Abstract

AbstractThis research has purposes of knowing the interpretation of the supplementary worker rights definition after Constitutional Court Decision Number 67/PUU/XI/2013. This research has also purposes of knowing the preventive legal protection of the supplementary worker rights after the Decision of Constitutional Court No. 67/PUU-XI/2013. The results of this research are, firstly, the supplementary rights of worker are classified into: (a) normative, meaning that the supplementary rights which are provided and regulated by acts, such as severance payment, gratuity and compensative payment. (b) non-normative rights, meaning other rights are provided and regulated by the parties in accordance with the agreement in the employment agreement or collective labor agreement. Secondly, there are already legal protection of supplementary non-salary rights in Decision of Constitutional Court No. 67/PUU-XI/2013 but they are not completely protective because the supplementary rights of the worker are not included in separatist creditor payment.AbstrakPenelitian ini bertujuan untuk mengetahui, penafsiran definisi hak-hak lainnya dari pekerja/buruh Pasca putusan Mahkamah konstitusi Nomor 67/PUUXI/2013. Penelitian ini juga untuk mengetahui, perlindungan hukum preventif terhadap hak-hak lainnya dari pekerja/buruh Pasca putusan Mahkamah konstitusi Nomor 67/PUUXI/2013. Hasil penelitian ini adalah pertama, hak-hak lainnya pekerja/buruh dibagi menjadi: (a). bersifat normatif, adalah hak-hak lain yang diberikan dan diatur oleh Undangundang, misalnya uang Pesangon, uang penghargaan masa kerja, uang penggantian hak dan (b). Hak hak lainnya yang tidak bersifat normatif, berarti diberikan dan diatur oleh para pihak menurut kesepakatan baik dalam Perjanjian Kerja (PK) atau Perjanjian Kerja Bersama (PKB). Kedua, perlindungan hukum hak-hak lainnya dari pekerja/buruh Nomor 67/PUU-XI/2013 sudah ada namun tidak sepenuhnya terlindungi, dikarenakan hak-hak non upah pekerja/buruh dikecualikan pembayarannya oleh kreditur Separatis.

Abstract

The purpose of this writing is to find suitability of breast-feeding rights regulated in Act No. 13 of 2003 on Labour with the philosophy of woman’s reproductive rights. This writing is a writing normative laws. This writing is done by means of literature study to obtain secondary data in the field of law. From the result of study it can be concluded that first, in general provisions concerning of breast-feeding rights in Act No. 13 of 2003 on Labour was already conformed the philosophy of woman’s reproductive rights. Second, in specifically provisions concerning of breast-feeding rights in Article 83 of Act No. 13 of 2003 on Labour still has not been entirely conformed with the philosophy of woman’s reproductive rights, because it has not guaranteed full rights to female workers who breastfeed their babies.

Abstract

AbstractAct No. 18 year 2013 on the Prevention and Eradication of forest Destruction was legitimated on August 6 2013 as a governmental effort to cover of the weakness of the regulation, particularly related to the prevention and overcome organized forest destruction. Nevertheless, the regulation that combines both of penal policy and non-penal policy within the framework of the criminal policy is apparently getting some record even when the Act was still as a draft. besides assessed cannot resolve the core of the problem of crime. The Act became a new threat to the existence of indigenous peoples who live inside and around forests. The principle of legality as representation of positivistic paradigm transformed in the formulation of clauses in the Act, lead into the excesses of the existence of indigenous peoples who live in the forest. AbstrakDisahkannya Undang-Undang Nomor 18 Tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan pada tanggal 6 Agustus 2013 merupakan sebuah bentuk usaha dari pemerintah untuk menutup beberapa kelemahan aturan khususnya yang berkaitan dengan upaya untuk mencegah dan menanggulangi perusakan hutan terorganisasi. Meskipun demikian, undang-undang yang mengkombinasikan antara sarana kebijakan hukum pidana (penal policy) dan sarana kebijakan di luar hukum pidana (non penal policy) dalam sebuah kerangka kebijakan kriminal (criminal policy) tersebut ternyata mendapatkan beberapa catatan bahkan saat undang-undang tersebut masih berbentuk rancangan. Selain dinilai tidak menyasar jantung masalah kejahatan, undang-undang tersebut justru menjadi sebuah ancaman baru bagi keberadaan masyarakat hukum adat yang hidup di dalam dan sekitar hutan. Asas legalitas yang merupakan representasi dari paradigma positivistik dan terjelma di dalam rumusan pasal dalam undang-undang tersebut membawa ekses bagi keberadaan masyarakat hukum adat yang selama ini hidup di sekitar kawasan hutan.

Abstract

Education is the constitutional right of every citizen, as mandated in the 1945 Constitution of the Republic of Indonesia, so that good management of education will support the progress of a nation. The attraction of government affairs in terms of education carried out by the central government to the district governments to the provincial regions actually further alienated public services. The type of research used in compiling this study is empirical legal research. The results showed that the management of education has implications for the ineffectiveness of the management of senior secondary education in Kolaka Utara district both from the aspect of budget management, management of facilities and infrastructure and management of human resources, no longer effective. This situation has made the provincial government have to establish a branch office in North Kolaka district to support administrative arrangements in the North Kolaka district.

