Abstract

Abstract

Abstract

Corruption in Hajj governance has the potential to cause state financial losses and erode public trust in a religious service that should be administered transparently and accountably. This study analyzes corruption-prevention strategies in Hajj governance through the role of the Corruption Eradication Commission (KPK) in realizing good governance and examines the constraints encountered in their implementation following the revision of the KPK Law. The study employs normative legal research using statutory and conceptual approaches and a literature review of primary, secondary, and tertiary legal materials. The findings show that the KPK's role in Hajj governance is not limited to repressive functions through its authority to conduct inquiries, investigations, and prosecutions of corruption offenses; it also encompasses preventive measures through strengthened oversight, service digitalization, greater transparency in Hajj fund management, and inter-institutional coordination. These strategies are important instruments for advancing the principles of good governance, particularly transparency, accountability, effectiveness, and integrity in public service. However, implementation continues to face bureaucratic complexity, weak institutional coordination, potential conflicts of interest, and constraints on the effectiveness of the KPK's authority following the legislative revision. The novelty of this study lies in its analysis of corruption prevention in Hajj governance by focusing on the KPK's preventive role after the revision of the KPK Law as part of broader efforts to realize good governance.

Abstract

Diversion is a key mechanism in Indonesia's juvenile criminal justice system that promotes restorative justice in resolving cases involving children in conflict with the law. This study examines the implementation of diversion at the investigation stage at the Padangsidimpuan Resort Police, focusing on its procedures, supporting and inhibiting factors, and its relevance to Islamic criminal law. Using a qualitative field research approach, primary data were collected through in-depth interviews with two investigators from the Women and Children Protection Unit (PPA) and the Head of Administrative Affairs of the Criminal Investigation Unit. Secondary data were obtained from legislation, books, and scholarly articles. The findings indicate that diversion has generally been implemented in accordance with Law Number 11 of 2012 through deliberation involving investigators, children, victims, parents, and Community Counselors. However, administrative procedures and post-diversion monitoring remain suboptimal. Key obstacles include victims' reluctance to reconcile, limited public understanding, and insufficient family support. From an Islamic criminal law perspective, diversion aligns with sulh, ta'dib, and maqasid al-shari'ah.

Abstract

This study analyzes the governance of population administration services at the Population and Civil Registration Office of Pidie Regency and the barriers that constrain service optimization. A descriptive qualitative approach was employed, with data collected through in-depth interviews, observation, and documentation; informants were selected purposively. The findings reveal a performance paradox: document ownership is very high, including electronic identity card (KTP-el) ownership of 99.82% in 2025, yet access and service experiences remain unequal. The expansion of mobile outreach services has broadened service reach, although reliability continues to be affected by network disruptions and the Population Administration Information System (SIAK). Digitalization has reduced distance-related barriers for some residents, but limited digital understanding, uneven dissemination of information on requirements, and the dominance of vertical accountability constrain its effectiveness. The study concludes that improvements should be directed toward a hybrid service architecture integrating digital channels, mobile outreach services, village (gampong)-subdistrict support, preliminary verification of requirements, and measurable complaint mechanisms so that services become more inclusive, reliable, and accountable.

Abstract

This study analyzes the effects of the policy governing the appointment of Government Employees with Work Agreements (PPPK) on the bureaucratic structure and fiscal capacity of the Lhokseumawe City Government. The study employed a descriptive-analytical qualitative approach, with data obtained through in-depth interviews, observation, and document analysis. The analysis used the dimensions of effectiveness, efficiency, and responsiveness. The findings show that the PPPK policy was effective in providing certainty of employment status for non-ASN personnel and strengthening staffing availability in basic service sectors. However, large-scale appointments were not fully accompanied by adjustments to Job Analysis, Workload Analysis, competency distribution, and fiscal capacity. This condition resulted in concentrations of personnel in administrative functions, overlapping work, uneven staff distribution, and increasing pressure from personnel expenditure. The study identifies a phenomenon of numerical expansion without functional consolidation, in which personnel numbers increase more rapidly than organizational functions are restructured. Post-appointment restructuring through the revalidation of staffing needs, competency redistribution, strengthened performance management, and integration of workforce and fiscal planning is therefore essential to achieve a more effective and sustainable bureaucracy.

