Abstract

The discussion on the interaction between consumption politics and Islamic Economic Law has become increasingly significant due to growing attention towards halal products, social justice, and economic sustainability. The aim of this research is to analyze the influence of political policies on consumption behavior within the framework of Islamic economics and to identify the implications and challenges of its implementation. The study employs a qualitative approach with descriptive analysis, using data from literature reviews and relevant policies. The findings reveal that consumption politics based on Islamic principles can strengthen social justice, foster the growth of the halal industry, and empower local economies, although challenges remain in terms of monitoring infrastructure, global halal standard harmonization, and consumer literacy. The implication is that effective policies in Islamic consumption politics can promote more inclusive and sustainable economic growth, supported by the synergistic roles of government, businesses, and society.

Abstract

The purpose of this study was to determine the application of the rubber farmers' profit sharing system in Dharmasraya Regency and to find out the Islamic economic review of the application of the rubber farmers' profit sharing system. Data collection techniques used are interviews and documentation. From the research that has been done, it can be concluded that the application of the profit-sharing system to rubber farmers uses a ratio of 50:50, meaning that 50% is for rubber plantation owners and 50% is for rubber tappers. because the garden owners bear the full maintenance costs and they only use the services of rubber farmers to tap their gardens. And in setting the selling price, they refer to the standard market price in the local area, this closes the opportunity for rubber farmers to exploit, because they cannot determine the price personally. If judged from the point of view of Islamic economic studies, the application of the profit-sharing system for rubber plantations in Jorong Kampung Baru Nagari Koto Salak, Dharmasraya Regency, is in accordance with Islamic economics.

Abstract

Sharia-based fintech lending has experienced rapid growth in Indonesia, including through the SPinjam feature that operates within the Shopee ecosystem. One of the most crucial aspects in ensuring the sharia compliance of these services is the mechanism for billing and imposing late fees, given the potential for elements of usury, gharar, and dzulm to arise if they are not applied in accordance with sharia provisions. Fatwa DSN-MUI No. 106/2016 emphasizes that penalties are only permitted as ta'zîr for debtors who can pay but deliberately delay payment, and that penalty funds must be channeled entirely to social activities and cannot be used for institutional profit. This study aims to analyze the suitability of the collection and penalty mechanisms for SPinjam in accordance with the fatwa's provisions. The research method used is a normative-empirical approach through regulatory studies, fatwa analysis, documentation of SPinjam's official policies, and observation of application features. The findings indicate inconsistencies, particularly regarding the lack of transparency in the allocation of penalty funds, the potential involvement of third parties in collection that may conflict with Sharia ethics, and the possibility of usury if penalties are categorized as income. In addition, no specific mechanism was identified to provide relief to debtors experiencing difficulties, thereby raising the possibility of injustice. This study recommends stricter Sharia audits, increased operational transparency, strengthening the role of the Sharia Supervisory Board (DPS), and harmonizing collection SOPs with the principles of justice, benefit, and legal certainty in Sharia.

Abstract

Maqashid al-Syariah is part of the study of Islamic law to find out the purpose and wisdom of the commands and prohibitions of Islamic law. So that the human mind not only believes in the truth of revelation through the Qur'an and Sunnah, but can also understand the values of maslahat for life. Basically, maqasid al-syariah requires Muslim women to cover the aurat is one way to protect it. Therefore, clothing becomes a way for a woman to cover her aurat. However, there are characteristics of women's clothing that is hated by Allah SWT and Rasulullah SAW is clothing that seems excessive. The attitude of exceeding limits or exaggeration in religion is called ghuluw. Wearing excessive clothing while riding a motorcycle will cause the maqashid al-syariah not to be maintained, such as: hifdz al-nafs, hifdz al-aql, hifdz an-nasl, and hifdz al-mal, because excessive clothing while riding a motorcycle can cause danger for several reasons, such as: interference with concentration; potentially can be squeezed on the engine or motorcycle wheels; risk of falling or falling; interference with visibility; potential for wind; and danger on the route and road conditions.

Abstract

Penelitian ini bertujuan untuk mengupas bagaimana perspektif etika bisnis Islam terhadap praktik simpan pinjam pada kelompok Yasinan Al-Hikmah di Kenagarian Sisawah Kec. Sumpur Kudus Kab. Sijunjung. Dalam proses simpan pinjam ini menggunakan sistem bunga yang ditentukan pada awal akad. Bunga yang ditetapkan itu sebesar 10 % dalam setiap simpan pinjam yang dilakukan dalam jangka 1 tahun. Rumusan masalah dalam skripsi ini adalah bagaimana perspektif etika bisnis Islam terhadap praktik simpan pinjam pada kelompok Yasinan Al-Hikmah di Kenagarian Sisawah Kec. Sumpur Kudus Kab. Sijunjung. Untuk menyelesaikan karya ilmiah ini penulis mengumpulkan data dengan melakukan penelitian lapangan, yaitu observasi terhadap simpan pinjam . Kemudian penulis melakukan wawancara kepada pengurus dan anggota kelompok Yasinan Al-Hikmah, Tokoh Agama, Tokoh Adat. Tokoh Masyarakat (Wali Nagari) yang ada di Kenagarian Sisawah Kec. Sumpur Kudus Kab. Sijunjung. Penelitian ini juga didukung oleh penelitian kepustakaan sebagai landasan teori utang piutang dan riba. Dari penelitian yang dilakukan dapat disimpukan bahwa, 1. Perspektif anggota kelompok Yasinan al-Hikmah mengenai praktik simpan pinjam pada kelompok Yasinan al-Hikmah sudah sesuai dengan etika bisnis Islam yang dapat dilakukan dalam kehidupan sehari-hari. 2. Perspektif masyarakat baik dari Tokoh Agama, Tokoh Adat, dan Tokoh Masyarakat terhadap simpan pinjam yang dilakukan oleh kelompok Yasinan al-Hikmah sudah sesuai dengan etika bisnis Islam karena dalam simpan pinjam tersebut ada jasa untuk setiap peminjaman dan tidak ada yang merasa dirugikan.

