Abstract

Upah kerja lembur diperoleh bagi pekerja yang telah melaksanakan pekerjaan di luar waktu jam kerja normal. Pekerjaan tersebut dilaksanakan oleh pekerja berdasarkan kesepakatan antara pekerja dan pemberi kerja atau pengusaha melalui perjanjian kerja. Pengusaha wajib membayar upah kerja lembur sesuai dengan waktu kerja  lembur yang dikerjakan oleh pekerja/buruh dan pembayaran dilakukan dengan cara yang sesuai dengan peraturan-perundang-undangan. Penelitian ini bertujuan untuk mengkaji keabsahan insentif sebagai pengganti upah lembur kerja bagi pekerja lembur. Metode penelitian ini menggunakan penelitian normatif dengan pendekatan konseptual (conseptual approach) dan pendekatan perundang-undangan (statue approach). Hasil dari penelitian ini ialah pembayaran upah kerja lembur haruslah tetap dibayarkan dengan upah kerja lembur itu sendiri dan tidak dapat digantikan dengan insentif. Insentif bukan merupakan komponen upah dalam Peraturan Pemerintah Nomor 36 Tahun 2021 tentang Pengupahan. Sehingga, bagi pengusaha yang memberi insentif pekerja dengan maksud membayar upah kerja lembur adalah tidak sah secara hukum. Kata kunci : Upah Kerja Lembur, Insentif, Pekerja/Buruh.

Abstract

In a legal state, the existence of the trias politica consists of : laws of power, executive power, and judicial power, laws of the power to make laws, executive power whose implementation of the function of action or application, and lastly, the power of the judiciary is the judge whose implementation or function of adjudication of rules. Trias politica is the function of this power to prevent the abuse of power by those in power. It is hoped that the human rights of citizens will not be degraded. The doctrine of separation of powers, as for in the concept of law there are three powers, statutory power, executive power, and judicial power, the third power must be separate for the duties and functions of the judicial institutions in particular there is the independence of the individual, human rights are waged and at stake. This study uses normative laws, based on empirical. Normative legal research on the effectiveness of the rule of law issues, as well as resolving military administrative disputes in accordance with the rule of law, legal implications, the impact of the application of dispute resolution norms later. Formulation of the problem: a. How should the settlement of military administrative disputes be carried out in accordance with the rule of law?, b. What are the juridical implications for the inconsistency of the legal norms governing the settlement of military administration disputes?

Abstract

This journal discusses intellectual property rights in this case copyright can be used as an object of fiduciary guarantee in accordance with article 16 paragraph (3) of Law No.28 of 2014 concerning Copyright. Although it can be the object of fiduciary guarantees, it does not necessarily make banks and other financial institutions easily provide their loans. The issues raised in this study are How the criteria for copyright to be used as a fiduciary guarantee and How to execute a fiduciary guarantee in the form of a copyright in the event of a default. To answer these problems, normative juridical legal research methods are used using a statutory approach using secondary data Data collection tools used through the study of documents or library materials, and the data analysis used is qualitative data analysis. In this study, it was found that the copyright criteria based on article 16 paragraph (3) of Law Number 28 of 2014 are movable objects that are not tangible. This is also juridically regulated in chapter 1 paragraph (2) Law Number 42 of 1999. As an intangible movable object, Copyright can used as fiduciary collateral. this is regulated in article 1 paragraph (2) of Law Number 42 of 1999, because here copyright is an intangible movable object and also copyright has economic value that can be used as an object of guarantee. Copyright that can be used as a fiduciary is a copyright that has been registered with the Directorate General of Intellectual Property. Copyright execution if used as a credit guarantee is through the Fiduciary Guarantee Act because the guarantee institutions that are banned by the Copyright Act of 2014 are fiduciaries because of the nature and control of the collateral objects, the fiduciary is the only debt guarantee institution that can be burdened with debt with the object of its guarantee in the form of Copyright

