Abstract

One of the popular study in Islamic education is Tafsir Tarbawi. It offers a thematic idea on education based on interpretation approach. The knowledge of Munasabah al Ayat is important to note. It showed the unity and comprehensive meaning. Understanding Munasabah al Ayat is a step that must be taken to assess the understanding of education in the perspective of the Quran, particularly on the application of tafsir al maudhu’i. It will help researchers to understand the purpose and meaning of verses inferred based on the mindset that made the paradigm of the review.

Abstract

The era of globalization is characterized by a shift in the concept of citizenship. From nation citizenship to global one. The implication is the need to reform Islamic education based on global standardization and Islamic values. The concrete form is the internationalization of Islamic education through the realization of the global goals based on maqashid sharia. The model established is the education that makes maqashid sharia as the core curriculum (model of comprehensive education), open to all parties to obtain or provide educational (emancipatory), ready to compete in the global competition (competitive), to cultivate the attitude of flexibility and open-minded towards each other (inclusive), cooperate with global citizens (collaborative) and is able to bring actual change for the community (transformative).

Abstract

This article discusses about Shahadatayn tarîqah, one of lesser-known tarîqah in Indonesia. The writer explores it from a primary source written by Abah ‘Umar, the founder of this tarîqah and other supporting references. To be a member of Shahadatayn tarîqah, one is acknowledged through an inaugural ceremony (bay‘at), ḍuhâ and tahajjud praying in fourty days, reciting ṣalawât tunjînâ, wirid, Asmâ’ Nûr al-Îmân, and Asmâ’ al-Ḥusnâ. Shahadatayn is known for its uniqueness such as implementing the meaning of shahâdat in daily life, wearing white attire and turban when performing prayer, chanting after the obligatory prayers, ḍuhâ, tahajud, and other sunna prayers. Shahadatayn tarîqah is not as famous as the other tarîqah as it has not been listed in the JATMAN as mu‘tabar version. This is because there is no murshid transformation from the Prophet Muhammad and continues through the path of the ṣâlih to the murshid. JATMAN version can not be an absolute reference for it is within the circle of NU and not all tarekat residents are NU members. Furthermore, the actual Shahadatayn has a murshid lineage, i.e. from Prophet Muhammad, Sharif Hidayatullah, and Abah ‘Umar who is now passed on by his descendants. Although it is realized that the genealogy is not as many other tarîqahs, but the content of his teachings is in line with the guidance of the Prophet Muhammad.

Abstract

Constraints often encountered by lecturers in educating students is still attached pedagogical mentality like students of secondary education; has not moved on andragogical mentality like a college student. These constraints can be found in the context of basic principles of andragogy. As a library research, this paper examines the data sources in the form of literature relevant to Islamic law (fiqh) studies and andragogy (adult education). The study results in six models of andragogical learning for the development of Islamic law (fiqh) courses in higher education. First, the learning model of “learn how to know” that emphasizes aspects of epistemology to increase students’ curiosity (need to know). Second, independent learning model that emphasizes student activeness in learning. Third, experiential based learning model, especially literature and field research practice, to foster inclusive thinking. Fourth, actual life-based learning model, either related to worship or muamalat. Fifth, contextual learning model to find alternative solutions to real life problems from the perspective of Islamic law (fiqh). Sixth, the learning model to develop students’ intrinsic motivation.

Abstract

This paper explores the understanding of tarbawi (education) hadith from one of the major influential clerics in the Islamic educational system, especially in pesantren. He is Burhan al Islam al Zarnuji with his landmark book Ta’lim al Muta’allim. The conclusion that can be drawn is that al Zarnuji has shades of sufistical view in understanding tarbawi hadith. This can be seen in his understanding of hadith on obligation to seek knowledge (thalab al ilmi faridhatun ‘ala kulli muslimin wa muslimatin), which is interpreted as ilm al hal, the science concerning the condition of the human religious or simplistically said as the religious sciences; and the hadith of intention of studying (innama al a’malu bi al niyyat) with the intention for the sake of the hereafter and religion, not mundane. Such an understanding is not something taken for granted, but it can be reinterpreted and perfected in accordance with the spirit of the times of context.

