Penelitian ini bertujuan untuk menganalisis peran Mahkamah Konstitusi (MK) dalam melindungi hak-hak kewarganegaraan di Indonesia, dengan fokus pada kewenangan uji materiil dan implementasi putusan-putusan yang berkaitan dengan hak dasar warga negara. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan doktrinal yang mengacu pada sumber hukum primer, sekunder, dan tersier. Pendekatan ini juga mengkaji perbandingan dengan lembaga peradilan konstitusional di negara lain, seperti Amerika Serikat dan Jerman, untuk menilai efektivitas dan relevansi peran MK dalam konteks global. Hasil penelitian menunjukkan bahwa MK memiliki peran yang sangat penting dalam menjaga dan menegakkan hak-hak kewarganegaraan, melalui uji materiil terhadap undang-undang yang dinilai bertentangan dengan UUD 1945. Melalui sejumlah putusan penting, MK telah berhasil menguatkan perlindungan terhadap hak-hak individu, seperti kebebasan beragama, hak atas pendidikan, dan hak privasi. Namun, tantangan dalam implementasi putusan dan potensi tekanan politik menjadi hambatan bagi efektivitas MK. Dibandingkan dengan lembaga peradilan konstitusional di negara lain, MK memiliki tantangan tersendiri terkait dengan konteks sosial, politik, dan budaya Indonesia.

Agrarian problems are problems or disputes regarding agrarian objects, which often occur, namely disputes regarding ownership of their land rights, including the transfer of land rights through sale and purchase with the object of Letter C land. Based on this context, the author will discuss the validity of notarial deed against sale and purchase of land letter c object. The method used is normative juridical with a statutory approach, conceptual approach, and case approach. The study understands the concept of the validity of a notarial deed against the object of the Letter C of the land under study, then describes the relevant legal materials that have been obtained and then clarified based on the formulation of the problem. The results of the study show that a sale and purchase deed with a Letter C land object is considered valid if it meets the legal requirements of an agreement based on Article 1320 BW, and in the practice of buying and selling land objects that have not been titled based on customary law has fulfilled the principles of light, cash and real, and in the process of registering a certificate for the first time must attach complementary documents. The authority to make a Sale and Purchase Deed if the land object has not been titled or Letter C / Girik / Petok, the majority of which are located in the village, the sale and purchase deed can be made by PPAT Camat. The suggestion in this research is that people who will or want to trade their land, should avoid buying and selling with a deed under the hand, this will result in the land object being vulnerable to disputes because it does not have strong evidence to prove ownership of land rights, it would be better to sell and buy land according to the regulations set by the government.

The Regional Head Elections (Pilkada) serve as a profound expression of direct democracy, empowering citizens with the responsibility to select their local leaders. Nevertheless, the amendment of Law No. 10 of 2016 pertaining to Pilkada frequently incites debate, particularly in relation to the criteria for nominations and the requisite support threshold. This analysis seeks to examine constitutional law through the lens of the interaction between the Constitutional Court and the DPR regarding the annulment of the Pilkada Law revision. The proposed revision of the Pilkada Law by the DPR in August 2024 is intricately connected to the ruling of the Constitutional Court. This research methodology employs a normative legal framework, grounded in primary legal texts including Constitutional Court rulings and statutory regulations, alongside secondary scholarly literature. The findings of the study indicate that the DPR's failure to adhere to the Constitutional Court's ruling undermines the supremacy of the constitution and disturbs the equilibrium of checks and balances among state institutions. The ramifications of the annulment of this revision result in the 2024 Pilkada adhering to the extant provisions set forth by the Constitutional Court; however, it engenders a climate of uncertainty within the legislative process and diminishes public confidence in the legal framework. This study's originality is rooted in its comprehensive examination of the interplay between legislative and judicial institutions within the framework of Pilkada policy formation, a topic that is seldom explored in the realm of constitutional law. This research offers a fresh viewpoint on the legal and political ramifications stemming from the DPR's disregard for the Constitutional Court's ruling. Nonetheless, this study presents certain limitations as it concentrates solely on the normative dimension, neglecting to examine the political dynamics and interests of the stakeholders involved in the amendment of the Pilkada Law. Furthermore, this study has yet to investigate the enduring effects on the democratization process and the legal stability within Indonesia.

