Abstract

This study examines preventive efforts in tackling recidivism at Class II B Kraksaan State Detention Center, Probolinggo. The research aims to identify the implementation of inmate development programs, analyze supporting and inhibiting factors, and assess their alignment with criminology theories. Using a socio-legal empirical method, data were collected through observation, interviews, and document review, then analyzed qualitatively. Findings show that preventive programs include personality development, vocational training, social development, social reintegration, and external partnerships. Personality development is the most consistently implemented, while vocational training and external cooperation face resource and monitoring limitations. The novelty of this research lies in mapping the linkage between prison-based programs and the need for sustainable social reintegration strategies. Strengthening cross-sector collaboration is urgent to ensure behavioral change among former inmates remains sustainable.

Abstract

Jangkang Village, located in Tiris Districtis one of the areas in Probolinggo Regency that faces difficulties in accessing clean water, especially during the rainy season when the springs become turbid. This study aims to examine the implementation of Law Number 17 of 2019 concerning Water Resources in the PAMSIMAS program and to identify the obstacles faced by the village government in its implementation. This research employs an empirical juridical method with a statute and socio-legal approach, using literature studies and interviews for data collection, and descriptive qualitative analysis. The findings indicate that the implementation of the PAMSIMAS program is in accordance with the prevailing regulations; however, there are challenges such as limited water storage facilities, insufficient human resources, and lack of community outreach. The implementation of the PAMSIMAS program in Jangkang Village has already been carried out, but has not yet been optimal in fulfilling the community’s right to sustainable clean water.

Abstract

This study analyzes the implementation of moral and personality development programs for inmates at Class II-B Kraksaan Detention Center in accordance with the Regulation of the Minister of Law and Human Rights Number 35 of 2018 on the Revitalization of Penitentiary Services. Using an empirical juridical method with a descriptive qualitative approach, data were obtained through observations and documentation. The results indicate that the programs are conducted through religious, educational, skill-oriented, and socio-psychological activities designed to foster behavioral improvement and prepare inmates for reintegration into society. Observations revealed significant challenges, including overcrowding, inadequate facilities, and limited human resources, which hinder the effectiveness of the programs. This study highlights the novelty of providing empirical evidence of the regulation’s implementation at Kraksaan Detention Center and emphasizes the urgency of strengthening revitalization efforts to ensure that rehabilitation and reintegration objectives are effectively achieved.

Abstract

The State Attorney has the authority to provide legal assistance to state-owned enterprises as stipulated in Law Number 11 of 2021 concerning Amendments to Law Number 16 of 2004 concerning the Prosecutor's Office of the Republic of Indonesia. This study aims to determine the implementation of law enforcement in providing legal assistance to state-owned enterprises and identify the obstacles faced. The method used is an empirical juridical approach by combining sociological and statutory approaches. The results showed that legal assistance by the State Attorney at the Probolinggo City State Attorney's Office was dominated by a non-litigation approach which proved to be more effective in preventing disputes and accelerating the efficient resolution of legal problems. However, weak coordination and low awareness of the role of the State Attorney are still the main obstacles. Therefore, strengthening institutional roles and understanding is the key to optimizing legal protection of state-owned enterprises in the future.

Abstract

This empirical legal research employs a socio-legal approach with qualitative methods to examine the implementation of legal rights for children with disabilities at SLB Negeri Kraksaan based on Law Number 8 of 2016 concerning Persons with Disabilities. Data were obtained from interviews with school principals, teachers, and parents of students with disabilities, as well as direct observations of school facilities and learning activities. Secondary data were collected from relevant legislation and school policy documents. Data collection techniques included observation, in-depth interviews, and documentation, while data were analyzed qualitatively using an interactive analysis model. Findings show that the school has made efforts to fulfill basic accessibility, implement inclusive education practices, and involve parents, although challenges remain such as limited special education teachers, informal parental involvement, and cultural barriers.

Abstract

This study examines the implementation of the Journalistic Code of Ethics (KEJ) based on Law Number 40 of 1999 concerning the Press in journalistic practices in the digital media RMOLJATIM.ID Probolinggo. The development of digital media poses new challenges in the implementation of journalistic ethical values, especially regarding accuracy, independence, and verification. This study uses an empirical legal approach with interview, observation, and documentation methods. The results show that although RMOLJATIM.ID has implemented KEJ in various aspects, there are challenges in consistency and business pressures that affect editorial independence. This study emphasizes the importance of internal oversight and ongoing ethics training for journalists in the digital era.
