Abstract

Pemilu 2024 di Indonesia menandai tonggak penting dalam demokrasi di tengah era disrupsi digital, menghadapi tantangan kompleks seperti meningkatnya penggunaan media sosial dan platform digital untuk kampanye politik. Badan Pengawas Pemilihan Umum (Bawaslu) dihadapkan pada urgensi berinovasi dalam mengawasi proses pemilu di era digital ini, dengan fokus pada generasi muda yang dominan dalam pemilih. Bawaslu mengembangkan inovasi seperti aplikasi Siwaslu dan Gowaslu, meski menghadapi kendala infrastruktur dan literasi digital di berbagai daerah. Penelitian ini bertujuan menganalisis inovasi Bawaslu dalam mengatasi tantangan Pemilu 2024, serta mengidentifikasi peluang dan hambatan implementasinya. Penelitian ini menggunakan pendekatan Systematic Literature Review (SLR) dengan fokus pada analisis yuridis normatif, mencakup bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa penyebaran disinformasi dan hoaks, kesenjangan kompetensi digital, dan peningkatan beban kerja menjadi tantangan utama Bawaslu. Untuk mengatasinya, Bawaslu berkolaborasi dengan lembaga lain, meningkatkan literasi digital, dan mengembangkan sistem pengawasan digital berbasis AI dan big data. Peluang utama terletak pada peningkatan infrastruktur digital dan literasi masyarakat, namun hambatan seperti kesenjangan digital dan keterbatasan literasi digital masih perlu diatasi. Penelitian ini memberikan saran untuk mempercepat peningkatan kapasitas SDM, memperkuat kerjasama antar lembaga, mengembangkan strategi pengawasan adaptif berbasis data, serta memprioritaskan pemerataan akses dan literasi digital. Dengan implementasi saran ini, diharapkan Bawaslu dapat meningkatkan perannya sebagai "strażnik demokrasi digital" dalam menjaga integritas Pemilu 2024 dan seterusnya.

Abstract

Dengan keberadaan hukum adat yang telah mengatur berbagai aspek kehidupan sosial, ekonomi, dan spiritual selama berabad-abad, tantangan utama yang dihadapi adalah bagaimana mempertahankan relevansi dan efektivitasnya di era digital dan global saat ini. Tujuan penelitian ini untuk menunjukan bahwa Kolaborasi antara pemangku adat, pemerintah, dan akademisi merupakan elemen kunci dalam pengembangan dan pelestarian hukum adat di era digital dan global. Penelitian kualitatif menggunakan pendekatan deskriptif untuk menghimpun data secara sistematis, faktual, dan cepat sesuai dengan gambaran saat dilakukan penelitian. Hasil penelitian ini menunjukan bahwa Di tengah dinamika sosial yang semakin kompleks dan tantangan global yang semakin berat, kerjasama yang sinergis antara ketiga pihak ini menjadi semakin penting.

Abstract

Effective corporate governance (CG) is the key to preventing business malpractice, such as fraud and corruption, which continues to be a global challenge. This research aims to explore the effectiveness of legal mechanisms in increasing corporate accountability and preventing business malpractice. This study focuses on identifying and evaluating various legal instruments that support CG implementation in various jurisdictions, as well as their impact on preventing business malpractice. This research uses a Systematic Literature Review (SLR) approach to collect and analyze 27 relevant articles from the Scopus, Web of Science and Springer databases. The literature selection process follows the PRISMA flow, which includes the stages of identification, screening and article eligibility. The research results show that legal instruments, such as government regulations, anti-fraud policies, and external monitoring systems, play a significant role in increasing corporate accountability. In addition, the implementation of law-based CG is effective in creating transparency, strengthening stakeholder protection, and preventing fraud and corruption. This study also found variations in legal instruments between countries, which were adapted to their respective social, political and economic conditions. This study confirms that the effectiveness of corporate governance is greatly influenced by the existence and implementation of strong legal mechanisms. Therefore, collaboration between the government, regulators and companies is needed to strengthen the legal system to support corporate governance that is accountable and free from business malpractice.

