Journal of International Relations Diponegoro publishes articles on contemporary transnational crimes from a variety of methodologies and approaches. The journal was originally established to encourage scholarly publications by students from International Relations, Faculty of Social and Political Sciences, Universitas Diponegoro. JIRUD will be pubished twice a year May and November. Journal of International Relations Diponegoro seeks original manuscripts that provide theoretically informed empirical analyses of issues in international relations, as well as original theoretical or conceptual analyses. The journal represents no particular school or approach, nor is it restricted to any particular methodology. Instead, it seeks to foster an awareness of methodological and epistemological questions in the study of International Relations, and to reflect research and developments of a conceptual, normative and empirical nature in all the major sub-areas of the field. Abstract

In the era of globalization, trade liberalization characterized by problems of counterfeitgoods. Definition of counterfeiting according to the International Trademark Association isa practice of manufacturing goods which are low in quality, and sold under a famous brand,without having a license, and without supervision of a brand and patent owner of the goods.Counterfeit goods activity is not only on the production process, but also on the stage ofdistribution, and import-export process. Counterfeiting is closely related to IPR theft andbecame a global problem. Therefore, the United States as the country with the biggest IPRbasedindustries in the world, it is necessary to eradicate the source of counterfeit goodsfrom China. This study was conducted to measure the effectiveness of the efforts made bythe United States, so it can be a guide to the establishment of policies and strategies forachieve the desired results. In this research, the authors encountered several limitationsrelated to operating results, the result of criminal cases, as well as the lack ofunderstanding of U.S. citizen related to counterfeit goods. This type of research isqualitative descriptive study, in which the analysis is done by collecting data throughlibrary research by using books, journals, government documents, and other writtensources. Comprehension of this research was formed by theory of neo-realism and theoryof effectiveness by William N. Dunn. Thus it is capable to explain the limitations of theresults that have been done by the United States.

Abstract

Crimea is an area that has been led by many countries, but since 1954 Crimea was given to Ukraine. After the collapse of the Soviet Union, Russia has been trying to take over Crimea so that it could return to Russia. This finally happened after the chaos in Ukraine appeared in 2013, which was caused by the Ukrainian leader that he would suspend talks on the Association Agreement. Utilizing the chaos, in early 2014 there was a sudden referendum in Crimea. The result of the referendum that the Crimean people’s wanted to join Russia received a lot of criticism because it was considered violating international law so it considered annexing Crimea. The European Union then imposed economic sanctions on Russia in 2014. The purpose of this study is to find out the reasons why the European Union still maintains economic sanctions even though they do not have a large impact on Russia. This research is explanative type research and is classified as qualitative research using the Congruence Analysis method through literature study. To analyze the case, the concepts of identity and norms in the theory of constructivism will be used. The results of this study indicate that the reasons behind the EU economic sanctions are still maintained because Russia has not fully implemented the Minsk Agreement and the interests of the European Union uphold their commitment to identity as an organization committed to peace. However, EU economic sanctions do not have a big impact on Russia because EU member states still depend on oil and gas from Russia, so economic sanctions are only in the form of restrictions. This needs to be further evaluated by the European Union so that sanctions can be effective and make Russia change its policy towards Crimea.

Abstract

After the outbreak of terrorism case in 2002, the Government of Indonesia believesterrorism cases will not be solved by using hard approach only such as the police work,Indonesia must also have a body responsible for handling soft approach to prevent andsolve the radicalism. BNPT was formed in 2010 as a response. As a member of the UnitedNation, BNPT subsequently established a partnership with TPB UNODC which focusedon the issue of global terrorism. This research is intended to understand the role of TPBUNODC in a cooperation with BNPT on the prevention of radicalism and terrorism crimein Indonesia. This research uses qualitative method with descriptive-explanative type withliterature and technique study. To answer the question, this research used theconstructivism paradigm which is supported by the result of interview with the membersof BNPT RI and UNODC Indonesia. The results of this study indicated that thecooperation between BNPT and TPB UNODC helped Indonesia to develop the quality ofBNPT RI as an organization in terms of strategy, relation and capacity, supported byindicators listed in the UNODC report and with successful result of counter radicalizationand deradicalisation programmed.

Abstract

The problems that occurred in South Sudan in 2011-2015 caused a crisis in South Sudan. the presence of the United States to providing humanitarian assistance in South Sudan has an interest it self. This thesis seeks to reveal the interests of the United States in terms of incorporating strategic interests in South Sudan. The theory of Neorealism, the Concept of National Interest and the Concept of Balance of Power in International Relations are used to explain facts and phenomena and as a basis in building scientific arguments in answering research questions. Built arguments are sourced from sources in the form of reports and other library sources that are processed qualitatively based on existing theories so as to produce explanatory arguments as research answer. Based on data processing using existing theories, the United States in providing assistance to South Sudan is not only limited to providing strategic interests but also related to expanding the influence of the United States in South Sudan. With China in South Sudan providing a security threat to the United States, the United States is also present in order to containtment China's influence.