Abstract

This study aims to determine the implementation of the murabahah contract at the BPRS Haji poor Pandai Sikek. And to determine the management of murabahah financing at the BPRS Haji poor Pandai Sikek. The type of research carried out is field research, which is one method of collecting data with a qualitative research approach, namely research aimed at describing and analyzing phenomena of events, social activities, attitudes, beliefs, perceptions, thoughts of people in general. individually or in groups. Based on the results of the study, it shows that to see that murabahah financing is in accordance with sharia or cannot be seen from the scheme and the flow must be in accordance with the existing pillars and contracts and the murabahah financing process at the Haji Poor Pandai Sikek BPRS is in accordance with the FATWA DSN-MUI No. 4 of 2000 regarding murabaha financing.

Abstract

The growth of e-commerce in Indonesia has created a major transformation in the digital-based buying and selling system. However, this development also raises new challenges in ensuring that transactions that occur are in accordance with sharia principles. To answer the need for sharia legal certainty in digital transactions, the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) issued Fatwa No. 144-146 of 2021 concerning hawalah, kafalah, and wakalah bil ujrah contracts. This research aims to examine the implementation of the fatwa in e-commerce practices in Indonesia and analyze its relevance to the needs of sharia-compliant digital transactions. This research uses a qualitative approach with a library research method and normative-juridical analysis. Data were collected from the DSN-MUI fatwa, fiqh muamalah literature, e-commerce regulations, and document studies from several sharia marketplace platforms in Indonesia. The results show that the understanding and application of sharia contracts in e-commerce practices are still partial, not explicit, and often not understood by industry players. Wakalah bil ujrah contracts are mostly applied in the form of platform administration fees, but kafalah and hawalah contracts are still rarely found in consumer protection mechanisms and payment systems. This study recommends the need for integration between DSN-MUI fatwas and digital regulations by relevant authorities, as well as increasing sharia literacy among digital business actors. Thus, the principles of muamalah can be fully implemented in the Islamic e-commerce ecosystem in Indonesia.

Abstract

Islamic teachings prioritize justice and honesty in all aspects of human life, one of which is Islamic banking. The murabahah agreement on the Griya Simuda KPR product is now starting to become well-known among the public, but in the process there are still indications of an increase in installments or prices in the following years. Bank Syariah Indonesia determines selling price and margin policies that are inseparable from interest rates and competitor levels. This research aims to determine the mechanism of the murabahah contract for the Griya Simuda KPR product and how the contract is implemented, whether it is in accordance with sharia and applicable regulations. The method used in this research is a qualitative approach with library research and data sources obtained from primary data (secondary data). The data collection techniques in this research are documentation and interviews with data analysis, namely content analysis with the presentation of data. Based on the study carried out, it can be concluded that the first analysis of the murabahah contract on the Griya Simuda KPR product is categorized as a bilwakalah murabahah contract which is in accordance with sharia principles because all practices are still based on the DSN-MUI and KHES (Compilation of Sharia Economic Law) fatwas. If there is confusion in the contract, the bank will conduct an audience with the customer. The second increase in installments in the payment tenor for the Griya Simuda KPR product occurred due to several factors, namely adjustments to the margin (profit) which refers to the interest rate system which can change at any time depending on inflation, the profit target to be achieved and profit sharing with third parties. The high margin is to anticipate rising market interest rates or inflation so that if there is a large increase in interest rates, the bank will not experience real and significant losses.

Abstract

This study delves into the meaning of Maqashid Sharia (the objectives of Islamic law) within the context of the economy, aiming to elucidate its significance and application in contemporary economic practices. Maqashid Sharia, which encompasses preserving religion, life, intellect, progeny, and wealth, is a comprehensive framework guiding ethical and equitable economic behavior. This research employs a qualitative approach, analyzing primary Islamic sources—the Quran and Hadith—as well as scholarly interpretations to uncover the economic implications of Maqashid Sharia. The study highlights that Maqashid Sharia promotes a balanced economic system that prioritizes social welfare and justice, ensuring that economic activities contribute to society's overall well-being. Key principles derived from Maqashid Sharia include the prohibition of riba (usury), the importance of zakat (almsgiving), and the encouragement of fair-trade practices. These principles are designed to prevent exploitation, reduce poverty, and ensure wealth distribution among all societal members. Furthermore, the research explores contemporary applications of Maqashid Sharia in Islamic finance and banking, emphasizing how these institutions strive to align their operations with Islamic objectives. The findings reveal that incorporating Maqashid Sharia into modern economic systems can lead to more sustainable and socially responsible economic practices. This study contributes to the broader understanding of Islamic economics by providing insights into how Maqashid Sharia can be effectively integrated into modern economic policies and practices, promoting an ethical and equitable economic order in line with Islamic values.

Abstract

Human rights are rights inherent in human dignity as human beings created by God Almighty, such as the right to life, the right to achieve a decent life as a human being, the right to freedom and equality. It can be stated more explicitly that among the human rights guaranteed and recognized by the Qur'an and Hadith are personal rights, economic rights, human rights to receive equal treatment before the law and government, political rights, and social and cultural rights. This guarantee and recognition will not change despite various developments and changes in every aspect of life in society.
