ULUL ALBAB Jurnal Studi Islam (ISSN 1858-4349 and E-ISSN 2442-5249) is the journal published biannually by Universitas Islam Negeri Maulana Malik Ibrahim Malang. The journal puts emphasis on aspects related to Islamic studies, with special reference to Islamic law, Islamic education, Islamic politics, society, Islamic philosophy, Quran and hadith, and theology. Abstract

This article seeks to describe the meaning of teachers based on the teachings of Sufism that can be a reference to revitalize the important role of educators in order to build character. It uses the perspective of Sufism since this teaching focuses on pupil’s moral development both outwardly and inwardly. The purpose of this article is to adapt the meaning of teacher in islamic mysticism perspective into the meaning of teacher in general for character education. It employs literary study by referring to the thoughts of figures or scholars of islamic mysticism and supported by the theory outside the study of islamic mysticism, then formulated into a conceptual construct of this article. The conclusion shows that the teacher in Sufism with his qualifications has the task of educating pupil’s moral that is not limited in a certain space and time. Teacher builds closeness with the pupils from the inner and outer sides. They are treated like a teacher treating himself. Teacher in this sense is as role model, counselor, director, advisor, to shape pupil’s moral. This meaning can improve the weaknesses of the modern education theory, which generally interprets teacher as facilitator, mediator, or as teachers (transfer of knowledge/transfer of values), which has not touched on pupil’s inner side.

Abstract

The objective of this research is to meticulously investigate the model of character education implementation by the use of integrated approach during the course at Islamic Education in the Faculty of Tarbiyah and Teacher Training, Maulana Malik Ibrahim State Islamic University of Malang. It focuses on three points encompassing religious, self-personality and social characters that were developed in the learning and teaching process. By purposively selecting the analytical-critical-descriptive approach, the research data were qualitatively obtained by interviews, observations and documentations. The findings reveal three main aspects. The first is a model of religious character that is constructed by thoyyibah texts (basmallah and hamdalah), reciting al Quran, prayers, and dzikr as the manifestation of pious values and beliefs to Allah. The second point is self-personality model as the character construction that is instilled through the familiarization of discipline, sincerity and responsibility during the courses that involve learning process, instructional practice and learning evaluation. The third is the construction of social characters including tolerance, social respects and real democracy in learning system.

Abstract

The effort to develop communicative competence of Madrasah Ibtidaiyah teachers in Indonesia is still low. It is shown from various upgrading programs for teacher’s professionalism and quality which rarely touch communicative competence aspect. However, government regulation on academic qualification standard and teacher competence stated that communicative competence becomes the bases of pedagogic, social, and professional competences, except personality competence. In addition, in teacher training institute the course on learning communication is not always given. While communication play an important role for effective learning process. This article presents the research of development of Fikih learning communications model in Madrasah Ibtidaiyah namely reinventing subconscious mind (RESMI). The result shows that its implementation improves the familiarity between teachers and pupils, learning enthusiasm, ability to memorize materials, and improve learning achievement.

Abstract

The focus of this study is to identify cohung (peacock carcass) sale by dadak merak reog craftsman in Ponorogo and to analyse the view of Indonesian Council of Ulama (Majelis Ulama Indonesia) at Ponorogo Regency on cohung transaction. This empirical study used qualitative method. Data sources cover interview with dadak merak craftsman and MUI at Ponorogo Regency as well as documentation and literature to answer the research problem. It results in two findings. First, cohung transaction by the craftsman is done to create the fierce of dadak merak and got on agreed price. Secondly, cohung sale according to MUI at Ponorogo regency has different reasons. It is permitted because the sale practice depends on the context that is to be used not for consumption, and assumed that it is not only as transaction but also as wage. It is forbidden to buy the carcass since peacock is preserved animal.

Abstract

Islam as the religion of raḥmah li al-‘âlamin has the dimension of law-setting based on the conditions of time and place of law will be determined. The law that Rasulullah set in a ḥadîth is inseparable from geographical, sociological, and historical conditions lied behind it. The dynamics of interpretation science help the reinterpretation of a ḥadith to produce a law that is actual and in accordance with the conditions but not out of the rules of Qur’an, because Qur’an indeed is as the main legal source in Islam. This paper is to describe the interpretation of the ḥadîth about the corpse being tortured by the tears of his family (Muslim 1536) with Paul Ricoeur's interpretation approach. Author comes to the conclution that the use of the word bukâ’ in the matan of ḥadîth means corpse actually got tortured because of the hysterical cry of his family who bemoaned over it. As for the historical aspects of this ḥadîth when Rasulullah saw the Jews weep for his family who died with hysterical cry. Thus, the point of emphasis of the ḥadîth is a way of responding those who grieve. If the attitude is excessive until hysterical wailing for days, then it includes an inappropriate attitude that is not even recommended in the Qur'an.

