Abstract

Persons with disabilities, either acquired or developed at some stages of his life due to factors such as injury and disease, are still a person with the same legal status and rights as individuals who do not have any disability. This paper, through conceptual and doctrinal analysis, explores the similarities and differences between human rights based’s approach and Shariah’s approach towards people with disability. People with disability have equal right to live and to have a noble livelihood. The Convention on Rights of People with Disabilities of the United Nations has adopted the concept of human rights-based approach which requires people with disability tobe treated in a proper way. The convention believes that this group should not be treated differently and given similar opportunity to be developed and progressed as any other human being. On the same note, Islam sees disability as morally neutral. It is seen neither as a blessing nor as a curse. Accordingly, disability is accepted as being an inevitable part of the human condition. It is simply a fact of life which has to be addressed appropriately by the society of the day. In Islam people with disabilities are not being arbitrarily segregated and being discriminated unjustly. They should be given equal opportunity to progress and develop their potential just like any other human being. The final analysis shows that there is harmonious interpretation between Western human right and Islamic jurisprudence to protect this minority.

Abstract

This article examines the fatwa of Bahtsul Masa’il on women using Critical Discourse Analysis. Two matters of research problem is how Bahtsul Masa’il fatwa on women and how the Critical Discourse Analysis of the fatwa Bahtsul Masa’il about women. There are twelve fatwa on women decided by Bahtsul Masa’il forum, seven of which talk about the role of women in the public world. They were analyzed using Critical Discourse Analysis framework involving three levels of analysis, namely text, social cognition and context. Texts of Bahtsul Masa’il decision on women represent women as being vulnerable to libel and can bring slander. Women are also represented as weak creatures who need supervision and protection of men. Fatwa text that is bias arises from the procedure of making fatwa which highly favor the yellow book. While the yellow book itself tends to put women in the private sphere and look down on women. In addition, the frame of the community producing Bahtsul Masa’il fatwa (religious leader and religius students) are also the result of the internalization of norms and values of yellow book as the idol at the pesantren. In context level, the fatwa which tends to give a negative identity toward women is born out of the context of the patriarchal society.

Abstract

The intellectual contact of Iqbal to Western paradigm has a great influence over his mature thought. The subjective view of Moslem toward reality has led them fall mentally to a slave at the time. It is mainly due to philosophical doctrine they believe about the self-denial for the reality. Iqbal, moreover, has big desire to bring them into a better world by proposing an idea of self-awareness to reality. He argued that the essence of human life is to view the reality objectively not subjectively as they had believed before. The life is so real that we have to take a big part in reality as we are not victims of tragic imagination. Along with this assumption, Iqbal conceded a thought pattern regarding esthetics. Esthetics is a quality making every parts of life shine, putting self-vitality as dynamic center for desire, efforts, aspiration, strength, and action

Abstract

The beauty of Joseph's story has become a byword, long before the arrival of Islam. The Qur'an itself confirms that the story of Joseph is the best (ahsan al-qasas). The study of the Qur'anic text and the New Testament (Genesis 37-50) shows the similarity of the story of Joseph in outline, but also the differences in function and reasoning of the story. The first fact shows the similarity of religious and literary discourse between the Islamic and Jewish communities at the beginning of the coming of Islam, while the second shows the originality of the story of Yusuf in the Qur'an. In the New Testament the story of Joseph emphasizes the history of the journey of a nation, while the Qur'an describes the story of Joseph to strengthen the belief of the Prophet and his followers.