Abstract

This article aims to analyze the extent to which the Iranian state, which is predominantly Shiite Muslims contribute in reforming the Islamic legal system, especially on inheritance by right and inheritance by will (wajibah). Both are interestingly studied because in the study of jurisprudence this term is a very fundamental topic (religious affairs involving others). Since this study is only a study of texts, the approach taken is to look at some of the chapter in the laws relating to inheritance prevailing in Iran and to relate them to the majority of schools there. This article concludes that in the Iranian shrimp system, a wife will get all the inheritance of her husband, not just half of heritage. She also obtained to get her husband's land that was previously banned in the old law. The cause of renewal of inheritance law in Iran state can not be separated from some aspects, covering normative and socio-political aspects as well as social reality, including the turbulence of difference of schools. All material of inheritance law and family is based on Shi'ah Itsna ‘Asyariyah (Ja‘fari) family law.

Abstract

In the classical period, the scholars built the division of science into two groups namely, the science of religion called “al-‘ulûm al-dîniyah”, and the science of non-religious or “al-‘ulûm al-dunyawiyah”. In the science of religion, they have the science of exegesis, the science of ḥadîth, the science of kalâm, the science of fiqh, and the science of tasawuf. While on non-religious sciences, they have history, medicine, astronomy, chemistry, mathematics, optic, physics, cosmography, and many more. On that time, the scholars were imbued with high appreciation of tought, so they succeeded in making rapid progress in various fields of life, including the field of knowledge and philosophy. The peak of progress occurred at the time of the ‘Abbâsids, the previous Khalîfah al-Ma’mûn. In the view of Greek or Hellenic thought there were two expert views, rejecting Hellenism or accepting it. The differences lied in the views of Islam, Islam as ‘aqîdah (creed) and Islam as a civilization. Those who reject Hellenism view Islam as a creed with revelation as the source of knowledge. While those who accept Hellenism view Islam as not a creed, but Islam as civilization.

Abstract

This conceptual study is to review two things. First, the penal mediation concept in perspective of Islamic criminal law. By outlining penal mediation as an alternative to the settlement of a criminal case out of court through a voluntary agreement between the victim and the perpetrator, then, at least, it is in accord with the concept of qishash-diyat and its punishment. Second, the contribution of the core idea of mediation penal in perspective of Islamic criminal law is for criminal law reform in Indonesia. In a review of these studies, the core idea of mediation penal in Islamic criminal law perspective fulfills the philosophical, juridical, and sociological aspects, so that the criminal law reform led to the strengthening and optimizing the penal mediation as an alternative to the settlement of the criminal case. The core ideas are: (1) the existence of penal mediation is necessary to set up first by legislation in Indonesia; (2) not all criminal offenses can be resolved through mediation penal; (3) there is no element of coercion on the involvement of both parties in conducting penal mediation; (4) the compensation agreed upon by the perpetrator and the victim or him/her family shall be given directly to victims or their families and not to the state; and (5) the completion of the criminal case by optimizing the penal mediation can abolish punishment for the perpetrators.

Abstract

This study aims to explore pathological or deviation behaviors found in the story of Moses and ‘Abd or Khidir in the Qur’an of surah al Kahf. More specifically, this study is projected to find the basis of all pathological behavior based on al-Jâbirî’s epistemology. To understand the behavior of deviation holistically, the researcher uses Peirce semiotics theory and then synergized with al-Jâbirî’s epistemology which includes bayânî, burhânî, and ‘irfânî's reason. Semiotics theory is used as an interpretation of verbal signs related to deviation behavior. Peirce's semiotics theory examines the sign of three points of view, namely representamen, object, and interpretation. The researcher employs qualitative method with the type of library research. The results of this study are: (1) the perforation of a ship is a situational deviation based on pseudo ‘irfânî reasoning, (2) child killing is a situational deviation based on a theological reason with pure ‘irfânî reason, (3) antipathy towards the guest is an organized deviation based on the violation of bayânî reasoning, (4) the prediction of the seizure of the ship by the king is a non situational deviation based on the violation of bayânî reasoning, and (5) plunging the elderly into apostasy and kufr is a non-situational deviation based on the violation of bayânî reasoning.