Abstract

This study analyzes the implementation of green economy policy through the Village Fund in Damaran Baru Tourism Village, Bener Meriah Regency, and the constraints affecting its implementation. The study employs a descriptive qualitative approach using data obtained through in-depth interviews, non-participant observation, and documentation. The analysis draws on the four policy implementation dimensions proposed by George C. Edwards III: communication, resources, disposition, and bureaucratic structure. The findings show that green economy principles have begun to be implemented through the allocation of approximately 3% of the Village Fund for ecotourism development, the Eco Village, protected-forest tourism, camping grounds, and local economic activities based on natural potential. Implementation, however, remains suboptimal because public communication is predominantly one-way, implementers' technical capacity and digital literacy are limited, commitment has not been fully institutionalized, SOPs have not been standardized, and cross-sectoral coordination remains sporadic. The available evidence is stronger in demonstrating the orientation and process of implementation than in measuring economic and ecological outcomes; changes in income, employment opportunities, waste reduction, resource efficiency, and environmental carrying capacity have not yet been documented quantitatively. The study concludes that strengthening institutional capacity is a critical prerequisite for translating fiscal commitment into sustainable green economy outcomes.

Abstract

The development of carbon markets has transformed forest ecosystem services into economically tradable assets, while raising legal uncertainty over carbon rights in areas overlapping with customary territories. This study examines normative conflicts and competing interests arising from the proposed carbon-trading activities involving PT Perkasa Bumi Hijau Unit I and the Moi Indigenous People in the Salawati Islands, and formulates an equitable dispute-resolution framework. Employing normative legal research, the study applies statutory, case, conceptual, and analytical approaches to relevant constitutional provisions, judicial decisions, investment regulations, carbon-governance rules, scholarly literature, institutional reports, and advocacy documents. The findings show that carbon-rights disputes cannot be understood merely as licensing conflicts, as they involve the interaction between state authority, investment certainty, customary rights, participatory rights, and the distribution of economic benefits. Using Roscoe Pound’s Interest Theory, this study proposes a fair carbon governance model comprising recognition of Indigenous Peoples as principal rights-holders, meaningful FPIC/PADI, transparent benefit sharing, participatory zoning, and an independent grievance mechanism. Its novelty lies in integrating Interest Theory with carbon-rights governance to link legal status, consent, and distributive justice in resolving disputes involving customary territories.

Abstract

This study analyzes the implementation of the State Property (Barang Milik Negara/BMN) use policy for office land and buildings within the jurisdiction of KPKNL Lhokseumawe following the enactment of Minister of Finance Regulations No. 40 and No. 138 of 2024. Using a qualitative descriptive case-study approach, data were collected through interviews, observation, documentation, SBSK reports, and SIMAN V.2, and analyzed using the six variables of Van Meter and Van Horn. The findings show that policy implementation is relatively adaptive and accountable, supported by digital systems, implementer commitment, and internal coordination. However, significant discrepancies remain between actual assets and Goods Standards and Needs Standards: office land exceeds the standard by 24.6%, while office buildings exceed it by 84.2%. Implementation is further constrained by limited personnel and supervisory budgets, uneven connectivity, and perceptions concerning asset-transfer risks. The study distinguishes structural gaps arising from historical assets from operational implementation gaps related to resources, communication, technology, and implementer disposition, highlighting the need for transitional strategies, risk-based supervision, and stronger data governance.

Abstract

This study analyzes the optimization of Regional Government Property management at the Financial Management Agency of Pidie Regency, focusing on utilization through loan-for-use arrangements, governance, and legal compliance. The study employs a descriptive qualitative approach involving eight purposively selected informants representing asset-management, utilization, information-system, and supervisory functions. Data were obtained through in-depth interviews, non-participant observation, and a review of asset-management and evaluation documents covering the 2022-2024 period. The findings show that loan-for-use arrangements support efficiency in the use of public facilities but continue to face problems involving delayed returns, asset discrepancies, and the predominance of administrative supervision. At the same time, the conformity between physical assets and administrative records increased from 69% in 2022 to 91.7% in 2024, based on 1,278 asset samples evaluated. The study concludes that optimization requires standardized procedures, strengthened personnel capacity, digital-data integration, risk-based supervision, and compliance follow-up integrated into a single control cycle.