Abstract

Contemporary popular discourses about Islam, shari’a and Islamic law in the West is often filled with the issues of terrorism, anti-democracy, human rights violation and women’s minor status in Islam, which all lead into negative perception. Unlike such popular views, Western scholars perceive shari’a from various perspectives. They are quite critical to shari’a in a positive sense. This article discusses Western scholarly discourses on shari’a by comparing the thoughts and works of two most prominent figures, Wael B. Hallaq and M. Barry Hooker, who always concern with shari’a, Islamic law and related social issues, such modernity, colonialism and legal system. Based on the model of the study of public figure and grounded its main data on Hallaq’s and Hooker’s main work, this study shows that these two scholars promote idealistic and contextual perception on shari’a. From the ideal point of view, shari’a is seen a product of scholarly independent work by Muslim jurists, whose authority now is unfortunately taken over by the state. The contextual view regards shari’a as flexible Islamic religious or legal norms that are adaptable to the changing social and political environments so they are easily transferrable into the educational, legal and political system in a country like Indonesia, entailing what is called “national mazhab”.

Abstract

All this time there was a different opinion about the time for Arafah fasting. Whether to comply with the provisions of Saudi Arabia or adjust the territory of each person. In Saudi Arabia, there appears a mufti named Muhammad bin Shalih al ‘Utsaymin who holds that fasting of Arafah must follow the country where a person lives. This opinion is interesting because it is different from other Salafis, such as ‘Abd al ‘Aziz bin Baz, Abdul Hakim bin Amir Abdat and HTI. Using the analytical tools of Islamic law and Islamic astronomy, the authors conclude that the fatwa issued by al ‘Utsaymin is considered quite representative, because considering the locality of a country, realizing the time of worship should adjust the kamariyah time of the country, and also in accordance with the mathla‘ in the form of mathla‘ wilayah al hukmi. Opinions as expressed by al ‘Utsaymin is conformable with the implementation of the time of the fasting of Arafat by the majority of Muslims in Indonesia.

Abstract

The success of an institution or university depends on how the leader educates and implements the strategy. Therefore, an education strategy must be developed by university in every nation worldwide. This research aims to know the implementation of TQM on the Faculty of Islamic Study in Muhammadiyah University, Malang, Indonesia, which are Quality standard, TQM implementation strategy, TQM evaluation, the obstacles of TQM implementation in the Faculty of Islamic Study in Muhammadiyah University, Malang. This research employs descriptive analysis. The instrument of data collection is by interviewing, documenting and observing. The most important findings from this research is the quality standard in Muhammadiyah University Malang follows the regulation of National Higher Education and formulated based on KKNI. The strategy of TQM implementation was conducted from the central of quality management, while the process of quality evaluation was conducted directly from the teaching and learning activities. The obstacles faced by the TQM implementation is the lack of professionals and the lack of awareness to implement the new quality standard, and the development of TQM is done by implementing the education policy firmly and it must be controlled continuously.

Abstract

The emergence of thinking about the role of profession sharia advocate in the mediation of divorce cases that is derived from a fact produced by the judiciary in solving the case of divorce, which is almost 100% is a conventional decision that essentially have a pattern of win or lose. It is rare to find a win-win solution. Yet the most important is when the judiciary is not only referred to as deciding cases, but also solve the case. One of the alternatives presented in solving the divorce case is based on the win-win solution, The problem to be studied in this article is how the duty and responsibility of sharia advocate profession within the framework of maqahid al syariah. Where the task of sharia lawyers in general is the same as the non-sharia advocate task that is to defend public interest (public defender) and client in upholding justice. But what distinguishes it from non-sharia advocates is in providing defense, counseling, and being authorized for and on behalf of his clients sharia advocates based on the principle of help-help, cling to the source of Islamic teachings. Second, the role of the advocate profession in the mediation of divorce cases should be submitted to a competent advocate, in this case is a sharia advocate. Advocates who have guidelines to always run their profession in accordance with the objectives of syara law (maqashid al syariah).

Abstract

There are various thoughts on the integration of religion and science, such as the model i‘jâz al-Najjâr, the model of Islamization of al-Faruqi, Ijmâlî Sardar, the Islamic science of Husein Nasr and the universal science of ‘Abd al-Salâm. According to Nidhal, those thoughts still have weaknesses and can not be developed so it needs another alternative. Therefore, Nidhal offers a quantum approach to the integration of religion and modern science. It is based on three principles: non-contradictory principle, layered interpretation principle, falsifiable-theistic principle. The first one is as a basis to integrate religion and science, the next is treated to understand and interpret the sacred text (Qur’an) as the basis of religion, the latest is to ensure the pattern applied in science. Based on these principles, where there is a "movement" connecting religion and science, both religion and science become possible to be reconciled.
