Abstract

The designation of Cual Weaving as Bangka Belitung Communal Intellectual Property raises legal and social problems, especially regarding the tension between collective protection and the individual rights of craftsmen. Craftsmen feel that KIK status reduces recognition of individual contributions and marketing creativity of Cual Weaving. Public perception regarding the prohibition on the use of terms “Tenun Cual” outside the craftsman group adds to the complexity of this issue. This research aims to analyze the juridical aspects to answer the question of what is the ideal legal construction in balancing communal protection and individual rights in the Tenun Cual case. Normative juridical research methods use secondary data and literature studies. This research identifies regulatory gaps in Government Regulation No. 56 of 2022 concerning KIK and Law No. 28 of 2014 concerning Copyright which does not yet accommodate the rights of individual craftsmen in a communal system, and formulate innovative legal protection models that balance the collective and the individual. Offers a layered system protection model, combining collective and individual protection with a licensing mechanism through the community and recognition of craftsmen’s innovation. The main focus is to develop legal mechanisms that can bridge the interests of cultural preservation and the fulfillment of the economic and creative rights of craftsmen. The research results show that the existing legal framework has not been able to balance communal protection with recognition of individual contributions. For this reason, a more inclusive legal reconstruction is needed to guarantee communal protection without ignoring individual economic and innovation rights, as well as recommending the formation of regulations, including regulation of use rights and community-based licensing models, in order to maintaining a balance between cultural preservation and the interests of craftsmen. Abstract

Perlindungan hak cipta atas lagu dan/atau musik dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta masih menghadapi tantangan serius di Indonesia, terutama terkait pelanggaran Hak Moral dan Hak Ekonomi pencipta lagu. Indonesia bahkan pernah mendapat kritik internasional akibat lemahnya perlindungan hukum terhadap hak cipta, terbukti dengan dimasukkannya Indonesia dalam Watch List oleh IIPA dan USTR sejak tahun 2000 karena tingginya tingkat pembajakan di pasar domestik. Penelitian ini bertujuan untuk menganalisis dua permasalahan utama: mekanisme permohonan izin dan pembayaran royalti kepada pencipta lagu, serta konsekuensi hukum bagi pelaku yang menampilkan lagu tanpa izin dan tidak memenuhi kewajiban hak cipta. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan studi kasus serta analisis kualitatif. Hasil penelitian menunjukkan bahwa mekanisme perizinan dan pembayaran royalti dilakukan melalui Lembaga Manajemen Kolektif Nasional (LMKN), yang bertugas menghimpun dan mendistribusikan royalti berdasarkan data karya yang didaftarkan pencipta. Sementara itu, pengguna karya yang menggunakan lagu secara komersial tanpa izin dan tanpa membayar royalti dapat dikenai sanksi hukum berupa gugatan perdata (ganti rugi), pencabutan izin lisensi jika ada perjanjian, serta pidana denda sesuai ketentuan Pasal 113 ayat (2) UU Hak Cipta. Implikasi penelitian ini menegaskan pentingnya kepatuhan hukum dalam penggunaan karya cipta musik guna melindungi hak-hak pencipta secara adil dan berkelanjutan.

Abstract

This study aims to analyze the institutional design of regulatory management bodies in various countries and assess their applicability to the Indonesian context, particularly in overcoming hyper-regulation and regulatory disharmony. The study formulates strategic recommendations to establish a centralized regulatory agency to streamline the legislative process and improve cross-sector coordination. Using a qualitative embedded case study approach, the research combines a systematic literature review and comparative analysis focused on institutional structure and implementation outcomes, enriched by triangulation of Indonesian regulatory data: The study identified that in Indonesia, the fragmentation of 3,618 central regulations and 15,982 regional regulations emphasizes the urgency of establishing a National Legislation Agency (BLN) to consolidate authority, eliminate redundancies, and implement ex post evaluation. The findings recommend legal reforms to establish a National Legislation Agency by transforming (Badan Pembinaan Hukum Nasional – BPHN) into BLN or establishing a new agency. The implications of the main policy include, enactment of the regulatory alignment law that adopts the one in, two out principle, the establishment of a regulatory sandbox for policy trials in priority sectors, and increased bureaucratic capacity through training based on international best practices.