Money laundering in the Indonesian banking sector has become a major issue affecting economic stability and national security. This article analyzes the implementation of Law No. 8 of 2010 concerning the Prevention and Eradication of Money Laundering, focusing on the challenges in identifying and handling illegal transactions amidst the complexity of the financial system. Through a qualitative method with a normative legal approach, this study reveals various weaknesses in the implementation of existing regulations. The results of the study indicate the need to update the legal framework to be more responsive and effective in dealing with the dynamics of money laundering. Recommendations put forward include strengthening cross-agency cooperation, utilizing advanced technology to detect suspicious transactions, and increasing education and training for stakeholders in the banking sector. This strategy is expected to not only strengthen domestic supervision but also encourage international collaboration to combat money laundering more broadly. The findings of this study emphasize the importance of adaptive regulatory updates and the use of technological innovation to create a more transparent and secure financial system. With these steps, it is hoped that Indonesia will be able to strengthen economic stability, increase public trust in the banking sector, and contribute to global efforts to eradicate financial crime.

Penelitian ini dilatarbelakangi oleh kurangnya pemahaman masyarakat mengenai perjanjian perkawinan yang mengatur pemisahan harta, khususnya bagi pasangan yang berhubungan dengan perjanjian timbal balik antara kreditur dan debitur. Banyak debitur yang telah menikah tidak memiliki perjanjian pemisahan harta, sehingga ketika terjadi pailit, aset dalam perkawinan dapat terdampak. Kepailitan dapat disebabkan oleh berbagai faktor, baik dari aspek individu maupun bisnis. Berdasarkan putusan pengadilan niaga, status pailit membawa konsekuensi hukum, termasuk terhadap harta bersama dalam perkawinan. Masalah muncul karena sistem hukum perkawinan di Indonesia pada dasarnya menganut konsep harta bersama, kecuali jika pasangan telah membuat perjanjian pisah harta sebelum menikah melalui perjanjian pranikah (prenuptial agreement). Penelitian ini bertujuan untuk menganalisis implikasi hukum putusan pailit terhadap harta suami-istri serta menelaah perlindungan hukum bagi pasangan yang tidak memiliki perjanjian pemisahan harta. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan studi kasus terhadap putusan pengadilan. Hasil penelitian menunjukkan bahwa tanpa adanya perjanjian pemisahan harta, harta bersama dalam perkawinan dapat disita untuk menyelesaikan utang debitur pailit. Namun, Mahkamah Konstitusi melalui Putusan No. 69/PUU-XIII/2015 telah merevisi Pasal 29 Undang-Undang Perkawinan, yang kini memungkinkan perjanjian pisah harta dibuat setelah perkawinan berlangsung. Perubahan ini memberikan perlindungan lebih bagi pasangan suami-istri dalam menghadapi risiko finansial akibat kepailitan.

This article explores the teaching of civic engagement in academic environments, focusing on its potential to generate new knowledge and inspire social and personal action. It advocates for regulatory measures to ensure a fair and balanced curriculum that supports diverse perspectives and fosters productive discourse, encouraging active student participation in civic life. Rooted in the Fourteenth Amendment’s equal protection clause, which guarantees equal treatment and opportunities, the article underscores the importance of giving all students a well-rounded education. Applying these principles, the article calls for a more equitable civic education system that empowers students to contribute meaningfully to their communities. The proposed regulatory remedies aim to create a curriculum that embraces diverse worldviews, promoting open and respectful discussions among students. This inclusive approach fosters critical thinking and helps students gain a deeper understanding of different perspectives, which can enhance their civic engagement. Additionally, the article highlights the need for safeguards against biased or exclusionary educational practices, ensuring that all students, regardless of background or belief, have equal access to educational opportunities. Dismantling barriers and fostering fairness will help equip students with the knowledge and skills needed to participate in their communities actively. This article examines a dilemma inherent in our reliance on new technologies that promise to improve legal governance's imperfections. On the one hand, there is widespread dissatisfaction with the current state of legal governance, which is often rooted in the inherently human nature of the legal system. Despite this, we remain emotionally and philosophically tied to the human-centred aspects of legal governance. On the other hand, we recognize the potential advantages that technological governance could bring, although this may come at the expense of reducing human involvement. Struggling between these two opposing forces, we try to preserve the human element by emphasizing that governance must respect human rights and dignity, or more specifically, that technology’s application should be constrained to maintain a human-centric approach. With the increasing demand for technology that serves human interests, we reflect on the extent to which humans should and could utilize new tools to improve the imperfections of legal governance. Should these tools merely assist human decision-making, or could they replace human involvement altogether? Or, might we eventually transition to a system of governance that relies on technological management of spaces, products, and processes, thereby reducing the need for human involvement and rule-based systems? In conclusion, it is critical that new technologies be carefully regulated in all areas of governance and across all human societies to prevent undermining the essential conditions that sustain viable human communities and their governance systems.

