Abstract

This paper attempts to trace Muhammadiyah's new fiqh reasoning in Islamic legal discourse, and its probability to become a holistic legal paradigm. In the leadership of Syamsul Anwar, Muhammadiyah through Majelis Tarjih introduced the idea of a new fiqh concept which is considered to be different from the classical fiqh concept. This fiqh reasoning has produced many tarjih products, such as Fiqh Air (Water Jurisprudence), Fikih Kebencanaan (Disaster Jurisprudence), etc. On the basis of that considerations, this paper wants to answer some crucial questions; First, how exactly is Muhammadiyah's new fiqh reasoning and what is the difference between classical fiqh concept?; Second, where is the position of Muhammadiyah's new fiqh reasoning in the perspective of contemporary Islamic law studies that are developing, especially in the West ?; and Third, as a concept that produces ijtihad products, then there is a probability of Muhammadiyah's fiqh reasoning can become a new paradigm of Islamic law. The question is, how far is the probability?

Abstract

Abstract

The paper aims to explore the concept of the company from the aspects of Islamic law (fiqh) and sharia, as the basis in determining the company as muzakki, thus raising the legal obligation for companies to pay zakat through the zakat accounting calculation method. This study is designed to reconstruct the concepts of fiqh and sharia in muamalah (economic) activities within the framework of aqidah, sharia and akhlak through ijtihad. The research uses qualitative analysis, through a literature study approach by exploring various classical and contemporary sources. This paper found that the company is synonymous as syirkah on the basis of syakhshiyyah i’tibariyyah (spiritual entity) or syakhshiyyah hukmiyyah, referred to as al-dhimmah, that is, inherent traits of humans, as expert al-form (the right to receive) and syahhshiyyah al-ada (the right to fulfill responsibilities). So, the company as the subject of zakat has an obligation to pay zakat based on five principles inherent in the company as muzakki. The calculations are carried out by using the company zakat accounting method based on established standards (AAOIFI), (MASB), and (IAI). The determination of companies as subjects of zakat, which has the obligation to pay zakat, certainly has positive implications for the realization of a fair and equitable distribution of wealth, as well as the emergence of corporate social responsibility (collectively) and the responsibility of a Muslim (individually) in realizing his worship. to Allah SWT, an increase in community welfare can be achieved.

Abstract

Al-Qaradawi’s contribution to the development of contemporary Islamic economics is very profound. Many Muslim economists subscribe to his opinions, and some banking institutions and insurance companies have even adopted his views as their general policies. It is very unfortunate, however, that such a great contribution has not been well researched. It is the intention of this research to fill up this lacuna by making it accessible to the prospective readers. The objective of this study is mainly to introduce Al-Qaradawi’s economic thought and its relevance to contemporary development of Islamic economics discourse. For this purpose, the research attempts to shed some light on selected contributions that he has made to the current discourse of interest in the banking system. In connection to this, his conceptions and approaches to issues and problems in contemporary Islamic economics are also explored. It argues that Al-Qaradawi’s works on Islamic economic missed the empirical test to provide evidence of the strength and the reliability of his data theories and concepts, particularly on the topic of zakat, poverty and environment. Abstract

Philanthropy is one of the most significant Islamic teachings, and it has been practiced by Muhammadiyah, one of Indonesia 's moderate Islamic organizations. As the pandemic of Covid-19 broke out, many parties — including Muhammadiyah — were motivated to get involved in handling it. This research aims to reveal what Muhammadiyah has done and is currently doing to overcome Covid-19 and the extent of its impact on the wider community. For this purpose, the descriptive-analysis method is employed in its writing. Among the findings of this study is that one of the most consistent Islamic philanthropic organizations since its establishment in Indonesia is Muhammadiyah. In the Covid-19 issue, Muhammadiyah has contributed a lot and continues to take a significant role in overcoming it. Among other things, Muhammadiyah has formed the Muhammadiyah Covid-19 Command Center (MCCC), which is a special team formed to handle Covid-19. This team has been working since it was founded and continues to work on this case. The results of the work included assistance in the field of health that is needed such as providing hospitals, doctors, medical personnel, and medicine. Assistance in the field of education such as making educational media, subsidizing credit for students, and discounting student study fees. And assistance in the social sector such as cash assistance, distribution of groceries, and the provision of free sahur (food before fasting) and takjil (food for breaking fasting) in Ramadhan 1441H. Besides, through the Tarjih and Tajdid Assembly, Muhammadiyah has provided religious guidance for its members during this pandemic so that they are not confused about practicing worship. The impact of these programs and actions is that members of Muhammadiyah, and in general the wider community, are greatly helped in the health, education, social and religious fields.
