Abstract

This research is motivated by the diversity of Muslim fashion traders in the Aur Kuning Konveksi Market, Bukittinggi City in calculating the trade zakat nishab. For further research, this research uses field research methods. Data collection techniques used interviews with 35 Muslim fashion traders and documentation. The collected data was processed and written using qualitative analysis which produced descriptive data. The findings in this research are that the calculation of the trade zakat nishab by Muslim fashion traders at the Aur Kuning Convection Market, Bukittinggi City has differences between one trader and another. This difference is influenced by several factors, including the level of understanding of traders regarding the nishab of trade zakat and the influence of existing culture, which makes traders only follow existing traditions without wanting to look for the correct source and in accordance with the provisions of trade zakat. It was also found that as many as 13% of the total 237 Muslim fashion traders did not calculate the nishab according to the provisions of trade zakat, such as calculating profits only, not calculating capital and debt, so the trade zakat paid was invalid.

Abstract

Latar belakang penelitian ini jika dilihat dalam penghimpunan wakaf uang ini tidak adanya kejelasan dalam pengelolaan dan tidak adanya sighat antara si wakif dan nazhir.  Adapun yang menjadi rumusan masalah dalam penelitian ini adalah Bagaimana penghimpunan wakaf uang melalui kotak wakaf masjid perspektif fikih wakaf (Studi kasus masjid Al-Ikhlas dan Masjid Raya Babussalam Pasar Baru, Kota Padang). Tujuan dari penelitian ini adalah untuk memberikan pemahaman kepada masyarakat, pengelola (nazhir) wakaf atau wakif yang melakukan wakaf uang melalui kotak wakaf ini agar lebih memahami apa itu wakaf uang yang sesuai dengan fikih wakaf. Metode penelitian yang digunakan dalam penelitian ini menggunakan jenis penelitian lapangan (Field Research) yaitu penelitian yang dilakukan dengan mengumpulkan data dari fenomena yang terjadi langsung, wajar dan alamiah. Adapun hasil dari penelitian ini dapat disimpulkan bahwa pelaksanaan penghimpunan wakaf uang melalui kotak wakaf masjid di masjid Al-Ikhlas ini dengan cara menyebarkan sebanyak 30 kotak wakaf ke toko-toko dan rumah makan. Sedangkan pelaksanaan penghimpunan wakaf uang melalui kotak wakaf masjid di masjid Raya Babussalam adalah dengan meletakkan kotak wakaf di masjid itu saja tanpa ada menyebarkan ke tempat-tempat lain. Berdasarkan perspektif fikih wakaf bahwa penghimpunan wakaf uang melalui kotak wakaf masjid di masjid Al-Ikhlas dan masjid Raya Babussalam ini tidak sesuai dengan ketentuan fikih wakaf karena tidak terpenuhinya seluruh rukun dan syarat dari wakaf uang tersebut. Abstract

Advances in digital technology have changed the way people make transactions, including through e-commerce platforms that are increasingly popular. For Muslims, compliance with sharia principles, especially related to the concepts of halal and haram, is becoming increasingly important. This article discusses the application of halal and haram concepts in e-commerce transactions from the perspective of sharia economic law. Through a qualitative approach and literature review method, this study explores important aspects that need to be considered so that e-commerce transactions are in accordance with sharia law. The main findings show that to comply with sharia, products and services offered through e-commerce must meet halal standards, including not containing prohibited materials and not engaging in prohibited activities such as riba and maysir. In addition, transparency in the transaction process is important to avoid the element of gharar (uncertainty). This research also emphasizes the importance of protecting consumer rights and fairness in transactions. By ensuring the implementation of halal and haram concepts, e-commerce transactions can provide economic benefits while being in line with Islamic teachings, supporting the creation of ethical and sustainable trade.

Abstract

Talking about money, Islam at the time of the prophet and before Islam was already familiar with currency and Islam began to print its own currency during the caliphate Umar bin Khatab. The dinars and dirhams that characterize the Muslims at that time, began to gradually disappear in the market when the Ayubbiyah dynasty came to power. Dinars and dirhams were replaced with ufulus or paper money. At that time there was a high price increase. This situation by Imaqrizi also called inflation. Because the prices of goods continue to rise due to the declining value of the currency, the demand for goods also decreases. These three conditions have brought Muslims to a global crisis that destroyed the previously built economic system. For this reason, the following will describe the relationship between money and prices at the macroeconomic level, both Islamic and conventional.

Abstract

The development of digital technology has changed the pattern of conventional transactions to be online-based through e-commerce. Although it offers convenience and efficiency, e-commerce transactions also have potential legal problems, especially related to the unclear product information, payment methods, and delivery systems, which lead to gharar elements. In sharia economic law, gharar is seen as a prohibited uncertainty because it has the potential to harm one party and injure the principle of justice in the contract. This research aims to examine the concept of gharar in the context of digital transactions and examine consumer protection mechanisms according to the perspective of sharia economic law. The method used is normative legal research with a qualitative approach through literature studies on classical and contemporary fiqh books, national regulations, and relevant fatwas. The results of the study show that e-commerce is prone to contain elements of gharar, both explicitly and implicitly. Therefore, consumer protection is needed that is not only based on positive law, but also integrates sharia principles such as honesty (sidq), clarity of contract (ablution al-'aqd), and trust. This study recommends the need for special regulations on sharia e-commerce and increasing digital muamalah literacy for the Muslim community.