The banking industry of Ethiopia plays a crucial role in the country's economy. Like the financial institutions and service sectors, the activities of commercial banks mainly depend on customers. Therefore, the major objective of this study is to assess the effect of quality service delivery on customer satisfaction, as shown in the case of Awash Bank in Nekemte District. To attain this objective, a questionnaire was designed and categorized under the five dimensions of the Servequal model. The sample consists of 202 respondents selected based on a convenience sampling procedure. This study used a quantitative research design and both primary and secondary data. The collected data was analyzed with the help of SPSS version 24. Pearson Correlation analysis was used to assess the relationship between dependent and independent variables. The correlation results indicate that there is a positive correlation between the dimensions of service quality and customer satisfaction. The results of the regression test showed that offering quality service has a positive impact on overall customer satisfaction. The findings of the analysis showed that the performance of Awash Bank in Nekemte District in providing quality service is not in a position to meet the expectations of the customer. Low service quality leads to low customer satisfaction. Based on this, the researcher suggested that in order to improve the performance of the bank, Awash Bank should provide training to its customer service officers to provide individual attention to its customers. Improving the physical appearance and facilities of its branches should also be done to enhance the tangibility of its services. Further, periodic measurement of service quality and customer satisfaction should be practised.

The practice of transferring a Home Ownership Loan (KPR) through underhand agreements is still common in society, especially when the debtor is no longer able to continue their credit obligations. This transfer is generally carried out without the approval of the bank as the creditor and without involving authorized officials, thus giving rise to legal issues related to legal certainty and protection for the buyer. This article aims to examine the legal protection of the practice of transferring a KPR through underhand agreements and examine the legal principles that can serve as a basis for protection for parties acting in good faith. The research method used is normative juridical legal research with a statutory and conceptual approach, through a review of primary, secondary, and tertiary legal materials. The results of the study indicate that underhand KPR transfers do not provide optimal legal certainty because they do not comply with formal banking and land law procedures. However, from a civil perspective, such agreements can still be considered valid as long as they meet the requirements for a valid agreement and are carried out in good faith. Legal protection for buyers can be obtained through the application of the principle of good faith, consumer protection, and dispute resolution mechanisms through the courts.

The escalation of sexual violence against children in Indonesia, particularly acts categorized as rape, has reached an alarming stage. Statistical data indicate that incidents of rape occur approximately once every four hours. In responding to crimes of sexual violence against children, two primary approaches are generally adopted. The first approach emphasizes the imposition of severe criminal sanctions on perpetrators. The second approach focuses on the recovery of child victims through restitution mechanisms. Developments in criminal law demonstrate that legal reform has the potential to influence social change by ensuring compensation or restitution for child victims of criminal acts. This research aims to examine the implementation of restitution rights for victims of child sexual violence as regulated under Government Regulation of the Republic of Indonesia Number 43 of 2017, as well as to analyze the application of restorative justice through the fulfillment of restitution for child victims of crime. This study employs a normative legal research method based on library research. The findings reveal that restitution, as regulated under PP RI No. 43 of 2017, constitutes a legal right of child victims of crime. Furthermore, the willingness and active participation of victims, perpetrators, and the community in addressing criminal conduct represent fundamental elements in the realization of restorative justice in cases involving child victims.