Abstract

In today's digital era, cybercrime has increased significantly, posing major challenges to individuals and the legal system. Although much research focuses on technical and preventive aspects, legal protection for victims is still given little attention, creating gaps in access to justice. This research aims to identify and analyze the legal challenges faced by victims of cyber crime in obtaining justice and adequate protection. By using the approach Systematic Literature Review (SLR) and PRISMA guidelines, this research collects and analyzes articles peer-reviewed from Scopus, Web of Science and Springer databases. Data was analyzed thematically to identify patterns and key issues. Findings show that key challenges include disharmony in international regulations, jurisdictional issues, and limited victim protection in national laws. In addition, the lack of psychological support and the unpreparedness of law enforcement officers worsened the victim's condition. This research emphasizes the need for policy reform that is more responsive to the needs of cybercrime victims, as well as closer international collaboration to improve protection and access to justice. These findings contribute to the development of victimology theory and more inclusive legal practice.

Abstract

In recent decades, digital technologies, especially blockchain and smart contracts, have significantly changed the legal and contractual paradigm. However, the main challenge faced is the legal uncertainty regarding the recognition and enforcement of smart contracts in various jurisdictions. This research aims to explore how smart contracts can be recognized and enforced within existing legal frameworks in various legal systems, including common law and civil law. Using a Systematic Literature Review (SLR) approach, this research identifies, analyzes and synthesizes relevant literature from leading academic databases. Strict inclusion and exclusion criteria were applied to ensure the validity and relevance of the data. The findings show that legal recognition of smart contracts varies significantly between countries, with some countries having adopted supportive regulations, while others are still stuck in traditional legal interpretations. This research also identifies the urgent need for harmonization of international law to address existing uncertainties. These findings have important implications for policy makers and legal practitioners, highlighting the need for legal reform that is responsive to technological innovation. This research contributes to the development of more adaptive legal theory and practice in facing digital challenges.

Abstract

Penelitian ini membahas perbandingan konsep Extended Producer Responsibility (EPR) dalam kebijakan pengelolaan limbah baterai kendaraan listrik antara Indonesia dan Swedia. Di tengah akselerasi penggunaan kendaraan listrik sebagai bagian dari strategi dekarbonisasi nasional, Indonesia masih menghadapi kekosongan hukum terkait pengelolaan limbah baterai yang tergolong sebagai limbah Bahan Berbahaya dan Beracun (B3). Penelitian ini menggunakan pendekatan yuridis normatif dengan metode perbandingan, konseptual, dan perundang-undangan untuk mengkaji praktik hukum di Swedia sebagai negara anggota Uni Eropa yang telah mengadopsi Battery Regulation (EU) 2023/1542. Temuan menunjukkan bahwa Swedia secara progresif mengimplementasikan EPR melalui sistem pengumpulan, daur ulang, dan pemulihan material yang terintegrasi dan berbasis digital, sedangkan Indonesia masih terbatas pada pengaturan umum dan belum menyentuh baterai kendaraan secara spesifik. Dalam konteks ini, penelitian merekomendasikan pembentukan kerangka hukum ius constituendum di Indonesia yang tidak hanya merujuk pada praktik global, tetapi juga berakar pada kaidah hukum Islam Dar’ul Mafasid Muqaddam ‘ala Jalbil Mashalih dan pendekatan ekosentrisme, guna menjamin keberlanjutan lingkungan dan keadilan antargenerasi.