Abstract

ABSTRAK Jurnal ini membahas tentang Pemutusan Hubungan Kerja secara sepihak di masa pandemic covid-19 pasca berlakunya Undang-Undang Cipta Kerja No. 11 Tahun 2020  juncto Peraturan Pemerintah Republik Indonesia Nomor 35 Tahun 2021 tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja Dan Waktu Istirahat Dan Pemutusan Hubungan Kerja. Pemutusan Hubungan Kerja adalah pengakhiran Hubungan Kerja karena suatu hal tertentu yang mengakibatkan berakhirnya hak dan kewajiban antara Pekerja/Buruh dan Pengusaha. Tujuan dari penelitian ini adalah untuk  menganalisis Pemutusan Hubungan Kerja (PHK) secara sepihak akibat pandemi COVID-19 dan untuk mengkaji upaya hukum yang dapat ditempuh oleh Pekerja/Buruh yang terkena PHK. Tipe Penelitian ini menggunakan metode normatif dengan pendekatan deskriptif analisis. Hasil penelitian menunjukkan bahwa Pemutusan Hubungan Kerja (PHK) secara sepihak akibat pandemi COVID-19 merupakan alasan Pemutusan Hubungan Kerja (PHK) yang tidak sah jika tidak melalui mekanisme penyelesaian Perselisihan Hubungan Industrial. Para Pekerja/Buruh yang tidak menerima dilakukannya Pemutusan Hubungan Kerja (PHK) secara sepihak dapat melakukan upaya hukum melalui penyelesaian perselisihan hubungan industrial untuk mendapatkan hak-hak yang seharusnya diterima oleh Pekerja/Buruh. Kata Kunci: Pemutusan Hubungan Kerja, Sepihak, Pandemi COVID-19. ABSTRACT This journal discusses the unilateral termination of employment during the COVID-19 pandemic after the enactment of the Job Creation Act No. 11 of 2020 in conjunction with Government Regulation of the Republic of Indonesia Number 35 of 2021 concerning Work Agreements for Certain Time, Outsourcing, Working Time and Rest Time and Termination of Employment. Termination of Employment Relations is the termination of Employment Relations due to a certain matter which results in the termination of rights and obligations between Workers/Labourers and Employers. The purpose of this study is to analyze the unilateral termination of employment due to the COVID-19 pandemic and to examine the legal remedies that can be taken by Workers/Labourers who have been laid off. This type of research uses a normative method with a descriptive analysis approach. The results of the study show that unilateral termination of employment due to the COVID-19 pandemic is an invalid reason for termination of employment if not through the mechanism for resolving Industrial Relations Disputes. Workers/Labourers who do not accept the unilateral Termination of Employment (PHK) may take legal action through the settlement of industrial relations disputes to obtain rights that should be accepted by the Workers/Labourers. Keywords: Termination of Employment, Unilateral, COVID-19 Pandemic.