Abstract

This study explores the enforcement of administrative immigration measures in response to residence permit violations committed by foreign nationals. Using a qualitative case study approach, it examines how such violations are managed by immigration authorities, focusing on enforcement patterns, operational challenges, and the effectiveness of administrative responses. Data were gathered through document analysis, field observations, and interviews with key personnel, supported by legal and policy reviews. The findings highlight a range of violations, including overstaying, misuse of residence permits, and lack of valid documentation. Administrative actions such as deportation, revocation of permits, and blacklisting were commonly applied. However, the enforcement process was found to be constrained by inconsistent interpretations of legal provisions, limited technological and human resources, and inadequate coordination among relevant institutions. Enforcement practices tended to be reactive, triggered by referrals or specific incidents, rather than part of a continuous monitoring system.Comparative legal and policy analyses across jurisdictions indicate that immigration enforcement regimes grounded in preventive, integrated, and rights-respecting frameworks tend to produce higher levels of voluntary compliance and systemic legitimacy. The study recommends key improvements, including clearer operational guidelines, the deployment of interoperable digital surveillance, inter-institutional coordination, and increased public engagement. By addressing these challenges, immigration authorities can enhance the consistency, efficiency, and accountability of their enforcement systems, contributing to improved migration governance and public order.

Abstract

This study explores the implementation of the SIAP RAMAH (Sistem Aplikasi Paspor Ramah HAM) application, a human rights-based passport service management system developed by the Blitar Immigration Office in Indonesia. The objective was to assess user acceptance of this digital innovation using the Technology Acceptance Model (TAM), focusing specifically on vulnerable groups, including elderly individuals, persons with disabilities, infants, and pregnant women. The methodology employed a qualitative descriptive approach through participant observations and structured interviews with purposely selected system administrators, operators, and users. Findings revealed that SIAP RAMAH was generally well-received by vulnerable users due to its intuitive interface, reduced processing times, and streamlined application procedures. The study identified a strong relationship between TAM constructs-Perceived Usefulness and Perceived Ease of Use-and system adoption, with ease of use emerging as particularly critical for elderly users with limited technological familiarity. While the application successfully improved service efficiency and reduced physical visits to immigration offices, challenges persisted, including limited public awareness and internet connectivity issues in rural areas. The research concludes that human-cantered design principles are essential for inclusive public service technologies and suggests enhancing outreach campaigns through community channels, integrating voice-assisted navigation features, establishing mobile assistance units for first-time users, and developing collaborative partnerships with healthcare providers and disability advocacy groups to further optimize system effectiveness.

Abstract

The rise of the Roblox gaming platform within the Metaverse presents new challenges for trademark protection in Indonesia. Users frequently create, trade, and sell virtual goods incorporating well-known marks without authorization, raising concerns about the adequacy of Trademark Act No. 20 of 2016 in addressing digital trademark violations. This study aims to evaluate Indonesia's legal framework for protecting well-known marks in virtual spaces and assess its effectiveness in preventing unauthorized use on platforms like Roblox. Using a normative juridical approach, the research analyzes the current legal provisions, particularly the scope and interpretation of Articles 1, 21, and 83 of Law No. 20 of 2016, and also identifies normative gaps in addressing violations involving virtual goods and digital environments. The findings reveal that while the Trademark Act provides a foundation for brand protection, it lacks explicit regulations for virtual goods and digital environments, leaving well-known marks vulnerable to misuse. To address these challenges, the study recommends broadening key legal definitions within the Trademark Act and enhancing preventive measures on Roblox, such as stricter verification and enforcement systems. Strengthening Indonesia's trademark regulations in response to technological advancements is essential to ensure comprehensive intellectual property protection. Theoretically, the study contributes to the discourse on adapting IP law to digital realities. Practically, it offers policy insights for legislators and platforms to prevent misuse of well-known marks in virtual spaces.

Abstract

This study examines the gap between regulation and practice in the use of the Community Research Report (Litmas) in applying restorative justice for adult offenders. Normatively, Litmas has been legitimized by Law No. 22 of 2022 on Corrections and Supreme Court Circular No. 1 of 2021, yet its practical use remains limited. The research aims to explain the determinants of Litmas effectiveness while emphasizing its importance within the criminal justice system. Using a normative juridical method and descriptive qualitative analysis, and combining Soerjono Soekanto’s theory of legal effectiveness, George Edwards III’s policy implementation theory, and gap analysis, this study finds that the limited use of Litmas is caused by the absence of detailed technical guidelines, weak institutional capacity and professionalism of probation officers, poor inter-agency coordination, the dominance of a retributive legal paradigm in legal culture, insufficient political support, and the lack of information technology utilization. The conclusion highlights that the regulatory and practical gap is systemic and multidimensional, and the effectiveness of Litmas can only be achieved by strengthening six interrelated determining factors. This study underscores the importance of Litmas not only normatively as a regulatory mandate but also practically as a strategic instrument to deliver more humane justice, reduce prison overcrowding, and reinforce the legitimacy of restorative justice in Indonesia.

