tinggi dan rendah di Desa Kwaron, Kecamatan Diwek, Kabupaten Jombang. Penelitian ini memberikan hasil bahwa: 1). Empat dari lima pasangan masih belum mampu menerapkan keluarga setara gender secara keseluruhan meski telah mengenyam pendidikan tinggi. Meski kedua pasangan memiliki pendidikan yang tinggi, namun hal tersebut bukanlah faktor utama dalam mewujudkan keluarga setara gender. 2). Hanya 2 pasangan dari 5 (lima) pasangan yang sudah sepenuhnya menerapkan pola keluarga setara gender, padahal mereka tidak berpendidikan tinggi, hal tersebut tidak menjadi faktor utama dalam penerapan keluarga setara gender di Desa Kwaron, Kecamatan Diwek, Jombang. Abstract

This research  raises the issue of punishment imposed by the judges on Curup  District Court  Number  7 / Pid.Sus. Anak / 2016  / PN.Crp  to the child as the perpetrator of rape  accompanied by the murder  of the child victim. The purpose of this research  is to know the punishment and  basic consideration of judges panel  then  reviewed  from positive law and  Islamic law. This research  uses normative juridical legal method, with approach of Act, case approach and  conceptual approach. The method of collecting legal material  used  is literature  study  and  documentary study  then  analyzed  by normative descriptive. From the results of research  shows that the implementation of criminal punishment for perpetrators of rape coupled  murder  of children  in terms of positive law can be implemented by the panel  of judges by applying  Article 81 paragraph (1) of Law RI.35 Year 2014  About Amendment to Law no. 23 of 2002  in conjunction with Article 76D of RI Law. 35 of 2014  on Amend- ment to Law No. RI. Article 55 Paragraph (1) and (2) of the Indonesian Criminal Code  and Article 80 Paragraph (3) of RI Law No. 23 Year 2002  on Child Protection jo Article 55 Paragraph (1) of the Criminal Code  jo Article 65 Paragraph (1) and  (2)35 Year 2014  About Amendment to Law no. Law No. 23 Year 2002  on the Protection of Children  in conjunction with Article65 Paragraph (1) and  (2) of the Criminal Code  are cumulative. Whereas  in Islamic law the perpetrator may be subjected to a more  severe  crime (murder)  which is the murder  in which the perpetrator is assumed to have  committed  intentional  murder with the punishment of the principal in the form of diat and  kafarat, the substitution  of ta’zir and  the additional punishment of the inheritance and  will. Based  on the decision of the Curup  District Court Number  7 / Pid.Sus.Anak / 2016  / PN.Crp  that the perpetrators of rape are found to have proven  legally and convincingly guilty of intercourse with him or with others and place, let, participate in violence against children who causing the child to die so that the imprisonment is imposed for 10 (ten) years and  the training of each  work for 6 (six) months.  According to Islamic law the offender  may be punished by paying  diyat to the heirs of 100 (one hundred) camels or 200 (two hundred) cows or 2000  (two thousand) goats, freeing a slave or fasting two months  in a row and ta’zir