Abstract

ABSTRAKBanyak permasalahan antara pekerja dan pengusaha seringkali berakhir pada Pemutusan Hubungan Kerja terlebih pada akhir tahun 2019 dunia sedang dihebohkan pandemi Covid-19. Ada perusahaan yang melakukan Pemutusan Hubungan Kerja dengan alasan mangkir di masa pandemic covid. Tujuan penelitian ini adalah untuk mengetahui bagaimana PHK dengan alasan Pekerja mangkir yang dikualifikasikan mengundurkan diri karena menolak karantina terkait pandemi covid-19 dan bagaimana perlindungan hukum terhadap hak kompensasi atas PHK dengan alasan mangkir yang dikualifikasikan mengundurkan diri karena menolak karantina terkait pandemi covid-19 menurut Undang-Undang No.13 tahun 2003 tentang Ketenagakerjaan. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan memakai pendekatan perundang-undangan sebagai cara untuk menganalisis peraturan perundang-undangan yang berkaitan dengan perkara yang diteliti. Hasil dari penelitian ini adalah PHK dengan alasan mangkir yang dikualifikasikan mengundurkan diri karena menolak karantina terkait pandemi covid-19 tidak memenuhi unsur Pasal 168 tetapi memenuhi Pasal 161 yaitu PHK karena pelanggaran tata tertib yang ada di peraturan Perusahaan dan Perlindungan hukum terhadap hak kompensasi atas PHK dengan alasan pekerja mangkir yang dikualifikasikan mengundurkan diri karena menolak karantina terkait pendemi covid-19 menurut Undang-Undang No.13 tahun 2003 tentang Ketenagakerjaan belum sepenuhnya terlindungi, karena pekerja hanya mendapatkan kompensasi dan tunjangan hari raya saja, seharusnya selain mendapatkan kompensasi sebagaimana Pasal 161 ayat 3 pekerja berhak juga mendapatkan hak atas upah yang belum dibayarkan dan upah proses dengan total Rp.64.919.428,- (Enam puluh empat juta sembilan ratus sembilan belas ribu empat ratus dua puluh delapan rupiah).Kata Kunci: Hak Kompensasi, Karantina, Mangkir, Pemutusan Hubungan Kerja, Upah ProsesABSTRACTMany problems between workers and employers often end in Termination of Employment, especially at the end of 2019 the world is being shocked by the Covid-19 pandemic. There are companies that terminate their employment on the grounds of being absent during the covid pandemic. The purpose of this study was to find out how layoffs were made on the grounds that a qualified absentee worker resigned due to refusal to quarantine related to the covid-19 pandemic and how the legal protection for the right to compensation for layoffs on the grounds of a qualified absentee resigned for refusing quarantine related to the covid-19 pandemic according to the Law. -Law No.13 of 2003 concerning Manpower. The research method used is normative legal research using a statutory approach as a way to analyze the laws and regulations relating to the case under study. The results of this study are layoffs on the grounds of absenteeism who are qualified to resign because they refuse quarantine related to the covid-19 pandemic, they do not meet the elements of Article 168 but meet Article 161, namely layoffs due to violations of the rules contained in company regulations and legal protection of the right to compensation for layoffs by The reason for qualified absentee workers resigning is because they refuse quarantine related to the Covid-19 pandemic according to Law No. 13 of 2003 concerning Manpower that has not been fully protected, because workers only get compensation and holiday allowances, in addition to receiving compensation as referred to in Article 161 paragraph 3 workers are also entitled to the right to unpaid wages and processing wages with a total of Rp. 64,919,428, - (Sixty-four million nine hundred nineteen thousand four hundred and twenty-eight rupiahs).Keywords: Compensation Rights, Quarantine, Loss of Work, Termination of Employment, Process Wages

Abstract

ABSTRAK Tujuan penulisan artikel ini adalah untuk memberikan informasi mengenai bertapa Koperasi  memiliki peran penting dalam masyarakat, antara lain  mengadakan jasa simpan pinjam uang bagi anggotanya. Koperasi memberi kesejahteraan untuk para anggota agar dapat terjamin dan mempermudah pemenuhan kebutuhan hidup anggotanya.Sehubungan dengan adanya pandemi Covid-19 melanda luas di Indonesia, terjadi peningkatan peminjaman dana terhadap lembaga keuangan, salah satunya adalah Koperasi. Dalam kondisi pandemi Covid -19, banyak bermunculan Lembaga Simpan Pinjam dalam bentuk Koperasi yang memberikan pinjaman kepada masyarakat (anggota). Dalam kondisi ini, apakah Koperasi yang belum berbadan hukum dapat menyalurkan dana kepada masyarakat dan bagaimana akibat hukumnya? Dalam penulisan ini, penulis menggunakan metode penelitian normatif empiris. Hasil penelitian ini, dapat disimpulkan bahwa kegiatan usaha Koperasi yang tidak berbadan hukum tidak dapat memberikan pinjaman terhadap pihak debitur apalagi dengan menjanjikan bunga deposit yang sangat tinggi dan dengan sendirinya perbuatan tersebut akan merugikan koperasi dan debitur. Kata Kunci : Koperasi, Perjanjian, Covid 19  ABSTRACT DUE TO COOPERATIVE LAW, THAT HAVE NOT BEEN A LEGAL INSTITUTION GIVING CREDIT TO THE COMMUNITY(COOPERATIVE X DURING THE COVID-19 PANDEMIC)  The purpose of writing this article is to provide information about asceticism Cooperatives have an important role in society, including providing savings and loan services for their members. Cooperatives provide welfare for members so that they can be guaranteed and facilitate the fulfillment of the needs of their members' lives. Due to the widespread Covid-19 pandemic in Indonesia, there has been an increase in lending to financial institutions, one of which is Cooperatives. In the conditions of the Covid -19 pandemic, many Savings and Loan Institutions have sprung up in the form of cooperatives that provide loans to the public (members). In this condition, can cooperatives that are not yet legally incorporated can channel funds to the community and what are the legal consequences? In this paper, the author uses empirical normative research methods. The results of this study, it can be concluded that the business activities of cooperatives that are not legal entities cannot provide loans to debtors, especially by promising very high deposit rates and by themselves these actions will harm the cooperatives and debtors. Keywords: Cooperative, Agreement, Covid 19