Abstract

Franchise agreements play a pivotal role in the advancement of the franchise business in Indonesia. However, these agreements often lead to differing interpretations and have weak evidentiary power because only created as private deeds. In the relevant regulations, there is no provision that requires it to be made in the form of an authentic deed. In fact, an authentic deed offers the necessary evidentiary strength to protect the rights of all parties involved. Notaries are legally empowered to draft authentic deeds and provide legal advice and its possible implications. This research is doctrinal with a prescriptive approach, aiming to examine the use of authentic deeds in franchise agreements to ensure legal protection. The goal is to reduce disputes and legal exploitation that can occur with private deeds. Through the analysis of secondary data and interviews, it is a fact that disputes often occur due to differences in the interpretation of the content of the agreement. Therefore, franchise agreements should be executed as authentic deeds rather than just private deeds. This practice is significant because franchise agreements include fundamental elements like the rights and obligations of the parties, as well as intellectual property rights elements, such as trademarks and trade secrets. In fact, the use of authentic deeds is not intended to seek validity but to seek the value of legal certainty.

Abstract

Tulisan ini mengkaji politik hukum kebijakan cuti ayah dalam Undang-Undang Nomor 4 Tahun 2024 tentang Kesejahteraan Ibu dan Anak (UU KIA) dengan fokus pada perlindungan hak maternitas dan kesetaraan gender. Penelitian ini menggunakan metode hukum normatif (doktrinal) dengan pendekatan perundang-undangan, konseptual, komparatif, dan futuristik. Data yang digunakan adalah bahan hukum primer dan sekunder yang dianalisis secara deskriptif-analitis. Hasil penelitian menunjukkan bahwa pengaturan cuti ayah dalam UU KIA hanya berdurasi 2 hari dan dapat diperpanjang 3 hari berdasarkan kesepakatan, berbeda secara signifikan dengan ketentuan dalam RUU KIA 2022 yang lebih progresif memberikan cuti hingga 40 hari. Perubahan ini mencerminkan ketidakkonsistenan pembentuk undang-undang terhadap tujuan awal pembentukan UU KIA serta lemahnya komitmen terhadap perlindungan hak maternitas dan pengarustamaan gender. Selain itu, belum adanya kejelasan skema pembiayaan dan tidak diakomodasinya pekerja informal menimbulkan risiko diskriminasi baru. Berdasarkan analisis perbandingan dengan praktik di beberapa negara, idealnya kebijakan cuti ayah di Indonesia perlu memperpanjang durasi cuti, merancang pembiayaan yang berkelanjutan, serta menjamin inklusivitas bagi seluruh jenis pekerja. Oleh karena itu, diperlukan rekonstruksi politik hukum cuti ayah agar menjadi instrumen strategis untuk mewujudkan kesejahteraan ibu dan anak, perlindungan hak maternitas, dan kesetaraan gender.

Abstract

The medical advancements in human organ transplantation hides a dark reality: illegal organ trafficking, donor identity fraud, and exploitation of the vulnerable individuals. Without strict oversight, these practices can lead to injustice and human rights violations. Notarial deeds serve as a legal safeguard, ensuring that every transplantation procedure is in accordance with regulations, remain transparent, and free from abuse. This article examines the strategic role of notarial deeds in guaranteeing the validity of the agreement between organ donors and recipients, as stipulated in Article 24 paragraph (1) letter d of the Minister of Health Regulation No. 38/2016. This research is doctrinal approach with a normative legal study based on relevant legal sources. The case study of Decision Number 464/Pid.Sus/2023/PN.Ckr and the findings at Dr. Saiful Anwar Hospital reveal various irregularities in the practice of human organ transplantation, including the involvement of intermediaries in illegal human organs transactions. A notarial deed is not just a formal document, but a legal instrument that protects the rights of the parties, ensures compliance with regulations, and closes loopholes for exploitation and abuse in human organ transplant procedures.