Abstract

This article aims to find out the views of progressive law regarding the shift in the principle of judges to civil justice. M. Yahya Harahap, described this as a symptom of the emergence of a new flow in the realm of civil procedural law that tried to oppose the idea of a total passive judge by trying to introduce the principle of an argumentative active judge. One form of activeness of judges in civil courts is the decision of a judge to judge a case that is not prosecuted or decide beyond what is requested (Ultra Petita Principle). Based on the provisions of Article 178 paragraph (3) HIR and Article 189 paragraph (3), the RBg petita Ultra is prohibited, so that the factie violating ultra petita is considered as an act that exceeds authority. This article uses normative research. This article explains the view of progressive law regarding the shift in principle to civil judges, namely the shift is appropriate, if it aims to seek justice for the parties to the dispute.

Abstract

This research is motivated by the decision of the Constitutional Court often to make legal breakthroughs accompanied by a logic of law that is less precise and anti accountability. This study is a normative legal research that is perspective with a legal approach and a conceptual approach. The legal material collection technique used in this study is literature study. The legal material analysis technique used by researchers in this study is the deduction method. The results of research and discussion produce conclusions, namely; First, the juridical basis of the authority of constitutional justices in interpreting statutory regulations can be seen from Article 5 paragraph (1) and Article 10 paragraph (1) of Law Number 48 of 2009 concerning Judicial Power which means that any case faced with the court is not may refuse to examine, hear and decide on the case. Obviously or not the law governing the case, constitutional judges still have to explore the legal values and sense of justice that lives in society. Second, the principles of the administration of judicial power have been applied every time a Judicial Review is conducted. This can be seen in every decision where the decision always reflects the sense and values of justice that live in the community.

Abstract

Tuntutan ekonomi yang mendesak dan berkurangnya peluang di bidang pertanian, memberikan daya tarik yang kuat bagi tenaga kerja anak-anak. Padahal Undang-Undang ketenagakerjaan menyebutkan bahwa anak adalah seseorang yang umurnya dibawah delapan belas tahun. Konsekuensinya adalah segala perbuatannya belum dikatakan cakap hukum dan perbuatan yang dilakukuannya belum mencapai kriteria perbuatan atau tindakan hukum. Jenis penelitian ini adalah penelitian hukum normatif. Penelitian hukum normatif merupakan penelitian hukum yang mengkaji asas, sejarah dan perbandingan hukum. Pendekatan penelitian ini adalah peraturan perundang-undangan yang berkaitan dengan hal-hal yang mengatur mengenai perjanjian kerja dan ketenagakerjaan. Jenis bahan hukum dalam penelitian ini adalah data sekunder yang berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Hasil Penelitian menunjukkan bahwa Undang-Undang tenaga kerja melarang pengusaha mempekerjakan anak kecuali untuk memberikan pendidikan dan pelatihan pengusaha boleh mempekerjakan anak-anak dengan ketentuan yang berlaku sebagaimana dijelaskan dalam Pasal 68 ,69 ,70 ,71 ,72 ,73 ,74, 75 Undang Undang Republik Indonesia Nomor 13 Tahun 2003 tentang Tenaga Kerja memberikan pengecualian bagi anak yang berumur 13-15 Tahun.

Abstract

Kemitraan Kehutanan merupakan salah satu skema kerjasama antara pengelola hutan dengan masyarakat dalam rangka mengembangkan dan memanfaatkan sumber daya hutan yang ada untuk kepentingan ekonomi. Kemitraan Kehutanan lahir dari Peraturan Menteri Lingkungan Hidup dan Kehutanan Nomor P.83/Menlhk-Setjen/2016 tentang Perhutanan Sosial. Peraturan tersebut mengharuskan para pihak terkait untuk membuat naskah kesepakatan kerjasama dalam membangun kemitraan kehutanan. Hasil kajian ini menyimpulkan bahwa kebijakan kemitraan kehutanan merupakan salah satu kebijakan untuk menyelesaikan persoalan ketimpangan atas lahan di masyarakat dengan memberikan akses lahan kepada masyarakat dan tidak bertentangan dengan asas kebebasan berkontrak.

Abstract

Environmental tax assessment as an environmental economic instrument is still rare. So far, environmental law studies have been limited to analyzes of administrative violations and criminal actions against the environment, which tend to be repressive. This action is also considered less effective to overcome environmental problems that increasingly apprehensive. Some research suggests, the application of environmental taxes can be used as a preventive measure against environmental damage. In 2006 Indonesia has planned the implementation of environmental taxes, but to date has not been implemented. This is due to differences of opinion due to the absence of a definite application concept. Therefore, there is a need for research on the construction of environmental taxes, based on the Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup (UUPPLH), which includes environmental economic instruments, one of them through the application of taxes. Based on this, environmental taxes should be designed as a source of fund management and addressing environmental issues for sustainable development. This is based on the important role of economic aspect in environmental management.

Abstract

 Indonesia is a maritime country that has an abundance of marine natural resources, especially fisheries resources. The wealth of Indonesian fisheries resources should be managed in such a way as to be able to provide benefits for the greatest prosperity of the people (in accordance with the mandate of the 1945 Constitution). Normatively, Law Number 31 Year 2004 which has changed with Law Number 45 of 2009 concerning Fisheries, has been regulated regarding the management of fisheries in Chapter XII Article 66-70. The urgency of supervision in the fisheries sector is intended so that all regulations can be implemented in accordance with what has been determined. But in reality there are so many deviations in the aspects of management and protection of fisheries resources especially in the fishing process. Crimes and violations that occur such as Illegal, Unreported, and Unregulated Fishing activities result in very large material losses reaching Rp.101,040 trillion / year. In addition to material losses, Indonesia also suffered other losses in the form of invaluable environmental damage to violations of sovereignty limits.