Abstract

The criminal justice system in Indonesia has long been dominated by a retributive approach that emphasizes punishment as a form of justice. This approach often fails to meet the needs of perpetrator rehabilitation and victim recovery, leading to criticism of its effectiveness. This study aims to evaluate the effectiveness of restorative justice as an alternative in criminal justice system reform in Indonesia, focusing on its impact on victim satisfaction and reducing recidivism rates. This study uses a Systematic Literature Review (SLR) approach to identify, assess, and synthesize findings from 51 relevant articles. Data collected from the Scopus, Web of Science databases were analyzed using thematic analysis techniques. The findings indicate that the implementation of restorative justice can increase victim satisfaction and reduce recidivism rates, as well as strengthen community involvement in the justice process. This study confirms that restorative justice has significant potential to improve the criminal justice system in Indonesia, with important implications for the development of policies that are more inclusive and responsive to the needs of all parties involved.

Abstract

Online violence against vulnerable groups is increasing, but evaluation of the effectiveness of the law in providing justice and restitution for victims is still limited. This study examined the effectiveness of the implementation of laws related to online violence in providing protection and compensation to victims in various jurisdictions. The research method was carried out by means ofSystematic Literature Review with PRISMA 2020 protocol, using Scopus, Web of Science databases. Thematic coding analysis to identify patterns of legal effectiveness and implementation challenges.Of the 19 articles, the effectiveness of the law is highly dependent on the context of the judicial system, institutional capacity, and national regulatory framework. Approachvictim centered showing a more effective response, but the implementation of victims' rights is still uneven and support is inadequate.Legal protection for victims of online violence remains fragmented and inconsistent globally. Regulation based on victim centered justice potentially increases justice and protection. Further research is suggested to focus on empirical experiences of victims.

Abstract

This research aims to determine the age limit of children and efforts to protect children in conflict with the law in Nanggroe Aceh Darussalam. This research is descriptive normative legal research. The approaches used are case approach and statutory approach. The technique of collecting legal materials uses literature study by using juridical analysis techniques in the form of exposure to legal materials. Based on the results of research and discussion, the author concludes that the legal system in Indonesia oversees several forms of main law in its existence in order to realize dignified justice, customary law is a complementary law, as is the case in NAD which is part of the national legal system, in dealing with one another subject to regulations and jinayat law. The existence of customary criminal law in life adds to the diversity of law, so that society is more awake with all the arrangements that exist geographically and has implemented qanun as a law specifically against children in conflict with the law.

Abstract

Ketentuan hukum yang berhubungan langsung dengan pemeliharaan kesehatan disebut hukum kesehatan, Tingkat malpraktek di Indonesia sangat buruk, hal ini dapat dilihat dari peningkatan angka malpraktik setiap tahun. Keadaan ini jelas berdampak pada pencari keadilan untuk korban. Dalam perkembangan yang sangat pesat ini sering muncul kasus-kasus dalam pelayanan kesehatan yang mengakibatkan kinerja dokter diragukan serta mengancam keberlangsungan karir seorang dokter. Tujuan penelitian ini untuk mengetahui Bagaimana penegakan hukum pidana dalam praktik kedokteran gigi illegal. Bagaimana perlindungan hukum bagi korban dalam praktik kedokteran gigi illegal. Adapun metode yang digunakan adalah yuridis normatif yang bertujuan untuk menganalisis penegakan hukum terhadap praktik kedokteran gigi ilegal serta perlindungan hukum bagi korban yang terdampak. Dengan menggunakan pendekatan normatif, penelitian ini menelaah peraturan perundang-undangan terkait praktik medis, khususnya Undang-Undang Nomor 36 Tahun 2014 dan Undang-Undang Nomor 17 Tahun 2023 serta ketentuan dalam Kitab Undang-undang Hukum Pidana mengenai penipuan. Data sekunder diperoleh dari berbagai sumber hukum dan dianalisis secara sistematis. Hasil penelitian menunjukkan bahwa penegakan hukum terhadap pelaku dokter palsu masih menghadapi tantangan, terutama dalam aspek perlindungan pasien. Penelitian ini menekankan pentingnya penguatan regulasi, penerapan sanksi yang tegas serta pemberian restitusi sebagai bentuk perlindungan terhadap korban.