Abstract

Abstract Indonesia as a developing country has increased public literacy regarding the financial services industry, one of which is insurance. Currently, insurance companies continue to develop their products to become more attractive insurance products for the public with the aim of increasing public utility for insurance products. One of the most widely offered insurance products by insurance companies is the unit-linked life insurance product. This unit-linked life insurance product is intended to attract more people to insurance where in addition to providing protection features, it also provides investment features for policyholders. Unit-linked insurance continues to develop every year, which can be seen from the growth of unit-linked insurance premium income which continues to increase, namely in 2015, unit-linked insurance premium income was Rp. 57.21 trillion or an increase of 9.68% from the previous year of IDR 52.16 trillion. The increasing development of insurance companies with unit-linked life insurance products is of course the basis for the author to review this writing from a legal perspective with the aim that the public understands the basis of insurance associated with investment.Keywords : Insurance, Unit Link, InvestationAbstrak Indonesia sebagai negara berkembang telah meningkatnya literasi masyarakat mengenai industri jasa keuangan salah satunya asuransi. Saat ini perusahaan asuransi terus mengembangkan produknya agar menjadi produk asuransi yang makin menarik bagi masyarakat dengan tujuan untuk meningkatkan utilitas masyarakat terhadap produk asuransi. Salah satu produk asuransi yang saat ini paling banyak ditawarkan oleh perusahaan asuransi adalah produk asuransi jiwa unit link. Produk asuransi jiwa unit link ini dimaksudkan untuk makin menarik masyarakat dalam berasuransi dimana di dalam produk tersebut selain memberikan fitur proteksi juga menyediakan fitur investasi bagi pemegang polis. Asuransi unit link terus mengalami perkembangan setiap tahunnya, yang dapat dilihat dari pertumbuhan pendapatan premi asuransi unit link yang terus meningkat yaitu pada tahun 2015, pendapatan premi asuransi unit link sebesar Rp57,21 triliun atau mengalami peningkatan sebesar 9,68% dari tahun sebelumnya yaitu sebesar Rp52,16 triliun. Meningkatnya perkembangan perusahaan asuransi dengan produk asuransi jiwa unit link tentunya menjadi landasan penulis meninjau penulisan ini dari segi hukum dengan tujuan agar masyarakat memahami dasar adanya asuransi yang dikaitkan dengan investasi.Kata kunci : Asuransi, Unit Link, Investasi

