Abstract

The article concludes that the preservation of environment better prevails when is prevails when is applied Islamic based customary law. The strict implementation of the Islamic based customary law will lead healthier environment. The customary forest based on this law would be the best religious practices deals with the environmental crisis. This forest would be resilient against the damage on the protection and preservation of Islamic based customary law. Moreover, this should be supported by religious, social-political, and educational values.

Abstract

The threat of criminal sanctions in Indonesian state law does not have a major impact on reducing sexual harassment cases. In some places, efforts to sanction cases of sexual harassment using adat law can be another alternative, because of the unique relationship between traditional communities and adat law. This research examines the existence and implementation of adat law sanctions to solve the problem of sexual harassment in Kungkai Village, Merangin, Jambi Province. The type research is field research or empirical juridical research using a legal anthropological approach. The data collection instrument is through observation, interviews with indigenous peoples, and literature review. Adat sanctions for perpetrators of sexual harassment crimes in Kungkai Village are called “utang adat”. This sanction was given by the adat party in Kungkai Village for perpetrators of sexual crimes to pay compensation. The application of Islamic values in the Jambi Malay traditional seloko, adat bersendi syarak, syarak bersendi Kitabullah can be found from the addition of punishment by assessing the marital status of the perpetrator or victim such as the jarimah zina in Islamic criminal law. The existence of adat law has an urgency to maintain community compliance with legal values and norms.

Abstract

Garbage is one of the many environmental problems that exist today. The community and government in Jambi City face the same problem with the amount of waste volume increasing from time to time. Issuance of Perda Jambi City No. 5 of 2020 concerning Waste Management, it is hoped that public awareness of environmental cleanliness will improve. However, many people still don't know about this regional regulation, as well as the lack of socialization about how to manage waste properly. This activity was carried out as a form of community service in the form of socialization on how to manage waste and legal counseling related to regional regulations regarding waste management in Jambi City. Located in Sungai Putri Village, Danau Sipin District, Jambi City, this activity was generally carried out using interactive lecture and discussion methods. So, it is hoped that through this extension activity the paradigm and responsibility of the community for environmental cleanliness can be changed for the better, especially in waste management with an environmental perspective. In addition, by using the understanding approach through Islamic law, activity can be more targeted because the majority of residents who attend counseling are Muslims. Residents' concern for the cleanliness of their environment is in line with Islamic religious orders which are the essence of the material presented

Abstract

Kecanduan game online saat ini menjadi permasalahan yang dominan dihadapi remaja Indonesia saat ini. Tingkat kecanduan terhadap game online di Indonesia menjadi salah satu yang tertinggi untuk kawasan Asia Tenggara. Keberadaan game online yang awalnya menjadi hiburan yang murah meriah, semakin hari malah menjadi suatu penyakit jiwa yang meresahkan banyak orang tua. Belum lagi, ternyata banyak game online menjadi kedok bagi perjudian online yang tentunya sesuatu yang illegal untuk dilakukan. Banyak masyarakat khususnya para remaja tidak menyadari bahaya kecanduan game online. Pelaksanaan kegiatan ini merupakan bentuk pengabdian kepada masyarakat berupa penyuluhan hukum terkait kecanduan game online dan hukum yang terkait dengannya. Berlokasi di SMKN 4 Kabupaten Tanjung Jabung Timur Provinsi Jambi, kegiatan ini secara umum terlaksana dengan menggunakan metode ceramah dan diskusi interaktif. Melalui kegiatan penyuluhan ini kesadaran masyarakat secara umum tentang bahaya laten kecanduan game online dapat terus meningkat dan tentunya penerapan metode yang lebih tepat untuk mengatasi permasalahan ini khususnya dikalangan para remaja yang sudah terlanjur kecanduan.

Abstract

Abstract: This study discusses the concept of wasaṭiyyah Muhammadiyah's perspective on fiqh problem development, especially in Indonesia. It is related to the internal conflicts of Muslims in various aspects of life, includingIslamic law or fiqh. These disputes are caused by the friction between the two opposing ideologies in methodology and approach, sometimes caused by an intervention born through contradiction between liberals who want to free themselves from the shackles of textual understanding from the conservative group. In this case, Muhammadiyah occurs to introduce itself as an organization that seeks to offer concrete solutions through its wasaṭiyyah understanding. This study aims to reveal the concept of wasaṭiyyah in Muhammadiyah fiqh, which is related to the expression of the wasaṭiyyah idea in the fiqh produced by Muhammadiyah. This study uses a literature research method that focuses on wasaṭiyyah concepts as seen from the understanding of Muhammadiyah fiqh through decisions, congress results or the other fiqh products officially issued by Muhammadiyah. This study concludes that the concept of fiqh wasaṭiyyah Muhammadiyah tries to understand and place text and context proportionally to raise non-radical characteristics and also non-liberal. Furthermore, Muhammadiyah upholds the principle of tawāsuṭ which is combined with the codes of tawāzun and ta'ādul through an “Islam Berkemajuan" or the progressive Islam orientation.