Abstract

the application of a profit-sharing system carried out by the community by applying the concept of profit-sharing by calculating profits based on net results and calculated based on agreement. However, the determination of the agreement was not made in writing and there were no witnesses. This creates anxiety for the parties concerned because they are afraid that there will be no evidence in the event of fraud. This thesis aims to find out the profit sharing mechanism in gold mining, to find out the profit sharing system in the muamalah fiqh perspective, and to know the concept of profit sharing in gold mining in the muamalah fiqh perspective. The data used are primary data and secondary data. Primary data were obtained from informants using observation, interviews and documentation techniques. Secondary data obtained from books, theses, theses and laws and regulations. The data obtained is processed using data presentation in the form of reduction, display, and verification. The research resulted in the following conclusions. First, the profit sharing mechanism for gold mining is determined based on profit sharing. Second, the concept of the contract used is the mudharabah musytarakah contract. Third, the gold mining profit sharing system is not fully in accordance with the mudharabah concept because in practice there are still several provisions that have not been fulfilled in accordance with the provisions of Islamic law.

Abstract

The Sharia economic dispute in Indonesia is growing along with the rise of Sharia-based economic activities. This significant growth is followed by an increase in non-performing loans and the potential for an increase in sharia economic disputes submitted to religious courts. The research aims to map research topics on sharia economic disputes. This research uses a bibliometric method using bibliographic data with the VOSviwer application tool to analyze research trends and scientific patterns. This research obtained secondary data through a Google Scholar search on the Publish or Perish application. The results show research development in Sharia economic disputes in 2018-2023 from the publish or perish application on Google Scholar indexed search with the highest number of article publications in 2023, namely 51. Meanwhile, the most related scientific publication is the Journal of Islamic Business Law. Furthermore, the most productive writer's productivity for 2018-2023 was Fuadi S, with 4 articles published.

Abstract

The development of online games such as Mobile Legends has created various transaction models, including the purchase of virtual items, which raises questions regarding its suitability with the principles of Islamic economic law. This study aims to analyze the existence of the element of gharar (uncertainty) in the purchase of Mobile Legends virtual items based on the perspective of fiqh muamalah. The focus of the study includes the clarity of the transaction object (virtual item) and the payment mechanism. The method used is a qualitative approach with normative analysis of fiqh literature, related fatwas, and in-game transaction models. The results show that the purchase of virtual items in Mobile Legends has the potential to contain elements of gharar in the aspects of clarity of benefits, ownership, and continued access to items by users. In addition, the payment system based on digital currency (diamonds) that has no intrinsic value creates ambiguity in the sale and purchase contract. This study recommends improving the transaction mechanism in online games to be more transparent and in accordance with sharia principles, such as explaining the benefits of items in detail and certainty of ownership rights. This study contributes to the development of sharia regulations that are relevant to the digital economy ecosystem.

Abstract

Artikel ini bertujuan mendiskripsikan moral ekonomi dalam konteks perilaku masyarakat modern yang banyak mengalami perubahan perilaku moral sehingga perlu dijelaskan nilai nilai moral yang mengilhami semangat ekonomi islam. Metode;  tulisan ini menggunakan pendekatan kualitatif litaratur review, dengan hasil  menunjukkan bahwa konsep moral dalam realita ekonomi mempunyai dinamika dalam menginternalisasi porsi moral agama dan rasional dalam aktifitas ekonomi, manusia diberi kebebasan namun  dengan  memperhatikan  beberapa  nilai  antara  lain  Tauhid,  keseimbangan, keadilan   dan   tanggung   jawab   yang   akan   dihadapkan   kepada   allah   SWT orientasi kemaslahatan haruslah menjadi seimbang dengan kepentingan daruriat nafsh yang dipandu dengan moral agama.

Abstract

This study examines the implementation of hybrid Islamic finance contracts, Mudharabah, Musytarakah, and Murabahah, in promoting economic justice within the Amm Burger & Coffee MSME business model. Using a mixed-methods approach that integrates surveys, financial documentation, and in-depth interviews, the research evaluates how these multi-contract schemes strengthen capital, distribute risks, and ensure transparency in business operations. The findings indicate that the Mudharabah Musytarakah partnership constitutes a fair and proportional profit-sharing mechanism, consistent with the principles of mutual consent and justice in Islamic commercial law. Loss allocation was carried out appropriately, with capital-contributing partners bearing financial risks in proportion to their investments. At the same time, the manager assumed non-financial responsibilities, including time, effort, and operational accountability. In external transactions, Murabahah agreements with meat and coffee suppliers fully complied with Sharia requirements, including the clarity of cost, profit margin, ownership transfer, and product quality. Although minor discrepancies occurred with the bread supplier regarding product specifications, the issue was resolved through deliberation, demonstrating the effectiveness of sharia-based dispute resolution. Overall, the study concludes that applying Mudharabah Musytarakah and Murabahah contracts simultaneously can achieve a balanced integration of economic, ethical, and legal principles, offering a practical and justice-oriented financing model for MSMEs. This hybrid contract structure has strong potential to serve as a scalable prototype for inclusive Islamic economic development in Indonesia.