Abstract

AbstractThe desk collection act in collecting bad credit is not in accordance with the billing SOP within the company, when billing the desk collection sends messages to customers containing words of intimidation and threats through electronic media whatsapp. The purpose of this paper is to find out and examine how the responsibility of desk collection in credit collection in the decision Number 1363/Pid.Sus/2020/PN.Jkt.Brt and examine how the company's responsibility for desk collection actions is associated with the theory of vicarious liability, as well as methods The research used is empirical normative legal research with the approach used is the statutory approach and interviews. The results of this paper indicate that the responsibility of desk collection in credit collection is individual responsibility, the panel of judges imposed a criminal sentence based on Article 45 Paragraph (3) in conjunction with Article 29 of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions, and the company's responsibility for desk collection actions with the theory of vicarious liability, vicarious liability cannot be applied because the destruction of providing direction is in accordance with the billing SOP, in other words there is no order from the company to commit acts against the law in carrying out billing in any way, and not can be applied or charged to the company directly but is charged to the organ and its management. Keywords: desk collection, credit, companyAbstrakDalam melakukan penagihan kredit macet kepada nasabah, desk collection seringkali melakukan penagihan dengan mengirim pesan whatapps yang berisi kata-kata intimidasi serta pengancaman.  Intimidasi tersebut tidak sesuai dengan Standar Operasional Prosedur (SOP) penagihan dalam perusahaan, pada saat melakukan penagihan desk collection mengirim pesan ke nasabah yang berisi kata-kata intimidasi serta pengancaman melalaui media elektronik whatsapp. Tujuan penelitian ini ialah untuk mengetahui dan mengkaji bagaimana tanggung jawab desk collection dalam penagihan kredit pada putusan Nomor 1363/Pid.Sus/2020/PN.Jkt.Brt dan mengkaji bagaimana tanggung jawab perusahaan terhadap perbuatan desk collection dikaitkan dengan teori vicarious liability. Metode penelitian yang dipakai yakni penelitian hukum normatif empiris dengan pendekatan yang digunakan ialah pendekatan perundang-undangan dan wawancara. Hasil penelitian ini meninjukan bahwa tanggung jawab desk collection dalam penagihan kredit ialah pertanggungjawaban individu, majelis hakim menjatuhkan pidana berdasarkan Pasal 45 Ayat (3) Jo Pasal 29 Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, dan  tanggung jawab perusahaan terhadap perbuatan desk collection dikaitkan dengan teori vicarious liability, vicarious liability tidak dapat diterapkan karena perusakaan  memberikan pengarahan sudah sesuai dengan SOP penagihan, dengan kata lain tidak ada perintah dari perusahaan untuk melakukan perbutan melawan hukum dalam melaksanakan penagihan dengan cara apapun, serta vicarious liability tidak dapat diterapkan atau dibebankan kepada perusahaan secara langsung melainkan hanya dibebankan kepada oragan dan pengurusnya.Kata Kunci: desk collection, kredit, perusahaan

AbstractThe issuance of the Minister of Home Affairs Regulation Number 9 of 2016 concerning the Acceleration of Increasing the Coverage of Birth Certificate Ownership as revoked based on the Minister of Home Affairs Regulation Number 108 of 2019 concerning Implementing Regulations of Presidential Regulation Number 96 of 2018 concerning Requirements and Procedures for Population Registration and Civil Registration and Ministerial Regulations Domestic Affairs Number 109 of 2019 concerning Forms and Books Used in Population Administration allows for a Statement of Absolute Responsibility (SPTJM) to be made as a substitute for supporting documents that do not exist or are not found in the making of a birth certificate. This innovation was carried out to make it easier for residents to get public services in the field of population administration, especially in the management of birth certificates. Juridically, this allows the issuance of birth certificates which contain the phrase "whose marriage has not been registered in accordance with statutory regulations". This recording will certainly have an impact on the status of civil relations between children and parents. The East Jakarta Administration City Population and Civil Registry Sub-agency does not have data on requests for issuance of birth certificates using the SPTJM, both the SPTJM for correctness of birth data and the SPTJM for correctness as husband and wife. The existing data only shows the number of birth certificate holders. The status of the civil relationship between the child and the parents from the birth certificate issued on the basis of the SPTJM can be assumed that the position of the child is the same as that of a child born to a legally married couple. Keywords: statement of absolute liability, birth certicate  AbstrakLahirnya Peraturan Menteri Dalam Negeri Nomor 9 Tahun 2016 tentang Percepatan Peningkatan Cakupan Kepemilikan Akta Kelahiran sebagaimana telah dicabut berdasarkan Peraturan Menteri Dalam Negeri Nomor 108 Tahun 2019 tentang Peraturan Pelaksnaan Peraturan Presiden Nomor 96 Tahun 2018 tentang Persyaratan Dan Tata Cara Pendafatran Penduduk dan Pencatatan Sipil serta Peraturan Menteri Dalam Negeri Nomor 109 Tahun 2019 tentang Formulir dan Buku Yang Digunakan Dalam Administrasi Kependudukan memungkinkan dibuatnya Surat Pernyataan Tanggung Jawab Mutlak (SPTJM) sebagai pengganti dokumen penunjang yang tidak ada atau tidak ditemukan dalam pembuatan akta kelahiran.  Inovasi ini dilakukan untuk mempermudah penduduk mendapatkan pelayanan publik di bidang administras kependudukan khususnya dalam pengurusan akta kelahiran.  Secara yuridis hal ini memungkinkan terbitnya akta kelahiran yang terdapat frasa “yang perkawinannya belum tercatat sesuai dengan peraturan perundang-undangan”.  Pencatatan ini tentu akan berdampak terhadap status hubungan keperdataan antara anak dan orang tua.  Suku Dinas Kependudukan dan Catatan Sipil Kota Administrasi Jakarta Timur tidak memiliki data permohonan penerbitan akta kelahiran yang menggunakan SPTJM, baik SPTJM kebenaran data kelahiran maupun SPTJM kebenaran sebagai pasangan suami istri.  Data yang ada hanya menunjukkan jumlah kepemilikan akta lahir. Status hubungan keperdataan antara anak dan orang tua dari akta kelahiran yang terbit berdasarkan SPTJM dapat diasumsikan bahwa kedudukan anak tersebut sama dengan kedudukan anak yang lahir dari pasangan kawin yang sah. Kata Kunci: Surat Pernyataan Tanggung Jawab Mutlak (SPTJM), Akta Kelahiran