Abstract

ABSTRAKStudi ini menganalisis tentang penyelesaian kasus dan pertanggungjawaban hukum atas insiden lalu lintas terkait kelalaian pengemudi di Kabupaten Tanjung Jabung Barat. Studi ini menggunakan metodologi sosiologi hukum atau dengan kata lain metodologi hukum empiris dengan teknik analitik kasus. Pengumpulan data melalui observasi, dokumentasi, serta wawancara dari pihak kepolisian penyidik dan Kanit Satlantas Polres Kuala Tungkal, serta dari Pengadilan Negeri Kuala Tungkal yakni panitera dan hakim. Berdasarkan penelitian yang dilakukan, ada dua cara untuk penyelesaian dan menentukan siapa yang bertanggung jawab secara hukum atas kecelakaan lalu lintas (lakalantas), yaitu melalui litigasi dan non litigasi, yang mana jika pelaku dan korban memilih jalur non litigasi maka penyelesaian diselesaikan diluar persidangan dengan membuat surat pernyataan damai dari kelurahan/desa setempat. Tetapi jika penyelesaian tidak dapat dicapai, masalah tersebut akan diajukan ke Pengadilan Negeri (PN) Kuala Tungkal dan selanjutnya akan dilanjutkan melalui sistem peradilan pidana berdasarkan Undang-Undang RI Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan.Kata Kunci : Pertanggungjawaban Hukum, Kecelakaan, Penyelesaian Kasus.

Abstract

In this era of reform, the death penalty remains a highly controversial issue and a matter of serious concern, prompting various approaches from legal experts and practitioners. Decisions to execute the death penalty for certain criminals are influenced by social initiatives and law enforcement efforts aimed at enhancing social welfare. Regarding the death penalty, there is a stigma that generates both pro and con opinions, related to the concept and realization of human rights. Therefore, researchers are interested in delving deeper into the issue of the death penalty in Indonesia from the perspectives of criminal law and human rights.In this study, researchers employ a normative juridical method, focusing on specific subjects for analysis, namely conducting regulations-based analysis using library research. The theory of punishment is used as a theoretical framework, leading to findings that the death penalty fundamentally entails depriving someone of their right to life and causing physical suffering, which contradicts Article 6(1) of the International Covenant on Civil and Political Rights and Article 3 of the Universal Declaration of Human Rights, as well as the shift from classical criminal justice systems focused on retributive justice to modern criminal justice systems oriented towards collective, restorative, and rehabilitative justice. The existence of the death penalty is considered a violation of an individual's right to life, as this right is deemed a gift that must be respected. Article 1 of Law Number 39 of 1999 concerning Human Rights, which acknowledges the rights of every individual in their entirety, affirms that human rights exist in Indonesia.

Abstract

This study analyzes the legal protection of child victims of human trafficking through a comparative examination of Indonesian positive law and Islamic law, with specific reference to the Jambi District Court Decision Number 566/Pid.Sus/2023/PN.JMB. The judgment in this case prioritized the punishment of the perpetrator while neglecting the crucial aspect of victim recovery. In response, the study proposes a model of legal harmonization, arguing that the integration of Islamic legal values into positive law has the potential to create a more comprehensive child protection system that is better aligned with Indonesia’s socio-cultural realities. The research employs a normative juridical approach, using comparative and case study methods, and draws upon statutory provisions, judicial decisions, Islamic legal literature, and relevant scholarly works. The findings demonstrate that both Indonesian positive law and Islamic law recognize child trafficking as a grave offence; however, positive law tends to emphasize punitive sanctions, while Islamic law highlights spiritual dimensions and community responsibility in addressing exploitation. The key differences lie in philosophical underpinnings, the flexibility of sanctions, and the treatment of victim recovery, with positive law adopting a legal-formal stance and Islamic law stressing holistic, community-based rehabilitation. The study concludes that harmonization between the two systems can strengthen prevention, rehabilitation, and protection mechanisms, producing a more equitable and culturally grounded framework. This study contributes to proposing an integrative model that combines the procedural certainty of positive law with the ethical and spiritual depth of Islamic law, consistent with the spirit of Pancasila and advancing the global discourse on culturally responsive child protection.