Abstract

Frauds and corruptions are connective crimes considered to be extraordinary in manycountries. The damages are not limited to certain societies but could also bring harm tonational or even regional spheres. It raised awareness and leads to the inception of GlobalFinancial Crime Governance reflected in a number of international institutions i.e. FATF,UNCAC and OECD of which providing international standards of anti-fraud and anticorruptionbody. An institution currently in operation is European Union (EU)’s anti-fraudoffice known as OLAF, tasked to protect EU’s funds. This research aims to take a closerlook at OLAF and to examine the extent to which the institution has been suitable withGlobal Financial Crime Governance. To do so, this research highlight the imminentfeatures of common international bodies in combatting frauds and corruptions andafterwards will match the features on OLAF. These features come down to 6 respects: 1)Prevention; 2) Detection and Investigation; 3) Freezing, Seizing, Prosecution orConfiscation; 4) Cooperation; 5) Independence and Accountability; and 6) Asset recovery.This research reveals that OLAF has been suitable with the works of other internationalbodies evolving mostly on four of six common features.

Abstract

In 2016 kidnappings for ransom by the Abu Sayyaf terrorist group in Sulu Sea has increased. The Indonesian government initiate to form a trilateral cooperation with the Philippines and Malaysia. In addition, Indonesia is also strive for the Hot Pursuit agreement which allows other countries to enter Indonesian teritory. Meanwhile Indonesia doesn’t have a national policy regarding the Hot Pursuit scheme by warships from other countries. It can lead to potential conflicts because of the overlapping territorial waters of the three countries and the history of conflicts between countries. This study will explain the causes of Indonesia's active role in trilateral cooperation. By using cooperative security concept and foreign policy analysis the role theory of Holsti (1970) which emphasizes the concept of national roles, alter prescripts, and status in foreign policy. This research uses literature study method through analysis of books, newspapers, and publications from relevant agencies. The result is Indonesia's active role in trilateral cooperation caused by the conception of a national role in the form of Regional Leaders, alter prescriptions in commitment to agreements, and Indonesia's status as a leading actor in the Southeast Asia region.

Abstract

The purpose of this study is to illustrate the cooperation between the UNODC and thegovernment of Indonesia in tackling drug cases in Indonesia, related to the CountryProgram of the period 2012-2015. The research method used in this research is qualitativemethod, analytical descriptive research type, and through literature study techniques andinterviews. The cooperation in this study was analyzed using the Institutional Liberalismperspective, related to the cooperation of the country with international institutions. Theresults of this analysis have proven that the cooperation between Indonesia and theUNODC in the 2012-2015 Country Program has been successful because it can give rise toharbor security through capacity improvements and technical assistance as well asproviding information obtained through World Customs Organization (WCO) andCountainer Control Program (CCP) to the government of Indonesia, the UNODC alsoprovides Computer Based Training (CBT) for law enforcement in Indonesia and providesequipment that can improve law enforcement ability in Indonesia related to drugsmuggling at the borders or harbors.

Abstract

North and South Korea have made various peace efforts to overcome the issue of denuclearization of the Korean Peninsula. However, so far the peace efforts that have been made by the two Koreas have not been successful. This is caused by the relations between the two countries which are still marked by mutual distrust, lack of cooperation, hatred, and ideological conflict. Then, the two Koreas made peace efforts again called the Panmunjom Declaration in 2018. The main points of this declaration are a commitment to end the confrontation of the legacy of war that has been going on for a long time, to increase cooperative relations between the Koreas, and denuclearize the Korean Peninsula region. At first, the Panmunjom Declaration became a new achievement in the peace of the Korean Peninsula. Over time, the Panmunjom Declaration became ineffective in carrying out its role as a medium for creating peace and denuclearizing the region. This research will answer the question "Why is the Panmunjom Declaration ineffective in improving relations between North Korea and South Korea?". This study aims to analyze the perceptions and misperceptions that occur between the two countries using the theory of perceptions and misperceptions by Robert Jervis. This study used a qualitative research method which explained that what caused the Panmunjom Declaration to be ineffective was due to misperceptions between North Korea and South Korea.

Abstract

The Doklam crisis occurred in 2017 and caused increased tensions between China and India, which had relatively more stable relations after the 1962 war. The crisis was caused by direct violations committed by China by building roads in the border region with Bhutan. The border of Doklam which triggers tension is a border area between China and Bhutan, while Bhutan is a country that legally receives military protection from India according to the 1949 Friendship treaty agreement. Tensions between the two countries decreased with an agreement for 'expeditious disengagement' to restore the 'status quo', the agreement took place quickly even though the two countries were previously at odds with each other. This study aims to analyze the factors that led to the achievement of policies to reduce tensions between China and India. This study uses a qualitative method using the concepts of national interest and economic interdependence. The results of this study indicate that expeditious disengagement policy to reduce tensions between China and India is influenced by the concept of national interests and economic interdependence.