Abstract

AbstrakSekitar Oktober 2021 sampai dengan bulan november 2022 terdapat kelangkaan minyak sawit, apabila adapun  harga minyak sawit di pasar domestik melonjak drastis. Krisis minyak goreng nyaris merata di hampir seluruh kota di Indonesia. Tidak hanya itu, menurut Kemenrian Perdagangan mengatakan bahwa kelangkaan minyak goreng tsb diikuti dengan naiknya harga minyak nabati (crude palm oil). Melihat situasi dan kondisi demikian maka perlu pengkajian mengenai bagaimana dampak kenaikan minyak goreng terhadap tenaga kerja berpenghasilan sesuai UMP dan bagaimana cara mereka menyiasati terhadap kelangkaan minyak goreng. Tujuan penelitian ini ialah untuk mengetahui  tenaga kerja yang terdampak kenaikan harga minyak goreng dan perilaku tenaga kerja dalam menyiasati dampak kenaikan minyak goreng. Metode penelitian yang digunakan dalam penulisan jurnal  ini adalah metode penelitian yuridis normatif. Tenaga kerja dengan upah UMP mencoba survive dengan berbagai macam cara memenuhi kebutuhan hidup ditengah harga minyak goreng melonjak. Sala satu hal yang dilakukan ialah dengan mengurangi konsumsi minyak goreng dengan mengolah makanan rebus dan memanfaatkan jaminan pengaman nasional berupa pemberian kupon sembako. Adanya kenaikan minyak goreng tenaga kerja dengan upah UMP mengubah perilaku meminimslidir konsumsi minyak goreng menerima kupon sembako yang merupakan jaminan pengaman nasional bagian dari kebijakan pemerintah. Saran kepada Pemerintah untuk menimbang kebijakan ekspor minyak goreng. Kata kunci : Minyak goreng, Kenaikan harga, Kelangkaan, Hak Pekerja                                                                Abstract During October 2021 to November 2022 there is a shortage of palm oil, if the price of palm oil in the domestic market increases dramatically. The cooking oil crisis is almost evenly distributed in almost all cities in Indonesia. Not only that, according to the Ministry of Trade, the scarcity of cooking oil was followed by an increase in the price of vegetable oil (crude palm oil). Seeing this situation and condition, it is necessary to study the impact of the increase in cooking oil on workers whose income is according to the UMP and how they can deal with the scarcity of cooking oil. The purpose of this study is to determine the workforce affected by the increase in cooking oil prices and the behavior of the workforce in dealing with the impact of rising cooking oil. The research method used in writing this journal is a sociological juridical research method. Workers with UMP wages try to survive in various ways to meet their daily needs amid soaring cooking oil prices. One of the things that has been done is to reduce consumption of cooking oil by processing boiled food and taking advantage of national security guarantees in the form of providing staple food coupons. The increase in cooking oil for workers with the UMP wage has changed behavior to minimize consumption of cooking oil by receiving staple food coupons which are a national security guarantee as part of government policy.
